R. 8581</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260429">April 29, 2026</action-date><action-desc><sponsor name-id="M001245">Mr. Menefee</sponsor> (for himself, <cosponsor name-id="R000606">Mr. Raskin</cosponsor>, <cosponsor name-id="C001067">Ms. Clarke of New York</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="B001281">Mrs. Beatty</cosponsor>, and <cosponsor name-id="J000288">Mr. Johnson of Georgia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require States to hold special elections to fill vacancies in the House of Representatives not later than 180 days after a vacancy occurs in the House of Representatives, and for other purposes.</official-title></form><legis-body id="H7716A2F2200B4324AE3262ED953DB278" style="OLC"><section id="H2470D8B9D5DC4A9AB6851ABAF9A42C75" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Special Election Timeliness Act</short-title></quote> or the <quote><short-title>SET Act</short-title></quote>. </text></section><section id="H3CB5E024B90E44C298F98E9141717E42"><enum>2.</enum><header>Requiring special elections to be held to fill vacancies in House</header><subsection id="H56815CF040434F0D89E9A0516030D855"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 26(a) of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/2/8">2 U.S.C. 8(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HDBBBC4D81F544F33B69589E7C315B4A0" display-inline="no-display-inline"><subsection id="HF063A368116A401C842A9E75B5BF9073"><enum>(a)</enum><header>In general</header><paragraph id="H915910609EB24436AC8D4EA680181F0B"><enum>(1)</enum><header>Special election to fill vacancy</header><text display-inline="yes-display-inline">Except as provided in subsection (b) and subject to the requirements under paragraph (2), the time for holding elections in any State, District, or Territory for a Representative or Delegate to fill a vacancy, whether such vacancy is caused by a failure to elect at the time prescribed by law, or by the death, resignation, or incapacity of a person elected, may be prescribed by the laws of the several States and Territories respectively.</text></paragraph><paragraph id="H4F520C1B684B4A6A99D723ED093E9CDE"><enum>(2)</enum><header>Deadline for special election</header><text display-inline="yes-display-inline">A special election to fill a vacancy under paragraph (1) shall occur not later than 180 days after the date the vacancy occurs, unless a regularly scheduled general election for the office involved is to be held at any time during the 180-day period which begins on the date the vacancy occurs.</text></paragraph><paragraph id="H50535108CB3E41A8B7F3C0DE54F05A0F"><enum>(3)</enum><header>Civil enforcement</header><subparagraph id="H57D58E6DC8F34641BB9CCD53ABCB8359"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may bring a civil action against the chief executive of the State concerned in an appropriate district court for such declaratory or injunctive relief as is necessary to carry out this subsection.</text></subparagraph><subparagraph id="H5F1A81109BC34F91A60D1DE2DD3ED589"><enum>(B)</enum><header>Private right of action</header><text display-inline="yes-display-inline">A person who is aggrieved by a violation of this subsection, including the Speaker of the House of Representatives or the Minority Leader of the House, may bring a civil action against the chief executive of the State concerned in an appropriate district court for such declaratory or injunctive relief as may be necessary to carry out this subsection.</text></subparagraph></paragraph><paragraph id="HF9C90CBB648E4688A7467A3BDE5767A8"><enum>(4)</enum><header>Special election defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>special election</term> means an election for purposes of electing a candidate to fill a vacancy described in paragraph (1) and does not include an election for purposes of nominating candidates to fill such a vacancy. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
