<section id="HD4E81A3BA2A848558A057BADC80BD0A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Petfax Act of 2026</short-title></quote>.</text></section> <section id="H49BC1767BC1747A4BCAD47A019E4EBC8"><enum>2.</enum><header>Provision of information to purchasers of dogs and cats</header> <subsection id="HB2983E4ACAF848D5B19B523040B1E565"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HCC58A2242DF84AE3A5CE49140908C99F"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph> <paragraph id="HA10275FAD40F4977A35DE186B7777924"><enum>(2)</enum><header>Covered dog or cat</header><text>The term <term>covered dog or cat</term> means a dog or cat bred and raised by any dealer that is required to be licensed under section 3 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2133">7 U.S.C. 2133</external-xref>).</text></paragraph> 
<paragraph id="H26920ED0483E4B5D857F425AE9E23833"><enum>(3)</enum><header>Covered seller</header> 
<subparagraph id="HC9DB82F9EAE6456A82785A7512CC04F4"><enum>(A)</enum><header>In general</header><text>The term <term>covered seller</term> means—</text> <clause id="H409DBCF675B54001B47B57C1EFDD5862"><enum>(i)</enum><text>a dealer;</text></clause> 
<clause id="H7BA5227215944FB6882D21822D203BD6"><enum>(ii)</enum><text>a retail pet store; and</text></clause> <clause id="HD1384D70B1EE4BC790663677E533ED43"><enum>(iii)</enum><text>any other person that sells, or offers for sale, dogs or cats, including through the internet, for compensation or profit other than on an intermittent basis.</text></clause></subparagraph> 
<subparagraph id="HB5B3459AF3BB43C6A11BF7A033C46B4F"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered seller</term> does not include—</text> <clause id="HBA920E4A4BFB4B06BB2DBC3A58636B05"><enum>(i)</enum><text>a public animal shelter; or</text></clause> 
<clause id="H603A891B876B42D0BBEDB61FCD08FBD2"><enum>(ii)</enum><text>an organization—</text> <subclause id="H8E1228A3DE3447F5AAC628E4AF80F25D"><enum>(I)</enum><text>described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code; and</text></subclause> 
<subclause id="H95CBA5DF08514D3AA1AF3608D20F8E35"><enum>(II)</enum><text>that is involved in bona fide animal adoption or rescue activities.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H6DCF689B77E443A791A1C080481CEF56"><enum>(4)</enum><header>Dealer</header><text>The term <term>dealer</term> has the meaning given the term in section 2 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2132">7 U.S.C. 2132</external-xref>).</text></paragraph> 
<paragraph id="HE432DE04EAA64A368C2491746ED5B7F7"><enum>(5)</enum><header>Financial consideration</header><text>The term <term>financial consideration</term> means any payment, including a donation, but does not include—</text> <subparagraph id="HC4DB289E7D314697B54E688235970CDF"><enum>(A)</enum><text>a payment made to a public animal shelter; or</text></subparagraph> 
<subparagraph id="HF95F9C40148C456C9FA345C91F6AB8C2"><enum>(B)</enum><text>a payment that is made solely to reimburse a person for the costs of caring for a dog or cat.</text></subparagraph></paragraph> <paragraph id="H63F41B84E42C4D9792D0D1407A37A2D0"><enum>(6)</enum><header>Purchaser</header><text>The term <term>purchaser</term> means a person that—</text> 
<subparagraph id="H021A015AF0AB4C13A7BE7DD57689494D"><enum>(A)</enum><text>is not a dealer; and</text></subparagraph> <subparagraph id="H9E408BE595F544918AE93C542B2EF9E3"><enum>(B)</enum><text>purchases a covered dog or cat.</text></subparagraph></paragraph></subsection> 
<subsection id="HFB825267CB1846C7BA8532FC70056160"><enum>(b)</enum><header>Requirement</header><text>A covered seller may not sell, or offer for sale, a covered dog or cat, including through the internet, unless, before the purchase of the covered dog or cat, the covered seller provides to the purchaser, in a form prescribed by the Commission—</text> <paragraph id="H57053D1763C146FAB4004E7CA561C951"><enum>(1)</enum><text>information relating to the source of the covered dog or cat, including—</text> 
<subparagraph id="H7E9C22EC8D6547A5B434AEFEB7BA9C61"><enum>(A)</enum><text>the name, address, telephone number, and Department of Agriculture license or registration number (if such a number exists) of—</text> <clause id="H67A216197EE0499CB9865461EC092E19"><enum>(i)</enum><text>the dealer that bred and raised the covered dog or cat, and—</text> 
<subclause id="HBE1880F03F2D4EBABDF7FB751C1CEF86"><enum>(I)</enum><text>the number of dogs and cats bred by such dealer during the prior 2 years; and</text></subclause> <subclause id="H0AEB5FB6271F40449ACAB626A7334C1F"><enum>(II)</enum><text>the number of dogs and cats sold by such dealer during the prior 2 years;</text></subclause></clause> 
<clause id="H915CE01388EB4F4E8447ECD8869F7078"><enum>(ii)</enum><text>the covered seller that acquired the covered dog or cat from the dealer described in clause (i), if any; and</text></clause> <clause id="HB097049E6A424D8D875A6F1AC3D52E7E"><enum>(iii)</enum><text>each covered seller that acquired the covered dog or cat thereafter, if any; and</text></clause></subparagraph> 
<subparagraph id="H82E62653578B40E78D0D94DFD9C92E20"><enum>(B)</enum><text>a listing and description of each violation of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>), if any, during the prior 2 years by each dealer and covered seller described in clauses (i), (ii), and (iii) of subparagraph (A), as applicable; and</text></subparagraph></paragraph> <paragraph id="H08B94CEFE60044CEB51DDB3DD3B45089"><enum>(2)</enum><text>information relating to the health history of the covered dog or cat, including—</text> 
<subparagraph id="H7DE88D5FD46F4C6C96702F432EB989CC"><enum>(A)</enum><text>the date of birth of covered dog or cat;</text></subparagraph> <subparagraph id="H48897BFD2F834A03936797F304AE7192"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="H71A1A22FB5B8420393C0EFFE4E70F734"><enum>(i)</enum><text>if the covered dog or cat has received individual examinations by a licensed veterinarian—</text> 
<subclause id="H0E7DE035CA4F43F5A4E6B77DE0083FA7" indent="up1"><enum>(I)</enum><text>the most recent date on which the covered cat or dog received an individual examination by a licensed veterinarian; and</text></subclause> <subclause id="HBB782B3BABD646EEA76FC6D1D4267E3E" indent="up1"><enum>(II)</enum><text>the name, address, telephone number, and State license number (if such a number exists) of the licensed veterinarian described in subclause (I); or</text></subclause></clause> 
<clause id="H4AE879375D3F42FA82B85973347FB99A" indent="up1"><enum>(ii)</enum><text>if the covered dog or cat has not received an individual examination by a licensed veterinarian, a statement that the covered dog or cat has not received an examination by a licensed veterinarian; and</text></clause></subparagraph> <subparagraph id="HD17E7DFC8C2D432EA75125CFF042341C"><enum>(C)</enum><text>a list of—</text> 
<clause id="H7E44E61C4D3149EBB0EAFD56286F3BE1"><enum>(i)</enum><text>each vaccine administered to the covered dog or cat;</text></clause> <clause id="H379483DCD25A425789448EE84560E0F8"><enum>(ii)</enum><text>each congenital deformity, disease, disorder, or condition that the covered seller knows, or should reasonably know, affects the covered dog or cat; and</text></clause> 
<clause id="HDC1AEE8CCB1442BE89C124490D7C5341"><enum>(iii)</enum><text>each infectious disease, disorder, or condition that the covered seller knows, or should reasonably know, affects the covered dog or cat.</text></clause></subparagraph></paragraph></subsection> <subsection id="HC263EE4151A642CA9741A849A5487A94"><enum>(c)</enum><header>Transfers</header><text>A covered seller providing to another covered seller a covered dog or cat that will ultimately be sold to a purchaser shall provide to the other covered seller the information described in subsection (b).</text></subsection> 
<subsection id="H75568620DE1C44C6A1EF0964D353BEC4">
        <enum>(d)</enum>
        <header>Application to non-Profit sellers</header>
 <text>Any organization described in subsection (a)(3)(B)(ii) that acquires a dog or cat in exchange for financial consideration shall disclose to any person seeking to acquire such dog or cat from such organization in exchange for financial consideration—</text>
        <paragraph id="HA8883ECAC28748F9AF5FA6EE913AB62C">
          <enum>(1)</enum>
 <text>the fact that such organization acquired such dog or cat in exchange for financial consideration and the amount of such consideration; and</text>
        </paragraph>
        <paragraph id="H87AB5771AE784FECB2CD92C5D4A0A526">
          <enum>(2)</enum>
 <text>the name of the person from which the organization acquired such dog or cat (if known to the organization).</text>
        </paragraph>
      </subsection> 
<subsection id="HE4F7FBFB578842ECBC4CD05715C25163"><enum>(e)</enum><header>Regulations</header> 
<paragraph id="H45F7BC6BBDD648E1803038D5E6237E13"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall promulgate regulations under section 553 of title 5, United States Code, to carry out this section.</text></paragraph> <paragraph id="H464498EF45604B7BA2A5A85E1DFF5645"><enum>(2)</enum><header>Requirements</header><text>The regulations under paragraph (1) shall—</text> 
<subparagraph id="H4EEC692D7BE14A7482B2BB72EC374A3A"><enum>(A)</enum><text>include the manner and method by which the information described in subsection (b) may be provided to a potential purchaser under that subsection, or to another covered seller under subsection (c), as applicable, to comply with this section; and</text></subparagraph> <subparagraph id="HCA81356184AB4CCBBD2AF2ECF53566E3"><enum>(B)</enum><text>provide that a covered seller that uses a different manner or method than the manner and method described in subparagraph (A) to provide the information described in subsection (b) to a potential purchaser under that subsection, or to another covered seller under subsection (c), as applicable, may not be determined to be in noncompliance with this section solely because of the manner and method used.</text></subparagraph></paragraph></subsection> 
<subsection id="H7F7BB74EA142408184922C1D5B039FA4"><enum>(f)</enum><header>Effect</header><text>Nothing in this section shall preempt any State or local law.</text></subsection></section> <section id="HFDB9A5399EE842AA8B61221232E9ADC5"><enum>3.</enum><header>Unfair or deceptive acts or practices with respect to the sale of animals for use as pets</header> <subsection id="HDE9365A5972B449DACF486B64467E9AF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H2D4CB10CD6794EDB979BD4FF3942FE57"><enum>(1)</enum><header>Commission; covered seller</header><text>The terms <term>Commission</term> and <term>covered seller</term> have the meanings given those terms in section 2.</text></paragraph> <paragraph id="H5D2A235E56764258B7DD84A4507D0976"><enum>(2)</enum><header>High-volume breeder</header><text>The term <term>high-volume breeder</term> means any person that—</text> 
<subparagraph id="H45B64EB8A74744E485C520BDEF34B4B0"><enum>(A)</enum><text>is engaged in the breeding of dogs or cats; and</text></subparagraph> <subparagraph id="HB99013C8FC5B48AE93DAB1C699C3D711"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="H4A06CB7ACF9F4D3D9A03DDD7BEDCA9E9"><enum>(i)</enum><text>is required to be licensed as a dealer under section 3 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2133">7 U.S.C. 2133</external-xref>);</text></clause> 
<clause id="H384329449C8F425DB6E9D4FC769A0D52" indent="up1"><enum>(ii)</enum><text>keeps on the premises of the person not fewer than 4 breeding dogs or cats; or</text></clause> <clause id="H8C08D9D7368E4AC8989750C14BDA5E25" indent="up1"><enum>(iii)</enum><text>during a 1-year period, sells not fewer than 25 dogs or cats that were bred on the premises of the person.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H0F66051AC79E45839257716E4E913CFB"><enum>(b)</enum><header>Unlawful activity</header> 
<paragraph id="HEE2BE3BD59EB4A5AA1C3FFC110E8FEEE"><enum>(1)</enum><header>In general</header><text>It is unlawful to engage in an unfair or deceptive act or practice with respect to any sale of an animal for use as a pet.</text></paragraph> <paragraph id="H7DFB86175A144023AE6BA046807ABFAC"><enum>(2)</enum><header>Misrepresentations relating to the source of dogs and cats</header><text>It is a violation of paragraph (1) for a covered seller, in selling, or negotiating the purchase or sale of, a dog or cat, to misrepresent where the dog or cat was bred or the source from which the covered seller acquired the dog or cat, including by misrepresenting whether—</text> 
<subparagraph id="HA3C26EDBE06344F8AD10C99FF132A820"><enum>(A)</enum><text>a high-volume breeder bred the dog or cat; or</text></subparagraph> <subparagraph id="HD9E2EEAFA9C24523BF90776D52E3BFCD"><enum>(B)</enum><text>the covered seller acquired the dog or cat from a high-volume breeder.</text></subparagraph></paragraph> 
<paragraph id="HFC56D795BAA247F3A6BA2939DCFC4219"><enum>(3)</enum><header>Violation of requirement to provide certain information</header><text>It is a violation of paragraph (1) for a covered seller to sell a dog or cat in violation of section 2 on or after the date that is 60 days after the date on which the Commission promulgates regulations under subsection (e)(1) of that section.</text></paragraph></subsection> <subsection id="HDCE460706C3D43719AD42E55872B955D"><enum>(c)</enum><header>Enforcement by the Commission</header> <paragraph id="HD5F8D1F33A0B4E1781E58B815C80F0AE"><enum>(1)</enum><header>In general</header><text>This section shall be enforced by the Commission under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HF3DF08805EBE4689AFC69C4D7381E8D3"><enum>(2)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph> <paragraph id="H0597DC06869E4EDD86FA828EF3077D46"><enum>(3)</enum><header>Actions by the Commission</header> <subparagraph id="H219B07CE8D2F4BAC988CB9A0A9FF604E"><enum>(A)</enum><header>In general</header><text>The Commission shall prevent any person from violating this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph> 
<subparagraph id="H4A9262C641B5408CA37E5B5074331CC0"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph></paragraph></subsection> <subsection id="HAE531BB745824656B4F7EEEF8DB3AD23"><enum>(d)</enum><header>Effect</header> <paragraph commented="no" display-inline="no-display-inline" id="H15B236CE93EC4CEBA266053D5CFD765F"><enum>(1)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission, the Secretary of Commerce, or the Secretary of Agriculture under any other provision of law.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1F7B30394B304A2896048A5E82D9F164"><enum>(2)</enum><header>Preemption</header><text display-inline="yes-display-inline">Nothing in this section shall preempt any State or local law.</text></paragraph></subsection></section> <section id="H7F6A3DECC40B4DDB9D21704827C765E5"><enum>4.</enum><header>Prohibition on issuing licenses to certain persons as a result of license revocation</header> <subsection id="HDE168F5C952F4945863FB844520C74AD"><enum>(a)</enum><header>Definition of immediate family member</header><text display-inline="yes-display-inline">Section 2 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2132">7 U.S.C. 2132</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H443AE3C749844E72A8A8AB893AEE89F9" style="OLC"> 
<subsection id="H6EE09CA581E54425867E6ED5F22D010F"><enum>(p)</enum><text display-inline="yes-display-inline">The term <term>immediate family member</term> means, with respect to a dealer—</text> <paragraph id="H985E1EFC3CB14369BDC3622BFEB08492"><enum>(1)</enum><text display-inline="yes-display-inline">a spouse, domestic partner, child, parent, brother, sister, grandparent, or grandchild of the dealer; and</text></paragraph> 
<paragraph id="H2C443596C3B0419D8523057275EAEA27"><enum>(2)</enum><text display-inline="yes-display-inline">a spouse or domestic partner of a child, parent, brother, sister, grandparent, or grandchild of the dealer.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9B048E44F590426B805947C2B934F088"><enum>(b)</enum><header>Prohibition on issuing licenses to certain persons as a result of license revocation</header><text display-inline="yes-display-inline">Section 3 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2133">7 U.S.C. 2133</external-xref>) is amended—</text> 
<paragraph id="HAFB96B52A7F6455387032970B8D81A1A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section designation and all that follows through <quote>The Secretary shall</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HD6A6D99AB7304E5684034E735DB26D3B" style="OLC"> <section id="H364BE7B98ED94CB68DF52AAE393E4A0B"><enum>3.</enum><header>Licenses</header> <subsection id="H7034A3016EFD466BB0FCA9C3D651825E"><enum>(a)</enum><header>In general</header><text>The Secretary shall</text></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H061FC05F81FF4FDC8A628050F71F5C4D"><enum>(2)</enum><text>in subsection (a) (as so designated), in the first sentence, in the first proviso—</text> <subparagraph id="H9560C0ACADC3463C8FEA484A02EB9473"><enum>(A)</enum><text>by inserting <quote>or renewed</quote> after <quote>issued</quote>; and</text></subparagraph> 
<subparagraph id="H65F48A721FBE46B793A31EAFBD687089"><enum>(B)</enum><text>by striking <quote>demonstrated that his facilities</quote> and inserting <quote>demonstrated through facility inspection that the facilities</quote>; and</text></subparagraph></paragraph> <paragraph id="H8194EBBF5A384FDC95D60EA0002F37A4"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE7D23312B3EE408299DDFF1C23B1191F" style="OLC"> 
<subsection id="H9A37AADC0C6B4853A000FAE4E04671F0"><enum>(b)</enum><header>Prohibition on issuing licenses to certain persons as a result of license suspension or revocation</header> 
<paragraph id="HD4C6518FC81E4859BD6093900F38BDA0"><enum>(1)</enum><header>In general</header><text>The Secretary shall not issue or renew a license for the purpose of being a dealer of dogs or cats to a person who is an immediate family member of, or who resides at the same address of, a dealer of dogs or cats if—</text> <subparagraph id="H35877CBEB9794518A192E365B66A0605"><enum>(A)</enum><text>the license is for purposes of operating a facility for dogs or cats at a location that the dealer has used as a facility for dogs or cats; and</text></subparagraph> 
<subparagraph id="H057A48F16F8B4253972991246FEFE667"><enum>(B)</enum><text display-inline="yes-display-inline">within the last 10 years, a license of that dealer has been suspended after notice and opportunity for hearing or revoked pursuant to section 19(a).</text></subparagraph></paragraph> <paragraph id="H648E97ECD21E4F039EF36C1C3DBDE7CB"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to a person described in that paragraph if that person shows by clear and convincing evidence that a dealer described in that paragraph—</text> 
<subparagraph id="H40B3C5A53AAD43EFB67B3EB1A963EDBC"><enum>(A)</enum><text>will have no ownership interest in the facility for which that person seeks a license;</text></subparagraph> <subparagraph id="H54AB214D08CB45A98A4B39DC29BC6E34"><enum>(B)</enum><text>will play no role in the care of dogs or cats at the facility; and</text></subparagraph> 
<subparagraph id="HDAEFB83C75634037A987377AA5934725"><enum>(C)</enum><text display-inline="yes-display-inline">will play no role in the management of the facility.</text></subparagraph></paragraph></subsection> <subsection id="HD0D10077F7AF4B7196E979DCFB2A88AB"><enum>(c)</enum><header>Prohibition on issuing licenses to certain legal entities as a result of license suspension or revocation</header> <paragraph id="H12540A695784484B85D2F7E17AB9036A"><enum>(1)</enum><header>In general</header><text>The Secretary shall not issue or renew a license for the purpose of being a dealer of dogs or cats to any person that is a partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity if any person who holds an ownership interest in the partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity—</text> 
<subparagraph id="H2823506F06A34268A7586F799B4190CC"><enum>(A)</enum><text>previously held a license for purposes of operating a facility for dogs or cats at the same address of the facility for which the license is being sought; and</text></subparagraph> <subparagraph id="H5B67FDEB7DED4C649062D24C3570B6BE"><enum>(B)</enum><text display-inline="yes-display-inline">within the last 10 years, that license has been suspended after notice and opportunity for hearing or revoked pursuant to section 19(a).</text></subparagraph></paragraph> 
<paragraph id="HA6E363C43DC54C83BBB00D415D2F7832"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to a person seeking the issuance or renewal of a license described in that paragraph if that person shows by clear and convincing evidence that a person who previously held a license for purposes of operating a facility for dogs or cats described in subparagraph (A) of that paragraph—</text> <subparagraph id="H4CAABB29139D416EBB17CAE84DDADC63"><enum>(A)</enum><text>will play no role in the care of dogs or cats at the facility; and</text></subparagraph> 
<subparagraph id="H6537ABF588B2457895FCA2EA3A1EF751"><enum>(B)</enum><text display-inline="yes-display-inline">will play no role in the management of the facility.</text></subparagraph></paragraph></subsection> <subsection id="H65EE33809517479589189748306364F4"><enum>(d)</enum><header>10-Year bar for suspension or revocation of a license of a dealer of dogs or cats</header><text>The Secretary shall not issue or renew a license for the purpose of being a dealer of dogs or cats to a person if—</text> 
<paragraph id="H1CF1D063D1A94DA5B1E70802F0041D8C"><enum>(1)</enum><text display-inline="yes-display-inline">within the last 10 years, a license for the purpose of being a dealer of dogs or cats of that person has been suspended after notice and opportunity for hearing or revoked pursuant to section 19(a); and</text></paragraph> <paragraph id="HCC50930492F14FDC9BB4CD8738B4A8ED"><enum>(2)</enum><text display-inline="yes-display-inline">the license is for purposes of operating a facility for dogs or cats at a location that the person has used as a facility for dogs or cats.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE5921BCC6F5743F9B34E4E5FCADCAC67"><enum>(c)</enum><header>Revocation of improperly granted licenses</header><text display-inline="yes-display-inline">Section 19 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2149">7 U.S.C. 2149</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H78C8B9ED4E344BFC91557D0E33BF928E" style="OLC"> <subsection id="HD7FA553E83744B1CAEDB2FA7FB10F033"><enum>(e)</enum><header>Revocation of improperly granted licenses</header><text display-inline="yes-display-inline">The Secretary shall revoke a license issued after the date of enactment of this subsection if the Secretary subsequently determines that, at the time of issuance, the issuance of the license violated section 3.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE99D161F942D4E7EA0CB96617F8402F0"><enum>(d)</enum><header>Regulations</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H0B8476256D9D4A0E83AD9108FD67957C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture may prescribe such regulations as the Secretary of Agriculture determines to be necessary to implement the amendments made by this section.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H3B0B2CA977A54AC59D88116583EEFBD2"><enum>(2)</enum><header>Deadline</header><text display-inline="yes-display-inline">Any regulations under paragraph (1) shall be prescribed not later than 1 year after the date of enactment of this Act.</text></paragraph></subsection></section>
