<section id="H37A0E2F07DCC44B99F06623F4AB157D8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Non-Domiciled CDL Reporting Act</short-title></quote>.</text></section> <section id="HD6F47D74937046709FD19A2AD019B532" section-type="subsequent-section"><enum>2.</enum><header>Commercial driver’s license database</header> <subsection id="H7EB32E68A81B4C88BD6D3CFEA24A3D03"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">chapter 311</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="HCA59573F31A24D1EBF972BA2FAE0128D"><enum>31162.</enum><header>Commercial driver’s license database</header> 
<subsection id="H6B7B6CCDF49D48C599228D1BE65EC9FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, the Director of the U.S. Citizenship and Immigration Services shall make the Systematic Alien Verification for Entitlements service available for the Federal Motor Carrier Safety Administration.</text></subsection> <subsection id="HE77B76546E3D4A52A153A2069F67FC9D"><enum>(b)</enum><header>Synchronization with States</header><text display-inline="yes-display-inline">State driver license agencies shall submit to the Administrator of the Federal Motor Carrier Safety Administration—</text> 
<paragraph id="HB8E0B69CF7A14E17B6D145277D5D260A"><enum>(1)</enum><text>the expiration date of any non-domiciled license issued by such State; and</text></paragraph> <paragraph id="H452349A4C8A543F1823FC29C4F7A711A"><enum>(2)</enum><text>a copy of the existing driver’s license for each individual issued a non-domiciled commercial driver’s license in such State.</text> </paragraph></subsection> 
<subsection id="HBE82F25F22CF4F84AA544061234BCD7B"><enum>(c)</enum><header>Waiver of submission</header><text display-inline="yes-display-inline">States may request a waiver of the provisions of this section under section 31315.</text></subsection> <subsection id="H011BB2B8936C48598C7D734960DA6074"> <enum>(d)</enum> <header>Processing of non-Domiciled CDLs</header> <paragraph id="HEFA79B14D9F4400B97FCCDC43A4B7A8E"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">After the Administrator receives a submission from a State under subsection (b), the Administrator shall process such information through the Systematic Alien Verification for Entitlements service described in subsection (a).</text>

              <paragraph id="H7967637407C34E82983B002D53A801D8">
                <enum>(2)</enum>
                <header>Submission to USCIS</header>
 <text display-inline="yes-display-inline">If the Administrator determines any non-domiciled commercial driver’s license holder has an unlawful presence in the United States, using the Systematic Alien Verification for Entitlements service, the Administrator shall submit information on such holder to the Director of the U.S. Citizenship and Immigration Services.</text>
              </paragraph>
              <paragraph id="H53A0B487DA904F1E8E62C103A7492EC6">
                <enum>(3)</enum>
                <header>Removal</header>
 <text display-inline="yes-display-inline">After receiving any submission under paragraph (2), the Director shall investigate the holder for which the submission occurred to determine whether such holder is eligible for removal from the United States.</text>
              </paragraph>
            </subsection> 
<subsection id="H6A0D6A4392024470AD49E76854306CD2"><enum>(e)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this section, and each year thereafter, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing information on how many non-domiciled commercial driver’s licenses were flagged using the system described in subsection (a) and the State in which such licenses were obtained.</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H74D5B2950B6F4CBC957B41EE6A270A81"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">chapter 311</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<subsection id="H07DBFEE2343E406EB0F54FACC44BABAC"><enum>(c)</enum><header>Withholding amounts for State noncompliance</header><text>Section 31314 of title 49, United States Code, is amended by inserting <quote>or section 31162</quote> after <quote>section 31311(a)</quote> each place it appears.</text></subsection> <subsection id="H8BB3E94C509343FAAA4BCB14078FBD0D"><enum>(d)</enum><header>Waivers, exemptions, and pilot programs</header><text>Subsections (a), (b), and (c) of section 31315 of title 49, United States Code, are amended—</text>
<paragraph id="HDE95812DC2C24E749FE8A66148512EB4"><enum>(1)</enum><text>by inserting <quote>or a State</quote> after <quote>a person</quote> each place it appears;</text></paragraph> <paragraph id="H0577220024974C13B77BD841C15484AD"><enum>(2)</enum><text>by inserting <quote>or State</quote> after <quote>the person</quote> each place it appears; and</text></paragraph>
<paragraph id="HF492676361E145FFA0AD3EAC422A8CC7"><enum>(3)</enum><text>by inserting <quote>or, with respect to States, the requirements of section 31162</quote> after <quote>31136</quote> each place it appears.</text> </paragraph></subsection></section> </legis-body></bill>
