    <official-title display="yes">To establish a task force to address the impacts of the chemical
      6PPD and its by-product 6PPD-Q on coho salmon and the environment and to promote research and
      funding opportunities for an alternative to the chemical 6PPD, and for other
      purposes.</official-title></form><legis-body id="HB741A16D1E554EC69F8E6DF099A3B49D" style="OLC"> 
<section id="HB41230CA7D334FC0B2EAE532D86BA3C8" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>6PPD Task Force Act</short-title></quote>.</text></section> 
<section id="H4E6F7329A0C64B20880C4EF4290FEEF9" section-type="subsequent-section" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="H8BA9FDE316164BAC86A85B183F4C16F9" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">6PPD is defined as the chemical compound N-(1,3-dimethylbutyl)-N'- 11 phenyl-p-phenylenediamine.</text></paragraph> 
<paragraph id="HA82807E438574AD683E74173C31D34BE" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">6PPD is a chemical commonly used in all motor vehicle tires, military vehicle tires, and aircraft tires, contributing to passenger safety by preventing tires from degrading quickly and ensuring their durability.</text></paragraph> <paragraph id="H644CD9CF30044A6CBF9FF2C119055614" commented="no"> <enum>(3)</enum> <text display-inline="yes-display-inline">As 6PPD in tires reacts with oxygen or ozone in the environment, it breaks down and transforms into compounds, including 6PPD- Stormwater runoff may cause tire and road wear particles containing 6PPD-Q to wash into streams, rivers, and other bodies of water that are habitats for aquatic species, such as Pacific salmon.</text>
      </paragraph> 
<paragraph id="HB4E1EB264C064617850DD891B6A559CC" commented="no">
        <enum>(4)</enum>
 <text display-inline="yes-display-inline">6PPD-from stormwater runoff is acutely toxic to adult and juvenile coho salmon (Oncorhynchus kisutch).</text>
      </paragraph> 
<paragraph id="H874E2D5845894734A4C7DBA55A564080" commented="no">
        <enum>(5)</enum>
 <text display-inline="yes-display-inline">Private-sector efforts in the United States exist to develop potential alternatives to 6PPD that will not transform into 6PPD-and enter into waterways, leading to coho salmon mortality, and will not harm other wildlife species or people, while also prioritizing motor vehicle passenger safety and environmental impacts.</text>
      </paragraph> 
<paragraph id="H23EFAD85A7324D3986D9EDC82E2FF457" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">Finding a 6PPD alternative has national security, domestic supply chain, and environmental and human health implications and must be addressed in a timely manner.</text></paragraph> <paragraph id="H917FB9C946A24BBBBBAB741842FA2E72" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">Efforts to replace 6PPD must ensure continued compliance with vehicle safety and performance standards critical to passenger and public safety.</text></paragraph> </section> 
<section id="HC40C25E7AFA64459B30AD6451F4323DD"><enum>3.</enum><header>Establishment of 6PPD Task force</header> 
<subsection id="H7AEDF4313BE8455FA1FC9AC4C0854599" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Transportation, in consultation with the Administrator of the Environmental Protection Agency, shall, to the extent practicable, enter into an agreement with the National Academy of Sciences through which the Academy shall establish a task force to be known as the <quote>6PPD Task Force</quote> (in this Act referred to as the <quote>Task Force</quote>).</text></subsection> <subsection id="HA8CDCD8E1E9C46FAADB523D11CD6F61F" commented="no"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The Task Force shall—</text> 
<paragraph id="HED91AE833A56414AB644CF192B4B28D8" commented="no"><enum>(1)</enum><text>improve data and information sharing for research into an alternative to 6PPD among Federal agencies, research institutions, and State, Tribal, and local governments for the purpose of—</text> <subparagraph id="HCD07E9C8A8794E3F81839C42B7FAB251"><enum>(A)</enum><text>identifying the potential impacts of 6PPD on coho salmon, other aquatic species, human health, and the environment; and</text></subparagraph> 
<subparagraph id="HE7BF9E146B1A453CB458FF0DAF3CCF40">
                        <enum>(B)</enum>
 <text>mitigating the adverse effects of 6PPD on water quality, human health, and the environment;</text>
                    </subparagraph></paragraph> 
<paragraph id="HCBDC4666B61E469886B5D4F14078E17C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">identify and recommend Federal funding opportunities to researchers, institutions of higher education, State governments, Tribal governments, local governments, tire manufacturers, chemical suppliers, tire additive manufacturers, and other entities to—</text> <subparagraph id="H403D584DE59F4409ACDECB64FB99C2F3"> <enum>(A)</enum> <text>study the potential impacts of 6PPD, related compounds, and their degradation products, including 6PPD-, on Pacific salmon, other economically or ecologically valuable aquatic species, and human health; and</text>
          </subparagraph> 
<subparagraph id="H0EE9758B18B24FE08AA40003444AAE20"><enum>(B)</enum><text display-inline="yes-display-inline">develop an alternative chemical to 6PPD, including scientific validation and scale-up activities to commercialize 6PPD alternatives;</text> </subparagraph></paragraph> <paragraph id="H3B54700E60F2490D998513485A36AE9E" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">identify and provide—</text> 
<subparagraph id="HC231D20BC0C142D1809D5F8A70C221A0" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">recommendations for expediting the identification, toxicity, and performance testing of safer alternatives to 6PPD; and</text></subparagraph> <subparagraph id="HBA9C3E6CADCD4E92A8A4E905519C9250" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">opportunities to encourage the adoption of safer alternatives to 6PPD in tires available on the market;</text></subparagraph></paragraph> 
<paragraph id="H6B999387E79549B1B2B243D34E5CE944" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">share with Federal agencies, research institutions, and State, Tribal, and local governments best practices, techniques, methodologies, and cost estimates for 6PPD mitigation efforts, including street sweeping and stormwater runoff treatment;</text></paragraph> <paragraph id="H0A87146BDF594D81A36002846B7D03E9" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">identify and provide research to Federal agencies, research institutions, and State, Tribal, and local governments regarding pathways not related to motor vehicle tires through which 6PPD exposure occurs, including exposure to 6PPD through—</text> 
<subparagraph id="HE35818EF2022484895EAC8685492F44C" commented="no"><enum>(A)</enum><text>reuse of tires, including artificial turf;</text></subparagraph> <subparagraph id="H7B00EA2C07E94E0CB5EB89B02FF204D7" commented="no"><enum>(B)</enum><text>playground materials;</text></subparagraph> 
<subparagraph id="HB56B96C00D4E42EEA06412F8FE89816E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">artificial reefs;</text></subparagraph> <subparagraph id="HEEBEED5C3C1E41C9AE900F779C56B797" commented="no"><enum>(D)</enum><text>underwater tire piles; and</text></subparagraph> 
<subparagraph id="HD8884B639CDA431EBE4CB936A2FBF922" commented="no"><enum>(E)</enum><text>other rubber materials; and</text></subparagraph></paragraph> <paragraph id="H048E6A099DB6438BA43EC6786953DE22" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">share funding information, technical assistance, yearly reports, and resources in an online repository accessible to—</text> 
<subparagraph id="H28CB916BBE274F5E97C9A1E5F4ACBC07" commented="no"><enum>(A)</enum><text>Tribes;</text></subparagraph> <subparagraph id="H08E11E30BF474668B84988E806856646" commented="no"><enum>(B)</enum><text>State departments of transportation;</text></subparagraph> 
<subparagraph id="H375278E6590B4EAE8CF218A5DF42924D" commented="no"><enum>(C)</enum><text>metropolitan planning organizations;</text></subparagraph> <subparagraph id="H9DD04FD9493D46528EE243D378BE953C" commented="no"><enum>(D)</enum><text>State and local governments;</text></subparagraph> 
<subparagraph id="HECC5F5783DAD41A38E4DDFE1C1566D3E" commented="no"><enum>(E)</enum><text>tire manufacturers;</text></subparagraph> <subparagraph id="H03E58B90D18B4BA1A4145384E3737643" commented="no"><enum>(F)</enum><text>chemical suppliers;</text></subparagraph> 
<subparagraph id="H39EE2D40E4C441A78563CDDBC14513FA" commented="no"><enum>(G)</enum><text>tire additive manufacturers;</text></subparagraph> <subparagraph id="H6608E86592E64924BEA74E5C2BDB4CA3" commented="no"><enum>(H)</enum><text>institutions of higher education; and</text></subparagraph> 
<subparagraph id="H0069F822D54F422D87BA25978929AC38" commented="no"><enum>(I)</enum><text>the public.</text></subparagraph></paragraph></subsection> <subsection id="H6CB7553917254C4596AC0B54F3C9BC30" commented="no"><enum>(c)</enum><header>Membership</header><text display-inline="yes-display-inline">The Task Force shall be composed of the following members:</text> 
<paragraph id="H2FA67684FB334C79885A6C23FC954C6E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">A designee of the Secretary of Transportation.</text></paragraph> <paragraph id="HD67D97937C0941A8BDDF282235DA4FEE" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A designee of the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="H354AF85788554D5690179197C3A4FB7D" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">A designee of the Secretary of Agriculture.</text></paragraph> <paragraph id="H063C5F2C9C9F4E30A29B588D897DF44E" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">A designee of the Director of the United States Geological Survey.</text></paragraph> 
<paragraph id="HD99E27A6CFDF410FA5F0481502717286" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">A designee of the Director of the United States Fish and Wildlife Service.</text></paragraph> <paragraph id="H4B958732128F4B25ACDE2A4859E6952B" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">A designee of the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph> 
<paragraph id="HCEE3DF1807004998806E61EE194ECE6A" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">A designee of the Director of the National Institutes of Health.</text></paragraph> <paragraph id="HFE0C7A170C3448FFA9FB07FACCF1BE32" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">A designee of the Director of the Centers for Disease Control and Prevention.</text></paragraph> 
<paragraph id="HCC7F593FFC794D69A776B2905EFB5230" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">Not less than four representatives from Tribal governments located on the western coast of the United States with current knowledge of 6PPD impacts on coho salmon appointed by the National Academy Sciences with consideration given to differences in regional perspectives and experience.</text></paragraph> <paragraph id="H04E126F883FB4FC69900A54EF33B8FF0" commented="no"><enum>(10)</enum><text display-inline="yes-display-inline">Not less than four representatives from the private sector appointed by the National Academy of Sciences, including—</text> 
<subparagraph id="H4D97D35639A04FD1A6B04935AA5FA498" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">two representatives from the tire manufacturing industry; and</text></subparagraph> <subparagraph id="H783C39F77E0B47E69C13C477664F640C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">two representatives from the tire chemical additive manufacturing industry.</text></subparagraph></paragraph> 
<paragraph id="H2FB223893F844C6890A84377FC718169" commented="no"><enum>(11)</enum><text display-inline="yes-display-inline">Not less than one representative from the environmental community appointed by the National Academy of Sciences.</text></paragraph> <paragraph id="HEC777679221D43AFAF57A6214BD88D48" commented="no"><enum>(12)</enum><text display-inline="yes-display-inline">Not less than two representatives, at least two of whom should be from different States, with expertise in environmental and public health from State government agencies with active 6PPD mitigation programs or that have documented 6PPD runoff impacts on aquatic species appointed by the National Academy of Sciences.</text></paragraph> 
<paragraph id="HD5FFA8CFDBB540E39627932FD7CA6D7A" commented="no"><enum>(13)</enum><text display-inline="yes-display-inline">Not less than one representative from a university research institution with experience researching 6PPD and aquatic toxicology appointed by the National Academy of Sciences.</text> </paragraph> </subsection> <subsection id="HF9F747D841F74CC49C118E8E3119E09D"><enum>(d)</enum><header>Co-Chairs</header><text display-inline="yes-display-inline">The members described in paragraphs (1) and (2) of subsection (c) shall serve as the Co-Chairs of the Task Force.</text></subsection> 
<subsection id="HE10F85BB1D1A4A6EADE0B477E5D9186E" commented="no"><enum>(e)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Task Force shall meet not less than three times annually.</text></subsection> <subsection id="HEBBFAEDC0D9C4B09B0BBDFF41DB46A9B"><enum>(f)</enum><header>Inapplicability of the Federal Advisory Committee Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>), shall not apply to the Task Force.</text></subsection> 
<subsection id="HC0686F50F5764A41AB721E7774022761"><enum>(g)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Task Force shall submit to the Committees on Transportation and Infrastructure and Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate and make publicly available a report that includes—</text> <paragraph id="HBC816964552843B08E8871EC06E1FABA"><enum>(1)</enum><text>findings and recommendations of the Task Force; and</text></paragraph> 
<paragraph id="H305774D7E7754CC697CBD732CDA23656"><enum>(2)</enum><text>a list of stakeholders and industry experts consulted by the Task Force.</text></paragraph></subsection> <subsection id="H5424895E6F5C46CEA144891E1D32B745"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0E4742A127394F3C88D60DD483287F8C"><enum>(1)</enum><header>6PPD</header><text display-inline="yes-display-inline">The term <quote>6PPD</quote> means the chemical compound N-(1,3-dimethylbutyl)-N’- 11 phenyl-p-phenylenediamine.</text></paragraph> <paragraph id="H09EE804F4AC04E19ACD1A1FBB4748ED9"> <enum>(2)</enum> <header>6PPD-Q</header> <text>The term <quote>6PPD-Q</quote> means 6PPD-quinone.</text>
