<section id="H6EB4BD630BDB4521884BCD7224BF88EC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Access Protection Act</short-title></quote>.</text> </section> <section id="HBCD5CF7E14A647849CA33A734C121717"><enum>2.</enum><header>Prohibition on collection of citizenship or immigration status information</header> <subsection id="H8899CFC3178F48F2A76E5ABD08DE70A8"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, a covered financial institution may not—</text> 
<paragraph id="H19569DEF0D774D02A342CE1A1B7B8EB3"><enum>(1)</enum><text>require a consumer or prospective consumer to disclose their citizenship status or immigration status as a condition of opening, maintaining, or accessing an account or financial service offered by such covered financial institution;</text></paragraph> <paragraph id="HFB37B648A49042048AAA9CB60991E07C"><enum>(2)</enum><text>request, collect, record, retain, maintain, or otherwise obtain information relating to the citizenship status or immigration status of a consumer; or</text></paragraph> 
<paragraph id="H2163F4D84028456289E473DEA928F350"><enum>(3)</enum><text display-inline="yes-display-inline">transmit, report, disclose, or otherwise make available information relating to the citizenship status or immigration status of a consumer available to any Federal agency or other governmental entity.</text></paragraph></subsection> <subsection id="H327B5CFD43EA4C24BA9C3907CB693272"><enum>(b)</enum><header>Prohibition on regulatory action</header><text>No appropriate Federal banking agency may, by regulation, rule, order, guidance, supervisory expectation, examination procedure, informal request, or otherwise—</text> 
<paragraph id="H5BDC0817937A41B199538235DAA105EF"><enum>(1)</enum><text>require or encourage a covered financial institution to collect or maintain information regarding the citizenship status or immigration status of a consumer; or</text></paragraph> <paragraph id="H0184E34FC0C645C0BB64099FA52B1EEF"><enum>(2)</enum><text display-inline="yes-display-inline">condition supervisory ratings, enforcement decisions, approvals, or other regulatory determinations on the collection or reporting of information about the citizenship status or immigration status of a consumer.</text></paragraph></subsection> 
<subsection id="H49FE40CA28BD498CAF84FCE254110918"><enum>(c)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Each appropriate Federal banking agency shall enforce this section with respect to covered financial institutions.</text></subsection> <subsection id="HA6BBDF2ABA6D4FD9944956BB6BBC377C"><enum>(d)</enum><header>Covered financial institution defined</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H20A5EFEA2E814FA49C802791635AD3C7"><enum>(1)</enum><header>Appropriate Federal banking agency</header><text display-inline="yes-display-inline">The term <term>appropriate Federal banking agency</term> has the meaning given the term in section 3 of the Federal Deposit Insurance Act.</text></paragraph> <paragraph id="H5301F1CCEFE747F2BE08513FD1114871"><enum>(2)</enum><header>Covered financial institution</header><text>The term <term>covered financial institution</term> means—</text> 
<subparagraph id="HFD39AF098DEC40C690A00F67D0A6EF40"><enum>(A)</enum><text>an insured depository institution (as such term is defined in section 3 of the Federal Deposit Insurance Act);</text></subparagraph> <subparagraph id="HA98B7F646A67486583FE526149C57F9D"><enum>(B)</enum><text display-inline="yes-display-inline">an insured credit union (as defined in section 101 of the Federal Credit Union Act) or any credit union regulated by the National Credit Union Administration;</text></subparagraph> 
<subparagraph id="H3AB05E8623A2444E9F84F47DCB854888"><enum>(C)</enum><text display-inline="yes-display-inline">a consumer reporting agency (as such term is defined in section 603 of the Fair Credit Reporting Act);</text></subparagraph> <subparagraph id="HB9C936810F304DAD92735776F5E19D9D"><enum>(D)</enum><text>a national bank or Federal savings association supervised by the Office of the Comptroller of the Currency;</text></subparagraph> 
<subparagraph id="H9303C23969354C448DA68D08EEA66EBA"><enum>(E)</enum><text>a State member bank supervised by the Board of Governors of the Federal Reserve System;</text></subparagraph> <subparagraph id="H1EED815260384236B5F426042416F359"><enum>(F)</enum><text>a State nonmember bank supervised by the Federal Deposit Insurance Corporation;</text></subparagraph> 
<subparagraph id="HE27B619C945C4E71BB009CBF8349B3AC"><enum>(G)</enum><text>a bank holding company or savings and loan holding company supervised by the Board of Governors of the Federal Reserve System; and</text></subparagraph> <subparagraph id="HF41A14C878094A639EAF36DFB8B8C102"><enum>(H)</enum><text>a subsidiary or affiliate thereof that is subject to examination or supervision by a Federal banking agency.</text></subparagraph></paragraph></subsection> 
<subsection id="H3083F190DF6F489CA7E5CD2E903DE7CF"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to—</text> <paragraph id="HD4C4ED1931B5446AAB3277F35925971C"><enum>(1)</enum><text display-inline="yes-display-inline">alter or limit the any obligations a covered financial institution has under the Bank Secrecy Act (as such term is defined in section 6003 of the Anti-Money Laundering Act of 2020); or</text></paragraph> 
<paragraph id="H2CAB5FA0D5274120B5232A4F1054DE51">
                    <enum>(2)</enum>
 <text>prevent covered financial institutions from complying with Federal, State, or local reporting requirements relating to the prevention of financial crimes including money laundering, terrorist financing, and compliance with sanctions.</text>
                </paragraph></subsection></section>
