<section id="H97B29032F8634442886D81F62A88C624" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinforcing Underserved, Rural, and Local Healthcare Act</short-title></quote> or the <quote><short-title>RURAL Healthcare Act</short-title></quote>.</text></section> <section id="HD1AB791780394518BEFBBB2C4721B085"><enum>2.</enum><header>Classification of qualified locum tenens professionals and advanced care practitioners as independent contractors under Fair Labor Standards Act of 1938 and National Labor Relations Act</header> <subsection id="HDAFAF39E0D404AF49A4B8CABD6DC6C6A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of the following Federal laws, an individual who is a qualified locum tenens professional or advanced care practitioner shall not be considered an employee of the entity on behalf of which the individual furnishes physician or advanced care practitioner services on a temporary basis, whether or not provided as a substitute for another provider:</text> 
<paragraph id="H2E66E0A28FB2448688D7E4199F2DDE53"><enum>(1)</enum><text display-inline="yes-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>).</text></paragraph> <paragraph id="H00B2443D9EC44270951145B6FBAE24B3"><enum>(2)</enum><text>The National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="HC0D7E499C4C14C4AA93359D68E5430F5"><enum>(b)</enum><header>Qualified locum tenens professional or advanced care practitioner defined</header><text>In this section, the term <term>qualified locum tenens professional or advanced care practitioner</term> means an individual who—</text> <paragraph id="H184149EBCE974925959CA28D279C7193"><enum>(1)</enum><text>provides temporary physician or advanced care practitioner services, including for workforce coverage, scheduling flexibility, or episodic staffing needs—</text> 
<subparagraph id="H0FC4A43963604C4FB6848935F3D62F4E"><enum>(A)</enum><text>for a period of not more than one continuous year at a single site of service; and</text></subparagraph> <subparagraph id="H9D473AB7B00D418C89422C0B05C3AC1F"><enum>(B)</enum><text display-inline="yes-display-inline">pursuant to a written contract providing that the individual will not be treated as an employee with respect to such services; and</text></subparagraph></paragraph> 
<paragraph id="H1B267C57F9BD4F1F8A6760EB4A5458B8"><enum>(2)</enum><text>is—</text> <subparagraph id="H900B3734A229429284372493083FD637"><enum>(A)</enum><text>a physician, as defined in—</text> 
<clause id="H4CA9E9B47A854475A3F7A6050DD640D7"><enum>(i)</enum><text>section 1861(r) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)</external-xref>); or</text></clause> <clause id="HC0290B6206384C7BA12476843D4C4377"><enum>(ii)</enum><text>section 8101(2) of title 5, United States Code; or</text></clause></subparagraph> 
<subparagraph id="H30DC0D5D2AA949E08E1EA119382AD341"><enum>(B)</enum><text display-inline="yes-display-inline">a nurse practitioner, physician’s assistant, or certified registered nurse anesthetist.</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
