<section id="HF2B66FA1940C477690501EFCE2B22133" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Honest Speech Act of 2026</short-title></quote>.</text></section> <section id="H19F593F5D5ED42EFA2466F86CE52DFA2"> <enum>2.</enum> <header>No Federal funds for compelled language</header> <subsection id="H96B3B85583074BCD888D1FCA66D7F5A3"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">Notwithstanding any other provision of law, no funds may be used for the purpose of implementing, administering, or enforcing any rule, policy, guidance, recommendation, or memoranda requiring an employee or contractor of any Federal agency or Department to use—</text>
        <paragraph id="H16D55BA261F04DBAB0139BD60EB5830F">
          <enum>(1)</enum>
 <text display-inline="yes-display-inline">another person’s preferred pronouns if they are incompatible with such a person’s sex; or</text>
        </paragraph>
        <paragraph id="H605D1519B1EE4F5B9CAEF50C4D1AE258">
          <enum>(2)</enum>
 <text>a name other than a person’s legal name when referring to such a person.</text> </paragraph> </subsection> <subsection id="HF2E877ADF399472B8900FA61E8D83862"> <enum>(b)</enum> <header>Enforcement</header> <paragraph id="H7651647854404501AB0D69B6D9676F7B"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">All Federal agencies and Departments shall ensure that, not later than 30 days following a written notice from any employee or contractor regarding an alleged violation of subsection (a), a formal response to the notice is issued to the employee or contractor.</text>
        </paragraph>
        <paragraph id="HE3313AE0CFBA4C2EAF0A280982421E04">
          <enum>(2)</enum>
          <header>Private right of action</header>
 <text>In the case that the formal response in subsection (a) does not represent a satisfactory outcome for a Federal employee or contractor, any employee or contractor aggrieved by a violation of subsection (a) may commence a civil action against the Federal agency or Department responsible for the alleged violation.</text>
        </paragraph>
        <paragraph id="H60457C5F4DE643B8AB13C138F9E5A279">
          <enum>(3)</enum>
          <header>Relief</header>
 <text>In any action under this subsection, the court may award appropriate relief, including—</text>
          <subparagraph id="H134525036F094E33BF1E5B35B8E0D979">
            <enum>(A)</enum>
 <text>temporary, preliminary, or permanent injunctive relief;</text> </subparagraph> <subparagraph id="H8BF2F6C091E743CBA19543C7BEFBD25A"> <enum>(B)</enum> <text>compensatory damages;</text>
          </subparagraph>
          <subparagraph id="H0D5F98047CC5461A872933F84B89C914">
            <enum>(C)</enum>
 <text>punitive or exemplary damages, which may not exceed $100,000; and</text> </subparagraph> <subparagraph id="H85DB054D90884CBEBE33618D812BCF16"> <enum>(D)</enum> <text>reasonable fees for attorneys.</text>
          </subparagraph>
        </paragraph>
        <paragraph id="H078F00F5A01440FD96DB5596025CC552">
          <enum>(4)</enum>
          <header>Statute of limitations</header>
 <text>An action under this subsection shall be brought not later than one year after the date on which the alleged violation of subsection (a) occurred.</text>
        </paragraph>
      </subsection>
      <subsection id="H77C8F4D15786475095D2C31677FA4654">
        <enum>(c)</enum>
        <header>Definitions</header>
 <text>In this section:</text> <paragraph id="H8FD601DC47CF4E37846D18191905F925"> <enum>(1)</enum> <header>Female</header> <text display-inline="yes-display-inline">The term <term>female</term> refers to an individual who has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text>
        </paragraph>
        <paragraph id="H5EC462AEC8AC404C80F87FE8A3AB7223">
          <enum>(2)</enum>
          <header>Male</header>
 <text display-inline="yes-display-inline">The term <term>male</term> refers to an individual who has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization.</text>
        </paragraph>

          <enum>(3)</enum>
          <header>Sex</header>
 <text display-inline="yes-display-inline">The term <term>sex</term> refers to biological sex, either male or female.</text>
        </paragraph>

          <enum>(4)</enum>
          <header>Person</header>
 <text display-inline="yes-display-inline">The term <term>person</term> refers to a natural person.</text>
        </paragraph>
