A BILL
To amend the Immigration and Nationality Act to limit alien eligibility
for admission and naturalization and enable deportation and
denaturalization for any membership, affiliation, or advocacy of
socialist, communist, Chinese communist, Marxist, or Islamic
fundamentalist doctrines, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Measures Against Marxism's Dangerous
Adherents and Noxious Islamists Act of 2026''.
SEC. 2. LIMITATION ON ALIEN ELIGIBILITY FOR ADMISSION AND
NATURALIZATION.
(a) Immigrant Alien Membership in Totalitarian Party.--Section
212(a)(3)(D) of the Immigration and Nationality Act (8 U.S.C.
1182(a)(3)(D)) is amended--
(1) in the heading, by striking ``Immigrant'' and inserting
``Alien'';
(2) in clause (i)--
(A) by striking ``immigrant'' and inserting
``alien''; and
(B) by striking ``with the Communist or any other
totalitarian party (or subdivision or affiliate
thereof), domestic or foreign,'' and inserting ``with--
``(I) a Chinese communist party,
``(II) a communist party,
``(III) a socialist party,
``(IV) an Islamic fundamentalist
party, or
``(V) or any other totalitarian
party (or subdivision or affiliate
thereof), domestic or foreign,'';
(3) in clause (ii)--
(A) in the heading by striking ``for involuntary
membership'';
(B) by striking ``is or was involuntary, or'';
(C) by striking ``16'' and inserting ``14''; and
(D) by striking ``, by operation of law, or for
purposes of obtaining employment, food rations, or
other essentials of living and whether necessary for
such purposes'';
(4) by striking clauses (iii) and (iv); and
(5) by adding at the end the following:
``(iii) Alien advocacy for socialist,
communist, chinese communist, marxist, or
islamic fundamentalist forms of governments.--
``(I) In general.--Any alien who
advocates or advocated for, or who is
or was affiliated with, any
organization that advocates or
advocated for the economic,
international, or governmental
doctrines of socialism, communism,
Chinese communism, Marxism, or Islamic
fundamentalism is inadmissible.
``(II) Exception.--Subclause (I)
shall not apply to an alien because of
advocacy if the alien establishes to
the satisfaction of the consular
officer when applying for a visa (or to
the satisfaction of the Attorney
General when applying for admission)
that the advocacy is or was solely when
under 14 years of age.
``(iv) Nonreviewability.--Notwithstanding
any other provision of law, any determination
made under this subparagraph shall be final and
shall not be subject to review by any court.''.
(b) Classes of Deportable Aliens.--Section 237(a)(4) of the
Immigration and Nationality Act (8 U.S.C. 1227(a)(4)) is amended by
adding at the end the following:
``(G) Furtherance of socialism, communism, chinese
communist, marxism, or islamic fundamentalism.--
``(i) In general.--Any alien who--
``(I) has engaged, is engaged, or
at any time after admission engages
in--
``(aa) advocacy for
communism, Chinese communism,
socialism, Marxism, or Islamic
fundamentalism;
``(bb) writing,
distributing, circulating,
printing, displaying,
possessing, or publishing any
written, electronic, or printed
matter that advocates for
communism, Chinese communism,
socialism, Marxism, or Islamic
fundamentalism; or
``(cc) writing,
distributing, circulating,
printing, displaying,
possessing, or publishing any
written, electronic, or printed
matter on behalf of or that
advocates for a Chinese
communist party, a communist
party, a socialist party, or an
Islamic fundamentalist party;
or
``(II) has been a member of or
affiliated with, is a member of or
affiliated with, or at any time after
admission becomes a member of or
affiliated with--
``(aa) a Chinese communist
party, a communist party, a
socialist Party, or an Islamic
fundamentalist party; or
``(bb) an organization that
advocates communism, Chinese
communism, socialism, Marxism,
or Islamic fundamentalism, or a
predecessor, successor, or
front for such organization,
is deportable and shall be removed from
the United States.
``(ii) Nonreviewability.--Notwithstanding
any other provision of law, any determination
made under this subparagraph shall be final and
shall not be subject to review by any court.''.
(c) Nationality Through Naturalization.--Section 313 of the
Immigration and Nationality Act (8 U.S.C. 1424) is amended--
(1) in the heading by inserting ``socialist, communist,
chinese communist, marxist, islamic fundamentalist, or'' after
``favor'';
(2) in subsection (a)--
(A) in paragraph (1), by inserting ``or was'' after
``who is'';
(B) by amending paragraph (2) to read as follows:
``(2) who is or was a member of or affiliated with, or who
advocates or advocated for--
``(A) a communist party;
``(B) a socialist party;
``(C) a Chinese communist party;
``(D) an Islamic fundamentalist party;
``(E) any other totalitarian party of the United
States; or
``(F) any organization that advocates or advocated
for, or is or was affiliated with, any party described
in subparagraphs (A) through (E); or'';
(C) in paragraph (3)--
(i) by inserting ``or advocated, or who is
or was a member of or affiliated with any
organization that advocates or advocated,''
after ``, advocates'';
(ii) by striking ``and governmental
doctrines of world communism'' the first place
it appears and inserting ``or governmental
doctrines of world communism, socialism,
communism, Chinese communism, Marxism, Islamic
fundamentalism,'';
(iii) by striking ``or who is a member of
or affiliated with any organization that
advocates the economic, international, and
governmental doctrines of world communism or
the establishment in the United States of a
totalitarian dictatorship,''; and
(iv) by inserting ``, electronic,'' after
``written'';
(D) in paragraph (4), by striking ``advocates or
teaches or who is'' and inserting ``advocates or
advocated, who teaches, or who is or was'';
(E) in paragraph (5)--
(i) by striking ``who writes or publishes
or causes'' and inserting ``who writes or
wrote, who publishes or published, or who
causes or caused'';
(ii) by striking ``knowingly causes'' and
inserting ``knowingly causes or caused'';
(iii) by striking ``has in his'' and
inserting ``has or had in their'';
(iv) by inserting ``, electronic,'' after
``any written'';
(v) by striking ``and governmental
doctrines of world communism'' and inserting
``or governmental doctrines of world communism,
socialism, communism, Chinese communism,
Marxism, or Islamic fundamentalism,''; and
(vi) by inserting ``(F) for a socialist
party, a communist party, a Chinese communist
party, or an Islamic fundamentalist party; or''
after ``dictatorship; or''; and
(F) by amending paragraph (6) to read as follows:
``(6) who is or was a member of, or affiliated with, any
organization that--
``(A) writes, circulates, distributes, prints,
publishes, or displays;
``(B) wrote, circulated, distributed, printed,
published, or displayed;
``(C) causes or caused to be written, circulated,
distributed, printed, published, or displayed; or
``(D) has or had in its possession for the purpose
of circulation, distribution, publication, issue, or
display,
any written, electronic, or printed matter of the character
described in paragraph (5).'';
(3) in subsection (c), by striking ``ten'' and inserting
``20'';
(4) in subsection (d)--
(A) by striking ``is or was involuntary, or'';
(B) by striking ``sixteen'' and inserting ``14'';
and
(C) by striking ``, or that such membership or
affiliation is or was by operation of law, or was for
purposes of obtaining employment, food rations, or
other essentials of living and where necessary for such
purposes'';
(5) by striking subsection (e); and
(6) by adding at the end the following:
``(e) Nonreviewability.--Notwithstanding any other provision of
law, any determination made under this section shall be final and shall
not be subject to review by any court.''.
(d) Revocation of Naturalization.--Section 340(c) of the
Immigration and Nationality Act (8 U.S.C. 1451(c)) is amended--
(1) by striking ``within five years next''; and
(2) by striking ``, in the absence of countervailing
evidence,''.
(e) Definitions.--Section 101(a) of the Immigration and Nationality
Act (8 U.S.C. 1101(a)) is amended by adding at the end the following:
``(53) The term `socialism' means a movement, revolutionary
plan, or transitional phase between a market-driven economic
model and communism or socialism where political power is
sought or used, through violent or other means, by a collective
class or group to--
``(A) restructure or advocate the restructuring of
economic and social relations to reduce class
distinctions;
``(B) establish or advocate government, worker, or
collective control, influence, or ownership over
substantially all production means or asset classes;
``(C) regulate or advocate the regulation of the
fundamentals of market and asset supply, demand, and
functions to make a supreme government or establish
collective control or ownership over substantially all
interests of asset owners, traders, or speculators;
``(D) suppress all threats to a single ruling
political party, organized on a dictatorial basis, with
so close an identity between the policies of such party
and the government policies of the country in which the
party exists that the government and the party
constitute an indistinguishable unit; or
``(E) institute or advocate the economic,
international, or governmental doctrines of Karl Marx
or Friedrich Engels or any member, official, or
revolutionary leader in a socialist party.
``(54) The term `communism' means a movement, revolutionary
plan, or societal structure where political power is sought or
used, though violent or other means, by a collective class or
group to--
``(A) establish or advocate a classless, money-
less, or stateless society;
``(B) restructure or advocate the restructuring of
economic and social relations to abolish class
distinctions;
``(C) assert or advocate state or collective
control over substantially all aspects of political,
cultural, social, or economic life;
``(D) enforce or advocate government, worker, or
collective ownership, influence, or control over
substantially all assets and markets;
``(E) suppress threats to a single ruling political
party, organized on a dictatorial basis, with so close
an identity between the policies of such party and the
government policies of the country in which the party
exists that the government and the party constitute an
indistinguishable unit; or
``(F) institute or advocate the economic,
international, or governmental doctrines of Karl Marx,
Friedrich Engels, or any member, official, or
revolutionary leader in a historic or current communist
party.
``(55) The term `Chinese communism' means a movement,
revolutionary plan, or societal structure, either beholden to
the Chinese government or possessing Chinese communist
characteristics where political power is sought or used,
through violent or other means, by a collective class or group
to--
``(A) establish or advocate a society, culture,
government, or economy with Chinese communist
characteristics;
``(B) require or advocate that companies, cultural
entities, or organizations abide by Chinese communist
party doctrines or dictates;
``(C) assert Chinese communist party control or
influence over substantially all aspects of political,
cultural, social, or economic life;
``(D) enforce or advocate Chinese communist party
ownership, influence, or control over substantially all
assets and markets;
``(E) suppress threats to a Chinese communist
party, organized on a dictatorial basis, with so close
an identity between the policies of such party and the
government policies of the country in which the party
exists that the government and the party constitute an
indistinguishable unit; or
``(F) institute or advocate the economic,
international, or governmental doctrines of Mao Zedong,
Deng Xiaoping, Xi Jinping, or any member, official, or
revolutionary leader in a Chinese communist party.
``(56) The term `Marxism' means a movement, revolutionary
plan, or societal structure, either in a final or transitory
stage, where political power is sought or used, through violent
or other means, by a collective class or group to--
``(A) advocate that human history is primarily
driven by class struggles between those who earn their
living on asset ownership and profits and those who
earn their living off their labor;
``(B) advocate that the foundation of all legal,
political, cultural, societal, and social structures is
class or economic standing and the destruction of such
structures;
``(C) establish or advocate for an atheistic
society or government prohibitions on private religious
practices;
``(D) establish or advocate resource distribution
from each person according to their ability, to each
person according to their needs; or
``(E) institute or advocate the economic,
international, or governmental doctrines of Karl Marx,
Friedrich Engels, or any member, official, or
revolutionary leader in a socialist, communist, or
Chinese communist party.
``(57) The term `Islamic fundamentalism' means a movement
to promote or achieve an Islamic society or enforce Islamic
values where legal, religious, military, social, cultural,
academic, or political power is sought or used to--
``(A) advocate or impose Islam as the state
sanctioned religion of the United States;
``(B) advocate or enforce Islamic political, legal,
military, social, cultural, or academic authority based
upon or enforcing Sharia law in any setting;
``(C) advocate, justify, or employ militant jihad;
``(D) advocate or enact the destruction of
Christian, Jewish, or other religious communities,
churches, synagogues, temples, historical sites,
relics, literature, property, organizations, or
members; or
``(E) advocate or justify the destruction of
western civilization, including the economic,
international, or governmental doctrines of capitalism,
constitutionalism, republicanism, or liberalism.
``(58) The term `communist party' includes--
``(A) the Communist Party of the United States, or
any section, subsidiary, branch, affiliate, or
subdivision of such party;
``(B) the Communist Political Association, or any
section, subsidiary, branch, affiliate, or subdivision
of such association;
``(C) the Communist Party of any State, foreign
state, or political or geographical subdivision of such
foreign state, or any section, subsidiary, branch,
affiliate, or subdivision of any such party;
``(D) the direct predecessors or successors of the
associations and parties described in subparagraphs
(A), (B), and (C), regardless of what name such
predecessor or successor may have used, may now bear,
or may adopt; and
``(E) any communist-action or communist-front
organization.
``(59) The term `socialist party' includes--
``(A) the Socialist Party of the United States, or
any section, subsidiary, branch, affiliate, or
subdivision of such party;
``(B) the Democratic Socialists of America, or any
section, subsidiary, branch, affiliate, or subdivision
of such organization;
``(C) the Socialist Party of any State, foreign
state, or political or geographical subdivision of such
foreign state, or any section, subsidiary, branch,
affiliate, or subdivision of any such party;
``(D) the direct predecessors or successors of the
parties described in subparagraphs (A), (B), and (C),
regardless of what name such predecessor or successor
may have used, may now bear, or may adopt; and
``(E) any socialist-action or socialist-front
organization.
``(60) The term `Chinese communist party' includes--
``(A) the Communist Party of China;
``(B) the Revolutionary Committee of the Chinese
Kuomintang;
``(C) the China Democratic League;
``(D) the China National Democratic Construction
Association;
``(E) the China Association for Promoting
Democracy;
``(F) the Chinese Peasants and Workers Democratic
Party;
``(G) the China Zhi Gong Party;
``(H) the Jiusan Society;
``(I) the Taiwan Democratic Self-Government League;
``(J) the United Front Work Department;
``(K) any section, subsidiary, branch, affiliate,
or subdivision of any party described in subparagraphs
(A) through (J);
``(L) the direct predecessors or successors of any
party described in subparagraphs (A) through (J),
regardless of what name such group or organization may
have used, may now bear, or may adopt; and
``(M) any Chinese communist-action or Chinese
communist-front organization.
``(61) The term `Islamic fundamentalist party' includes--
``(A) the Muslim Brotherhood;
``(B) the Islamic State;
``(C) the Al-Nour Party;
``(D) Hamas;
``(E) Hezbollah;
``(F) Hizb ut Tahrir;
``(G) Boko Haram;
``(H) Al-Shabaab;
``(I) any political, legal, militant, social,
cultural, or academic organization that seeks to
implement Sharia law as a contractual or binding basis
in any setting;
``(J) any political, legal, religious, militant,
social, cultural, or academic organization that
advocates, promotes, or justifies the use of militant
jihad;
``(K) any section, subsidiary, branch, affiliate,
or subdivision of any party or organization described
in subparagraphs (A) through (J);
``(L) the direct predecessors or successors of any
party or organization described in subparagraphs (A)
through (J), regardless of what name such party or
organization may have used, may now bear, or may adopt;
and
``(M) any Islamic fundamentalist-action or Islamic
fundamentalist-front organization.
``(62) The term `Sharia law' means any system of
adjudication or contract enforcement, whether governmental or
private, rationalized or proscribed, on the basis of Qur'anic,
Sunnahic, ijma'ic, or qiyasic precedent, text, or reasoning.
``(63) The term `militant jihad' means the use of force,
coercion, violence, or terror to--
``(A) enforce Islamic values or Sharia law;
``(B) enforce conversions to Islam;
``(C) achieve an Islamic political goal; or
``(D) establish Islam as the state religion.''.
(f) Regulations.--The Attorney General shall issue regulations as
necessary to carry out the amendments made by this Act.
(g) Severability.--If any provision of this Act, an amendment made
by this Act, or the application thereof to any person or circumstance,
is held invalid, the remainder of the Act or an amendment made by this
Act, or the application thereof to any person or circumstance shall not
be affected.
