R. 856</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250131">January 31, 2025</action-date><action-desc><sponsor name-id="D000032">Mr. Donalds</sponsor> (for himself and <cosponsor name-id="C001078">Mr. Connolly</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Director of the Office of Management and Budget conduct a review to determine the impact of the lowest price technically acceptable source selection process on national security, and for other purposes.</official-title></form><legis-body id="H034E9C596BAB4BD9B4DB2A8064758F53" style="OLC"><section id="H95F8D759532D44A4BFC6A3B1D88C23E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe and Smart Federal Purchasing Act</short-title></quote>. </text></section><section id="H238B3730630E4B75884EE989A376F055"><enum>2.</enum><header>Review to determine the impact of the lowest price technically acceptable source selection process on national security</header><subsection id="H6096033DB430465BB6BFC1969E438CE1"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">The Director shall review the procurement management practices of Defense and Civilian agencies to determine whether the provisions of section 15.101–2 of the Federal Acquisition Regulation have created any national security risk.</text></subsection><subsection id="H6ADF71BA74E84E1682E44292DF0FAA2B"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the enactment of this Act, the Director shall submit a report on the results of the review under subsection (a) to—</text><paragraph id="HEA1CF047E32C40A28FFC581E576FE10B"><enum>(1)</enum><text>the Committee on Oversight and Government Reform of the House of Representatives; and</text></paragraph><paragraph id="H982D3A2303EA4291B8A77611E556513E"><enum>(2)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate.</text></paragraph></subsection><subsection id="H73993285AB0F4A34B0E2A2FA1A1DE3EE"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HF20A49B59B71448FA5BEAD09A4128FD6"><enum>(1)</enum><header>Defense and Civilian Agency</header><text>The term <term>Defense and Civilian agency</term> has the meaning given the term <term>agency</term> in section 133 of title 41, United States Code.</text></paragraph><paragraph id="H13E760DD0D4C423CBC1C6B79652C51D0"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph></subsection></section></legis-body></bill>
