<section id="H10E025572A594A1C98B27C9214DC0437" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forestry Protection Act of 2026</short-title></quote>.</text></section> <section id="H154DBDC300834BF99110E8E3B63E9E01"><enum>2.</enum><header>Tariff reduction for goods containing 100 percent United States raw wood material</header> <subsection id="H151A82D2361D412C9D6E0C93E77C883B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each duty and covered import restriction imposed or modified on a finished forestry product pursuant to a covered trade law shall be reduced by 50 percent if the importer of such product demonstrates to the satisfaction of the Commissioner of U.S. Customs and Border Protection that such product contains 100 percent raw wood material originating in the United States.</text> </subsection> 
<subsection id="H172C187575D7480D893D1C8F4DB7237C"><enum>(b)</enum><header>Directed rulemaking</header><text>Not later than 90 days after the date of enactment of this Act, the Commissioner of U.S. Customs and Border Protection, in consultation with the United States Trade Representative, shall issue such regulations as necessary to implement this section, including procedures for verification and fraud prevention.</text></subsection> <subsection id="H7633B922755B42968ABD6F2FB8431874"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H02A4C5EC64DA4392AF4253E908DC4A45"><enum>(1)</enum><header>Covered import restriction</header><text>The term <term>covered import restriction</term> means a fee, other than a duty or other tariff, paid by an importer.</text> </paragraph> <paragraph id="H7454721DA29241F4B6FD2B0E3C7C3C53"><enum>(2)</enum><header>Covered trade law</header><text display-inline="yes-display-inline">The term <term>covered trade law</term> means—</text> 
<subparagraph id="H1A5A60DC6D1540C8A3BB6F6CB6883D39"><enum>(A)</enum><text>section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>);</text></subparagraph> <subparagraph id="H289EEB2AD6764026A9D0C7ED51D7FE81"><enum>(B)</enum><text>section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>);</text></subparagraph> 
<subparagraph id="HC4B878E671D746A1924136611880D69E"><enum>(C)</enum><text>section 122 or 301(b) of the Trade Act of 1974 (19 U.S.C. 2132 or 2411(b)); or</text></subparagraph> <subparagraph id="HFAA4D3A23CE646358B6C69A622D7394A" commented="no"><enum>(D)</enum><text>section 203 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HC1977F2226B44B229DE2CB8A83BB8EE0"><enum>(3)</enum><header>Finished forestry product</header><text>The term <term>finished forestry product</term> means any article classified under subheadings 4408 through 4421 of the Harmonized Tariff Schedule of the United States that has been manufactured, processed, or assembled outside the United States from raw wood material.</text> </paragraph> <paragraph id="HBE20354CEFB34485973A55D41A9D5155"><enum>(4)</enum><header>Raw wood material</header><text>The term <term>raw wood material</term> means any product classified under subheadings 4401 through 4407 of the Harmonized Tariff Schedule that has not undergone processing beyond sawing, chipping, or drying.</text></paragraph></subsection> </section> 
<section id="H7C2E92A2F5114D0588B39919CDC20338"><enum>3.</enum><header>Notification requirement for imposition or modification of duty or other import restriction pursuant to covered trade law</header> <text display-inline="no-display-inline">The Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19 U.S.C. 1304 et seq.</external-xref>) is amended by adding after section 323 the following:</text> <quoted-block id="HB681ADCA56F24D37A82BA9048D109639" style="OLC"> <section id="HA04867B416374CE795F98816FA59ED58"><enum>324.</enum><header>Notification requirement for imposition or modification of duty pursuant to covered trade law</header> <subsection id="H568A2D6F29654F7CACCCBAF11EFBA940"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a finished forestry product, the President may not impose or modify a duty or other import restriction pursuant to a covered trade law unless such imposition or modification is published in the Federal Register, as described under subsection (b), not less than 90 days before the effective date of such imposition or modification.</text> </subsection> 
<subsection id="H2259E731F8294526945873CD1F5D059A"><enum>(b)</enum><header>Contents of notice</header><text>The notice required under subsection (a) shall include—</text> <paragraph id="H8CF9F7B606DB4F2E8B68FF5B659DC6E1"><enum>(1)</enum><text>the rate or amount of the duty or other import restriction being imposed or modified;</text></paragraph> 
<paragraph id="H2C11B52D29434FF089A53673E877D749"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the covered trade law pursuant to which the duty or other import restriction is being imposed or modified;</text></paragraph> <paragraph id="H98660AED67B146F8BE48CF814852DC69"><enum>(3)</enum><text>each finished forestry product affected and its corresponding code under the Harmonized Tariff Schedule of the United States;</text></paragraph> 
<paragraph id="HBA508D3957F8499ABCE43F09094ED9E5"><enum>(4)</enum><text display-inline="yes-display-inline">the justification for the duty or other import restriction being imposed or modified; and</text></paragraph> <paragraph id="H77B4A344545946D68D083BCB24574DAD"><enum>(5)</enum><text display-inline="yes-display-inline">the proposed effective date of the duty or other import restriction being imposed or modified.</text></paragraph></subsection> 
<subsection id="H0C3636ABB91A43B8BBE88B3A45D3654D"><enum>(c)</enum><header>Public comment</header><text display-inline="yes-display-inline">The notice required under subsection (a) shall provide a period of not less than 60 days during which interested parties may submit written comments to the President.</text></subsection> <subsection id="HCB6B0B73CEFD42EBAEDF60DDE4E6EABC"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HEA3F320804A34743A6F3BC3AC4F0FF6D"><enum>(1)</enum><header>Covered import restriction</header><text display-inline="yes-display-inline">The term <term>covered import restriction</term> means a fee, other than a duty or other tariff, paid by an importer.</text> </paragraph> <paragraph id="HD2FA21CB5FB1470998E3C92850AB88D1"><enum>(2)</enum><header>Covered trade law</header><text>The term <term>covered trade law</term> means—</text> 
<subparagraph id="H1B35BF5DFF1247649FBA9536C6F0A07A"><enum>(A)</enum><text>section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>);</text></subparagraph> <subparagraph id="H53A951286C724F7AA60FF9651DF477F0"><enum>(B)</enum><text>section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>);</text></subparagraph> 
<subparagraph id="H00E6DE33668848D799156133BA543938"><enum>(C)</enum><text>section 122 or 301(b) of the Trade Act of 1974 (19 U.S.C. 2132 or 2411(b)); or</text></subparagraph> <subparagraph id="H710B212E36724BF89FC1F6D6FAAC1894"><enum>(D)</enum><text>section 203 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref>).</text></subparagraph> </paragraph> 
<paragraph id="H9FFE160EF0B74BB09C93306AFDE6BD72"><enum>(3)</enum><header>Finished forestry product</header><text display-inline="yes-display-inline">The term <term>finished forestry product</term> means any article, that has been manufactured, processed, or assembled outside the United States from raw wood material, classifiable under the following codes of the Harmonized Tariff Schedule of the United States:</text> <subparagraph id="HA1546210B4984D1091C91633CE753AEB" commented="no"><enum>(A)</enum><text>4401 (fuel wood, wood chips, sawdust, and wood pellets).</text></subparagraph> 
<subparagraph id="HF357BB6A0F5B41CE9ABA21B58DE13BF9" commented="no"><enum>(B)</enum><text>4402 (wood charcoal).</text></subparagraph> <subparagraph id="H72BECD5685FA47F19EA02B852D989FB0" commented="no"><enum>(C)</enum><text>4403 (wood in the rough).</text></subparagraph> 
<subparagraph id="HF479AF2112E247ED87139B79988A46EA" commented="no"><enum>(D)</enum><text>4404 (hoopwood, split poles, wooden stakes).</text></subparagraph> <subparagraph id="H5AB0FFEB861F44198D532CF340FE1447" commented="no"><enum>(E)</enum><text>4405 (wood wool and wood flour).</text></subparagraph> 
<subparagraph id="HD039FBD2E66947CEB25397B85B1CC57F" commented="no"><enum>(F)</enum><text>4406 (railway or tramway sleepers of wood).</text></subparagraph> <subparagraph id="H2E4BD1959D5945DC9F5CA8250FA60DF6" commented="no"><enum>(G)</enum><text>4407 (wood sawn or chipped lengthwise, including lumber).</text></subparagraph>

<subparagraph id="H45D207B44C8D456D8011B3714FEC4803" commented="no"><enum>(N)</enum><text>4414 (wooden frames for paintings, photographs, mirrors, or similar objects).</text></subparagraph> <subparagraph id="H3CFCF62DB6134206B26870C12BF8134F" commented="no"><enum>(O)</enum><text>4415 (packing cases, boxes, crates, drums, and similar packings of wood).</text></subparagraph> 
<subparagraph id="H9115A657C9CD48A59DD44FA9DDD88650" commented="no"><enum>(P)</enum><text>4416 (casks, barrels, vats, tubs, and other coopers’ products of wood).</text></subparagraph> <subparagraph id="HC0CE1A3E4CD74D93999EAF2F6134AE7F" commented="no"><enum>(Q)</enum><text>4417 (tools, tool bodies, tool handles, broom or brush bodies and handles of wood).</text></subparagraph>

<subparagraph id="H75F32ACCE7AC481F89CBDC65C6CB3821" commented="no"><enum>(T)</enum><text display-inline="yes-display-inline">4420 (wood marquetry and inlaid wood; caskets and cases for jewelry or cutlery; statuettes and other ornaments of wood).</text></subparagraph> <subparagraph id="H004FDD5D8BC24B95B0DCA313333FEE15" commented="no"><enum>(U)</enum><text>4421 (other articles of wood).</text></subparagraph>
