<section id="HA7B562EF79274DE2B41DCDB993C49E4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civics Learning Act of 2026</short-title></quote>.</text></section> <section id="H4FA8A1CDE871419D92513AE27F0CB3BF" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HC2C9B8F19A544A0B90641EB5BC4BE5A8"><enum>(1)</enum><text display-inline="yes-display-inline">The dearth of civics lessons available to students across the United States has helped to foster a political climate that is deeply partisan and divided.</text></paragraph> <paragraph id="HB32518ABF9AC4D828A7274A7C9612F63"><enum>(2)</enum><text display-inline="yes-display-inline">Polarization in the United States has fractured public morale in our democratic institutions and has created an environment in which people are less likely to be well-informed on the processes of our constitutional republic, the current state of affairs, and the importance of participating in the political process.</text></paragraph> 
<paragraph id="H4CA8B9C1866646F2909A968D17CCA659"><enum>(3)</enum><text display-inline="yes-display-inline">It is impossible to tell the true, full history of this Nation and recognize the power of our representative democracy without discussing the painful and powerful history of the civil rights movement. It is incumbent on Congress to ensure the full history of our great Nation is being taught to the next generation of leaders.</text></paragraph> <paragraph id="H3332A38C517A44679192D11B169A0FD9"><enum>(4)</enum><text display-inline="yes-display-inline">According to the Annenberg Constitution Day Civics Survey conducted by the Annenberg Public Policy Center of the University of Pennsylvania, in 2022—</text> 
<subparagraph id="H76EF6763811B4EB9BD195F76322C69F1"><enum>(A)</enum><text display-inline="yes-display-inline">only 47 percent of people in the United States surveyed were capable of naming all 3 branches of government, while 25 percent of Americans were not able to name any of the branches of government;</text></subparagraph> <subparagraph id="H7B147FC7270B452B82875FF263A23301"><enum>(B)</enum><text display-inline="yes-display-inline">less than half of Americans (46 percent) correctly stated that the Supreme Court has the final responsibility for determining the constitutionality of laws if the President and Supreme Court disagree; and</text></subparagraph> 
<subparagraph id="H77471655207E409BBD4CF2572F396B78"><enum>(C)</enum><text display-inline="yes-display-inline">26 percent could not name any of the rights guaranteed under the First Amendment.</text></subparagraph></paragraph> <paragraph id="H4A3CFD087B1B4746B64F95F2A895C5EC"><enum>(5)</enum><text display-inline="yes-display-inline">In 2022, only 22 percent of eighth graders were found to have performed at or above the proficient level on the National Assessment of Educational Progress civics exam conducted by the National Center of Education Studies.</text></paragraph> 
<paragraph id="H9FE6799301C545A4A67EAC31BE695D3D"><enum>(6)</enum><text display-inline="yes-display-inline">A lack of knowledge regarding the structural basics of our constitutional republic and the history of our struggle for suffrage and civil rights creates an increasingly ill-equipped electorate which over time, can, and will continue to, contribute to a weakened democracy.</text></paragraph></section> <section id="HF4C3BE696D3E4D3DBE33401405B21444"><enum>3.</enum><header>Amendments to the Elementary and Secondary Education Act of 1965</header><text display-inline="no-display-inline">Section 2233 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6663">20 U.S.C. 6663</external-xref>) is amended—</text> 
<paragraph id="H2F5A0810F57D425EACE71687627C22BE"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text> <subparagraph id="HB9E352CC385E4CD6ABBDD3085D2B9BA9"><enum>(A)</enum><text>by inserting <quote>and prioritize innovative civics learning and teaching, including by encouraging</quote> after <quote>to encourage</quote>; and</text></subparagraph> 
<subparagraph id="H361DE0FFB25A4ADEAC64F13178103DC6"><enum>(B)</enum><text>by inserting <quote>(including students and teachers at high-need schools (as defined in section 2221))</quote> before the period;</text></subparagraph></paragraph> <paragraph id="H592D4ADAFA16449992B357ECB5C667B9"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H533F3643BB734034962C0FF3C565532A"><enum>(A)</enum><text>by inserting <quote>and appropriated under subsection (h) of this section</quote> after <quote>2231(b)(2)</quote>; and</text></subparagraph> <subparagraph id="H3ACE5BBBE87F41E38CE181A8F7746436"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text>

<paragraph id="HBBD8895E5424483DBA6DEBEB6095B2CE"><enum>(2)</enum><text>may include—</text> <subparagraph id="HD59A569BAEB849B6B3E2B26F993853C3"><enum>(A)</enum><text>hands-on civic engagement activities for teachers and students;</text></subparagraph> 
<subparagraph id="HD83BE9D56C7D41B486AEA0380F196B2D"><enum>(B)</enum><text display-inline="yes-display-inline">activities about the history and principle of the Constitution of the United States, including the Bill of Rights, women’s suffrage, and the civil rights movement;</text></subparagraph> <subparagraph display-inline="no-display-inline" id="HAF305D1981044CA2BE963316557F1B04"><enum>(C)</enum><text display-inline="yes-display-inline">before-school, during-school, after-school, and extracurricular activities;</text></subparagraph> 
<subparagraph display-inline="no-display-inline" id="H76191774DAF349BF8905DB1F1A266788"><enum>(D)</enum><text display-inline="yes-display-inline">activities that include service learning and community service projects that are linked to school curriculum;</text></subparagraph> <subparagraph display-inline="no-display-inline" id="HEE9BBAD98ECC4004A4E1ED2118A56F92"><enum>(E)</enum><text>activities that encourage and support student participation in school governance; and</text></subparagraph> 
<subparagraph id="H524F8DE9E06543BDA203FD9DB22074B9"><enum>(F)</enum><text>online and video game based learning.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H0ABD12883F13439FAFC1246A045D2C67"><enum>(3)</enum><text>in subsection (c), by striking paragraph (3) and inserting the following:</text>

<paragraph id="HC0FB3028891641DEA4B58F7729D4C1EE"><enum>(3)</enum><header>Diversity of projects</header> 
<subparagraph id="HE769E8D16ED647D087567B86B00A1620"><enum>(A)</enum><header>Diversity of grants</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall ensure that, to the extent practicable, grants are distributed among eligible entities that will serve geographically diverse areas, including urban, suburban, and rural areas, and public elementary schools.</text></subparagraph> <subparagraph id="H92642A5F99AF428F92C98D3F7C3F72B2"><enum>(B)</enum><header>Allocation of grant funding</header><text display-inline="yes-display-inline">To the extent practicable based on the applications received under subsection (d), the Secretary shall ensure that—</text> 
<clause id="HCC5B96CE2F594B1AAF4212040B48DBEF"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 30 percent of the grant funds under this section are awarded to eligible entities that serve elementary school students and teachers;</text></clause> <clause id="H4505C624D8BA425D94BA5EC8007226CA"><enum>(ii)</enum><text>not less than 30 percent of the grant funds under this section are awarded to eligible entities that serve middle school students and teachers; and</text></clause> 
<clause id="H060FAEBFA3434F6C88476105A09E1C21"><enum>(iii)</enum><text>not more than 40 percent of the grant funds under this section are awarded to eligible entities that serve high school students and teachers.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H4AE964F9307F4825A7691AB799C1B643"><enum>(4)</enum><text>in subsection (d), by inserting <quote>, and containing such information,</quote> after <quote>manner</quote>; and</text></paragraph> 
<paragraph id="HEC97EF7B1E8547C1A4FCC1AEC268A6F3"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H2296DB9784EF4E8D8AD4079D8061E9DD" style="OLC"> <subsection id="H5A490DE3AF394167B977362CED0ED2BC"><enum>(f)</enum><header>Grant award preference</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give preference to applications for programs that carry out the activities listed in subsection (b)(2) for the purpose of strengthening civics education and learning.</text></subsection> 
<subsection id="H10707AFC1D96406FA5DC5283BBA89D9E"><enum>(g)</enum><header>Annual report</header><text>Not later than 90 days after the end of each fiscal year, the Secretary shall submit to the Committee on Education and Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report containing—</text> <paragraph id="HCDC6C24413304982A1C10D64343AE006"><enum>(1)</enum><text display-inline="yes-display-inline">a description of each eligible entity awarded a grant under this section during the preceding fiscal year;</text></paragraph> 
<paragraph id="H5BF9200A8BD24608B663443BAA5B6AC0"><enum>(2)</enum><text display-inline="yes-display-inline">a description of whether each such eligible entity was able to meet each of the purposes under subsection (a), and if so, how such eligible entity was able to meet such purposes; and</text></paragraph> <paragraph id="HB54600598029484C8C56FAD6E0872D00"><enum>(3)</enum><text>any recommendations for continuation of the grant program under this section.</text></paragraph></subsection> 
<subsection id="H7359CC6CA1D1452FAE8AE13D56EE6BB3"><enum>(h)</enum><header>Authorization of appropriations</header><text>In addition to the amounts reserved under section 2231(b)(2), there are authorized to be appropriated $70,000,000 to carry out this section for fiscal year 2027.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
