<section id="H2174D5DE643947978175C57755FC9C0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fireworks for Freedom Act</short-title></quote>.</text></section> <section id="H3496B3B3AB5E4214AAB6C69B0757EBA3"><enum>2.</enum><header>Findings and purpose</header> <subsection id="H28190F46A8BC44208BF9A04BD79C7840"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H9A2C584254B3459E82B1F3684CF23301"><enum>(1)</enum><text>The year 2026 marks the 250th anniversary of the founding of the United States, commemorated as <quote>America250</quote>.</text></paragraph> <paragraph id="H466D918D3F7A4A648EE86BDB5010C766"><enum>(2)</enum><text>Public fireworks displays have served as a quintessential American tradition of patriotic celebration since the first anniversary of independence in 1777.</text></paragraph> 
<paragraph id="HAB0180041D8F48BBAA72E24806DF603C"><enum>(3)</enum><text>The semiquincentennial represents a singular national milestone, and the entirety of calendar year 2026 constitutes a year-long national commemoration meriting unprecedented public celebration across all 50 States, the District of Columbia, and the territories.</text></paragraph> <paragraph id="H2922A7AD5D9A4ABABE65D0F564A128EE"><enum>(4)</enum><text>A streamlined Federal and State regulatory framework will facilitate communities of all sizes in honoring this historic occasion, while local governments remain best positioned to address site-specific safety, fire risk, and community concerns.</text></paragraph></subsection> 
<subsection id="H940A140BFC4E4B039DB943407E30F7EF"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to enable maximum public participation in fireworks displays during the 250th anniversary year of the United States by temporarily suspending Federal and State regulatory restrictions thereon, while preserving the authority of units of local government, and while preserving Federal and State authority over the manufacture, sale, purchase, and transportation of fireworks and over safety standards applicable to covered fireworks displays.</text></subsection></section> <section id="H5D8901436B3A485DB22EE7370DF316AF"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H658101A30C01472E8BF040BC2036CC8E"><enum>(1)</enum><header>Covered fireworks display</header><text>The term <quote>covered fireworks display</quote> means any public or private display of fireworks, including consumer, commercial, or display-grade pyrotechnics, conducted within the United States during the covered period.</text></paragraph> <paragraph id="HB32914194A0B494498C244B02B21FBB4"><enum>(2)</enum><header>Covered period</header><text>The term <quote>covered period</quote> means the period beginning on the date of enactment of this Act and ending on December 31, 2026.</text></paragraph> 
<paragraph id="H8FBE84009F5042B8A12596A52CBE8DD0"><enum>(3)</enum><header>Unit of local government</header><text>The term <quote>unit of local government</quote> means any county, municipality, town, township, village, parish, borough, special district, federally recognized Indian Tribe, or other general-purpose political subdivision of a State, including any fire protection district or fire marshal exercising authority delegated by such subdivision.</text></paragraph></section> <section id="HF008B818509742D39C8C5B8F3A9B99C5"><enum>4.</enum><header>Waiver of Federal and State law</header> <subsection id="HDE8B84EA41D04B9D984DE902EC0893E9"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, during the covered period, no provision of Federal or State law, regulation, or rule shall apply to, restrict, prohibit, or impose penalties upon any covered fireworks display or the persons conducting such display, except that each waiver applies only to the act of conducting the display and to the possession and use of fireworks solely at the display site during the display event itself.</text></subsection> 
<subsection id="HE88F21398E834FD7A584A37FD80EEED2"><enum>(b)</enum><header>Scope of waiver</header><text>The waiver under subsection (a) shall include Federal and State laws and regulations concerning—</text> <paragraph id="H1C869DA918424AA4B9A05FC030C297E9"><enum>(1)</enum><text display-inline="yes-display-inline">State and local event permitting and display-operation licensing requirements only, while preserving Federal Bureau of Alcohol, Tobacco, and Firearms licensing and certification of pyrotechnic operators, manufacturers, dealers, and importers under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/40">chapter 40</external-xref> of title 18, United States Code;</text></paragraph> 
<paragraph id="H566D01BEB49C4FAEA54E1D65D3E8D749"><enum>(2)</enum><text display-inline="yes-display-inline">State-level venue storage and setback requirements only, while preserving Federal classification, labeling, and storage standards under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/40">chapter 40</external-xref> of title 18, United States Code;</text></paragraph> <paragraph id="H801BD7BA1DA047B5A883ED04AFF36900"><enum>(3)</enum><text display-inline="yes-display-inline">State-level event notification requirements only, while preserving Federal Environmental Protection Agency Clean Air Act standards; and</text></paragraph> 
<paragraph id="H7AFC02775004437C8DFB6A85AF2D350D"><enum>(4)</enum><text>State-level fire codes, setback requirements, burn restrictions, and noise standards.</text></paragraph></subsection> <subsection id="HF7E7C7A9479048AABED35DC69C28ABDA"><enum>(c)</enum><header>Preemption of state law only</header><text>No State may enforce any State law, regulation, or rule inconsistent with this section during the covered period, except that this preemption does not apply to—</text>
<paragraph id="H04447C6B9D764F21B457EA89924A63AF"><enum>(1)</enum><text>State laws governing the manufacture, sale, or purchase of fireworks or explosive materials;</text></paragraph> <paragraph id="H9AF052E6534F4AD7B65CE2B430FDF7C6"><enum>(2)</enum><text>State occupational safety and health laws; or</text></paragraph>
<paragraph id="HD495056C90E242A7B3E94C9AF0840192"><enum>(3)</enum><text>State consumer product safety laws.</text></paragraph></subsection> <subsection id="H9A7C55EF5D82468FA8C75C1137AC1557"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to preempt, supersede, or limit any law, regulation, ordinance, rule, code, or order of a unit of local government.</text></subsection> 
<subsection id="HC3C2C14F3ABF493EBA3D55321F87DDE0"><enum>(e)</enum><header>Clarification</header><text display-inline="yes-display-inline">No formal designation, registration, sponsorship, or affiliation with America250 or any official commemorative entity shall be required for a fireworks display to qualify as a covered fireworks display, as Congress recognizes that all fireworks displays during calendar year 2026 occur within the context of the year-long national celebration of the 250th anniversary of American independence.</text></subsection></section> <section id="HC69C27723A444A60920393A3C3AA80EC"><enum>5.</enum><header>Preservation of Federal authority</header> <subsection id="H4F44B471A8574FD6BE9C9AAA0F8F5265"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 4, the following Federal laws and their implementing regulations remain in full force:</text>
<paragraph id="HFFFCFCEB0ECF4F8CBBA3E35504BFD877"><enum>(1)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/40">Chapter 40</external-xref> of title 18, United States Code (relating to explosive materials licensing, storage, classification, and recordkeeping).</text></paragraph> <paragraph id="H9A331DAE0B2245818BE1C6A2809944A9"><enum>(2)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">Chapter 51</external-xref> of title 49, United States Code (relating to hazardous materials transportation).</text></paragraph>
<paragraph id="HE4D8EF595B3B49D788F8CCF922133531"><enum>(3)</enum><text>The Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1261">15 U.S.C. 1261 et seq.</external-xref>) and all consumer and hazardous products safety standards thereunder.</text></paragraph> <paragraph id="HA055AA95065B4F49A6FBDEFA14FE07F1"><enum>(4)</enum><text>The Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>) and all Occupational Health and Safety Administration standards thereunder.</text></paragraph>
<paragraph id="H8280D69DAA1D4120BDDD1D12A7A23AA8"><enum>(5)</enum><text>The Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) and all Environmental Protection Agency regulations promulgated thereunder.</text></paragraph></subsection> <subsection id="HD37E6B4853D148BAAD69236381CF9316"><enum>(b)</enum><header>Manufacture and sale</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to waive, suspend, or limit any Federal or State law governing the manufacture, importation, wholesale distribution, retail sale, or purchase of fireworks or pyrotechnic materials.</text></subsection></section> 
<section id="H9CABE6777D74458E9F3BA58AAB0B2330"><enum>6.</enum><header>Preservation of local authority</header> 
<subsection id="H02A8440D9F3D46CB86F792F2D9A84D19"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 4, units of local government shall retain full authority to regulate, restrict, condition, permit, or prohibit covered fireworks displays within their respective jurisdictions, including authority over—</text> <paragraph id="H9EC89CE8B5304D92BCF9A7080596D5DC"><enum>(1)</enum><text>permitting, licensing, and inspection of displays and operators;</text></paragraph> 
<paragraph id="HBD10E82076824E90BAE35F03855F81B5"><enum>(2)</enum><text>local fire codes, burn bans, and red-flag restrictions;</text></paragraph> <paragraph id="H21BC6F596F9B47CA8E393F54B82D991E"><enum>(3)</enum><text>setback, separation, and fallout-zone requirements;</text></paragraph> 
<paragraph id="HBA485833FF634F9E8E12238C2CB4DA85"><enum>(4)</enum><text>hours of operation and noise ordinances;</text></paragraph> <paragraph id="H90894252546145AAADF05AE89E358FAB"><enum>(5)</enum><text>zoning, land use, and crowd-management requirements;</text></paragraph> 
<paragraph id="H57053990F0E6499C8C41316989EB944F"><enum>(6)</enum><text>insurance, bonding, and liability requirements;</text></paragraph> <paragraph id="H364F8AB882EF496CB85AE9BD03AD3D5F"><enum>(7)</enum><text>emergency response, evacuation, and public notification requirements; and</text></paragraph> 
<paragraph id="HF86D1BA2B65B4E7EA6B86DA97E527423"><enum>(8)</enum><text>restrictions tailored to drought conditions, wildland-urban interface areas, sensitive ecological zones, hospitals, schools, places of worship, livestock operations, or other site-specific concerns.</text></paragraph></subsection> <subsection id="HAD82C4687E2B4617B3212155E4DE6E9D"><enum>(b)</enum><header>Default to local law</header><text>Where a unit of local government has not expressly authorized a covered fireworks display, otherwise applicable local law shall continue to govern.</text></subsection> 
<subsection id="H960571D41C524E5A802CF6E821F373D9"><enum>(c)</enum><header>State enabling authority unaffected</header><text>Nothing in this Act shall be construed to diminish the authority of a unit of local government that derives from a State constitution, charter, or statute, to the extent such authority is exercised by the unit of local government itself rather than by the State.</text></subsection> <subsection id="HE0788FB5C0E84249BCFE71FC2DC438A3"><enum>(d)</enum><header>Tribal sovereignty</header><text>Nothing in this Act shall be construed to limit the inherent sovereign authority of any federally recognized Indian Tribe to regulate fireworks within its jurisdiction.</text></subsection></section> 
<section id="H565534BF40E84F5B9BFA4A305C3A25B5"><enum>7.</enum><header>Sunset</header><text display-inline="no-display-inline">This Act, and the waiver provided under section 4, shall expire at 11:59 p.m. Eastern Standard Time on December 31, 2026.</text></section> </legis-body></bill>
