<section id="H895609AC1CBA40EA9E34C2C12FA530D2" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Health Resilience Act of 2026</short-title></quote>.</text></section> 
<section id="H975DDA13AED243E38A0A8320552D99F9" section-type="subsequent-section"><enum>2.</enum><header>Rural health care facility stabilization assistance program</header><text display-inline="no-display-inline">Subtitle D of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1981">7 U.S.C. 1981–2008w</external-xref>) is amended by inserting after section 374 the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HF095D2DF64B64AC6B99ACD488ED30711"> <section id="H467D546F1B194C379E97FCE4FA31F802"><enum>375.</enum><header>Rural health care facility stabilization assistance program</header> <subsection id="H1019EFE62F5544F59570466E9873FD28"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide loans and loan guarantees to help prevent rural health centers from closing or reducing essential services.</text></subsection> 
<subsection id="HE19ECE8F6BBD4AB5814429550E883CEF"><enum>(b)</enum><header>Eligible borrowers</header> 
<paragraph id="HAA8E3D39BE62458D99ED5D37673F6A79"><enum>(1)</enum><header>In general</header><text>A health center shall be eligible for a loan or loan guarantee under this section if—</text> <subparagraph id="H16E20E65B13C47B9A1D232AB1ACB7BA5"><enum>(A)</enum> <clause id="HCF2BAAC6CA7C41ED80E57F3DCF3D6B79" display-inline="yes-display-inline"><enum>(i)</enum><text>the health center—</text> 
<subclause id="HC2CD80286013460C9C58ED2622F1E9AD" indent="up1" display-inline="no-display-inline"><enum>(I)</enum><text>is located in a rural area; or</text></subclause> <subclause id="HCF618F1ABA334BFCAD8ADE6D0CBC9BF0" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">serves a rural community with a hospital at least 60 percent of the patients of which have their primary residence in a rural area; or</text></subclause></clause> 
<clause id="HADBFEDCA4DF04F4988D3AE7175F8B72F" indent="up1"><enum>(ii)</enum><text>at least 30 percent of the patients of the health center reside in a rural area; and</text></clause> </subparagraph> <subparagraph id="H55806047CB554088AF582EF6B2B6A6F2"><enum>(B)</enum><text>the health center demonstrates financial distress through objective indicators such as operating margin of less than 5 percent, low cash reserves, risk of service loss, or such other indicators as may be determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HE72CCF16076C4EE3953885DBC90BFF0D"><enum>(2)</enum><header>Definitions</header><text>In this section:</text> <subparagraph id="HFF5CFFD8BEB846449193E33EAF178A54"><enum>(A)</enum><header>Health center</header><text display-inline="yes-display-inline">The term <term>health center</term> means the following:</text> 
<clause id="H16B97194A2CB4583B1C9557EFD74BC48"><enum>(i)</enum><text>A subsection (d) hospital (as defined in paragraph (1)(B) of section 1886(d) of the Social Security Act).</text></clause> <clause id="HF155840E762445B7BB1B02190CA7408F"><enum>(ii)</enum><text display-inline="yes-display-inline">A critical access hospital (as defined in section 1861(mm)(1) of the Social Security Act).</text></clause> 
<clause id="H8F679150F5434CC29297579E4A9AAE39"><enum>(iii)</enum><text display-inline="yes-display-inline">A sole community hospital (as defined in section 1886(d)(5)(D)(iii) of the Social Security Act).</text></clause> <clause id="H4965B6E582D346B592E6AE179501D571"><enum>(iv)</enum><text display-inline="yes-display-inline">A Medicare-dependent, small rural hospital (as defined in section 1886(d)(5)(G)(iv) of the Social Security Act).</text></clause> 
<clause id="H252042890680413EBF4E35985B16DE90"><enum>(v)</enum><text display-inline="yes-display-inline">A low-volume hospital (as defined in section 1886(d)(12)(C) of the Social Security Act).</text></clause> <clause id="H7FBF0A232C3640F384876161F237D685"><enum>(vi)</enum><text display-inline="yes-display-inline">A rural emergency hospital (as defined in section 1861(kkk)(2) of the Social Security Act).</text></clause> 
<clause id="H36E58B05920B42B5AC7C0C7C471107A4"><enum>(vii)</enum><text display-inline="yes-display-inline">A rural health clinic (as defined in section 1861(aa)(2) of the Social Security Act).</text></clause> <clause id="H8580C7B7F8CC4C0FA7C2B66E4490DC1C"><enum>(viii)</enum><text display-inline="yes-display-inline">A Federally qualified health center (as defined in section 1861(aa)(4)) of the Social Security Act.</text></clause> 
<clause id="H44FA7FD9498743AD9E9611D80CA936AA"><enum>(ix)</enum><text display-inline="yes-display-inline">A community mental health center (as defined in section 1861(ff)(3)(B) of the Social Security Act).</text></clause> <clause id="H5C7D58EED3FB4C20937F19B4A79B3BE2"><enum>(x)</enum><text>A health center that is receiving a grant under section 330 of the Public Health Service Act.</text></clause> 
<clause id="HF8582C37EEB9454284C71159D7766962"><enum>(xi)</enum><text>An opioid treatment program (as defined in section 1861(jjj)(2) of the Social Security Act).</text></clause> <clause id="HDDE0015F2B7C48A1BF6201D40768CC48"><enum>(xii)</enum><text>A certified community behavioral health clinic (as defined in section 1905(jj)(2) of the Social Security Act).</text></clause></subparagraph> 
<subparagraph id="H9C7680AC572343C887F92804782094B8"><enum>(B)</enum><header>Rural area</header><text>The term <term>rural area</term> has the meaning given the term in subparagraph (A) of section 343(a)(13), including an area described in clause (ii) of such subparagraph that the Secretary determines under subparagraph (D) of such section is a rural area.</text></subparagraph></paragraph> <paragraph id="H94DA9857050E429D83CE23F5F88A991D"><enum>(3)</enum><header>Priority</header> <subparagraph id="HBF20E6A8EB9F4123A73C374A3B417659"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary may prioritize the provision of assistance to health centers that are—</text> 
<clause id="HC952101EE3544BBBA889982513497FA1"><enum>(i)</enum><text>sole community providers, as determined by the Secretary;</text></clause> <clause id="H70BEBB35B2314C76B644E1D3FA1ED795"><enum>(ii)</enum><text>providers in a high poverty area or an area designated by the Secretary as having a shortage of personal health services; and</text></clause> 
<clause id="H70B7610FD9E949BF845CE49906500A88"><enum>(iii)</enum><text>hospitals delivering critical emergency and safety-net services, as determined by the Secretary.</text></clause></subparagraph> <subparagraph id="HE1636C890C43435B953D84B826D96E08"><enum>(B)</enum><header>High poverty area defined</header><text display-inline="yes-display-inline">In subparagraph (A), the term <term>high poverty area</term> means an area with an areawide poverty rate of 20 percent or more, based on the Official Poverty Measure of the Bureau of the Census.</text></subparagraph></paragraph></subsection> 
<subsection id="HBA2A237EBD7B4C978F317D72CAA0FB2C"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this subtitle, a health center to which a loan or loan guarantee is provided under this section may use the loan or loan guarantee to prevent the closure of, or the reduction of the provision of essential services by the health center, and to restore the provision of essential services by the health center, by using the loan proceeds in ways such as—</text> <paragraph id="H634C7E84B09D41B29063D94F5F47D756"><enum>(1)</enum><text>for projects to acquire, repair, or upgrade the systems, facilities, and equipment of the health center;</text></paragraph> 
<paragraph id="H2AE1D47F2BBC4666866803F15915C5C1"><enum>(2)</enum><text>to cover the operational costs of the health center, including supplies and payroll expenses (except bonuses);</text></paragraph> <paragraph id="H00C82BCB0509496288FC81CF8E5FF062"><enum>(3)</enum><text>for debt payments, working capital, maintaining essential service lines, bridging reimbursement timing gaps, or refinancing high-interest debt incurred for patient care operations; or</text></paragraph> 
<paragraph id="HF34EC6E9535645BBBA6AF7E2D3F07E1E"><enum>(4)</enum><text>any other activity as the Secretary may allow.</text></paragraph></subsection> <subsection id="H0352C79F6D714FDB9AD252B352EE2DBC"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Within 18 months after the date of the enactment of this section, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on the activities and outcomes of the program carried out under this section, including the effect of the program on stabilizing the finances of the rural health care facilities assisted by the program, and shall make available to the public a summary of the report which does not include any personal information or any financial information about a health center.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
