<section id="HA01EA3C78EA1494D8514AF138E42E59C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Developing the Community Health Workforce Act of 2026</short-title></quote>.</text></section> <section id="H5C0C497B16174C07878C13C8B83ECD28"><enum>2.</enum><header>Improving recruitment and retention of Federal qualified health center staff</header> <subsection id="HCB5EFBFD09F04386847DD7B2BAC19ABC"><enum>(a)</enum><header>Priority to FQHCs and rural health clinics</header><text display-inline="yes-display-inline">Section 333(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254f">42 U.S.C. 254f(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="traditional" id="HFB7D82E70FDF4A058FED58AD89FDE125" display-inline="no-display-inline"> 
<paragraph id="H577ED77A5B764B259C1323E2E94D61DF" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In approving applications for assignment of members of the Corps, the Secretary shall, notwithstanding paragraph (3), give priority to applications with respect to health professional shortage areas that are Federally qualified health centers and rural health clinics, as defined in section 1861(aa) of the Social Security Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H13C472AFC36747478F404B0D2E8505CA"><enum>(b)</enum><header>Loan repayment program</header> <paragraph id="H3CAFD469D7BB444CA80E6A85B5D27A4E"> <enum>(1)</enum> <header>In general</header> <text>The Secretary of Health and Human Services shall award grants to Federally qualified health centers (as defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>)) for the purpose of addressing health professional workforce shortages by making loan repayments on behalf of health care professionals serving at such centers.</text>
                </paragraph> 
<paragraph id="HE3E03C6E948C4057B7ED737B9BCD3AB7"><enum>(2)</enum><header>Applications</header><text>To seek a grant under paragraph (1), a Federally qualified health center shall submit an application to the Secretary of Health and Human Services at such time, in such manner, and containing such information as the Secretary may require. At a minimum, such an application shall include—</text> <subparagraph id="H92F4F38229D342708CDD859F38D1A6D0"><enum>(A)</enum><text>a description of the center’s capacity to address specific regional workforce shortages, supported by data;</text></subparagraph> 
<subparagraph id="H6667947FD6944647A7F594156D984249"><enum>(B)</enum><text>a plan for making loan repayments as described in paragraph (1); and</text></subparagraph> <subparagraph id="H0C15884C93AE412FB2AD1F4C9A9265D4"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the center’s use of an interdisciplinary approach to care (such as through the use of teams to provide care that include physicians, nurses, social workers, community health workers, pharmacists, and other health care professionals).</text></subparagraph></paragraph> </subsection></section> 
<section id="HA396B6C078B3446588D12661DAC9638E"><enum>3.</enum><header>Community Health Center Workforce Pipeline Program</header> 
<subsection id="H377A67A5F4E54C3488331275F6B50BD8">
                <enum>(a)</enum>
                <header>Grants To recruit, train, and retain a community-Based health center
                    workforce</header>
                <paragraph id="HB53CD2A8AD264DA290085C90B43C0847">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>Section 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>) is amended—</text>
                    <subparagraph id="H537673008FCB4BC6B50D7A44FA41851E">
                        <enum>(A)</enum>
 <text>by redesignating subsection (r) as subsection (u); and</text> </subparagraph> <subparagraph id="H123218BF9C37413DA1233EB02F0CA886"> <enum>(B)</enum> <text>by inserting after subsection (q) the following new subsection:</text>

                            <subsection id="HF41D90DF752A4D22A8E901D183F2EA7A">
                                <enum>(r)</enum>
                                <header>Recruiting, training, and retaining a community-Based
                                    workforce</header>
 <text>The Secretary may award grants to health centers for the purpose of assisting such centers in—</text>
                                <paragraph id="HC5596C3F6D374B73B32B34F0C209F39E">
                                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">recruiting and hiring staff with the skills and experience necessary to effectively serve health center patient populations in rural and underserved areas; and</text>
                                </paragraph>
                                <paragraph id="H5848A0F3E85F46EEA5BAFEE55CF2A2B2">
                                    <enum>(2)</enum>
 <text display-inline="yes-display-inline">supporting career advancement and workforce development opportunities for such staff.</text>
                                </paragraph>
                            </subsection>

                        </quoted-block>
                    </subparagraph>
                </paragraph>
            </subsection> 
<subsection id="HE519027E13CF4F28B95E1D57224056AC">
                <enum>(b)</enum>
                <header>FQHCs deemed eligible To register as apprenticeship program</header>
 <text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Labor shall revise the regulations under part 29 of title 29, Code of Federal Regulations, as in effect on the date of the enactment of this Act, so that Federally qualified health centers (as defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>)) are eligible to register as apprenticeship programs under such part.</text>
            </subsection> 
<subsection id="HEFAA6FE697DF477B8B0B5B7F53EEC4DB"><enum>(c)</enum><header>Health centers career opportunities</header><text display-inline="yes-display-inline">Section 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>) is further amended by inserting after subsection (r), as inserted by subsection (a) of this section, the following:</text> <quoted-block style="OLC" id="H794820CA54434880A8CDE0DED48E7BAD" display-inline="no-display-inline"> <subsection id="H5AF5D6DC26D34600AF0B9A17AB295F39"><enum>(s)</enum><header>Health centers career opportunities</header> <paragraph id="HAA604A1879E148DF90C43BEFD226ADC3"><enum>(1)</enum><header>In general</header><text>The Secretary may award grants to institutions of higher education, including community colleges and minority-serving institutions, to establish partnerships with one or more health centers funded under this section for training students in health professions.</text></paragraph> 
<paragraph id="H08419A21F5F644E8893EA71EEF1E8C34"><enum>(2)</enum><header>Use of funds</header> 
<subparagraph id="H130AF106E9914A859BB9891DA033B306"><enum>(A)</enum><header>Costs</header><text>An institution of higher education receiving a grant under this subsection may use the grant to pay the costs of training, including the salary of the clinicians or other educators who provide the training.</text></subparagraph> <subparagraph id="HE558F7260E3C4A6EABC56FAF6BEA3BD7"><enum>(B)</enum><header>Training supported</header><text>The training supported pursuant to a grant under this subsection may include formal training and mentorships.</text></subparagraph> 
<subparagraph id="H74FFABC794B3411E871CBBD9F9968ADE"><enum>(C)</enum><header>Types of training</header><text display-inline="yes-display-inline">The types of training supported pursuant to a grant under this subsection may include clinical, information technology, operations, finance, or other training for students of health professions, as determined by the institution of higher education receiving the grant in partnership with the health center involved.</text></subparagraph></paragraph> <paragraph id="H5BDE04FB72DC41E2AB749A5B04836929"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HD15FE3BAE4BC424B9C13D8D89A89EAEC"><enum>(A)</enum><text>The term <term>institution of higher education</term> means an institution of higher education described in subsection (a) or (b) of section 101 of the Higher Education Act of 1965.</text></subparagraph> <subparagraph id="H7034E1743F654C7184ECADED8109B219"><enum>(B)</enum><text>The term <term>minority-serving institution</term> means an institution of higher education described in section 371(a) of the Higher Education Act of 1965.</text></subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC02D4D125E654098ACB6C2607C13767E"><enum>(d)</enum><header>Behavioral health specialists</header><text display-inline="yes-display-inline">Section 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>) is further amended by inserting after subsection (s), as inserted by subsection (c) of this section, the following:</text> <quoted-block style="OLC" id="H7C1683C3E42B426199BA502AA6995BD7" display-inline="no-display-inline"> <subsection id="H74B333C1751B434681B8BE06C866E8F5"><enum>(t)</enum><header>Behavioral health specialists</header> <paragraph id="H36D876A346904EB982A96F6A7CEF73C3"><enum>(1)</enum><header>In general</header><text>The Secretary may award grants to health centers to establish, operate, or expand training programs for behavioral health specialists.</text></paragraph> 
<paragraph id="H9D26B1FFCDD94EC799B21BC7E9D57FD6"><enum>(2)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The training programs for behavioral health specialists supported pursuant to a grant under this subsection may include—</text> <subparagraph id="H01309E6FF24246C29BE99EE9F662EBD1"><enum>(A)</enum><text>stipends for personnel to operate the training programs;</text></subparagraph> 
<subparagraph id="H8FBA4BD4C0CC40A898632B92DCBB7EB8"><enum>(B)</enum><text>apprenticeship programs; and</text></subparagraph> <subparagraph id="HE2983A42C30F4A8583B5C8722FDD905E"><enum>(C)</enum><text>other recruitment and retention activities for behavioral health specialists.</text></subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H208F24FB53CA451BA22345D8E8DCE60E" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Expanding hospital and FQHC partnerships for graduate medical education</header> 
<subsection id="H61EDF9DC5874443CA314C6EF7E031832"><enum>(a)</enum><header>Payments to teaching health centers</header> 
<paragraph id="H64FC36424EDC4D1185D177F7BDE0C5D3"><enum>(1)</enum><header>In general</header><text>Section 340H of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256h">42 U.S.C. 256h</external-xref>) is amended—</text> <subparagraph id="H62CC46751275493592CEB022FA01FFFA"><enum>(A)</enum><text>in subsection (a)(1), by inserting <quote>, or that have in effect a covered agreement with a sponsoring institution so listed,</quote> after <quote>relevant accrediting body</quote>; and</text></subparagraph> 
<subparagraph id="HAF611A5CF91E456AAC3DE1BA3566DCB3"><enum>(B)</enum><text>in subsection (j), by adding at the end the following new paragraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H1B77BC9399004E0B9CF0C025275D412E"> <paragraph id="H110932A5D2D14351B7F3E50668A829AD"><enum>(5)</enum><header>Covered agreement</header><text display-inline="yes-display-inline">The term <term>covered agreement</term> means a written contract, memorandum of understanding, or other written agreement entered into for not less than 2 years for the purpose of conducting an approved graduate medical residency training program.</text></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H41B0C500B3864619A32AF921865B2CCE"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply with respect to expenses incurred on or after October 1, 2025.</text></paragraph></subsection> <subsection id="HBCDEC6CEE9C842239ECA80FD0404EE39"><enum>(b)</enum><header>Medicare GME cap</header><text>Section 1886(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(h)</external-xref>) is amended—</text> 
<paragraph id="H3A84FC5C928247E2A692FD10E10E224B"><enum>(1)</enum><text>in subsection (4)(F), by striking <quote>and (10)</quote> and inserting <quote>(10), and (11)</quote>; and</text></paragraph> <paragraph id="H986F881FA3164207A1ADDD4777BB4EF9"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H642B5F6E3AB8496080BC579F11F220AD"><enum>(11)</enum><header>Training programs at Federally qualified health centers</header> 
<subparagraph id="HD9A326F700804D369C76B925297D1EB2"><enum>(A)</enum><header>In general</header><text>For cost reporting periods beginning on or after October 1, 2025, in the case of a hospital that has an approved medical residency training program where a significant portion of such program occurs at a Federally qualified health center (as determined by the Secretary), the Secretary shall increase the otherwise applicable resident limit for such hospital by 3 full-time equivalent residency positions.</text></subparagraph> <subparagraph id="HC76ACA615E364C778FB52E509884204F"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="HCC97D16118CD48FE9250F919577EADD2"><enum>(i)</enum><header>Otherwise applicable resident limit</header><text display-inline="yes-display-inline">The term <quote>otherwise applicable resident limit</quote> means, with respect to a hospital, the limit otherwise applicable under subparagraphs (F)(i) and (H) of paragraph (4) on the resident level for the hospital determined without regard to this paragraph but taking into account paragraphs (7)(A), (7)(B), (8)(A), (8)(B), (9)(A), and (10)(A).</text></clause> <clause id="H458DF5D7A39A4070842B517A7F385137"><enum>(ii)</enum><header>Resident level</header><text>The term <quote>resident level</quote> has the meaning given such term in paragraph (7)(C)(i).</text></clause></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HD7234495F7B4415BA9F2CD9EE8ECF0E0"><enum>5.</enum><header>Expanding FQHC services</header> 
<subsection id="HC0B2149D73B0427ABACFD1BBBC78920D" commented="no"><enum>(a)</enum><header>Behavioral health professional and case manager services</header> 
<paragraph id="HC02AFD813F0E43118AEB08E95584CB0D"><enum>(1)</enum><header>Medicare</header><text>Section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>) is amended—</text> <subparagraph id="H0E49E9FC32C4425C9F6A0F84B23E491E"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="HFFDFB4D3B83448E5B442E21DC336EEF9" commented="no"><enum>(i)</enum><text>in subparagraph (B), by inserting <quote>such services furnished on or after October 1, 2025, by a behavioral health consultant, peer support specialist, or other behavioral health professional (as such terms are defined by the Secretary),</quote> before <quote>and such services</quote>;</text></clause> <clause id="H028589C7D5D741FB8D3D878F285D3AE8"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="HCF08150C06794E1B9BD3BDCDCD2A82ED"><enum>(iii)</enum><text>in subparagraph (D), by striking the comma at the end and inserting <quote>, and</quote>; and</text></clause> <clause id="HA5B450D9534645BFA7717495FB6136D1"><enum>(iv)</enum><text>by inserting after subparagraph (D) the following new subparagraph:</text>

                                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">case management services furnished on or after October 1, 2025, by a case manager (as defined by the Secretary),</text>
                                </subparagraph>
                                <after-quoted-block>; and</after-quoted-block>
                            </quoted-block></clause></subparagraph> 
<subparagraph id="H54F6689981524D2884304EF3FE668250"><enum>(B)</enum><text>in paragraph (3)(A), by striking <quote>(D)</quote> and inserting <quote>(E)</quote>.</text></subparagraph></paragraph> <paragraph id="H0C2B81ED8E214E898E599F52019376E0"><enum>(2)</enum><header>Medicaid</header><text>Section 1905(l)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(l)(2)(A)</external-xref>) is amended by inserting <quote>and (E)</quote> before <quote>of section</quote>.</text></paragraph> </subsection> 
<subsection id="HCD974C2103EA46D6BBEB6E5DC87CDFF4" commented="no"><enum>(b)</enum><header>Guidance on State Medicaid payments to FQHCs</header><text display-inline="yes-display-inline">Section 1902(bb) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(bb)</external-xref>) is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6E09892AD05140D8B2235999407DF119"> <paragraph id="H3D2F08A721EB41C8829E902BEC118C5D" commented="no"><enum>(7)</enum><header>Study and guidance on payment adjustments</header><text display-inline="yes-display-inline">Not later than October 1, 2025, and not less frequently than annually thereafter, the Secretary shall—</text> 
<subparagraph id="H73EECC1646FF4E308CF99755ECDE0109" commented="no"><enum>(A)</enum><text>conduct a study on any differences in the methods by which State plans adjust the payment amount under paragraph (3) for services furnished during a fiscal year; and</text></subparagraph> <subparagraph id="H5D817AF18F304090926E3E9C783C66E8" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">based on the results of the study conducted under subparagraph (A), issue guidance to State plans on best practices for adjusting the payment amount under paragraph (3) for services furnished during a fiscal year.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
