<section id="H1844E6A277644AB098086867314C56D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Championing Honest And Responsible Transparency in Education Reform Act</short-title></quote> or the <quote><short-title>CHARTER Act</short-title></quote>.</text></section> <section id="HE95A472D657847ADA58473E4E67483BC"><enum>2.</enum><header>Purpose and findings</header> <subsection id="H367EE494D6F04D2DA827AD75CD1C4867"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to ensure that each charter school that receives funding under the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) (in this section referred to as the <quote>ESEA</quote>) or the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>) (in this section referred to as the <quote>IDEA</quote>)—</text>
<paragraph id="H5542B53E8FA04241B9D51F7C4EBA4164"><enum>(1)</enum><text>complies with the intent of the requirements for funding under such Act; and</text></paragraph> <paragraph id="H8EFDA7A0842F4098AE012E322F62BCC3"><enum>(2)</enum><text>best serves the educational needs of students by prohibiting such charter school and its charter management organization from entering into a contract with a for-profit entity under which the for-profit entity—</text>
<subparagraph id="H8143D678A1574FF7BAF35EF5BB3B6DD4"><enum>(A)</enum><text display-inline="yes-display-inline">operates, oversees, or manages the charter school in order to exert influence in school management; and</text></subparagraph> <subparagraph id="HF284C4B3AB654723AE18C966F28C3F1A"><enum>(B)</enum><text display-inline="yes-display-inline">receives a portion of school revenue in order to extract profit for itself or its related entities.</text></subparagraph></paragraph></subsection>
<subsection id="HF8010297CC5A466A89880F38190D566C"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="HF1966162FB2C496D903E23BF273ACBB6"><enum>(1)</enum><text display-inline="yes-display-inline">An <quote>elementary school</quote> is defined as <quote>a nonprofit institutional day or residential school, including a public elementary charter school, that provides elementary education, as determined under State law</quote> under section 8101 of the ESEA (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) and section 602 of the IDEA (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>).</text></paragraph>
<paragraph id="H2020F06D45024BC2A6203197FF5AE3D9"><enum>(2)</enum><text display-inline="yes-display-inline">A <quote>secondary school</quote> is defined as <quote>a nonprofit institutional day or residential school, including a public secondary charter school, that provides secondary education, as determined under State law, except that the term does not include any education beyond grade 12</quote> under section 8101 of the ESEA (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) and section 602 of the IDEA (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>).</text></paragraph> <paragraph id="HAACF04EF30F3448DA4326B6A62391440"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>nonprofit</term> as applied to a school, agency, organization, or institution means <quote>a school, agency, organization, or institution owned and operated by 1 or more nonprofit corporations or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual</quote> under section 602 of the IDEA (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>).</text></paragraph>
<paragraph id="H8D49071AD97145879EDFCF207D15C298"><enum>(4)</enum><text display-inline="yes-display-inline">In 2003, the Department of Education Office of Inspector General, upon auditing the Arizona Department of Education, concluded that the State educational agency in Arizona had improperly distributed funds under the ESEA and the IDEA to for-profit charter schools.</text></paragraph> <paragraph id="HD41617DB321847D69CA9F7180E5787B9"><enum>(5)</enum><text display-inline="yes-display-inline">In 2006, the United States Court of Appeals Ninth Circuit Court in Arizona State Bd. v. U.S. Dept. of Educ., 464 F.3d 1003 (9th Cir. 2006) found that the terms <term>elementary school</term> and <term>secondary school</term> in the ESEA and the IDEA were limited to nonprofit entities, holding that for-profit charter schools were ineligible for Federal funds under the ESEA and the IDEA.</text></paragraph>
<paragraph id="H1857BF6DDCE84D7BBFA17831AE368644"><enum>(6)</enum><text display-inline="yes-display-inline">In response to the decision in Arizona State Bd. v. U.S. Dept. of Educ., the appellant for-profit charter schools reorganized as for-profit operators of nonprofit organizations, enabling the appellants to continue to receive Federal funds under the ESEA and the IDEA.</text></paragraph> <paragraph id="H0217F9E92AA146758FAB40B5E05836FB"><enum>(7)</enum><text display-inline="yes-display-inline">Every student in a publicly funded school in the United States, including charter school students, is entitled to access education services without having publicly funded resources depleted due to profit extraction.</text></paragraph>
<paragraph id="HEE550A6EA11D47069A187E8DDB7A1B3F"><enum>(8)</enum><text display-inline="yes-display-inline">Every taxpayer in the United States should be confident that public funds are responsibly stewarded and not funding the enrichment of for-profit charter operators at the expense of students and taxpayers.</text></paragraph></subsection></section> <section id="HC143FCE7AA77465CB40CD42F736A1312"><enum>3.</enum><header>ESEA definition of charter school</header> <subsection id="H08FA043E39254AA2B2C9D2BD15594B33"><enum>(a)</enum><header>Prohibition of contracting with for-Profit entity for essential services</header><text display-inline="yes-display-inline">Section 4310(2) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221i">20 U.S.C. 7221i(2)</external-xref>) is amended—</text>
<paragraph id="H0403300D36104911B121234EAFEBFC1A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (L), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H527E942BE15449CC9823FCBC4490275C"><enum>(2)</enum><text>in subparagraph (M)—</text>
<subparagraph id="HF6DC28812B3349FE93D19965ED770013" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">by moving the margins of such paragraph 2 ems to the left; and</text></subparagraph> <subparagraph id="HF064C55D6E824F988FC7D44D5976AD07"><enum>(B)</enum><text>by striking the period and inserting a semicolon; and</text></subparagraph></paragraph>
<paragraph id="H6C3AEF58BD0144F385A16792E1618614"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HF3D6B8822B5346F1A94B33400AA742CB" display-inline="no-display-inline"> <subparagraph id="H01F4F2BDA8FA4E829C7915EAC4D52670"><enum>(N)</enum><text>does not enter into a contract with a for-profit entity, or have a charter management organization or other nonprofit entity enter into such a contract on behalf of such school, under which the for-profit entity operates, oversees, manages, or otherwise carries out the administration of such school, which may include curriculum development, budget management, and faculty management (such as hiring, terminating, or supervising school-level staff); and </text></subparagraph>
<subparagraph id="HB1F45EEB2E654E098EB4C07E91A6B217" commented="no"><enum>(O)</enum><text>may enter into a contract with a for-profit or nonprofit entity for the provision of—</text> <clause id="HDE5B153CC2FB4E838C0D3CA92CC414E0"><enum>(i)</enum><text>food, payroll, facilities maintenance, or transportation services;</text></clause>
<clause id="H06A9E71F8B3C4FB192008B847449666C"><enum>(ii)</enum><text>classroom supplies (such as textbooks); or</text></clause> <clause id="H8C90A143C74C419CA276971B54E1FEA6"><enum>(iii)</enum><text>ancillary services or supplies.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H44AAD423D98A4EC79EA4C60522B97206"><enum>(b)</enum><header>General definitions</header><text display-inline="yes-display-inline">Section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H88C742A129C945369117C34E07DEE7D3" display-inline="no-display-inline"> <paragraph id="HAC301C40326D4000A8C9161547B6C111"><enum>(53)</enum><header>Charter school</header><text display-inline="yes-display-inline">The term <term>charter school</term> has the meaning given the term in section 4310.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H75E03714C63346118EABA2F6589EA12A"><enum>4.</enum><header>IDEA definition of charter school</header><text display-inline="no-display-inline">Section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H9A7F388278F540569250AF474C5F8F21" display-inline="no-display-inline"> <paragraph id="HB922DBB3C88A4083AA597CF70B71CF1F"><enum>(37)</enum><header>Charter school</header><text display-inline="yes-display-inline">The term <term>charter school</term> has the meaning given the term in section 4310 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221i">20 U.S.C. 7221i</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H517A656DCBB545738D37CBD80DF1A2EA"><enum>5.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act—</text> <paragraph id="HCB8FFB7C547E4F9187B7717E229A3C79"><enum>(1)</enum><text>shall take effect on the date that is 3 years after the date of the enactment of this Act; and</text></paragraph>
<paragraph id="HC366BF9A49874C5BBEF65FB4DA012A44"><enum>(2)</enum><text>shall only apply with respect to any contract entered into, renewed, or extended on or after the date of the enactment of this Act.</text></paragraph></section> </legis-body></bill>
