<section id="HC815663B7B0A4E0FB1C7BD5A25EDDE6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Short-Term Holding Facility Standards Restoration Act.</short-title></quote></text></section> <section id="H9D4E060033844A75AEB5005714703F3B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H71C4AF22F55E46BDB3C33B8DCDBE8392"><enum>(1)</enum><text display-inline="yes-display-inline">U.S. Immigration and Customs Enforcement holding facilities are designed for short-term custody and processing.</text></paragraph> <paragraph id="H8236370B74C5485EAD8985F3C72ACABD"><enum>(2)</enum><text display-inline="yes-display-inline">Prior U.S. Immigration and Customs Enforcement policy defined <quote>short-term</quote> as not exceeding 12 hours, absent exceptional circumstances.</text></paragraph> 
<paragraph id="HDFE8E0B0D22E47148F8148FD8EE640B6"><enum>(3)</enum><text display-inline="yes-display-inline">Prolonged detention in holding facilities undermines detainee welfare, facility design limits, and operational intent.</text></paragraph> <paragraph id="H983F98E727D840909B0027745349E921"><enum>(4)</enum><text display-inline="yes-display-inline">Restoring the 12-hour standard ensures consistency with prior agency guidance.</text></paragraph></section> 
<section id="H8F4F9BBCC72F4D489242649E4D763F40"><enum>3.</enum><header>Limitation on duration of detention</header> 
<subsection id="HDE129AA48F014667A79600BF7DED3D5E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall ensure that, absent exceptional circumstances described in subsection (b), a U.S. Immigration and Customs Enforcement holding facility may only be used for short-term custody of a detainee.</text></subsection> <subsection id="HCBE4175949A449CEACE2F773AF3C2775"><enum>(b)</enum><header>Exceptional circumstances</header><text display-inline="yes-display-inline">Exceptional circumstances are temporary and unforeseen circumstances requiring immediate action, including—</text> 
<paragraph id="HD114C2A2353B4070AC171FCAA4B8DF8F"><enum>(1)</enum><text>medical emergencies;</text></paragraph> <paragraph id="H4D41E50384774FEDABA183ED1BBBFF23"><enum>(2)</enum><text>natural disasters or facility disruptions;</text></paragraph> 
<paragraph id="HE72791F33E644E09B5EE8A1748CF54BA"><enum>(3)</enum><text>transportation or transfer delays beyond the control of the Department of Homeland Security; or</text></paragraph> <paragraph id="H440F3C51306A420085D3366447989D60"><enum>(4)</enum><text>other exigent operational conditions as determined by the Secretary of Homeland Security.</text></paragraph></subsection></section> 
<section id="H00D29529A77B4EB884AFF0B57928ABE6"><enum>4.</enum><header>Humane conditions</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall ensure that—</text> <paragraph id="H0FE0907682C2466BAA566B85C214C748"><enum>(1)</enum><text display-inline="yes-display-inline">each U.S. Immigration and Customs Enforcement holding facility is safe, clean, equipped with restroom facilities, and clear of any object that could be used as a weapon; and</text></paragraph> 
<paragraph id="H98656AADED124863BE469A35335FD400"><enum>(2)</enum><text>each detainee in such facility—</text> <subparagraph id="H6BAFDBF296E64736B46CF1A0047C2DE4"><enum>(A)</enum><text>is provided a meal not less than every 6 hours;</text></subparagraph> 
<subparagraph id="HB4E4A4E0319D410FB201798AA846E1F8"><enum>(B)</enum><text>in the case of a minor, pregnant woman, or breastfeeding woman, is provided immediate access to meals, snacks, milk, and juice, without regard to the amount of time in custody; and</text></subparagraph> <subparagraph id="H23BBBAB8F72F478CB8539FD77715A05C"><enum>(C)</enum><text>is provided with access to drinking water in each room in which a detainee is held at all times.</text></subparagraph></paragraph></section> 
<section id="H0955D24F6E6B4A8A8921675A5AABAAE7"><enum>5.</enum><header>Documentation and compliance</header> 
<subsection id="H8A4FF52F99CE4CD48EC02F70BA8C33E7"><enum>(a)</enum><header>Documentation</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall require contemporaneous documentation of any instance in which a detainee is held in a U.S. Immigration and Customs Enforcement holding facility for custody other than short-term custody.</text> </subsection> <subsection id="H3AA14209291644F689C2CB6041F2F3D3"><enum>(b)</enum><header>Retention</header><text display-inline="yes-display-inline">Records under this section shall be maintained for oversight, audit, and reporting purposes for a period of 5 years.</text></subsection></section> 
<section id="HB038D4FFDC5F4A16B59805BA3E7B4185"><enum>6.</enum><header>Oversight and reporting</header> 
<subsection id="HF5C35A46565C4B29BABF289983E25135"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall submit to Congress an annual report detailing—</text> <paragraph id="H14B0EB86C034420C9C199B69C8935037"><enum>(1)</enum><text>the number of detainees held in custody other than short-term custody in a U.S. Immigration and Customs Enforcement holding facility;</text></paragraph> 
<paragraph id="H3855EC8B857A464EBDCD3AC96183110D"><enum>(2)</enum><text>the duration of such custody;</text></paragraph> <paragraph id="H2E62C4D34875469A9450902DCF7F15CD"><enum>(3)</enum><text>the justification for each instance in which a detainee is held in a U.S. Immigration and Customs Enforcement holding facility for custody other than short-term custody; and</text></paragraph> 
<paragraph id="H984B64A517A94709B8C8D12730218ECB"><enum>(4)</enum><text>corrective actions taken to ensure compliance.</text></paragraph></subsection> <subsection id="H9C901262CC564EB4B90FCAD50E1DB0AD"><enum>(b)</enum><header>Inspector General review</header><text display-inline="yes-display-inline">The Inspector General of the Department of Homeland Security shall perform periodic audits of U.S. Immigration and Customs Enforcement holding facilities and Department of Homeland Security records to ensure compliance with this Act.</text></subsection></section> 
<section id="H9BF7F0E4A9634FF0A5B156CD5D03977F"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act—</text> <paragraph id="HD5649594D0E545DDA1180366BF1CF11D"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>holding facility</quote> means any facility or holding room for temporary custody, processing, or transfer, and not designed for long-term detention; and</text></paragraph> 
<paragraph id="HE3149ECA66264F15BDDAC240B48FF687"><enum>(2)</enum><text>the term <quote>short-term custody</quote> means detention in a holding facility for a period not to exceed 12 hours, absent exceptional circumstances.</text></paragraph></section> </legis-body></bill>
