<section section-type="section-one" id="H342C99A8606D44AC8DA1D20439F82925"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Decentralized Access to Technology Alternatives Act of 2026</short-title></quote> or the <quote><short-title>DATA Act of 2026</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H76D418398A94410C8145CDB5BDED767B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph commented="no" display-inline="no-display-inline" id="H1CD9D7B94C1E418993D9B0249DA91722"><enum>(1)</enum><header>Bulk-power system</header><text>The term <term>bulk-power system</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE2870D13FA9B4C449B13EB590B62F344"><enum>(2)</enum><header>Consumer-regulated electric utility; <enum-in-header>CREU</enum-in-header></header><text display-inline="yes-display-inline">The term <term>consumer-regulated electric utility</term> or <term>CREU</term> means an electric generation and supply system that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H4BFF971B914F4F08824D37A4CDC4EBCB"><enum>(A)</enum><text display-inline="yes-display-inline">is established—</text> <clause commented="no" display-inline="no-display-inline" id="HB342308D25F84F28B4F4821B408F7381"><enum>(i)</enum><text display-inline="yes-display-inline">after the date of enactment of this Act; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HAC04C206221743F7B203387B8A018153"><enum>(ii)</enum><text display-inline="yes-display-inline">exclusively for the purpose of serving new electric loads that were not previously served by any retail electricity supplier;</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA295EC8EC299439E8ECA7D300204612A"><enum>(B)</enum><text>may own, construct, and operate facilities necessary for generation, energy storage, transmission, distribution, and the retail supply of electricity;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H28D059236A1A4E51B2FB23602100DA9B"><enum>(C)</enum><text>may sell electricity at retail to eligible CREU customers, subject to the condition that the system is physically islanded from—</text> <clause commented="no" display-inline="no-display-inline" id="H96F49AEA380A461CA806F21B4D6050BD"><enum>(i)</enum><text display-inline="yes-display-inline">all regulated utilities;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HF51624E616EC43AA8436819C98A66107"><enum>(ii)</enum><text>the bulk-power system; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H69E214769AA64453BD6D85E616FAD671"><enum>(iii)</enum><text display-inline="yes-display-inline">the Bulk Electric System (as defined by the Electric Reliability Organization);</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H11E9E416BBCD422FBCE54AEB3F7957F9"><enum>(D)</enum><text>engages in any combination of—</text> <clause commented="no" display-inline="no-display-inline" id="HBCDE32B8F44343A9A844F107ADEDCEE2"><enum>(i)</enum><text display-inline="yes-display-inline">generating electricity;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HAC2BD3547C224C97B79323C6C2E5CE03"><enum>(ii)</enum><text>transmitting electricity;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H59AD638B7D8146F193222A64CE2B3977"><enum>(iii)</enum><text>distributing electricity; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H03CFA59C2F6A47B8A4C42CC94DCEFB7B"><enum>(iv)</enum><text>selling electricity at retail to consumers;</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H685E0432A6D74719AF63D6B4070346FA"><enum>(E)</enum><text>is not connected to the bulk-power system or any other electric transmission or distribution system for primary or backup supply; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB24BA5328EAD43A09D2E34EF0CB619F1"><enum>(F)</enum><text>operates independently of any public utility.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H07C9658859734D1CA27C8B8150435852"><enum>(3)</enum><header>Electric Reliability Organization</header><text>The term <term>Electric Reliability Organization</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2EF97683DAD840BC8E7BEEBBE8C03CF1"><enum>(4)</enum><header>Eligible <enum-in-header>CREU</enum-in-header> customer</header><text display-inline="yes-display-inline">The term <term>eligible CREU customer</term> means any entity that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H35CF9FDA98B14CF2B6CFE088F47B0742"><enum>(A)</enum><text display-inline="yes-display-inline">purchases electricity at retail from a consumer-regulated electric utility;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H85D5B4BF0EED45AA8EFB73FEA312F759"><enum>(B)</enum><text display-inline="yes-display-inline">receives electric service exclusively through facilities owned, constructed, or operated by consumer-regulated electric utilities; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7701DC87ADE14A5A98D51E054923CB51"><enum>(C)</enum><text display-inline="yes-display-inline">is located within premises that are physically islanded from—</text>
<clause commented="no" display-inline="no-display-inline" id="HB64783AB22B54014AB36E16AAD99F079"><enum>(i)</enum><text display-inline="yes-display-inline">all regulated utilities;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H2A133AAB89A2439CBC4966D59278E3F7"><enum>(ii)</enum><text display-inline="yes-display-inline">the bulk-power system; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H9AF01D2FAB7B456D9A0EF3095859444A"><enum>(iii)</enum><text display-inline="yes-display-inline">the Bulk Electric System (as defined by the Electric Reliability Organization).</text></clause></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H37CF80EBE4E3451EA85EB1673E954807"><enum>(5)</enum><header>Reliability standard</header><text>The term <term>reliability standard</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph></section>
<section id="HAF630F42DD22474EB3EBC494D4916217"><enum>3.</enum><header>Federal Power Act exemption</header><text display-inline="no-display-inline">A consumer-regulated electric utility—</text> <paragraph commented="no" display-inline="no-display-inline" id="H53B470A28E3643679AAFFF10AFF775D0"><enum>(1)</enum><text>shall be exempt from regulation under the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>), including with respect to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBDCA9C2E53A74561B0F253EB17355954"><enum>(A)</enum><text display-inline="yes-display-inline">rate regulation;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2A07D0AD68F44CA99ECF46429C11E35B"><enum>(B)</enum><text>corporate or financial oversight;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD30081E2171549A19364C0EE1FF0A959"><enum>(C)</enum><text>transmission or distribution regulation;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4CB307F378124C209FA0FD1D92A77983"><enum>(D)</enum><text>reliability standards under section 215 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9377961344EE4A169B91E3934BB723D6"><enum>(E)</enum><text>interconnection requirements;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA33A6B75D96B4D079FB0CE87672E5832"><enum>(F)</enum><text>participation in regional transmission planning or cost allocation; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HBC373A95D8B543E0BF70C1B01DFA79E7"><enum>(G)</enum><text>merger, consolidation, acquisition, or disposition approval under section 203 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824b">16 U.S.C. 824b</external-xref>);</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HAF5FC9AC72274C918ACADC944D32AC56"><enum>(2)</enum><text>shall not be considered to be a public utility for purposes of that Act;</text></paragraph>
<paragraph id="HD0F0F27546D64EF58CB1101F26C60683"><enum>(3)</enum><text>shall not be considered to be a part of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H9C961280853A4BDA868232C49A9738FF"><enum>(A)</enum><text display-inline="yes-display-inline">the bulk-power system; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H95DA8A0FE6B94F679C21860A32F00CE1"><enum>(B)</enum><text>the Bulk Electric System (as defined by the Electric Reliability Organization); and</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1C78883E92B842C988D29E2B2529328B"><enum>(4)</enum><text>shall not be required to register with the Electric Reliability Organization or comply with reliability standards, unless the consumer-regulated electric utility voluntarily elects to connect to the bulk-power system.</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H82D77B892FC44E74B53ACB275DB9EB4E"><enum>4.</enum><header>Exemption of new CREUs from FERC and DOE regulation</header>
<subsection commented="no" display-inline="no-display-inline" id="H742E2A7403CF444C84340EB67610286D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a consumer-regulated electric utility that begins operations on or after the date of enactment of this Act shall be exempt from Federal regulation with respect to matters under the jurisdiction of the Federal Energy Regulatory Commission or the Secretary of Energy, including—</text> <paragraph commented="no" display-inline="no-display-inline" id="H7316BD014F3D4D98ACE000E493709325"><enum>(1)</enum><text display-inline="yes-display-inline">all reliability standards; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA54040B60E2449C1B41C5D9DC9E15401"><enum>(2)</enum><text display-inline="yes-display-inline">all other standards, rules, regulations, or other requirements established, administered, or enforced under—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HFCD1D787F4534AEE864E442918B0E0BA"><enum>(A)</enum><text display-inline="yes-display-inline">section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H495B7ED1FAF247EAAB035122FBA8743B"><enum>(B)</enum><text display-inline="yes-display-inline">any other provision of that Act; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HDA4D7751B045492EA0ACCC8ADDFA0AAD"><enum>(C)</enum><text display-inline="yes-display-inline">any other provision of Federal law (including regulations).</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5541A240EBE94B1780A86A1BDB9A9957"><enum>(b)</enum><header>Beginning of operations</header><text>For purposes of subsection (a), the date on which a consumer-regulated electric utility begins operations is the date on which the consumer-regulated electric utility first generates, transmits, distributes, or sells electricity.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="HFDDD71FFEA634E729855FFDD3B6DBE7D"><enum>(c)</enum><header>Termination of exemption</header><text>If a consumer-regulated electric utility elects to connect to any portion of the bulk-power system or any other electric transmission or distribution system for primary or backup supply, the consumer-regulated electric utility shall, immediately on making that connection—</text>
<paragraph id="H0C710480E8CA4EAE95B8B214492D3DCE"><enum>(1)</enum><text>cease being a consumer-regulated electric utility; and</text></paragraph> <paragraph id="HF6AEA3A9A0C54A7883C408A5261DD06D"><enum>(2)</enum><text>become subject to all Federal regulation applicable to the consumer-regulated electric utility from which the consumer-regulated electric utility was exempt under subsection (a).</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H9892C543E5EF4189AB2C0F4BF5CCD26A"><enum>5.</enum><header>PURPA exemption</header><text display-inline="no-display-inline">Section 210 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/824a-3">16 U.S.C. 824a–3</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HEFE12E661AE7458B9A04CB9356C7935F"> <subsection commented="no" display-inline="no-display-inline" id="H7CEF95B04BAA4D7595ADDB2DFED655E1"> <enum>(o)</enum> <header>Consumer-Regulated electric utilities</header> <paragraph commented="no" display-inline="no-display-inline" id="H8E7055B97387454A879F623012A37A40"> <enum>(1)</enum> <header display-inline="yes-display-inline">In general</header> <text>Nothing in this section applies to a consumer-regulated electric utility (as defined in section 2 of the <short-title>DATA Act of 2026</short-title>).</text>
          </paragraph>
          <paragraph commented="no" display-inline="no-display-inline"
            id="HB20C007A366347768A2ED1909B958FCA">
            <enum>(2)</enum>
            <header>Exemption</header>
 <text>A consumer-regulated electric utility (as defined in section 2 of the <short-title>DATA Act of 2026</short-title>) shall not be required to interconnect with, purchase from, or sell to an electric utility under this section.</text>
          </paragraph>
        </subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H51660F74894F44A7951D319DA73F1456"><enum>6.</enum><header>PUHCA exemption</header><text display-inline="no-display-inline">Section 1268 of the Public Utility Holding Company Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16456">42 U.S.C. 16456</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H2AFBC8340A6E43E2B89D6E361A0D4F14"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>Except</quote> and inserting the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H41DAA0640C704372B921FBB51E01B277"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H136F349DC9D44B65B6FAFECA2E87A6E6"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H0BC119D74FA14699B555902F4AB55936">
<subsection commented="no" display-inline="no-display-inline" id="H973A3B2B9FA844A3A5D6D5C6918FF46B"><enum>(b)</enum><header>Consumer-Regulated electric utilities</header><text>No provision of this subtitle shall apply to any holding company solely by reason of its ownership or control of a consumer-regulated electric utility (as defined in section 2 of the <short-title>DATA Act of 2026</short-title>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H2F8FA5F81C4A49DDB9C921B763030A27"><enum>7.</enum><header>Facilities located within public rights-of-way</header> <subsection commented="no" display-inline="no-display-inline" id="HAB4CEBFC099948A3AB699E40009D6429"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A consumer-regulated electric utility may construct and operate facilities within existing public rights-of-way, subject to the same permitting, restoration, and public-safety requirements applicable to a public utility (as defined in section 201(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(e)</external-xref>)).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H67B1F23D21DC45B58F7A667226DC94AD"><enum>(b)</enum><header>Limitation</header><text>Notwithstanding subsection (a), the review of an application for the construction or operation of a facility within an existing public right-of-way by a consumer-regulated electric utility shall be confined exclusively to the adequacy of—</text> <paragraph commented="no" display-inline="no-display-inline" id="HC496A5C72F4745AD971921C80D2BAC7F"><enum>(1)</enum><text display-inline="yes-display-inline">right-of-way restoration; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6F4DA5D8766A4D5EB8290CB8FEC1F25F"><enum>(2)</enum><text>storm-response planning.</text></paragraph></subsection></section> </legis-body></bill>
