<title id="HA05402DD9AE4431E816511816ED744CE" style="OLC"><enum>I</enum><header>Violent Criminal Offender Database</header>
<section commented="no" display-inline="no-display-inline" id="HDCF061936D9D45EEBA919473FAA07420"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph commented="no" display-inline="no-display-inline" id="H1F6272D4E4754253A87D1411F9141877"><enum>(1)</enum><header>Byrne JAG grant program</header><text>The term <term>Byrne JAG grant program</term> means the grant program established under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H66AD5C860DB5473E97DBF9DED309BFF3"><enum>(2)</enum><header display-inline="yes-display-inline">Database</header><text>The term <term>Database</term> means the database established under section 102(a).</text></paragraph> <paragraph id="HBBDB041D27154562BBE1B312017009AE"><enum>(3)</enum><header>Qualifying conviction</header><text>The term <term>qualifying conviction</term>—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H214D13137E1E41BFB736151C588092BB"><enum>(A)</enum><text display-inline="yes-display-inline">means any conviction for an offense that—</text> <clause id="HD37A821905AC4C45B6E540317E628E79"><enum>(i)</enum><text>is punishable by imprisonment for a term exceeding 180 days, regardless of the sentence actually imposed; and</text></clause>
<clause id="H50BA08FE9CD9435690771F29F80AF1F2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum>
<subclause commented="no" display-inline="yes-display-inline" id="HD295BED1275B49C5AE11616F0AAA6BB7"><enum>(I)</enum><text>has as an element the use, attempted use, or threatened use of physical force against the person or property of another; or</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HF3E127BD752E46A493B49CB7D23F4DEB" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense; and</text></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H24C0016A80AB46DFA6CF48436FC9AC93"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any conviction—</text> <clause commented="no" display-inline="no-display-inline" id="H06202FADC2DC4B65AD497CFAA4792233"><enum>(i)</enum><text display-inline="yes-display-inline">that has been expunged, vacated, set aside, or otherwise rendered legally inoperative under Federal or State law; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H14DC7B45ACCB4F03B8D4E48A4DCB9EC1"><enum>(ii)</enum><text display-inline="yes-display-inline">if the person who committed the offense of conviction has been pardoned for the offense pursuant to a full and unconditional pardon.</text></clause></subparagraph></paragraph> <paragraph id="H325423D7BD2A4C5380A86CE38EB57F93"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means a State of the United States, the District of Columbia, any commonwealth, territory, or possession of the United States, and a tribal organization.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFC15CFD724B049DF803C22120469A912"><enum>(5)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></section> <section id="H5A7C897116704EDCA59C420A8A94E26A"><enum>102.</enum><header>Database</header> <subsection id="H7E91BF0B7A464468A28CA3D8B2CD208A"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall establish a publicly accessible database of all individuals with qualifying convictions, to be known as the <quote>Violent Criminal Offender Database</quote>.</text></subsection>
<subsection id="HF70C8C8DD719439F8BFBC2542C844FBD"><enum>(b)</enum><header>Requirements</header><text>The Attorney General shall ensure that—</text> <paragraph id="H0208E5AC70AF43C996870B08E2117534"><enum>(1)</enum><text>the Database includes both Federal and State records of qualifying convictions;</text></paragraph>
<paragraph id="HD47B0DCCB839446B834D8B3912416338"><enum>(2)</enum><text>to the extent practicable, the Database utilizes records collected by the Federal Bureau of Investigation;</text></paragraph> <paragraph id="HEC6ECB3BCFA5491997E2676E5F867AE2"><enum>(3)</enum><text>the Database is available free of charge to the public;</text></paragraph>
<paragraph id="HE5AD81EEF9FF487AA6EE081FCD670968"><enum>(4)</enum><text>the Database is searchable by—</text> <subparagraph id="H27A70940DD554092B278996C1B12A0EB"><enum>(A)</enum><text>name;</text></subparagraph>
<subparagraph id="HF8D6BBFB70D94661A4ED77287FD1A6A4"><enum>(B)</enum><text>address;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9330810D937B4B66BFD9736E87E51E73"><enum>(C)</enum><text>date of birth;</text></subparagraph>
<subparagraph id="H7C479E2FC6F34D80B9145447439FC914"><enum>(D)</enum><text>sex;</text></subparagraph> <subparagraph id="H8D932AF63F0B448C926AE685129104DF"><enum>(E)</enum><text>race;</text></subparagraph>
<subparagraph id="H6E92BA26B04D497CB93D4C0D96BCCFB0"><enum>(F)</enum><text>nationality;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H61ED0443FE304E16BAD3BCF3CAD43FAE"><enum>(G)</enum><text>citizenship status;</text></subparagraph>
<subparagraph id="H2FCD6FD81A294CC6921AE8148CF38F95"><enum>(H)</enum><text>type of conviction;</text></subparagraph> <subparagraph id="H54AA958D7ED042CB9B21FAEFD8F57D2D"><enum>(I)</enum><text>current and historical probation status related to a qualifying conviction, including information on any probation revocation or violation;</text></subparagraph>
<subparagraph id="H2F736BB5DC2E44D4BD5E3D64CF174230"><enum>(J)</enum><text>jurisdiction of each qualifying conviction;</text></subparagraph> <subparagraph id="HA5A1B2476A9F415CA3C83B0084E0DDBD"><enum>(K)</enum><text>the maximum fine and term of imprisonment authorized, and the actual fine and term of imprisonment imposed, for each qualifying conviction;</text></subparagraph>
<subparagraph id="HD09639D56E2F4846815FABAA86FF8BC9"><enum>(L)</enum><text>whether each qualifying conviction was the result of a plea agreement or a trial;</text></subparagraph> <subparagraph id="H1CCAA7E58D924E1381C3FA60A4B91E24"><enum>(M)</enum><text>the sentencing judge for each qualifying conviction;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA9BA3C937427460FB87038A857A1D787"><enum>(N)</enum><text display-inline="yes-display-inline">the prosecuting office for each qualifying conviction; and</text></subparagraph> <subparagraph id="H7A93D8EA1352417282D95F5A3B91EBA4"><enum>(O)</enum><text>any other searchable category the Attorney General determines appropriate to ensure the safety of the public; and</text></subparagraph></paragraph>
<paragraph id="HB1DF7D466DD94147887E3D65C59825DB"><enum>(5)</enum><text>the public is informed of the availability of the Database.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H0D252637345A48748BC3D46C8AABC380"><enum>(c)</enum><header>Updates</header> <paragraph commented="no" display-inline="no-display-inline" id="H31DAC8BBAC5047A1B2DE32F6E82C4571"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not less frequently than quarterly, the Attorney General shall update the Database.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0802F8876F0B4CCABB51C8DCF3E1C1BE"><enum>(2)</enum><header>Removal of persons with legally inoperative convictions</header><text display-inline="yes-display-inline">Upon determining that a conviction for which a person has been listed in the Database no longer constitutes a qualifying conviction by reason of section 101(3)(B), the Attorney General shall remove the person from the Database with respect to that conviction.</text></paragraph></subsection></section> <section id="H72335FFEE3264F5DBBA8A10912A6B3A4"><enum>103.</enum><header>State participation in database</header> <subsection id="HDF14B4E974BC4322828139E72BDFFC1D"><enum>(a)</enum><header>Submission of data</header><text>Not later than 180 days after the date of enactment of this Act, and on an ongoing basis thereafter, each State that receives amounts under the Byrne JAG grant program shall submit to the Attorney General all data regarding qualifying convictions entered by a court of the State or a political subdivision of the State necessary for the Attorney General to comply with section 102.</text></subsection>
<subsection id="HBF67A7143835490DAF52B78F420663CE"><enum>(b)</enum><header>Byrne JAG grant penalty for noncompliance</header><text>The Attorney General—</text> <paragraph commented="no" display-inline="no-display-inline" id="HB152C8A4B1B74918B33CDB0714544428"><enum>(1)</enum><text display-inline="yes-display-inline">shall not distribute amounts under the Bryne JAG grant program to a State that is not in compliance with subsection (a); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCCFFFC15D10948D28A12E4E4F2BC322A"><enum>(2)</enum><text>in the case of amounts under the Byrne JAG grant program that the Attorney General would have distributed to a State but for the prohibition under paragraph (1) of this subsection, may, at the discretion of the Attorney General, and without regard to the requirements and limitations under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10156">34 U.S.C. 10156</external-xref>), distribute those amounts directly to units of local government in the State, which shall be in addition to the grants required to be made directly to units of local government under subsection (d) of such section 505.</text></paragraph></subsection></section></title> <title id="H4EB30526FBDB4451A813F4E9BD81304C" style="OLC"><enum>II</enum><header>Federal efforts to increase data sharing among States</header> <section id="H4B3B2C4DA8594ECDA443ABD3FD16DA28"><enum>201.</enum><header>Report and recommendations on information sharing</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report that includes the following:</text>
<paragraph id="H9CFFF9A2C26940DF93151D1CD1F7FFEE"><enum>(1)</enum><text>A description of the current process and procedure for sharing criminal records, including fingerprint, warrant, and criminal history data—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7AD94B04232C413B9819354106A87DFC"><enum>(A)</enum><text display-inline="yes-display-inline">between the States; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC77E699AFA734E4C818F56B6CC5AAAFC"><enum>(B)</enum><text display-inline="yes-display-inline">between the States and the Federal Government.</text></subparagraph></paragraph> <paragraph id="HCA893D9C87374C72A8738871555B4D64"><enum>(2)</enum><text>The identification of any procedural or process burdens that can or could result in criminal records not being shared between prosecutorial offices or departments, to the extent that such burdens result in harm to the public.</text></paragraph>
<paragraph id="HE4B55DCF2A7A49F991F8BD6195BA5A58"><enum>(3)</enum><text>Recommendations for both the Department of Justice and Congress to ensure that criminal records are shared between relevant prosecutorial offices and law enforcement agencies of States and between such offices and agencies of States and the Federal Government such that the public is protected from criminal offenders.</text></paragraph> <paragraph id="HC0C40637FDCD41F7A03785DEE2C920EF"><enum>(4)</enum><text>Any other matters, issues, laws, compacts, or regulations that the Attorney General identifies as detrimental to the goal of ensuring that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBA13F794F7C64AA3AD02A4FB066A8B63"><enum>(A)</enum><text display-inline="yes-display-inline">the records of criminal offenders are shared with prosecutors nationwide; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H534BD1FF3DE4461FB17436DCF352AF7A"><enum>(B)</enum><text display-inline="yes-display-inline">repeat criminal offenders are not given inappropriately light sentences due to their records not being shared as described in subparagraph (A).</text></subparagraph></paragraph></section></title>
