<section id="H3A5FAFB9C5B6407F9F3BAF98C40EEC33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Area Population Act</short-title></quote>. </text></section> <section id="H110B9E908344488EB9FEF82BBCA6D34E"><enum>2.</enum><header>Uniform definition of <quote>rural area</quote> for USDA rural development programs</header> <subsection id="H15DCAB7B773647089E90A8092D368BA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 343(a)(13) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)</external-xref>) is amended—</text> 
<paragraph id="H71E184EA274843EB8CC2B52D4C8CBC88"><enum>(1)</enum><text>in subparagraph (A)(ii), by striking <quote>urbanized</quote> and insert <quote>urban</quote>;</text></paragraph> <paragraph id="HC8C88E0833D541608C25B1C4CEC0253B"><enum>(2)</enum><text>by striking subparagraphs (B) and (C);</text></paragraph> 
<paragraph id="H157B65DE53FF4136926C63CCE48D54DA"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text> <subparagraph id="HF922A0FFFF124C809A355B3C197BE9E8"><enum>(A)</enum><text>by striking <quote>(F)</quote> each place it appears and inserting <quote>(D)</quote>; and</text></subparagraph> 
<subparagraph id="HAC531E634D81492A9E4E738F466CEB33"><enum>(B)</enum><text>in clause (i), by striking <quote>urbanized</quote> each place it appears and inserting <quote>urban</quote>; </text></subparagraph></paragraph> <paragraph id="H4B6A118A4D664DED86E6255ED3E01F95"><enum>(4)</enum><text>in subparagraph (E), by striking <quote>urbanized</quote> and inserting <quote>urban</quote>; </text></paragraph> 
<paragraph id="H5EC6AEE5864F48FA9D1C39B6F1BBDB5D"><enum>(5)</enum><text>in subparagraph (F)—</text> <subparagraph id="H2DA8A9992B73407C94F3DB01AF0BE827"><enum>(A)</enum><text>in clause (i)(II), by striking <quote>urbanized</quote> and inserting <quote>urban</quote>; and</text></subparagraph> 
<subparagraph id="H8B06E7140A124C60AA2E799564877B7F"><enum>(B)</enum><text>in clause (ii), by striking <quote>consider—</quote> and all that follows and inserting <quote>consider an area described in clause (i)(I) not to be a rural area for purposes of subparagraph (A).</quote>; and</text></subparagraph></paragraph> <paragraph id="H62D54E71F19046A18F30AAF64C9FC39E"><enum>(6)</enum><text>by redesignating subparagraphs (D) through (I) as subparagraphs (B) through (G), respectively.</text></paragraph></subsection> 
<subsection id="H08316038395849B899A061DCF4FF4306"><enum>(b)</enum><header>Conforming amendments to the Rural Electrification Act of <enum-in-header>1936</enum-in-header></header> 
<paragraph id="HDEF6107868D24DE9A331583A5C738F3C"><enum>(1)</enum><text display-inline="yes-display-inline">Section 13(3) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/913">7 U.S.C. 913(3)</external-xref>) is amended—</text> <subparagraph id="H5E38B0EF9BB2434D92F572A979D785A5"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>(C)</quote> each place it appears and inserting <quote>(A)</quote>; and</text></subparagraph> 
<subparagraph id="HD93565EBFE6C4CCB85CC08D846117D98"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>loan</quote> and inserting <quote>loan, or has had a loan,</quote> before <quote>made under</quote>. </text></subparagraph></paragraph> <paragraph id="HD821F1E1837A4341B6EB7100C930A14D"><enum>(2)</enum><text display-inline="yes-display-inline">Section 203(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/924">7 U.S.C. 924(b)</external-xref>) is amended to read as follows:</text>

<subsection id="HC0455CD73321450A8070C34AEE1AE3AB"><enum>(b)</enum><text display-inline="yes-display-inline">In this title, the term <term>rural area</term> shall have the meaning given the term in 343(a)(13)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)(A)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H3F2F1BCA6494493E8936F16E9E622323"><enum>(3)</enum><text>Section 601(b)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(b)(3)</external-xref>) is amended to read as follows:</text>

<paragraph id="H0900599D1F4F4199A071CBDA2A66C00C"><enum>(3)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <term>rural area</term> shall have the meaning given the term in 343(a)(13)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)(A)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H2E7C9C42DEB74F3FAFC3378C48913BA3"><enum>(4)</enum><text>Section 604(a)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb-3">7 U.S.C. 950bb–3(a)(4)</external-xref>) is amended to read as follows: </text>

<paragraph id="HAC7A796CE51F4C368B964D3A8402A2D1"><enum>(4)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <term>rural area</term> shall have the meaning given the term in 343(a)(13)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)(A)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H5C01229E13674261B0A463CECB7BF73B"><enum>(c)</enum><header>Housing provisions</header><text>Section 520 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490">42 U.S.C. 1490</external-xref>) is amended—</text> 
<paragraph id="H88A75FDC656145F2ABA78C0F9B3F565D"><enum>(1)</enum><text>by striking the first sentence and inserting the following: <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—As used in this title, the term <term>rural area</term> shall have the meaning given the term in 343(a)(13)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)(A)</external-xref>).</quote>;</text></paragraph> <paragraph id="H3ADABD766E244B368A54D50620E675A9"><enum>(2)</enum><text>by striking <quote>For purposes of this title</quote> and inserting the following:</text>

<subsection id="HBECF122E382D48F5A9D30D9298875451"><enum>(b)</enum><header>Legacy areas</header><text display-inline="yes-display-inline">For purposes of this title</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HC6ACACCC7BAD48DD97BA5CF531E6B9B6"><enum>(3)</enum><text>by striking <quote>, and the city</quote> and all that follows through <quote>year 2000</quote>; and</text></paragraph> 
<paragraph id="HDABD845B59514AE1B2641252F999BD6B"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H3EF30463B49B4D0CAC6257AF45FCB20A" display-inline="no-display-inline"> <subsection id="HBBE0F970B3E34FA0B9113AB20B88BB14"><enum>(c)</enum><header>Rural defined</header><text>As used in this title, the term <term>rural</term> shall have the meaning given the term <term>rural area</term> in subsection (a). </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> </section> 
<section id="H8E030935CF924D7FBCF73FE369C0C3F7"><enum>3.</enum><header>Expansion of <quote>rural in character</quote> authority</header><text display-inline="no-display-inline">Section 343(a)(13) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H67B787E24513453EBCE668D924A8E6A7" display-inline="no-display-inline"> <subparagraph id="H4DB06384DA89486BB0487892B390C5A1"><enum>(J)</enum><header>Authority to designate areas with persistent poverty, high concentration of farmworker households, or significant infrastructure gaps as rural areas</header> <clause id="H9D9680B8DB0D4E6A8F7F284F87D12A9B"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Director of the Bureau of the Census, may designate an area that is a census tract, or a census-designated place or an unincorporated area recognized by a local or tribal government with fewer than 35,000 inhabitants, as a rural area for purposes of this paragraph, regardless of whether the area is within an urban area, if the area exhibits persistent poverty, a high concentration of farmworker households, or a significant infrastructure gap.</text></clause> 
<clause id="H5B96F4BB28BA4376B289418807E88760"><enum>(ii)</enum><header>Definitions</header><text>In this subparagraph:</text> <subclause id="H741C93DB019F49D294415016F1A74AF9"><enum>(I)</enum><header>Persistent poverty</header><text display-inline="yes-display-inline">The term <quote>persistent poverty</quote> means, with respect to an area referred to in clause (i), that the income of at least 20 percent of the population of the area was below the poverty line (within the meaning of section 673(2) of the Omnibus Budget Reconciliation Act of 1981, including any revision required by such section applicable to a family of the size involved), as measured by the 1990, 2000, and 2010 decennial censuses.</text></subclause> 
<subclause id="HBD61A070058E4B57AD1C363B6F8AFACA"><enum>(II)</enum><header>High concentration</header><text>The term <quote>high concentration</quote> means a percentage that significantly exceeds the percentage of farmworker households in the United States or in the State involved, as determined by the Secretary.</text></subclause> <subclause id="H77DF991814A24796AA9C21C4720C475D"><enum>(III)</enum><header>Significant infrastructure gap</header><text display-inline="yes-display-inline">The term <quote>significant infrastructure gap</quote> means, with respect to an area referred to in clause (i), that the area lacks access to potable water, wastewater treatment, or reliable electricity that meets Federal standards, as determined by the relevant State or local health department and the relevant USDA Rural Development field office. </text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H051DD69EA78E4135AECE431723D17584"><enum>4.</enum><header>Designation of high-need rural pockets as rural areas</header><text display-inline="no-display-inline">Section 343(a)(13) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H176CD83291F54087835553D86324B192" display-inline="no-display-inline"> <subparagraph id="H3B8BAE5A5E6648E896DA3DFE7328F5ED"><enum>(K)</enum><header>High-need rural pockets</header> <clause id="H52C6355186C0452A924F11D7D9E73A22"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In making determinations under this paragraph, the Secretary shall use indicators (such as Rural-Urban Commuting Area codes) at the census tract level to prioritize and maintain eligibility for small, geographically distinct settlements (whether or not incorporated) that are surrounded by an urban area but lack urban services and have a poverty rate of at least 20 percent, including tribal lands and farmworker settlements, to be designated as rural areas.</text></clause> 
<clause id="HFD92E9D6ADBF4EC1B6171AD6CA0DC89D"><enum>(ii)</enum><header>Farmworker settlement</header><text display-inline="yes-display-inline">In this subparagraph, the term <quote>farmworker settlement</quote> means an area in which more than 50 percent of the households derive their primary income from agricultural labor or are headed by an individual who is or recently was employed in agriculture, as verified using American Community Survey data on industry and occupation and local data provided by State or tribal labor agencies.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H826914E7FD794FDB94B4A8D9AAD2F604"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect 180 days after the date of the enactment of this Act.</text></section> 
<section id="H53DBD5F17881474F93635158A1E11EB9"><enum>6.</enum><header>Rulemaking</header> 
<subsection id="H4C468D7ED6414C638BB28C1A27E590DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall prescribe such rules as are necessary with respect to implementing the amendments made by this Act.</text></subsection> <subsection id="H728C007A6CCF446EBE7A73FD48ECAD2A"><enum>(b)</enum><header>Grandfather provision</header><text>A rural area designation made under section 343(a)(13) of the Consolidated Farm and Rural Development Act before the effective date of this Act shall not be changed by reason of any amendment made by this Act, before data from the 2030 decennial census is available.</text></subsection></section>
