<section id="HEF6BA8CE32F8454E8D098150F809BFDA" section-type="section-one"><enum>1.</enum><header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Trade and Development Agency Modernization Act of 2026</short-title></quote> or the <quote><short-title>USTDA Modernization Act of 2026</short-title></quote>.</text></section> <section id="HBF21F894E34542F3B532CFBDD9A24041"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the United States Trade and Development Agency plays a critical role in advancing United States commercial, energy, digital, and infrastructure interests in priority emerging markets by supporting early-stage project preparation and technical assistance and should be authorized to allocate some of its annual program funds for activities in high-income countries that directly affect United States economic and national security.</text></section> 
<section id="H1D8586C15F0B4E6BBA67B5C6CFC855A9"><enum>3.</enum><header>Expansion of country eligibility</header><text display-inline="no-display-inline">Section 661(b) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2421">22 U.S.C. 2421(b)</external-xref>) is amended—</text> <paragraph id="H88E1FEF8A7A7420280D3144B2F15CC26"><enum>(1)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (4), (5), and (6), respectively; and</text></paragraph> 
<paragraph id="HF1BF1584B9A147A38BEA371C0866287F"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block id="H249FED36D8DC4B6682029EFFDE2D1210" style="OLC"> <paragraph id="H7F11A0DCFB594DF9A36B581CC578ACB3"><enum>(3)</enum><header>Assistance in high-income countries</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Director of the Trade and Development Agency is authorized to provide not more than 15 percent of the total amount of funds appropriated in a fiscal year for assistance under this section for—</text> 
<subparagraph id="HA949534C0F2A49FAA6692E584F1276FF"><enum>(A)</enum><text display-inline="yes-display-inline">activities described in paragraph (2) in high-income countries; or</text></subparagraph> <subparagraph id="HC52862E374DB4E86899A43044A7041F0"><enum>(B)</enum><text display-inline="yes-display-inline">projects in high-income countries that serve United States strategic interests in the energy, critical minerals, transport, or telecommunications sectors.</text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H336A8E7FD97247E887D6B76DB51A20CE"><enum>4.</enum><header>Personnel authorities</header><text display-inline="no-display-inline">Section 661(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2421">22 U.S.C. 2421(c)</external-xref>) is amended—</text> <paragraph id="HAFC9FEC960534FF7B90BE6860D288293"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(C), by striking <quote>2</quote> and inserting <quote>5</quote> before <quote>may be appointed</quote>; and</text></paragraph> 
<paragraph id="HCBCF2FEA3C94456C99234C27DF72D0A4"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H20B1976793FC4F7B89E86041A737666A" style="OLC"> <paragraph id="HE1CA8C6238DE4FCEBB97B5732B84A994"><enum>(3)</enum><header>Personal services contractors</header> <subparagraph id="HCF6FCB9A82874AC2AC0D11A2F6000707"><enum>(A)</enum><text>The Trade and Development Agency may contract with individuals for personal services, and such individuals may not be considered Federal employees for the purpose of any provision of law administered by the Director of the Office of Personnel Management.</text></subparagraph> 
<subparagraph id="HB667C1D19E174674A6E520B16F1ADC0D"><enum>(B)</enum><text display-inline="yes-display-inline">The Director shall submit to Congress an annual report describing the number of individuals contracted for personal services by the Trade and Development Agency, the roles of such contractors, and the costs associated with such contracts.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
