<section section-type="section-one" id="HA8FB4ABA596F49BBA5B3E69C9E69D50D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our Manufacturers from Being Unfairly taxed while Championing Health Act</short-title></quote> or <quote><short-title>KOMBUCHA</short-title></quote>.</text></section> <section id="H5AD4F0EE943B4AF3A1B0EADEEB5D7A1D"><enum>2.</enum><header>Tax-free production of low alcohol by volume kombucha</header> <subsection id="HEE0F71DC4F094A16B487C28F9807E060"><enum>(a)</enum><header>Exemption from tax on wine</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5042">Section 5042(a)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text>

<paragraph id="H821B12E7C55E45ED9633BF2A3847EEBA"><enum>(4)</enum><header>Low alcohol by volume kombucha</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H30430ED33E054D13A2A60CFA7D70CABF"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to regulations prescribed by the Secretary, low alcohol by volume kombucha shall not be subject to—</text> <clause commented="no" display-inline="no-display-inline" id="HC2C4BBC9920144278F23572D4DCD5BD5"><enum>(i)</enum><text display-inline="yes-display-inline">tax as wine, or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HA3BB932932414357982402612E0616BD"><enum>(ii)</enum><text display-inline="yes-display-inline">the provisions of subchapter F.</text></clause></subparagraph> <subparagraph id="H48B6F13E8D56413F8BCAC9202982E1A7"><enum>(B)</enum><header>Definition</header><text>For purposes of this chapter, the term <term>low alcohol by volume kombucha</term> means a beverage which—</text>
<clause id="HFAF6D3B68A3D442E814574A55E372686"><enum>(i)</enum><text>is fermented solely by a symbiotic culture of bacteria and yeast,</text></clause> <clause id="H071DAE6908554CD9AD1078AD10963DE3"><enum>(ii)</enum><text>contains not more than 1.25 percent of alcohol by volume,</text></clause>
<clause id="H8A29EEDDFE1D482CAB053CC1FB2D6E04"><enum>(iii)</enum><text>is sold or offered for sale as kombucha, and</text></clause> <clause id="H0D2E2A04A6B14DAA846ABE7D65E95517"><enum>(iv)</enum><text>is derived from—</text>
<subclause id="HC9CC4CB75D7C4E3EBFD805FD7C8F9C92"><enum>(I)</enum><text>fermentable sugars, including sugar, malt or malt substitute, honey, and fruit juice, and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H1948C38D59C64FA5AD8C26E355059A98"><enum>(II)</enum><text>plant materials, including tea and coffee.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H10CF55D6B8554A6C9F7157A7E1FA2404"><enum>(b)</enum><header>Exemption from tax on beer</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5053">Section 5053</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="H85BAD76112F24C91B4C431CE38C7FC4B"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (j), and</text></paragraph>
<paragraph id="HB8C70F5CB0104C85A31DF9B47DCFB5A0"><enum>(2)</enum><text>by inserting after subsection (h) the following new subsection:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H14EE400BCAA84861AE31513E3F1FD011"> <subsection id="H2B1F825713234C9DA2A13C4E890800F6"><enum>(i)</enum><header>Production of low alcohol by volume kombucha</header><text>Subject to regulations prescribed by the Secretary, low alcohol by volume kombucha (as defined in section 5042(a)(4)(B)) shall not be subject to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H07864E2C7EC64782B349684537331470"><enum>(1)</enum><text display-inline="yes-display-inline">tax as beer, or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB15CB7A546E8489C89C2C4140833E65B"><enum>(2)</enum><text display-inline="yes-display-inline">the provisions of subchapter G.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H34D755B366EC4FD8B480841D673D8FFE"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to calendar quarters beginning after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
