<section section-type="section-one" id="HEA969215058741F49AF1E2457BB84EBA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hazard Pay for Health Care Heroes Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H4202B8AE7CC242BF8D5E45617EF9F815"><enum>2.</enum><header>Safeguarding essential health care workers</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 319D–1 (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-4b">42 U.S.C. 247d–4b</external-xref>) the following:</text>

<section id="HD6AC8889904040C594720A62B04402BA"><enum>319D–2.</enum><header>Emergency grants to safeguard essential health care workers</header>
<subsection id="HD7647477EEEC46D8ABD746E71507A3DF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HB20E9AD6B4A441BAA869D9016D486B44"><enum>(1)</enum><header>Emergency or disaster</header><text>The term <term>emergency or disaster</term> means—</text>
<subparagraph id="H4690587297C24AAC93C6A3F6FCFB195E"><enum>(A)</enum><text>a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act;</text></subparagraph> <subparagraph id="HFE2D26367D934A83A13928F2560F4343"><enum>(B)</enum><text>an emergency declared by the President under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act;</text></subparagraph>
<subparagraph id="HB767AB6C2C9C4CCF9E46B88FFF65F7C9"><enum>(C)</enum><text>a national emergency declared by the President under the National Emergencies Act;</text></subparagraph> <subparagraph id="HCAB285E50DF544BA96359EA4674642C0"><enum>(D)</enum><text>a public health emergency declared under section 319; and</text></subparagraph>
<subparagraph id="HD87567EEA9604F1686F4E6030A4EAE3D"><enum>(E)</enum><text>a State, local, territorial, or Tribal emergency or disaster, as declared by the applicable State, local, territorial, or Tribal government.</text></subparagraph></paragraph> <paragraph id="H60E772B5844444D29ED8EBB00502E255"><enum>(2)</enum><header>Eligible health care worker</header><text>The term <term>eligible health care worker</term> means an essential health care worker whose work cannot be conducted remotely.</text></paragraph>
<paragraph id="H7CD5507C33554D74A97AD80D2105E434"><enum>(3)</enum><header>Essential health care worker</header><text>The term <term>essential health care worker</term> means—</text> <subparagraph id="HC1C6CF02E46546DCB5FB01D9506088F7"><enum>(A)</enum><text>a health care provider, including a direct care worker (as defined in section 799B);</text></subparagraph>
<subparagraph id="HB0A7B2F260E2456CAA000B7207463F67"><enum>(B)</enum><text>a medical technologist;</text></subparagraph> <subparagraph id="H4293FEA3B72249BEBFEAF0733AEE8C3D"><enum>(C)</enum><text>a public health worker;</text></subparagraph>
<subparagraph commented="no" id="H9DBC4E20EF234AC5B58227E49D5B82BE"><enum>(D)</enum><text>an orderly (as defined in the 2010 Standard Occupational Classifications of the Department of Labor under the code for Orderlies (31–1015));</text></subparagraph> <subparagraph id="HA6543F28265347549ED72D96AE849B91"><enum>(E)</enum><text>an environmental service, janitorial, or custodial worker in a health care setting; and</text></subparagraph>
<subparagraph id="HA0F2F579E7CF410BAB7A825A87D05667"><enum>(F)</enum><text>any other professional role that the Secretary determines is essential to the care of patients or the maintenance of public health.</text></subparagraph></paragraph></subsection> <subsection id="H9551D3CF99D24A61B586CC01B2C57404"><enum>(b)</enum><header>Grants</header> <paragraph commented="no" display-inline="no-display-inline" id="H6E8D21B1610E4485A0DC345767771E96"><enum>(1)</enum><header>In general</header><text>The Secretary may make grants to public or private nonprofit health care facilities and home health agencies for use in accordance with paragraph (2).</text></paragraph>
<paragraph id="H3DD778CC5DC94952B108E557F89BA559"><enum>(2)</enum><header>Use of funds</header>
<subparagraph id="H462A0E15B8F84F05B5540DDBFBE4D628"><enum>(A)</enum><header>Hazardous duty compensation</header>
<clause id="HB2AE73E115714A9BA1051EB1BD9C55BA"><enum>(i)</enum><header>In general</header><text>The recipient of a grant under paragraph (1) shall use the grant funds to provide hazardous duty compensation to eligible health care workers for work performed during the period of an emergency or disaster in cases in which the Secretary determines that—</text> <subclause id="H10A4F4A8F015486DA636158DF827EE16"><enum>(I)</enum><text>the performance of the work by the eligible health care worker for the applicable health care facility or home health agency is hazardous; or</text></subclause>
<subclause id="H694F1180887F484897857CB141C9AA25"><enum>(II)</enum><text>the commute of the eligible health care worker is hazardous.</text></subclause></clause> <clause id="H9D6DEDC9F4EA484FB382C46F157EA1AD"><enum>(ii)</enum><header>Requirement</header> <subclause id="H973E05FA88834CCF9BB815157CD079F3"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), the amount of hazardous duty compensation under clause (i) shall be not more than $13 per hour, which shall be in addition to the wages or remuneration the eligible health care worker otherwise receives for the work.</text></subclause>
<subclause id="H98A1FF3D08D443F9832F0E50FEBDFD68"><enum>(II)</enum><header>Maximum amount</header><text>The total amount of hazardous duty compensation received by any 1 eligible health care worker under this subparagraph may not exceed $25,000 per year.</text></subclause></clause></subparagraph> <subparagraph id="HF6FDE7B0DD5E48809032C45F0BE84455"><enum>(B)</enum><header>Additional uses</header><text>The recipient of a grant under paragraph (1) may use the grant funds to provide safety measures to safeguard and protect eligible health care workers from hazards due to the applicable emergency or disaster, including alternative transit options, personal protective equipment, and other safety measures.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7D5779F118744F17BBBEB4CE07F18AA8"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
