<section id="H57A2FC9353884577BDFA9F032F9FD95F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal and State Food Safety Information Sharing Act of 2026</short-title></quote>.</text></section> <section id="H932C7A30E9F04E95B7C0B58A99DCDAC2" section-type="subsequent-section"><enum>2.</enum><header>Sharing food safety information with State, local, Tribal, and Territorial authorities</header> <subsection id="HA4E732E1CDE741208542D9D4EAFD5C1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 708 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379">21 U.S.C. 379</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H2CBE472820004678BFB1ED0493CFDC38"><enum>(d)</enum><header>Sharing food safety information with State, local, Tribal, and Territorial authorities</header> 
<paragraph id="H139109B96E4041EBB87B78BF21CA2A25"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">Notwithstanding section 301(j) and any other law, regulation, or policy, the Secretary may share, with a State, local, Tribal, or Territorial authority with counterpart functions related to the protection of public health, unredacted information in the possession of the Food and Drug Administration relating to any of the following:</text> <subparagraph id="H02B2767729D8486E9A448DE9ADB72B9E"><enum>(A)</enum><text>Foodborne illness surveillance data.</text></subparagraph> 
<subparagraph id="H9AC4E9C50C3D4942B196663BC03D886A"><enum>(B)</enum><text>Laboratory sampling testing information.</text></subparagraph> <subparagraph id="HB93975B82B3E4978A5DBDCF1D4BE3F5A"><enum>(C)</enum><text>Inspectional information and results.</text></subparagraph> 
<subparagraph id="H731E75B8CB954AF48A4506EA37B2BE8F"><enum>(D)</enum><text>Distribution lists for recalls and outbreaks.</text></subparagraph> <subparagraph id="H9346303BA1544AA09EBD15F60A1788FF"><enum>(E)</enum><text>Consumer complaints.</text></subparagraph> 
<subparagraph id="H29735EA93D834CAD8FDE6D42FF54E024"><enum>(F)</enum><text>Any other information the Secretary determines will assist such authority in protecting the public.</text></subparagraph></paragraph> <paragraph id="HA415862227D14A598F24BB0E429ED51F"><enum>(2)</enum><header>Timing</header><text>The Secretary may share information pursuant to paragraph (1) as soon as is reasonably practicable.</text></paragraph> 
<paragraph id="H92C1E1B0307B4624AC1139ED030746F7"><enum>(3)</enum><header>Limitation on further disclosure</header><text display-inline="yes-display-inline">A State, local, Tribal, or Territorial authority in receipt of information provided by the Secretary under this subsection shall not further disclose such information without permission of the Food and Drug Administration unless such authority determines that disclosure of such information is necessary to contain a foodborne illness outbreak, carry out a recall, or carry out other State enforcement activities.</text></paragraph> <paragraph id="HEE598CD1CD4C46C0A4B79D65E05E049D"><enum>(4)</enum><header>Effect of subsection</header><text display-inline="yes-display-inline">Nothing in this subsection affects the ability of the Secretary to enter into any written agreement authorized by other provisions of law to share confidential information.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF286340DE49245BBBF0C9347024C88F9"><enum>(b)</enum><header>Conforming amendment</header><text>The first sentence of section 301(j) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(j)</external-xref>) is amended—</text> <paragraph id="H9ECC4061128D4481B36E8A74CE86AD38"><enum>(1)</enum><text>by striking <quote>The</quote> and inserting <quote>Except as provided in section 708(d), the</quote>; and</text></paragraph> 
<paragraph id="HC62F6DA0D8234385A225057419567938"><enum>(2)</enum><text>by striking the second period at the end.</text></paragraph></subsection></section> <section id="H49593B517FB543CAB718C985AE24538B"><enum>3.</enum><header>Grants to enhance food safety</header> <subsection id="H55E0F8ADA8EB47DC949BFDD3EE237173"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1009 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/399">21 U.S.C. 399</external-xref>) is amended—</text> 
<paragraph id="H8FB9DE3D0C3E4235BB76AADA166F583D"><enum>(1)</enum><text>in subsection (d)(1), by striking <quote>3 years</quote> and inserting <quote>5 years</quote>; and</text></paragraph> <paragraph id="HD8872200B47B43BD9B664263A31DE22E"><enum>(2)</enum><text>in subsection (e)—</text> 
<subparagraph id="HAB085EC6AB7848DBB977C98239F22151"><enum>(A)</enum><text>by striking <quote>3 years</quote> and inserting <quote>5 years</quote>; and</text></subparagraph> <subparagraph id="H42CDA4C645874FE1B09F371D63DCE94C"><enum>(B)</enum><text>by amending the second sentence to read as follows: <quote>In the event the Secretary conducts a program evaluation, funding in subsequent years of the grant, where applicable, shall be contingent on a successful program evaluation by the Secretary after the first year of the grant.</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H21A18C6D13AE4DA9AC0E103D7508FDA5"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) apply only with respect to grants awarded under section 1009 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/399">21 U.S.C. 399</external-xref>) on or after the date of the enactment of this Act.</text></subsection></section> </legis-body></bill>
