<section id="H5D3B633E7DA44764A2390D70BCCB695B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End H–1B Visa Abuse Act of 2026</short-title></quote>.</text></section> 
<section id="H940FB317216F449D835FBAFDC0B6D334"><enum>2.</enum><header>Pausing the issuance of H–1B visas</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, no alien may be issued a nonimmigrant visa described in section 101(a)(15)(H)(i)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(i)(B)</external-xref>) until the date that is 3 years after the date of enactment of this Act.</text></section> <section id="HC398ADBD84D84429B0C3384D88F735EF"> <enum>3.</enum> <header>Necessary reforms of the H–1b visa</header> <subsection id="H5E0FF912A12743659D5DF368CDBCF0DB"> <enum>(a)</enum> <header>Ending dual intent</header> <text>Section 214(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(b)</external-xref>) is amended by striking <quote>, and other than a nonimmigrant described in any provision of section 101(a)(15)(H)(i) except subclause (b1) of such section)</quote>.</text>
      </subsection>
      <subsection id="H6754D483D8C0457680D45D356969568D">
        <enum>(b)</enum>
        <header>Numerical limitations and visa duration</header>
 <text display-inline="yes-display-inline">Section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended—</text>
        <paragraph id="H1B6B35CABA744B7A96BAB5040E88E901">
          <enum>(1)</enum>
 <text>in paragraph (1), by amending subparagraph (A) to read as follows:</text> <quoted-block style="OLC" id="H747967A1B69A4C26AAB74A5D0A7A10AB" display-inline="no-display-inline"> <subparagraph id="HF3D45AFCB1284D46959EAFA25A5CE5B2"> <enum>(A)</enum> <text display-inline="yes-display-inline">under section 101(a)(15)(H)(i)(b) may not exceed 25,000 in any fiscal year; and</text>
            </subparagraph>
            <after-quoted-block>;</after-quoted-block>
          </quoted-block>
        </paragraph>
        <paragraph id="HBD69A0C20DBD43B7AF041649FB3817F4">
          <enum>(2)</enum>
 <text>in paragraph (4), by striking <quote>may not exceed 6 years</quote> and inserting <quote>may not exceed 3 years</quote>; and</text>
        </paragraph>
        <paragraph id="H4378C84C00D54D45A4086C6E66D047C8">
          <enum>(3)</enum>
 <text>by striking paragraph (5) and redesignating paragraphs (6), (7), and (8) as paragraphs (5), (6), and (7).</text>
        </paragraph>
      </subsection>
      <subsection id="H2146335E4368418089643E771AF6D52A">
        <enum>(c)</enum>
        <header>Trump fee</header>
 <text display-inline="yes-display-inline">Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>) is amended—</text>
        <paragraph id="H1D32D63376A64F94B9F15CFA3E86B1C9">
          <enum>(1)</enum>
 <text>by redesignating paragraphs (10), (11), (12), and (13) as paragraphs (11), (12), (13), and (14) respectively; and</text>
        </paragraph>
        <paragraph id="HFAD29198645D4520AB063A80EDAF93EE">
          <enum>(2)</enum>
 <text>by inserting after paragraph (9) the following:</text> <quoted-block style="OLC" id="H557644C902BF454786B8676583991F61" display-inline="no-display-inline"> <paragraph id="H71C5ED2572254572B257684186AF7944"> <enum>(10)</enum> <header>Additional H–1B fee</header> <subparagraph id="HF1A5D013E72540BAAE83B1836ED35E3F"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">Notwithstanding any other provision of law, for fiscal year 2026 and each fiscal year thereafter, a fee of $100,000 shall be imposed on each employer filing a petition under paragraph (1)—</text>
                <clause id="HA8FEE3CD8D744DABA68BEE28BD1F5EC7">
                  <enum>(i)</enum>
 <text>to grant an alien nonimmigrant status described in section 101(a)(15)(H)(i)(b); and</text>
                </clause>
                <clause id="H3B6BF16E834F47219BB61B30D1836AB9">
                  <enum>(ii)</enum>
 <text>to obtain authorization for an alien having such status to change employers.</text>
                </clause>
              </subparagraph>
              <subparagraph id="H7E92AD1A694A45888F0BC51B152540BF">
                <enum>(B)</enum>
                <header>Deposit of fees</header>
 <text display-inline="yes-display-inline">Fees collected under this paragraph shall be deposited in the Treasury in accordance with section 286(s).</text>
              </subparagraph>
            </paragraph>

          </quoted-block>
        </paragraph>
      </subsection>
      <subsection id="H93F9DBEAD8E640518BD2213B06ADB6BA">
        <enum>(d)</enum>
        <header>Wage floor and recruitment requirements</header>
 <text display-inline="yes-display-inline">Section 212(n) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(n)</external-xref>) is amended—</text>
        <paragraph id="H0824D7B4CEEE4CCEA013341F2FE4EA50">
          <enum>(1)</enum>
 <text>in paragraph (1)(A)—</text> <subparagraph id="H1063A0AC5129485596C837A4BE6FAB20"> <enum>(A)</enum> <text>by striking <quote>; and</quote> at the end of clause (i)(II) and inserting <quote>;</quote>;</text>
          </subparagraph>
          <subparagraph id="H74FE2706E71F4BDD92580F28C776D0B9">
            <enum>(B)</enum>
 <text>by redesignating clause (ii) as clause (vi); and</text> </subparagraph> <subparagraph id="H24DDA226BE09452193BE1035B7EEA538"> <enum>(C)</enum> <text>by inserting after clause (i) the following:</text>

              <clause id="HD272D218FD6847C18C9A537584490456">
                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">attests that there are not sufficient workers who are able, willing, qualified, and available at the time of application for a nonimmigrant visa and admission to the United States and at the place where the alien is to perform such labor;</text>
              </clause>
              <clause id="H396D8DD2E16445FC82FFCDCEC7CB7FCF">
                <enum>(iii)</enum>
 <text>attests that the employment of such alien will not adversely affect the wages and working conditions of workers in the United States similarly employed;</text>
              </clause>
              <clause id="HAC9FE14286F344DEB133F4AD91D0845F">
                <enum>(iv)</enum>
 <text>has not laid off any workers in the previous 12 months and will not lay off any workers in the following 12 months;</text>
              </clause>
              <clause id="H765D721A8B7F4E238B557187D6E7A4B4">
                <enum>(v)</enum>
 <text>is offering to pay each alien granted nonimmigrant status described in section 101(a)(15)(H)(i)(b) wages at a rate that is not less than $200,000 per year; and</text>
              </clause>
              <after-quoted-block>;</after-quoted-block>
            </quoted-block>
          </subparagraph>
        </paragraph>
        <paragraph id="HB1E0CC01463C4B5DB198DB569894394C">
          <enum>(2)</enum>
 <text>in paragraph (1)(E)(ii), by striking <quote>An application is not described in this clause if the only H–1B nonimmigrants sought in the application are exempt H–1B nonimmigrants.</quote>;</text>
        </paragraph>
        <paragraph id="H884DD26D1C2A4A73A6A2264A71D2A3FC">
          <enum>(3)</enum>
 <text>in paragraph (2)(E), by striking <quote>a nonexempt</quote> and inserting <quote>an</quote>; and</text>
        </paragraph>
        <paragraph id="HD8F3AB74ADD54AFDADB0FE21D73A8160">
          <enum>(4)</enum>
 <text>in paragraph (3), by striking subparagraphs (B) and (C).</text> </paragraph> </subsection> <subsection id="H9640588D76A34DEC9BEDCDA29CB97A43"> <enum>(e)</enum> <header>Eliminating the H–1B lottery</header> <text>Section 214(g)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(3)</external-xref>) is amended to read as follows:</text>

            <enum>(3)</enum>
            <subparagraph id="HE3228769D38D47E0B1920173EE717E2A" display-inline="yes-display-inline">
              <enum>(A)</enum>
 <text>Aliens who are subject to the numerical limits in paragraph (1)(A) shall be issued visas in order of the highest wage levels being offered by the petitioning employers, following a registration period that U.S. Citizenship and Immigration Services shall hold open for no more than two weeks each year.</text>
            </subparagraph>
            <subparagraph id="H4FD79E24396845F68E0FA0B489572F64">
              <enum>(B)</enum>
 <text>Aliens who are subject to the numerical limitations of paragraph (1)(B) shall be issued visas (or otherwise provided nonimmigrant status) in the order in which petitions are filed for such visas or status.</text>
            </subparagraph>
          </paragraph>

        </quoted-block>
      </subsection>
      <subsection id="H203E7D7EA30143059480F56AC327F783">
        <enum>(f)</enum>
        <header>Prohibiting concurrent and third-Party employment</header>
 <text>Section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amended by adding at the end the following:</text>

          <paragraph id="HDF0EB21516034B5BA256B4AE7AAA6C99">
            <enum>(12)</enum>
            <header>Prohibition on concurrent employment</header>
 <text>An alien admitted or otherwise provided status under section 101(a)(15)(H)(i)(b) may not be employed by more than one employer at a particular time. The approval of a subsequent petition for a nonimmigrant described in such section shall automatically terminate the validity of any previously approved petition for that same alien, unless the subsequent petition is specifically designated as a change of employer and not as additional employment.</text>
          </paragraph>
          <paragraph id="H914209DE90ED41919AA480130D349825">
            <enum>(13)</enum>
            <header>Prohibition on third-party employment</header>
 <text>A third-party employment or staffing agency may not—</text> <subparagraph id="H9927CBC5AACA4199833782530880DFB4"> <enum>(A)</enum> <text>file a petition to sponsor a nonimmigrant described in section 101(a)(15)(H)(i)(b); or</text>
            </subparagraph>
            <subparagraph id="H345A9142751241FABF79A61725B237F6">
              <enum>(B)</enum>
 <text>facilitate the recruitment or employment of a nonimmigrant described in section 101(a)(15)(H)(i)(b) on behalf of another employer.</text>
            </subparagraph>
          </paragraph>

        </quoted-block>
      </subsection>
    </section> 
<section id="H15E58441AC2C47BEAE2682451691946D"><enum>4.</enum><header>Restricting H nonimmigrants to primary workers</header><text display-inline="no-display-inline">Section 101(a)(15)(H) is amended by striking <quote>; and the alien spouse and minor children of any such alien specified in this paragraph if accompanying him or following to join him</quote>.</text></section> <section id="H04366275E7FE4575BA195100FD8551EE"> <enum>5.</enum> <header>Prohibiting Federal employment of nonimmigrant visa holders</header> <subsection id="HF41C4A9EC8EA496087E5FE48D27CAB9D"> <enum>(a)</enum> <header>Barring Federal petitions</header> <text>Section 214(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(c)</external-xref>) is amended by adding at the end the following:</text>

 <text>No agency, department, or instrumentality of the Federal Government may file a petition for a nonimmigrant described in section 101(a)(15).</text>

      </subsection>
      <subsection id="H32F21B3A3F06429FBA5D7CC3847158BA">
        <enum>(b)</enum>
        <header>Barring Federal employment</header>
 <text>Section 274A(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(h)</external-xref>) is amended by adding at the end the following:</text>

            <enum>(4)</enum>
            <header>Prohibition on Federal employment of nonimmigrants</header>
 <text display-inline="yes-display-inline">No agency, department, or instrument of the Federal Government may employ, either directly or through a contract, a nonimmigrant described in section 101(a)(15).</text>
          </paragraph>

      </subsection>
    </section> 
<section id="HDE3DB087BEA2498F9F845DC310057AAB"><enum>6.</enum><header>Eliminating the optional practical training program</header><text display-inline="no-display-inline">Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HF4C8537BBAA84E6DAC4DFAA0730B27B1" style="OLC"> <subsection id="H2BC25345FBD444B1B6F22438E0B88046"><enum>(s)</enum><header>Prohibition on employment authorization for foreign students</header> <paragraph id="H9DFDBC9840B74AEFA32629D277B7F472"><enum>(1)</enum><text>Notwithstanding any other provision of law, no alien present in the United States as a nonimmigrant under section 101(a)(15)(F) or section 101(a)(15)(M) may be provided employment authorization in the United States.</text></paragraph> 
<paragraph id="H9721041270014D4E9430E58EA59290F4"><enum>(2)</enum><text>Notwithstanding any other provision of law, no alien present in the United States under section 101(a)(15)(J), who was admitted for the purpose of attending an educational or training institution, may be provided employment authorization in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HB908D11330754C238EFF9C3D9C32CD94"><enum>7.</enum><header>Prohibiting adjustment of status</header><text display-inline="no-display-inline">Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended to read as follows:</text>

<section id="H95609C5A98C34CED874252768416D33B"><enum>245.</enum><header>Limitation on status for nonimmigrants</header> 
<subsection id="H5601F05B67F64F3DA534AA50B346EE21"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (c), nonimmigrants described in section 101(a)(15), aliens who have been granted temporary parole pursuant to section 212(d)(5), and any other aliens with temporary authorized presence in the United States are ineligible to adjust their status to that of a person admitted for permanent residence while residing in the United States.</text></subsection> <subsection id="HC8DA47957E964A14A9AFB38BFE32C470"><enum>(b)</enum><header>Employment authorization</header> <paragraph id="HB898EC46A8534C6C8307019BAB15F78D"><enum>(1)</enum><header>In general</header><text>An alien described in subsection (a) is not authorized to engage in employment in the United States on the basis of submitting an application for adjustment of status.</text></paragraph> 
<paragraph id="H0B949404B26E4F3996CDDB1E94BA4A7E"><enum>(2)</enum><header>Rescission of prior employment authorization</header><text>All employment authorizations granted to aliens pursuant to section 274a.12(c)(9) of title 8, Code of Federal Regulations, shall be immediately rescinded and all employment authorization documents issued to such alien applicants for adjustment of status are invalid beginning on the date of enactment of this Act.</text></paragraph> <paragraph id="H97AF79DBC0CB418FB871EE65937D4205"><enum>(3)</enum><header>Pending applications</header><text>Aliens with pending applications for employment authorization documents under such section 274a.12(c)(9) shall have their applications denied and shall be refunded any fees paid in association with such applications.</text></paragraph></subsection> 
<subsection id="H514614CA94A04ED2A15324E2AB1B9D5F">
            <enum>(c)</enum>
            <header>Aliens eligible To adjust status</header>
 <text>An alien is eligible for an adjustment of status to that of a person admitted for permanent residence if—</text>
            <paragraph id="HD79A4F2EDB154F68AC020ABE2CD0A063">
              <enum>(1)</enum>
 <text>such alien is otherwise eligible to receive an immigrant visa;</text> </paragraph> <paragraph id="H136ED7D01DDC413399DCF8AA1A404805"> <enum>(2)</enum> <text>an immigrant visa is available for such alien under chapter 1; and</text>
            </paragraph>
            <paragraph id="HB0D111BCD6434B9082485692CA620577">
              <enum>(3)</enum>
 <text>the alien—</text> <subparagraph id="HFF49DAB1E5024E41845139951A67FB98"> <enum>(A)</enum> <text>filed a petition for adjustment of status before the date of the enactment of this section and such petition is adjudicated not later than 1 year after such date of enactment;</text>
              </subparagraph>
              <subparagraph id="H7708A199BCE8489BB6FD2AB85A4A415C">
                <enum>(B)</enum>
 <text>is a refugee;</text> </subparagraph> <subparagraph id="HCCBEE3598A1640B1BF2DF0DC51290B51"> <enum>(C)</enum> <text>applied for asylum before the date of the enactment of this section and such application is adjudicated not later than 1 year after such date of enactment; or</text>
              </subparagraph>
              <subparagraph id="H3FDAE8F9E78B4A228626F105A2868AA7">
                <enum>(D)</enum>
 <text>has been granted conditional permanent resident status pursuant to section 216.</text>
              </subparagraph>
            </paragraph>
          </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H718034B357534ABF8DA8953EB771D97C"><enum>8.</enum><header>Prohibiting change of status</header><text display-inline="no-display-inline">Section 248 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1258">8 U.S.C. 1258</external-xref>) is amended to read as follows:</text>

          <enum>248.</enum>
          <header>Change of nonimmigrant classification</header>
 <text display-inline="no-display-inline">The Secretary of Homeland Security may not authorize a change from any nonimmigrant classification to any other nonimmigrant classification.</text>
        </section>

      </quoted-block> </section> 
<section id="HE8A4682CAA1C43E08F0BE620FC3B0C1C"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date of enactment.</text></section> </legis-body></bill>
