<section id="HDA9BF7BD9F424EF595E0FA2642D782F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Law and Order on America’s Streets Act</short-title></quote>.</text> </section> <section id="H2F84A982F51D425AB05CAE527F78D3FE"><enum>2.</enum><header>Authorizing the civil commitment of persons who are a danger to public safety</header> <subsection id="H8E9DB9F4247144368583533190916DC9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4248 of title 18, United States Code, is amended—</text> 
<paragraph id="HCE3227C3247E4AA1A04046A227088E68"><enum>(1)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="USC">or a person who is a danger to public safety</header-in-text></quote> after <quote><header-in-text level="section" style="USC">of a sexually dangerous person</header-in-text></quote>;</text></paragraph> <paragraph id="HBECEF97966C24B5988B604708B3A3DFD"><enum>(2)</enum><text>by inserting <quote>or a person who is a danger to public safety</quote> after <quote>sexually dangerous person</quote> each time it appears;</text></paragraph> 
<paragraph id="H3CB063AAD6D54E368A78C2274D9293CB"><enum>(3)</enum><text>by inserting <quote>or a danger to the public</quote> after <quote>sexually dangerous to others</quote> each time it appears; and</text></paragraph> <paragraph id="H4FDDCBBE28DC49529FC359C718F281C5"><enum>(4)</enum><text>by adding at the end the following:</text>

<subsection id="H57F0690884F8400EB73357B6EE9AC558"><enum>(h)</enum><header>Required determination for homeless individuals</header><text display-inline="yes-display-inline">The Attorney General or the Director of the Bureau of Prisons, as appropriate, shall evaluate each person described in subsection (a) who was homeless (as such term is defined in section 103 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302</external-xref>)) immediately prior the date on which the person entered the custody of the Attorney General or the Bureau of Prisons, or immediately prior to the date on which criminal charges were dismissed solely for reasons relating to the mental condition of the person, to determine whether to certify that such person is a sexually dangerous person or a person who is a danger to public safety. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> <subsection id="H8D1617EA64E24F569E7D4F3AEAB8131C"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 4247 of title 18, United States Code, is amended—</text> 
<paragraph id="HD2DC76A284C04250A923E5C79D49D1CE" display-inline="no-display-inline"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H1E4B47131F3D46889F4BAFBA35C92C5E"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HB48D676472EF4C588B32FF8CECF6793A"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting a semicolon; and</text></subparagraph> <subparagraph id="HBFBD782146F2432EB3F5E5F3BA6E9925"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H068303FF169040279E4B067CB7CDF20C"><enum>(7)</enum><text><quote>person who is a danger to public safety</quote> means a person—</text> <subparagraph id="HCEEE33A13A1B45E5BA3E169D7924C23F"><enum>(A)</enum><text>who has engaged or attempted to engage in—</text> 
<clause id="H90483E2B0F1F47119063DDC9B8106D0D"><enum>(i)</enum><text>a crime of violence;</text></clause> <clause id="H99FFBC9CCDD249AA89DED679E7C15E3E"><enum>(ii)</enum><text>burglary, robbery, or larceny;</text></clause> 
<clause id="H2EB4D0070A604CF0A68D56CDEBE6F593"><enum>(iii)</enum><text>the unlawful possession, use, sale, transfer, or distribution of a controlled substance in a public place;</text></clause> <clause id="HBB45C224456247F9BF52BE2940A4E615" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">urban camping or urban squatting; or</text></clause> 
<clause id="HF2E989C667F847B2A7B532ABE2198163"><enum>(v)</enum><text>vandalism; and</text></clause></subparagraph> <subparagraph id="H2D3660DE08894E6CBC8984FDBA6554B4"><enum>(B)</enum><text>who is a danger to the public;</text></subparagraph></paragraph> 
<paragraph id="H53C57CA44651461286D0669F276B09DC"><enum>(8)</enum><text><quote>danger to the public</quote>, with respect to a person, means that the person suffers from a serious mental illness, abnormality, or disorder as a result of which such person would have serious difficulty in refraining from engaging in—</text> <subparagraph id="HD32ECFE7D9464C22A31D9232A0BE6D16"><enum>(A)</enum><text>a crime of violence;</text></subparagraph> 
<subparagraph id="H224102A6DECE407EA3107BC80939C085"><enum>(B)</enum><text>burglary, robbery, or larceny;</text></subparagraph> <subparagraph id="HC24A07FED7A64E29860077858C5624E3"><enum>(C)</enum><text>the possession, use, sale, transfer, or distribution of illegal narcotics in a public place;</text></subparagraph> 
<subparagraph id="H330B487B2C6649688C7F790B4567AF1D" commented="no"><enum>(D)</enum><text>urban camping or urban squatting; or</text></subparagraph> <subparagraph id="HF7185AF2879B47B387B6FA3C5F0FA0AE"><enum>(E)</enum><text>vandalism;</text></subparagraph></paragraph> 
<paragraph id="HBB08C21FEF9B45A3BE5B415D4F455652"><enum>(9)</enum><text display-inline="yes-display-inline"><quote>urban camping</quote> means using as a primary living accommodation (rather than transient recreation) any temporary outdoor shelter, including tents, tarps, bedding, or vehicle for sleeping or residing for a period exceeding 24 hours in a single location on public or private property not designated for recreational use; and</text></paragraph> <paragraph id="H44E879597AA44A538F680DC6FDCB154C"><enum>(10)</enum><text display-inline="yes-display-inline"><quote>urban squatting</quote> means using or occupying a vacant or abandoned building, structure, or land, without authorization.</text></paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H01FDD5044F1F4D4AB94F4475579F985C"><enum>(2)</enum><text>in subsection (c)(4)(D), by inserting <quote>or a person who is a danger to public safety</quote> after <quote>sexually dangerous person</quote>.</text></paragraph></subsection> </section> </legis-body></bill>
