<section id="HA0A83E37614248C184E3D0F5CA7268AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Monitor Accountability Act</short-title></quote>.</text></section> <section id="HF0D0383295EA4414914D4D15F7A605D2"><enum>2.</enum><header>Conditions on the appointment of monitors by courts</header> <subsection id="H3B8539EF030542C8A985859970B90A3B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the effective date of this section, the Judicial Conference of the United States shall by rule establish conditions on the appointment by a district court of the United States of any person charged, pursuant to a court order, with monitoring the conduct of a State or unit of local government. Such conditions shall include the following:</text>
<paragraph id="H57FD0A86AF38414489D6F85856D69015"><enum>(1)</enum><header>Fees</header><text>Such person—</text> <subparagraph id="H53271C9EEB43450493D6E6BF3DF4F896"><enum>(A)</enum><text display-inline="yes-display-inline">may not assess a fee in excess of such maximum rates as the Judicial Conference of the United States may establish; and</text></subparagraph>
<subparagraph id="H760A63F66E0E477EA53CC876D2BFF54F"><enum>(B)</enum><text display-inline="yes-display-inline">shall be authorized to employ the use of pro bono time or reduced rates.</text></subparagraph></paragraph> <paragraph id="HE29004B9687D423483AC41A06C1BC469"><enum>(2)</enum><header>Exclusivity and term</header><text>Such person may not be—</text>
<subparagraph id="HCBE2A1E68DBA4FA68B0DCE8828301227"><enum>(A)</enum><text>appointed to more than one such monitorship at a time;</text></subparagraph> <subparagraph id="H3F8F276963D4440F96C34147A6BB9F7F"><enum>(B)</enum><text>appointed for a term greater than 5 years; or</text></subparagraph>
<subparagraph id="H39DDF1203CF7484C8246062C5C6D731B"><enum>(C)</enum><text>reappointed after the expiration of such term pursuant to the same court order.</text></subparagraph></paragraph> <paragraph id="H7DE79B52021649F992FAE0C285CB4164"><enum>(3)</enum><header>Subsequent monitors</header><text>A monitor who is appointed to a monitorship after the expiration of the term of a monitor who served pursuant to the same court order may not be employed by the same employer as the previous monitor.</text></paragraph>
<paragraph id="H4A562406B7BE46C6B89A6BE06FD7C9A0"><enum>(4)</enum><header>Public comment</header><text>Prior to the appointment of a monitor, the court shall provide notice of the person to be appointed and afford the public an opportunity for comment thereon.</text></paragraph> <paragraph id="HE320AD6F7D5C43BA99CDD9B98268C38A"><enum>(5)</enum><header>Termination</header> <subparagraph id="H365282E6C65D4FABB0934D94D44F6EFC"><enum>(A)</enum><header>Revision</header><text display-inline="yes-display-inline">In the case that a court, a party, or a monitor seeks to revise a monitorship imposed by a court order, the court shall conduct a hearing.</text></subparagraph>
<subparagraph id="H4C16467E6AD44166A737CD42346CA4F2"><enum>(B)</enum><header>Scope of monitorship</header><text>The court may only revise a requirement of a monitorship with respect to which the subject of the monitorship has not attained substantial and sustained compliance.</text></subparagraph></paragraph></subsection> <subsection id="HFB9ADE080EBA4A75A36CE7A36FDF4E8C"><enum>(b)</enum><header>Transfer</header><text>On the date that is 6 years after the court order imposing a monitorship, if such monitorship is in effect on such date, the case shall be transferred to another judge in the district in which the case is pending.</text></subsection>
<subsection id="H94B110FEA7AF48D1B81FB330069CBCDC"><enum>(c)</enum><header>Accounting</header>
<paragraph id="HC9AE8F1B376E45118209F088F4F30D59"><enum>(1)</enum><header>In general</header><text>On an annual basis, a monitor shall submit to the court imposing the monitorship an accounting, which shall include—</text> <subparagraph id="H29FC12EDDD0D4947A4071633B360A265"><enum>(A)</enum><text display-inline="yes-display-inline">information on the services provided and the fee charged for such services; and</text></subparagraph>
<subparagraph id="H62641BFE4E694D2BB28E0CD2B614184B"><enum>(B)</enum><text display-inline="yes-display-inline">whether any such services were provided pro bono or at a reduced rate.</text></subparagraph></paragraph> <paragraph id="H783BCEF0827C4C1BA6F01B0ABA4CF2BC"><enum>(2)</enum><header>Publication</header><text>The court shall make available to the public any accounting submitted to the court under paragraph (1).</text></paragraph></subsection>
<subsection id="HF7893C97D57F49828FDB7F8BDD8E97F9"><enum>(d)</enum><header>Retroactivity</header><text display-inline="yes-display-inline">In the case of a monitorship that is in effect on the date of enactment of this Act and has been in effect for 6 years—</text> <paragraph id="H90B9CF54140944E88591D941ED3151E4"><enum>(1)</enum><text>a new monitor shall be appointed not later than 180 days after such date of enactment in accordance with the limitations under this section; and</text></paragraph>
<paragraph id="HAB5BBEA407144FF08052AA6145D1BC73"><enum>(2)</enum><text>the case shall be transferred not later than 1 year after such date of enactment in accordance with this section.</text></paragraph></subsection> <subsection id="HBEA1E6A7429D4AC6AC527693FDA88D2A"><enum>(e)</enum><header>Sense of Congress</header><text>It is the sense of Congress that monitoring is a public service and monitorships should be structured to encourage the use of pro bono time or reduced rates. </text></subsection></section>
