<subsection commented="no" display-inline="no-display-inline" id="H8B95FB534BE04A58808CED8B013352CE"><enum>(a)</enum><header display-inline="yes-display-inline">Video programming accessibility definitions</header><text display-inline="yes-display-inline">Section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HC3FA4000EBB44EB788E3CF56C48CB54A"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (a);</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAD81651DA07C4137AEFF8ACF49154D83"><enum>(2)</enum><text display-inline="yes-display-inline">by moving subsection (a), as so redesignated, so that it appears immediately before subsection (b); and</text></paragraph> <paragraph id="H64C563250A054A58833A491040450E41"><enum>(3)</enum><text>in subsection (a), as so redesignated—</text>

<subparagraph commented="no" display-inline="no-display-inline" id="HB0D79626AA3247499C95629095184528"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H1EB7BB07FF2142F18C570F5FF0ADEE8C"> <paragraph id="H2447CE535D02487BBA69E526326120CB"><enum>(2)</enum><header>Live programming</header><text>The term <term>live programming</term> has the meaning given the term in section 79.1 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph>
<paragraph id="H8F417BD866374BF490DA3E69BED0E039"><enum>(3)</enum><header>Near-live programming</header><text>The term <term>near-live programming</term> has the meaning given the term in section 79.1 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H554588863257451DAF189C62B2FE313B"> <enum>(4)</enum> <header>Online video programming</header> <text>The term <term>online video programming</term> means video programming delivered using Internet protocol or any successor protocol.</text>
                </paragraph>
<paragraph id="HE78079D58534464F8386D295189DD7E7"><enum>(5)</enum><header>Prerecorded programming</header><text>The term <term>prerecorded programming</term> has the meaning given the term in section 79.1 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HEAF6D4AB395A40308A64D47BD168B46E"><enum>(6)</enum><header>Video programming</header><text>The term <term>video programming</term>—</text>
<subparagraph commented="no" display-inline="no-display-inline"
                    id="H0AE06D6E03124560ACFD14D2BC7360E1">
                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">means programming by, or generally considered comparable to programming provided by, a television broadcast station or nonbroadcast network, including programming delivered using Internet protocol or any successor protocol;</text>
                  </subparagraph>
<subparagraph id="H01D015D607F84872AEACA369465D9FAE"><enum>(B)</enum><text>includes—</text> <clause id="HE93F5B0376F444D3BB67052863F675A5"><enum>(i)</enum><text>programming provided on demand at the request of a viewer; and</text></clause>
<clause id="HB3A16F4CA7B048058413ACF899DB4F72"><enum>(ii)</enum><text>programming streamed live or at a prescribed time or times to all or a subset of viewers; and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4A41305869434DCDA8BA68CAB2F2064A"><enum>(C)</enum><text display-inline="yes-display-inline">does not include consumer generated media.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="HD40FEDDD85F2453D919EC820C3038F3B"><enum>(b)</enum><header>Disability</header><text>In this Act, the term <term>disability</term> has the meaning given the term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></subsection></section> <section id="H3DE288425F254038984C35803E88E61E"><enum>102.</enum><header>Closed captioning</header><text display-inline="no-display-inline">Section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>) is amended—</text>
<paragraph id="H744FE07DE5054738BD0DBA74368E711C"><enum>(1)</enum><text>by redesignating subsections (d) through (g) as subsections (e) through (h), respectively;</text></paragraph> <paragraph id="HCFCE3FEF6DA34913BBDEFFAEE6A2CD3A"><enum>(2)</enum><text>in subsection (c)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H9428EE09D6754BF595CDBF46E40D8DB8"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text style="OLC" level="subsection">Deadlines</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Requirements</header-in-text></quote>;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE997895FA9104B6C9B55F6AB35EFD6DB"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1), in the heading, by striking <quote><header-in-text style="OLC" level="paragraph">In general</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Deadlines for television programming captions</header-in-text></quote>; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1AF1556A539E4B679A5808E112EFD49A"><enum>(C)</enum><text display-inline="yes-display-inline">by striking paragraphs (2) and (3) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H01DDE3A664FB4C5D85F8EBA4C9F59076"> <paragraph id="H97FBDE4EF76C4C22A00E558E37806818"><enum>(2)</enum><header>Closed captioning regulations for online video programming and consumer generated media</header> <subparagraph id="H93A0DF1F2F3D4D1BA02E8BA0D29C227B"><enum>(A)</enum><header>Closed captioning regulations for new online video programming</header><text>Not later than 12 months after the date of submission of the recommendations to the Commission under section 106(d)(1) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall revise its regulations, taking into account those recommendations, to require all online video programming that is first made available on or after the effective date of the revised regulations to be fully accessible through the provision, receipt, and display of closed captioning, except as provided in subsection (e).</text></subparagraph>
<subparagraph id="H708174079F834838AE011B753E34ABD4"><enum>(B)</enum><header>Schedule</header><text>The regulations revised under subparagraph (A) shall include an appropriate schedule of deadlines, the earliest of which shall be not less than 2 years after the effective date of the revised regulations and the latest of which shall be not more than 6 years after that effective date, for the provision, receipt, and display of closed captioning on online video programming that is first made available on or after the effective date of the revised regulations.</text></subparagraph> <subparagraph id="H7BFEFAEAE8724D65ACA8B8D832B84D13"><enum>(C)</enum><header>Requirements for regulations</header><text>The regulations revised under subparagraph (A)—</text>
<clause id="H4280B7F355144A02AA188E35B6935B9E"><enum>(i)</enum><text>shall ensure that English-language and Spanish-language online video programming that is first made available on or after the effective date of the revised regulations is fully accessible through the provision, receipt, and display of closed captions in the original language of the audio track of the programming;</text></clause> <clause id="HCFF3B766BC12490883CBC45CD981E04B"><enum>(ii)</enum><text>shall define the categories of entities involved in the delivery of online video programming and apportion the responsibilities for the provision, quality, pass-through, and rendering of closed captions among such entities to ensure that closed caption data—</text>
<subclause commented="no" display-inline="no-display-inline" id="H4B3F24ECF818465AB3378F9036EED6A2"><enum>(I)</enum><text display-inline="yes-display-inline">remains with the video programming to which the data is added; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HF31EE9533F484430BB20CB9BDEDCB50D"><enum>(II)</enum><text display-inline="yes-display-inline">is distributed in common formats so that closed captions can be exhibited intact by all other entities that subsequently make the programming available to viewers;</text></subclause></clause>
<clause id="H96074F6D8D82415FADD7835E0B49DC8C"><enum>(iii)</enum><text>may not distinguish between full-length programming and video clips; and</text></clause> <clause id="H4B85D9DEBAE744ACB3414BA6A214F44A"><enum>(iv)</enum><text>for the purposes of determining closed captioning obligations under this section and assessing compliance with regulations of the Commission governing the quality of closed captioning, including under section 79.1 of title 47, Code of Federal Regulations, shall treat any video programming that was live programming or near-live programming at the time that it was initially made available to viewers as prerecorded programming if it is again made available to viewers more than 48 hours after its initial availability.</text></clause></subparagraph>
<subparagraph id="HC87F47B7AA1447708108E7CCC2656667"><enum>(D)</enum><header>Closed captioning regulations for older online video programming and on consumer generated media</header>
<clause id="HD1B2EF323E364B80846E6F39C98FEBC6"><enum>(i)</enum><header>In general</header><text>Not later than 12 months after the date of submission of the recommendations to the Commission under section 106(d)(1) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall prescribe regulations, taking into account those recommendations, to maximize, through the provision, receipt, and performance of closed captioning, the accessibility of—</text> <subclause id="H0FD949E3555540D4AF9CAB6E365821F9"><enum>(I)</enum><text>online video programming that was first made available before the effective date of the revised regulations under subparagraph (A) of this paragraph; and</text></subclause>
<subclause id="H30385825EF174A93B7D58D3646D595E7"><enum>(II)</enum><text>consumer generated media.</text></subclause></clause> <clause id="H352E7290866F4A4FBE5D611DE3C8D845"><enum>(ii)</enum><header>Requirement for consumer generated media</header><text>In prescribing regulations for consumer generated media under clause (i)(II), the Commission shall require that an entity engaged in making available consumer generated media, whether or not the entity is also engaged in making available video that is not consumer generated media, provides—</text>
<subclause id="HD6A4C08367CD493EABC228AF807C2F93"><enum>(I)</enum><text>authoring tools that permit users who post videos on the entity’s platform to add closed captions;</text></subclause> <subclause id="HC89DE758AE7341D98D6362383EC1572C"><enum>(II)</enum><text>timely and effective notice, at or before the time of upload, to users who post videos on the entity’s platform that such authoring tools are available for videos; and</text></subclause>
<subclause id="H8F576893707E4857BFB9E2A1E3DD7B0D"><enum>(III)</enum><text>guidance on how to use such authoring tools.</text></subclause></clause></subparagraph> <subparagraph id="HBE2CFE5D69424FF5B626A38720F1FD2A"> <enum>(E)</enum> <header>Relation to previous requirements</header> <text>The regulations revised or prescribed under subparagraphs (A) and (D) may not impair or preclude the applicability of, compliance with, or the enforcement of the requirements under this section or the regulations prescribed thereunder that were in effect on the day before the date of enactment of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, including the requirement to provide closed captioning on video programming that is published or exhibited on television and subsequently delivered using Internet protocol or any successor protocol.</text>
                </subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H0039AE7C5A324268B65227178B7F349B"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H570164629DC0490E9127E3ADA73B8747"> <subsection id="H399625BBFB584ECC9547C92C99CB4A2F"><enum>(d)</enum><header>Caption quality updates</header> <paragraph id="H9C81042B9E74402DBFC2F4B53686A2C9"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of submission of the recommendations to the Commission under section 106(d)(1) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall prescribe regulations, taking into account those recommendations, that extend the requirements for the quality of closed captions under section 79.1 of title 47, Code of Federal Regulations, or any successor regulations, to all online video programming and consumer generated media for which closed captioning is required to be provided under subsection (c) or the regulations prescribed thereunder.</text></paragraph>
<paragraph id="HB1BEE444B4A34DA3993F153ABBF282CE"><enum>(2)</enum><header>Regular updates</header><text>Not later than 4 years after the date of enactment of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, and every 4 years thereafter, the Commission shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H96ED5538783548FBA7E43ACA82EDA4D4"><enum>(A)</enum><text display-inline="yes-display-inline">review its regulations and associated deadlines pertaining to the quality of closed captions; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF62A2455169848C18A39AA869EB205DA"><enum>(B)</enum><text display-inline="yes-display-inline">as necessary, update the regulations and associated deadlines described in subparagraph (A) to reflect technological and methodological advances.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HDBCEC0F892C44630ACEB2A95E6F3FA4C"><enum>(4)</enum><text>in subsection (e), as so redesignated—</text>
<subparagraph id="HBC07473DFBAA43B3B8790EA88E0C25AC"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>subsection (b)</quote> and inserting <quote>subsections (b) and (c)</quote>; and</text></subparagraph> <subparagraph id="HB46177C5A8C84C5CADAE1D0499848E8D"><enum>(B)</enum><text>in paragraph (1), by striking <quote>provider or owner of such programming</quote> and inserting <quote>entity responsible for publishing, exhibiting, or making available such programming.</quote>.</text></subparagraph></paragraph></section>
<section id="HC483C7C3522049BC9FF3A426C65E119F"><enum>103.</enum><header>Audio description</header>
<subsection id="H97D1E9900B2749D1B142A9CEE706B300"><enum>(a)</enum><header>In general</header><text>Subsection (g) of section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>), as redesignated by section 102, is amended—</text> <paragraph id="H43A7164B0C9446BEB18CC0D5AEE3FE82" commented="no"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text style="OLC" level="subsection">Video</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Audio</header-in-text></quote>; and</text></paragraph>
<paragraph id="H0F7B1675FB6545C68E1A61019487009E"><enum>(2)</enum><text>by striking paragraphs (2), (3), and (4) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HC7FBECA8A4614CF2B11F6F8F31C86F57"> <paragraph id="HF17F800D4EFF448D98B364D079262591"><enum>(2)</enum><header>Audio description regulations for programming published or exhibited on television</header> <subparagraph id="H5BB930E1234942A9886DA6C5A7D970DC"><enum>(A)</enum><header>In general</header><text>Not later than 12 months after the date of submission of the recommendations to the Commission under section 106(d)(1) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall revise its regulations, taking into account those recommendations, to require all video programming first published or exhibited on television on or after the effective date of the revised regulations to be fully accessible through the provisions, receipt, and performance of audio description.</text></subparagraph>
<subparagraph id="H7A8757B811C1498D8815619DBD3F2094"><enum>(B)</enum><header>Requirements</header><text>The regulations revised under subparagraph (A)—</text> <clause id="H0676A4BD8B644EFD827F75C6C672A90D"><enum>(i)</enum><text>shall ensure that all English-language and Spanish-language video programming first published or exhibited on television on or after the effective date of the revised regulations, is fully accessible through the provision, receipt, and performance of audio description in the original language of the audio track of the programming in all designated market areas, except as provided in paragraph (5);</text></clause>
<clause id="H88DF2382DECD4D71ABBFB49B631946C4"><enum>(ii)</enum><text>shall include an appropriate schedule of deadlines, the earliest of which shall be not less than 2 years after the effective date of the revised regulations and the latest of which shall be not more than 6 years after that effective date, for the provision, receipt, and performance of audio described programming first published or exhibited on television on or after that effective date;</text></clause> <clause id="H61718F5CA9714254A6DB28F459BEAD6D"><enum>(iii)</enum><text>shall provide that audio described programming first published or exhibited on television on or after the effective date of the revised regulations shall be labeled and searchable or otherwise easily discoverable through navigation devices, apparatuses, applications, and other methods by which the programming is published or exhibited;</text></clause>
<clause id="H2BB53D3F6EA941349D29E264179DF612"><enum>(iv)</enum><text>shall provide that to the extent there is an audio channel or audio track dedicated solely to making audio description available, video programming first published or exhibited on television on or after the effective date of the revised regulations with audio description shall be made available to the public on such channel or track, so long as it is achievable (as defined in section 716(g)); and</text></clause> <clause id="H60702E0CACA8483E9E381E827A29FD2A"><enum>(v)</enum><text>shall require any entity involved in the publishing or exhibiting of audio described programming on television that is first published or exhibited on or after the effective date of the revised regulations to provide contact information, consistent with section 79.1(i) of title 47, Code of Federal Regulations, or any successor regulation, for consumers to report problems related to audio description.</text></clause></subparagraph></paragraph>
<paragraph id="HAA5F05F2E18D468FBC778BB4169B99E6"><enum>(3)</enum><header>Audio description regulations for online video programming and consumer generated media</header>
<subparagraph id="H751579E20BE042E7BDD20AD864C0CA94"><enum>(A)</enum><header>Audio description regulations for new online video programming</header><text>Not later than 18 months after the date of submission of the recommendations to the Commission under section 106(d)(1) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall revise its regulations, taking into account those recommendations, to require all online video programming that is first made available on or after the effective date of the revised regulations to be fully accessible through the provision, receipt, and performance of audio description.</text></subparagraph> <subparagraph id="HBCC96CEA653545818DBE2716534C18AB"><enum>(B)</enum><header>Schedule</header><text>The regulations revised under subparagraph (A) shall include an appropriate schedule of deadlines, the earliest of which shall be not less than 2 years after the effective date of the revised regulations and the latest of which shall be not more than 6 years after that effective date, for the provision, receipt, and performance of audio description on online video programming that is first made available on or after that effective date.</text></subparagraph>
<subparagraph id="H26906AFD9F6F492798DFFFE1946F8A3D"><enum>(C)</enum><header>Requirements for regulations</header><text>The regulations revised under subparagraph (A) shall—</text> <clause id="H1EA23504C4264F0EA461FD33DAFA50C9"><enum>(i)</enum><text>ensure that all English-language and Spanish-language online video programming that is first made available on or after the effective date of the revised regulations is fully accessible through the provision, receipt, and performance of audio description in the original language of the audio track of the programming;</text></clause>
<clause id="H0B947F25B9304719A49B97B499475D25"><enum>(ii)</enum><text>define the categories of entities engaged in making available online video programming and apportion the responsibilities for the provision, quality, pass-through, and rendering of audio description among such entities to ensure that audio description data—</text> <subclause commented="no" display-inline="no-display-inline" id="H05B4FAC6D2504482A0AC97A513248724"><enum>(I)</enum><text display-inline="yes-display-inline">remains with the video programming to which the data is added; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HE3D132CC626F49D2A7A8D368464398CC"><enum>(II)</enum><text display-inline="yes-display-inline">is distributed in common formats so that audio description can be exhibited intact by all other entities that subsequently make the programming available to viewers;</text></subclause></clause> <clause id="HCA5D0C351B18414C9E7ACAE1681EA52D"><enum>(iii)</enum><text>require, to the extent that an entity makes available to the public guides or listings of its online video programming, that the entity include information about the availability of audio description in those guides or listings to enable that programming to be searchable or easily discoverable through navigation devices, apparatuses, applications, and other methods on which the programming is made available;</text></clause>
<clause id="HBA6BDDD596E441D18A3365DA329DE833"><enum>(iv)</enum><text>shall provide that to the extent there is an audio channel or audio track dedicated solely to making audio description available, online video programming shall be provided on such channel or track, unless that is not achievable (as defined in section 716(g)); and</text></clause> <clause id="HB5DEBAEEF6044D7995EC39E41313F3DE"><enum>(v)</enum><text>require entities engaged in making available audio described online video programming to provide contact information, consistent with section 79.4(c)(2)(iii) of title 47, Code of Federal Regulations, or any successor regulation, for end users to report problems related to audio description.</text></clause></subparagraph>
<subparagraph id="H6C46B6EFA9594DA2922456B2D7210E4E"><enum>(D)</enum><header>Audio description regulations for older online video programming and on consumer generated media</header>
<clause id="H50DED2C554D34F3580E16BC94BFE1C8E"><enum>(i)</enum><header>In general</header><text>Not later than 18 months after the date of submission of the recommendations to the Commission under section 106(d)(1) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall prescribe regulations, taking into account those recommendations, to maximize, through the provision, receipt, and performance of audio description, the accessibility of—</text> <subclause id="H00526B25098F43DE89CCA12193D4A00B"><enum>(I)</enum><text>online video programming that is first made available before the effective date of the revised regulations under subparagraph (A) of this paragraph; and</text></subclause>
<subclause id="H70B7844558D94125B1F73BF2280CA2FA"><enum>(II)</enum><text>consumer generated media.</text></subclause></clause> <clause id="H584EE3B5D8C3431086C2B492A029E8AF"><enum>(ii)</enum><header>Requirement for consumer generated media</header><text>In prescribing regulations for consumer generated media under clause (i)(II), the Commission shall require that an entity engaged in making available consumer generated media, whether or not the entity is also engaged in making available video that is not consumer generated media, provides—</text>
<subclause id="H37622C7B022E4308B83793238CE36657"><enum>(I)</enum><text>authoring tools that permit users who post videos on the entity’s platform to add closed captions;</text></subclause> <subclause id="H6D74BD00A70C415E96483F86FD53EBF5"><enum>(II)</enum><text>timely and effective notice, at or before the time of upload, to users who post videos on the entity’s platform that such authoring tools are available for videos; and</text></subclause>
<subclause id="HBAC1E1BCEA294A11BB53A5BD8D173783"><enum>(III)</enum><text>guidance on how to use such authoring tools.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H0BAA48BD1C9A44498B328DFD8E305C77"><enum>(4)</enum><header>Audio description quality</header> <subparagraph id="H289CCB80225A444ABD5CCE165FCFF26F"><enum>(A)</enum><header>In general</header><text>Not later than 4 years after the date of enactment of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall prescribe regulations to ensure the technical quality of audio description on video programming, including online video programming, and consumer generated media as necessary to afford access to video programming and consumer generated media that is functionally equivalent to the access provided by the visual components of the programming or media.</text></subparagraph>
<subparagraph id="H78B913A24FB44BF59773C082022920B4"><enum>(B)</enum><header>Requirements</header><text>The regulations prescribed under subparagraph (A) shall require that audio description—</text> <clause id="H4007A34A3F43430E8AE212B59B68F6C4"><enum>(i)</enum><text>effectively convey key visual elements of the program or media;</text></clause>
<clause id="HB6E39A4B7CBD4DC08653A3268A1C77AA"><enum>(ii)</enum><text>when utilizing text-to-speech synthetic voices, effectively convey the visual content and vocal nuance of the program or media in a manner that is functionally equivalent to the ability of human voicing to convey the visual content and vocal nuance;</text></clause> <clause id="HEE381F61444D470682DF984C8218BA30"><enum>(iii)</enum><text>be edited, encoded, and delivered to the public in a manner that ensures consistency with the editing, encoding, and delivery of the non-description audio track of the programming or media; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H32BF2CCF45614D2B9A5A9E29D7C5B56E"><enum>(iv)</enum><text>to the extent practicable, be provided for open subtitles in the same language as the audio or in other languages if the subtitles convey information relevant to the program or media that is not conveyed in the audio of the program or media.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H189AC73BE59640A69EA7615C1B62ECC2"><enum>(C)</enum><header>Compliance and enforcement</header><text>For the purposes of achieving compliance with and enforcement of the requirements of this paragraph and the regulations prescribed thereunder, the Commission shall prescribe regulations that include the compliance and enforcement procedures under section 79.1(g)(9) of title 47, Code of Federal Regulations, or any successor regulation.</text></subparagraph></paragraph>
<paragraph id="HB71D96FB1F9D40FCA93E94AEB5FE4A51"><enum>(5)</enum><header>Audio description exemptions</header><text>Notwithstanding paragraphs (2) and (3)—</text> <subparagraph id="HAADA7DFD47384DB58B9EBEBD1FE4E98E"><enum>(A)</enum><text>the Commission may exempt by regulation from the requirements under paragraphs (2) and (3) programs or media, classes of programs or media, or services for which the Commission has determined that the provision of audio description would be economically burdensome to an entity responsible for publishing, exhibiting, or making available such programming or media; and</text></subparagraph>
<subparagraph id="HA8035D20A915494CA378F107DDA0BCA8"><enum>(B)</enum><text>an entity responsible for publishing, exhibiting, or making available video programming or consumer generated media may petition the Commission for an exemption from the requirements under paragraphs (2) and (3), and the Commission may grant the exemption upon a showing that the requirement to include audio description would be economically burdensome.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H15291EDA8164420CAD3FFD76EBFA9710"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H5BE8F8049A67490AABE506E5CEFFE110"><enum>(1)</enum><text display-inline="yes-display-inline">in title III (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>)—</text> <subparagraph id="H0B0D942C3C954E80A239D6E05E442344"><enum>(A)</enum><text>in section 303(u) (<external-xref legal-doc="usc" parsable-cite="usc/47/303">47 U.S.C. 303(u)</external-xref>)—</text>
<clause id="H90B8E3EA37304599A72B766AFA1F2EA6"><enum>(i)</enum><text>in paragraph (1)(B)—</text> <subclause id="H70EDE1EA00864A639E278CB645EFE59C" commented="no"><enum>(I)</enum><text>by striking <quote>video description</quote> and inserting <quote>audio description</quote>; and</text></subclause>
<subclause id="HB88C3F2472E34B8FBE281887A036A655"><enum>(II)</enum><text>by striking <quote>section 713(f)</quote> and inserting <quote>section 713(g)</quote>; and</text></subclause></clause> <clause id="H7BE69DE73D624AC187985A5C77A2F38F"><enum>(ii)</enum><text>by moving the left margin of that subsection and each paragraph, subparagraph, and clause therein 2 ems to the left; and</text></clause></subparagraph>
<subparagraph id="H7F874E82F39642A3856C5E2893AFA7B8" commented="no"><enum>(B)</enum><text>in section 330(b) (<external-xref legal-doc="usc" parsable-cite="usc/47/330">47 U.S.C. 330(b)</external-xref>), by striking <quote>video description</quote> each place the term appears and inserting <quote>audio description</quote>; and</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF76CBACA4A0E49249662300BB510A1F5"><enum>(2)</enum><text>in section 713 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>), in subsection (a)(1), as redesignated by section 101—</text>
<subparagraph id="H81FDE5088F31447DB7F038CA8822C36D"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Video description</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Audio description</header-in-text></quote>; and</text></subparagraph> <subparagraph id="H20AFC585F41D4EADA75055F8825E5FE7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>by striking <quote>video description</quote> and inserting <quote>audio description</quote>.</text></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H6E7ACD87341A43D483DCF08DF238B9CB"><enum>104.</enum><header display-inline="yes-display-inline">Technical and conforming amendments relating to economic burden</header><text display-inline="no-display-inline">Subsection (f) of section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>), as redesignated by section 102, is amended to read as follows:</text> <quoted-block id="H49202C0B4C5B4BBEAA337D8B05630E68" display-inline="no-display-inline" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="H5EC866E89F7145F49E031D7ED003F0A0"><enum>(f)</enum><header display-inline="yes-display-inline">Economically burdensome</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>economically burdensome</term> means resulting in significant difficulty or expense. In determining whether the closed captions or audio description necessary to comply with the requirements of this section would be economically burdensome, the factors to be considered include—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H61EA4F7A9FEE49F6B3D1490F74A9215D"><enum>(1)</enum><text>the nature and cost of the closed captions or audio description for the programming;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H640ADFB6732E4CDB966A44131A683F75"><enum>(2)</enum><text>the impact on the operation of the provider or program owner;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4A4C317CDDD0454885158103074A0E86"><enum>(3)</enum><text>the financial resources of the provider or program owner; and</text></paragraph> <paragraph id="H79B6DA8AF91540B2B226322247725351" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>the type of operations of the provider or program owner.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HA7D799C2974A4DA0B806D5F6DF463FDC"><enum>105.</enum><header>Sign language in video programming</header><text display-inline="no-display-inline">Section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>) is amended by inserting before subsection (j) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H758BDBCA6C2A458A886720FB1C8BC271"> <subsection id="H52152D5DCADB4B4990F8F565ADAB803B"><enum>(i)</enum><header>Sign language interpretation of video programming</header> <paragraph id="H5DD73DBD73D54257965758A04A3092A5"> <enum>(1)</enum> <header>In general</header> <text>Not later than 1 year after the date of submission of the recommendations to the Commission under section 106(d)(2) of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, the Commission shall prescribe regulations, taking into account those recommendations, to require, in the case of video programming first published or exhibited on television or first delivered using Internet protocol or any successor protocol on or after the effective date of the regulations that includes the provision of sign language, that the entity providing the programming ensure that the sign language presentation is visible on the viewer’s screen throughout the programming pursuant to standards established by the Commission.</text>
            </paragraph>
<paragraph id="H3FE976A048144DD985E27D2D03B50206"><enum>(2)</enum><header>Compliance and enforcement</header><text>For the purposes of achieving compliance with and enforcement of the requirements of this subsection and the regulations prescribed thereunder, the Commission shall prescribe regulations that include the compliance and enforcement procedures under section 79.1(g)(9) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HBC6A60C50EC344CA9C469D7E308747B9"><enum>106.</enum><header>Closed Captioning, Audio Description, and Sign Language Advisory Committee</header> <subsection id="HF305C2F5F98149899DBC867631943187"><enum>(a)</enum><header>Definitions</header> <paragraph commented="no" display-inline="no-display-inline" id="H18E01550108549F89690C28811C72399"><enum>(1)</enum><header>In general</header><text>In this section:</text>
<subparagraph id="H75CC9DAF837C4E4385468DF9D49F8925"><enum>(A)</enum><header>Advisory Committee</header><text>The term <term>Advisory Committee</term> means the Closed Captioning, Audio Description, and Sign Language Advisory Committee established under subsection (b).</text></subparagraph> <subparagraph id="HF99C43F55BFF457F80001DD156D3A2DE"><enum>(B)</enum><header>Chair</header><text>The term <term>Chair</term> means the Chairman of the Commission.</text></subparagraph>
<subparagraph id="H1B8C7C7B692348E7B2BDB4EC4FA78E98"><enum>(C)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></subparagraph> <subparagraph id="H04973C5C717548CEA440F4F3FB6EEDE0" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header>Consumer generated media</header><text>The term <term>consumer generated media</term> has the meaning given the term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBED919F5ED8A4ADBB33558E9567E2E8E"><enum>(2)</enum><header>Terms defined in section 713 of the Communications Act of 1934</header><text>In this section, the terms <term>audio description</term>, <term>live programming</term>, <term>near-live programming</term>, <term>online video programming</term>, <term>prerecorded programming</term>, and <term>video programming</term> have the meanings given those terms in section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>), as amended by this title.</text></paragraph></subsection> <subsection id="H830D1D3C345D41B0BF94590AC7BD23D2"><enum>(b)</enum><header>Establishment</header><text>Not later than 60 days after the date of enactment of this Act, the Chair shall establish an advisory committee to be known as the <quote>Closed Captioning, Audio Description, and Sign Language Advisory Committee</quote>.</text></subsection>
<subsection id="H2138670FFF0C486198B3ADDC8DAFF2BD"><enum>(c)</enum><header>Membership</header><text>The Chair shall appoint individuals who have the technical knowledge and engineering expertise to serve on the Advisory Committee in the fulfillment of its duties, including the following:</text> <paragraph id="H7F29AFCD4A9A4FFD85E40E5400E81413"><enum>(1)</enum><text>Individual representatives, or representatives of national organizations, including broadcasters and multichannel video programming distributors (as defined in section 602 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/522">47 U.S.C. 522</external-xref>)), engaged in making available video programming, including online video programming.</text></paragraph>
<paragraph id="H93B6AB5CA26C4B7DAC085F9648B7D30F"><enum>(2)</enum><text>Individual representatives, or representatives of national organizations, of vendors, developers, and manufacturers of systems, facilities, information technology equipment, and consumer electronics for the provision of video programming, including online video programming.</text></paragraph> <paragraph id="H4D5BC23D99AF4A3C9446619366258E75"><enum>(3)</enum><text>Individuals with expertise generating consumer generated media.</text></paragraph>
<paragraph id="HE1720F1D758A46A2840B0D371CB99DFA"><enum>(4)</enum><text>Representatives of national organizations representing individuals with disabilities and older Americans.</text></paragraph> <paragraph id="HDD3A749076EF4E5CB2B3B766D0BA9DF7"><enum>(5)</enum><text>Representatives of service agencies engaged in the provision of captioning and audio description for video programming, including online video programming.</text></paragraph>
<paragraph id="HF6D97B1C2C914BC096F59661119990A9"><enum>(6)</enum><text>Academic experts or representatives of research institutes with expertise on closed captioning and audio description.</text></paragraph> <paragraph id="H4D75EE2904144C6D89340CAAD8EBD05B"><enum>(7)</enum><text>Individuals with expertise that can contribute to standards for the display of sign language interpretation on video programming.</text></paragraph>
<paragraph id="H0C551B44EFB24698B9ED7728EDC00928"><enum>(8)</enum><text>Other individuals with technical and engineering expertise, as the Chair determines appropriate.</text></paragraph></subsection> <subsection id="HEC153F148ABA400DAC7AD378CD69C2C4"><enum>(d)</enum><header>Development of recommendations</header> <paragraph id="H7A7F559BCB9640B3A011D049E2E8E4DD"><enum>(1)</enum><header>Closed captioning and audio description recommendations</header><text>Not later than 180 days after the date of establishment of the Advisory Committee under subsection (b), the Advisory Committee shall develop and submit to the Commission recommendations that include the following:</text>
<subparagraph id="H5C69C421F87149B5897A7B3FC40BED65"><enum>(A)</enum><text>A recommended schedule of deadlines for the provision of closed captioning and audio description on online video programming.</text></subparagraph> <subparagraph id="H9F1824D83E514CC6BD8D92A1D8D5BC07"><enum>(B)</enum><text>Identification of, and recommendations for, the protocols and technical capabilities, standards, and procedures needed to enable responsible entities to reliably provide, receive, and display closed captions and audio description of online video programming.</text></subparagraph>
<subparagraph id="HF6E98BAEA95D4A7DBB5B9490C1BF260A"><enum>(C)</enum><text>A recommendation for any regulations that may be necessary to ensure compatibility between online video programming and apparatuses and navigation devices capable of receiving and displaying such programming in order to facilitate access to closed captions and audio description.</text></subparagraph> <subparagraph id="HBC2E4A9F0A4D46EA9338C4FC88DF00B8"><enum>(D)</enum><text>Identification of the categories of entities involved in the delivery of online video programming, along with a recommendation on how to apportion the responsibilities for the provision, quality, pass-through, and display of closed captions and the provision, quality, pass-through, and performance of audio description among those entities to ensure full access by viewers.</text></subparagraph>
<subparagraph id="HEAA00A8638A24B14ADFF214B14531591"><enum>(E)</enum><text>A recommendation for defining metrics and thresholds to be used for measuring—</text> <clause id="HA076DFA325E64274810B677CEDE61A83"><enum>(i)</enum><text>the accuracy, synchronicity, completeness, and placement of closed captions for live programming as necessary to afford access to video programming that is functionally equivalent to the access provided by the audio track, with minimum thresholds that are neutral to different modalities for creating closed captions; and</text></clause>
<clause id="H1DDA1590645649009D5CF4209364D566"><enum>(ii)</enum><text>the quality of audio description as necessary to afford access to video programming that is functionally equivalent to the access provided visually with minimum thresholds that are neutral to different modalities for creating audio description.</text></clause></subparagraph> <subparagraph id="HF5F01F6012FE46E4AFC64FD39C48BB60"><enum>(F)</enum><text>A recommendation for the achievability of making audio description available on a dedicated audio channel.</text></subparagraph>
<subparagraph id="HE9E0A1D5CE0348338D1FCC69666EE250"><enum>(G)</enum><text>A recommendation for standards, protocols, and procedures to ensure that audio described video programming is labeled and searchable or otherwise easily discoverable through navigation devices, apparatuses, applications, and other methods on which such programming is published, exhibited, or made available.</text></subparagraph> <subparagraph id="H1CC65E02C036418AAD6AE8A5D6F296A8"><enum>(H)</enum><text>A recommendation for best practices for ensuring that closed captions and audio description on programming that was live programming or near-live programming at the time that it was initially made available to viewers are subsequently made available at the level of quality required for prerecorded programming.</text></subparagraph>
<subparagraph id="H47F7238F9AAA47B2B1FC841789C98BAA"><enum>(I)</enum><text>Identification of attributes of easy-to-use authoring tools that permit users who post videos on a platform to add closed captions and audio description to online video programming.</text></subparagraph> <subparagraph id="H4DB41032D8B04156BA3A8B58357EA070"><enum>(J)</enum><text>Recommendations for applying the closed captioning and audio description obligations under section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>), as amended by this title, to consumer generated media, including—</text>
<clause id="H3509B1D5532C4F418F904773BE507A5A"><enum>(i)</enum><text>thresholds and measures used to determine the extent to which the obligations, including obligations for providing closed captioning and audio description on video clips, should apply to consumer generated media, for which the Advisory Committee may consider—</text> <subclause commented="no" display-inline="no-display-inline" id="HE04077097A5D4B6EBC0192D0264D948D"><enum>(I)</enum><text display-inline="yes-display-inline">the volume of postings;</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HD27E716F01CF48A995923954E3CA1607"><enum>(II)</enum><text display-inline="yes-display-inline">the size of viewership;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="HC5A0E1405B7D4A8D8E63606C20B32816"><enum>(III)</enum><text display-inline="yes-display-inline">whether the obligation is economically burdensome (as defined in section 713(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613(f)</external-xref>), as amended by this title); and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H3B0CD3A6915D43AF80318220BBE2F531"><enum>(IV)</enum><text display-inline="yes-display-inline">other measures as necessary to ensure expanded access for individuals with disabilities;</text></subclause></clause> <clause id="H7A76B1DFD9C342E28AEB80F01F9A429D"><enum>(ii)</enum><text>deadlines for bringing consumer generated media into compliance with the obligations; and</text></clause>
<clause id="H937AACB5103F48609FE146F43A62BE49"><enum>(iii)</enum><text>reasonable timeframes for providers of consumer generated media to respond to consumer complaints and concerns relating to closed captioning and audio description on consumer generated media.</text></clause></subparagraph> <subparagraph id="H5F7835C4981A40EDB2EF2ED7AEDAF1EE"><enum>(K)</enum><text>Recommendations for applying the closed captioning and audio description obligations under section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>), as amended by this title, to online video programming that was first made available before the effective date of the applicable regulations revised under that section, pursuant to this title, including—</text>
<clause commented="no" display-inline="no-display-inline" id="HF28A9392F4474BABAD07B3526496BF1A"><enum>(i)</enum><text display-inline="yes-display-inline">deadlines for bringing such programming into compliance with the closed captioning and audio description obligations, for which the Advisory Committee may consider—</text> <subclause id="H5806485E08F442958FDEB3ED1F9B03EB"><enum>(I)</enum><text>the volume of programming;</text></subclause>
<subclause id="H5F477A9EE1694EF9A36E79829D4EA818"><enum>(II)</enum><text>the size of viewership;</text></subclause> <subclause id="H3507F697BC614F239140D6DD47316BF0"><enum>(III)</enum><text>whether the obligation is economically burdensome (as defined in section 713(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613(f)</external-xref>), as amended by this title); and</text></subclause>
<subclause id="H1ED130D24FF347108EC684F6E5E8DCE7"><enum>(IV)</enum><text>other measures as necessary to ensure expanded access for individuals with disabilities;</text></subclause></clause> <clause id="H28C4CBC280D848F4A842348E14510697" commented="no"><enum>(ii)</enum><text>the intervals at which determinations under clause (i) should be reviewed and updated; and</text></clause>
<clause id="HE43DE38C004B4762AAB88B2B22A79994"><enum>(iii)</enum><text>reasonable timeframes for providers of such programming to respond to consumer complaints and concerns relating to closed captioning and audio description on such programing.</text></clause></subparagraph></paragraph> <paragraph id="HA1FAD0502EDC46D19A6E0CC8794D0BA7"><enum>(2)</enum><header>Sign language video programming report</header><text>Not later than 6 months after the date of establishment of the Advisory Committee, the Advisory Committee shall develop and submit to the Commission recommendations for standards to ensure that where sign language is provided on video programming, it is visible on the viewer’s screen throughout the programming.</text></paragraph></subsection>
<subsection id="H67FC34296B8F44D1A480076D6449C401"><enum>(e)</enum><header>Meetings</header>
<paragraph id="H259B0C4DE9964504B195D1C262974558"><enum>(1)</enum><header>Initial meeting</header><text>The initial meeting of the Advisory Committee shall take place not later than 45 days after the date on which the Chair has appointed all the members of the Advisory Committee under subsection (c).</text></paragraph> <paragraph id="H2EA6C380B2A74279BA2798702A73A3CB"><enum>(2)</enum><header>Other meetings</header><text>After the initial meeting, the Advisory Committee shall meet at the call of the Chair.</text></paragraph>
<paragraph id="H99C4CB8DC8CE44F89EE26732FB9C2D80"><enum>(3)</enum><header>Notice; open meetings</header><text>Any meeting held by the Advisory Committee shall be noticed not later than 14 days before the meeting and shall be open to the public.</text></paragraph></subsection> <subsection id="H94E9FB9495B64AE1BD568EF26E339740"><enum>(f)</enum><header>Procedural rules</header> <paragraph id="H62AAC0719E604417839CEC42497B83A8"><enum>(1)</enum><header>Quorum</header><text>The presence of one-third of the members of the Advisory Committee shall constitute a quorum for conducting the business of the Advisory Committee.</text></paragraph>
<paragraph id="H9EAA5BBD2D5B43039736740319670DAF"><enum>(2)</enum><header>Subcommittees</header><text>To assist the Advisory Committee in carrying out its functions, the Chair may establish appropriate subcommittees composed of members of the Advisory Committee and other subject matter experts.</text></paragraph> <paragraph id="H55ACC9DF12714E2BB29F3E944F9AF326"><enum>(3)</enum><header>Additional procedural rules</header><text>The Advisory Committee may adopt other procedural rules as needed.</text></paragraph></subsection>
<subsection id="HB85213F422E741EEA26174E3B86362CC"><enum>(g)</enum><header>Inapplicability of Federal Advisory Committee Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the Advisory Committee.</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="H42CA2EA2C9894E8A85132C45E9492CF3"> <enum>107.</enum> <header>Inquiries and reports to Congress</header> <text display-inline="no-display-inline">Section 713 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613</external-xref>) is amended by adding at the end the following:</text>

 <text>The extent to which the measures, thresholds, scope, intervals, and associated deadlines used by the Commission to determine the closed captioning or audio description (as applicable) obligations for consumer generated media and video programming described in subparagraph (B) have been effective in providing video programming access to individuals with disabilities.</text>
              </subparagraph>
            </paragraph>

              <enum>(3)</enum>
              <header>Continuing Commission authority</header>
 <text>The Commission may, as necessary, update its regulations and associated deadlines for the provision of closed captioning or audio description on consumer generated media and video programming described in paragraph (2)(B) if the Commission determines, based on the findings in the applicable report under paragraph (1), that updated regulations are necessary to—</text>

<paragraph id="H6BD42407C5564C758FCCFB2DB4868010"><enum>(5)</enum><text>that, if achievable and technically feasible, apparatus equipped with the functions described in paragraph (1) be equipped with an audio channel or audio track dedicated solely to making audio description available;</text></paragraph> <paragraph id="H472C3B6ECE3D474CB90D50D936AD3197"><enum>(6)</enum><text>that apparatus equipped with the functions described in paragraph (1) provide a user with a prompt to modify closed captioning and audio description activation and performance settings upon initial power-on after user purchase of the apparatus or upon a reset to factory settings of the apparatus;</text></paragraph>
<paragraph id="HC25ACC77FAD04CBCA46F309636E4ACD4"><enum>(7)</enum><text>that apparatus equipped with the functions described in paragraph (1), if technically feasible, provide the necessary hardware and software to achieve compatibility with, and to the extent achievable (as defined in section 716(g)), the integration of, assistive technologies and services, peripheral devices, or specialized customer premises equipment commonly used by individuals with disabilities to achieve access to the apparatus, including refreshable braille displays, switch activation such as sip and puff devices, hearing aids, hands-free technologies, and, if such apparatus is equipped with voice input that is used to access its functions, voice recognition functionality so that such menus or indicators are accessible to and usable by individuals with speech disabilities in real-time; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H04E9604BA7FF4512B21E3D71292A784E"><enum>(F)</enum><text>in paragraph (8), as so redesignated, by striking <quote>does not include</quote> and inserting with <quote>includes</quote>.</text></subparagraph></paragraph></subsection>
<subsection id="HEAF5CA1802314F55A98D32FA5F48205B"><enum>(b)</enum><header>Implementing regulations</header>
<paragraph id="H70225C73A36F4568960035930FAAD191"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>navigation device</term> has the meaning given the term in section 76.1200 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph> <paragraph id="H6C5ED9AA4B864082924A466A052B3A0B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Requirement</header><text>Not later than 18 months after the date of enactment of this Act, the Federal Communications Commission shall prescribe such regulations that apportion the responsibilities for compliance with subsections (u), (z), and (aa) of section 303 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/303">47 U.S.C. 303</external-xref>), as amended by subsection (a), among the categories of entities engaged in manufacturing, importing into the United States, maintaining, operating, or providing applications, plugins, or other software for apparatus and navigation devices to ensure full access by viewers via all entities responsible for digital apparatus and navigation devices.</text></paragraph></subsection></section></title>

<section id="HE06EEF2D0D0546D48B884D6711B235F6"><enum>301.</enum><header>Video conferencing</header><text display-inline="no-display-inline">The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended—</text> <paragraph id="H669FB209AAD2479EABF43B88EC1E19C5"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)—</text>

<subparagraph commented="no" display-inline="no-display-inline" id="HEEB30B2B3C354EE18ABF95EF854E5BEC"><enum>(A)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this paragraph, the Commission shall prescribe regulations to require, unless not achievable, that all providers of interoperable video conferencing services and all manufacturers of equipment capable of providing or enabling interoperable video conferencing services make available—</text> <clause commented="no" display-inline="no-display-inline" id="H1DA687E88DCC47F7A0A7FD723B61C275"><enum>(i)</enum><text display-inline="yes-display-inline">voice recognition functionality that is capable of generating understandable speech when used by individuals with speech disabilities;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HDAA6F337B62342F19F58895710482807"><enum>(ii)</enum><text>a simplified user interface that is accessible to individuals with cognitive disabilities, including a simplified, secure modality for initiating and authenticating interoperable video conferencing services;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H427AE1D5BDE94265B24DD3E314C70D36"><enum>(iii)</enum><text>instructional materials for activating interoperable video conferencing services with plain and simple language and iconography that is accessible to individuals with cognitive disabilities;</text></clause>
<clause id="H31B8E5B7671440699D59543305AD054B"><enum>(iv)</enum><text>visual interpretation services;</text></clause> <clause id="H5DB05A0006314D409C0AC22F7FBBF0EE"><enum>(v)</enum><text>screen-reader capability for all user interface elements and visual information, including presentations, videos, and interactive documents shared during interoperable video conferencing calls;</text></clause>
<clause id="HDA188839AE614404B1122C2366FF8C26"><enum>(vi)</enum><text>refreshable braille displays and other devices used for the tactile conveyance of interface elements and visual information, including presentations, videos, and interactive documents shared during interoperable video conferencing calls; and</text></clause> <clause id="H59CE780B54854CF0B2B74F47C30E7521"><enum>(vii)</enum><text>hands-free technologies.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD29BB5AB10734EE89436DD5A2920708B"><enum>(B)</enum><header>Industry flexibility</header><text display-inline="yes-display-inline">An entity may satisfy the requirements under the regulations prescribed under subparagraph (A) with respect to the video conferencing services, equipment, or systems the entity provides or manufactures, as applicable, by ensuring that the services, equipment, or systems are accessible and usable by individuals with disabilities—</text> <clause commented="no" display-inline="no-display-inline" id="H77DA03FBF047436F8BE69729B623F570"><enum>(i)</enum><text display-inline="yes-display-inline">without the use of third party applications, peripheral devices, software, hardware, or customer premises equipment; or </text></clause>
<clause commented="no" display-inline="no-display-inline" id="H2B1855C611DD4E15A7166220009A3FF5"><enum>(ii)</enum><text display-inline="yes-display-inline">with the use of third party applications, peripheral devices, software, hardware, or customer premises equipment, so long as consumers are not assessed charges associated with achieving accessibility through such third party mechanisms.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H8ECAD974723F4EECAD0111E06998D6D7"><enum>(C)</enum><header>Compatibility for video conferencing services</header><text display-inline="yes-display-inline">If compliance with a regulation prescribed under subparagraph (A) is not achievable through the means set forth in subparagraph (B), a manufacturer or provider that enables interoperable video conferencing services shall, unless not achievable, ensure that its interoperable video conferencing service or equipment is compatible with existing peripheral devices or specialized customer premises equipment commonly used by individuals with disabilities to provide the accessibility features described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H16310817B16048AB9E516DD05C2B2510"><enum>302.</enum><header>Relay services</header><text display-inline="no-display-inline">Section 225 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/225">47 U.S.C. 225</external-xref>) is amended—</text> <paragraph id="H1EE6C59A208542A2A1C69D2036DD7ADB"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="HAD23BC09C21F4F20A9655CF38BEAA0C1"><enum>(A)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (5) and (6), respectively;</text></subparagraph> <subparagraph id="H1D9C62BAECF94C94AF30394D26159EFB"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="HD49FC2DF2FA54F7CB320A0262131BAAC">
<paragraph id="H63F8DE6B9BB7405EBA7F4EF7E57344DB"><enum>(2)</enum><header>Communication facilitator</header><text>The term <term>communication facilitator</term> means a skilled user of sign language who is able to facilitate the ability of a DeafBlind person to engage in transmission and other services described in this section by conveying the information provided during the use of those services to the DeafBlind person through close vision or tactile sign language.</text></paragraph> <paragraph id="HC11FE499705A4CAC8D9B9600AE5363AD"><enum>(3)</enum><header>Deaf interpreter</header><text>The term <term>Deaf interpreter</term> means an individual who—</text>
<subparagraph id="HC42289DB953D43B6B06C1155B5A40027"><enum>(A)</enum><text>is deaf or hard of hearing;</text></subparagraph> <subparagraph id="H7A15CCC8E4CA430DAB57E4AD3CD3C3A5"><enum>(B)</enum><text>possesses native or near-native fluency in sign language; and</text></subparagraph>
<subparagraph id="H1E8E277E6E1F43388C09FA6A85B213DA"><enum>(C)</enum><text>has specialized training or experience to assist in providing functionally equivalent sign language interpretation for an individual using sign language in a situation that—</text> <clause id="HE514161951774648ABC6E6DCA4B9E71B"><enum>(i)</enum><text>requires linguistic or cultural mediation;</text></clause>
<clause id="HA897AB0F65694F78B16BD9F167FC9DD4"><enum>(ii)</enum><text>may be highly complex in nature; or</text></clause> <clause id="HB0A79BA3FCC64FDBBC6600FD49ED283C"><enum>(iii)</enum><text>may involve individuals who face linguistic challenges, such as through atypical language use, language deprivation, or idiosyncratic signing styles.</text></clause></subparagraph></paragraph>
<paragraph id="H7FD7012FD40C4FE28B40D8E1124D3753"><enum>(4)</enum><header>Direct video calling service</header><text>The term <term>direct video calling service</term> means telephone customer support using one-to-one video communication that—</text> <subparagraph id="HDFBB384CFFE448C087351829AA04ED80"><enum>(A)</enum><text>is facilitated by a contact center representative; and</text></subparagraph>
<subparagraph id="HDA45735CEF634A47A8918DB372254993"><enum>(B)</enum><text>enables a real-time conversation to occur directly between not fewer than 2 parties using sign language—</text> <clause id="H6A7ED855DC4A41A0AC61CF1FD38831D9"><enum>(i)</enum><text>not less than 1 of the parties to which is a governmental agency, business, non-profit organization, emergency authority, or other enterprise; and</text></clause>
<clause id="H2CD6D5172F8246E8BCD1F0B05E12A169"><enum>(ii)</enum><text>not less than 1 of the parties to which—</text> <subclause id="H5D860258CB1D48E2B364E9284E6C3E25"><enum>(I)</enum> <item commented="no" display-inline="yes-display-inline" id="H9136993B483C4B6AB8ACA8BA40C8E32A"><enum>(aa)</enum><text>is deaf, hard of hearing, or DeafBlind; or</text></item>
<item indent="up1" commented="no" display-inline="no-display-inline" id="H26C5D56F83E74C00BC776CE47C64AD16"><enum>(bb)</enum><text>has a speech disability or auditory processing disorder; and</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="HC7061EAF6CEB4B849C192F0101213909"><enum>(II)</enum><text display-inline="yes-display-inline">relies on sign language for communication.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HF051A969A20C4C1A9BC78818C2902493"><enum>(C)</enum><text>by striking paragraph (6), as so redesignated, and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9E0518D7BB98468B9BF5C84BD72090BD"> <paragraph id="H967F08254DD345FE99855D03960E5566"><enum>(6)</enum><header>Telecommunications relay services</header><text>The term <term>telecommunications relay services</term> means—</text>
<subparagraph id="H428BF0DD4CB147759E46B0A913366612"><enum>(A)</enum><text>transmission services that provide the ability for an individual who is deaf, hard of hearing, or DeafBlind, or who has a speech disability or an auditory processing disorder, to engage in communication by wire or radio with 1 or more individuals, in a manner that is functionally equivalent to, or, if technically feasible, provides access that is equal to, the ability of a hearing individual who does not have a speech disability to communicate using voice communication services or advanced communications services by wire or radio; and</text></subparagraph> <subparagraph id="H66B461C74B564A53A2798591A9226641"> <enum>(B)</enum> <text>other services facilitating functionally equivalent communication by wire or radio for an individual who is deaf, hard of hearing, or DeafBlind, or who has a speech disability or an auditory processing disorder, including the provision of communication facilitators for an individual who is DeafBlind and the provision of direct video calling services for communication in real-time by sign language users with customer service centers and other call centers operated by local, State, or Federal Government agencies, crisis centers, and emergency authorities.</text>
                </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H927892BD8E5748FFB8E37197267B80CF"><enum>(2)</enum><text>in subsection (d), by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HF0B0119F584D43FF8C4D9D760D810660"> <paragraph id="HFC6BFF497F3546F5838108DBB9D87D91"><enum>(4)</enum><header>Sign language access to emergency services; communication facilitators; direct video calling services</header> <subparagraph id="H37DE27613A4E4205A6731E4CA1641C2F"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <term>video relay service</term> has the meaning given the term in section 64.601(a)(57) of title 47, Code of Federal Regulations, or any successor regulation.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3D68F4F4F1704105BF6E73C819B34A36"><enum>(B)</enum><header display-inline="yes-display-inline">Regulations</header><text>Not later than 2 years after the date of enactment of this paragraph, the Commission shall prescribe such regulations as are necessary to—</text> <clause id="H0FC26CEBE3174C5485AC58A4C238CFAB"><enum>(i)</enum><text>define as eligible for relay service support from the fund described in section 64.604(c)(5)(iii) of title 47, Code of Federal Regulations, as in effect on that date of enactment—</text>
<subclause id="H2F10252BAF324A2A87EB4B5BC9459D56"><enum>(I)</enum><text>direct video calling services between sign language users and call center representatives in local, State, or Federal government agencies, crisis centers, and emergency authorities;</text></subclause> <subclause id="H14D4C8F98AA34BFBA9872FD2925A0522"><enum>(II)</enum><text>services provided by communication facilitators on telecommunications relay services calls with individuals who are DeafBlind; and</text></subclause>
<subclause id="H2B4742F9D7F84A98911991C0C5CFA62E"><enum>(III)</enum><text>the provision of a Deaf interpreter to accompany a hearing communications assistant, as defined in section 64.601(a)(13) of title 47, Code of Federal Regulations, or any successor regulation, when necessary to assist in providing functionally equivalent sign language interpretation on calls using video relay service;</text></subclause></clause> <clause id="H07516F10CB6245F395154E682859B623"><enum>(ii)</enum><text>achieve full, equal, and direct access to public safety answering points, as that term is defined in section 222(h), and other local emergency authorities, including emergency authorities responding to wireless calls placed by dialing 9–1–1, by individuals who—</text>
<subclause id="H8E74C601005B4001A4A52811A309B295"><enum>(I)</enum><text>are deaf, hard of hearing, or DeafBlind, or who have a speech disability or a cognitive disability; and</text></subclause> <subclause id="H469AE196C21A481DB4EC1A4FE8ED3E5A"><enum>(II)</enum><text>use sign language; and</text></subclause></clause>
<clause id="H9F3272A3B02B4697A9AD6DBABBCF2DB2"><enum>(iii)</enum><text>unless not achievable (as defined in section 716(g)), ensure that a person can have a single telephone number for the purpose of receiving calls and messages from other entities calling by means of video relay services or voice or electronic text messaging services.</text></clause></subparagraph> <subparagraph id="H0844A7DDBA414145B5B2F9162D1E7917"><enum>(C)</enum><header>Contents</header><text>The regulations described in subparagraph (A)(ii) shall, unless not achievable (as defined in section 716(g)), at a minimum, require that users communicating by means of a video relay service or a direct video calling service shall be capable of using native dialing or 1-step access on a mobile phone so that such communication—</text>
<clause id="HE2D0076DE61F4C6C8E80303D4B69AF92"><enum>(i)</enum><text>includes the location information of the user, to be transmitted and delivered immediately and directly to the applicable emergency authority; and</text></clause> <clause id="H262A31660FF14C84931B70906C2D2433"><enum>(ii)</enum><text>is received by the applicable emergency authority with the same speed and efficiency as a voice call made by dialing 9–1–1.</text></clause></subparagraph></paragraph>
<paragraph id="HF07D535FC8344515AD21FFEFFE15D832"><enum>(5)</enum><header>Reassessment of available services and minimum standards</header><text>Not later than 4 years after the date of enactment of this paragraph, and once every 4 years thereafter, the Commission shall, as necessary to respond to evolving communication technologies, reassess and update the regulations prescribed under this subsection to ensure that those regulations effectively satisfy the communication needs of individuals with disabilities who are covered by this Act, including by—</text> <subparagraph id="H991F9521E3334B4BB3E73DC7866E656C"><enum>(A)</enum><text>assessing the need for new modes of telecommunications relay services; and</text></subparagraph>
<subparagraph id="H1617098AC9354550BA724578E6F95B3B"><enum>(B)</enum><text>increasing and improving the mandatory minimum standards to ensure the quality and privacy of telecommunications relay services.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H38374C91AB5C442CBFBBC406BE43FF1B"><enum>303.</enum><header>National DeafBlind equipment distribution program</header> <subsection commented="no" display-inline="no-display-inline" id="HA3B4453A030840598978D1642E1DF525"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 719 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/620">47 U.S.C. 620</external-xref>) is amended—</text>
<paragraph id="H64027F8FDFA141BFBBF8ADDE718AABCB"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC1D63C5E92194790907C8939D18A3CA6"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>low-income</quote>; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC37D523B156F46A98E8F01C4397DCC75"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>deaf-blind</quote> and inserting <quote>DeafBlind</quote>;</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2A054A882C9D42989C730FE579D36C34"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text>

<subsection id="HFD187B2D7AC542BDB188C2A88AAEBC1D"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>individual who is DeafBlind</term>—</text> <paragraph commented="no" display-inline="no-display-inline" id="H11B1541F359240D5AD95FD961DF3FC0F"><enum>(1)</enum><text display-inline="yes-display-inline">has the meaning given the term <term>individual who is deaf-blind</term> in section 206 of the Helen Keller National Center Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1905">29 U.S.C. 1905</external-xref>); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA9567C69559540C991C503A033EAF589"><enum>(2)</enum><text display-inline="yes-display-inline">includes an individual who—</text> <subparagraph id="HC4BE4A953EE24A759873EE7629C36D58"><enum>(A)</enum><text>for the purposes of satisfying subparagraph (A)(i) of such section 206(2), has been diagnosed with a cortical or cerebral visual impairment;</text></subparagraph>
<subparagraph id="H640C3DF0E1934F92843809236C5E299C"><enum>(B)</enum><text>for the purposes of satisfying subparagraph (A)(ii) of such section 206(2), has been diagnosed with an auditory processing disorder; or</text></subparagraph> <subparagraph id="HCE38FCA7C22E40B1AF47866035D2935E"><enum>(C)</enum><text>for the purposes of satisfying subparagraphs (A)(i) and (A)(ii) of such section 206(2), has been diagnosed with both a cortical or cerebral visual impairment and an auditory processing disorder.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4CF26FDA9713498DBBD851BC67305E0E"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c), by striking <quote>$10,000,000</quote> and inserting <quote>$20,000,000, which the Commission shall adjust annually for inflation using an inflation factor determined by the Commission</quote>.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H7A80730CC480468094A96ABEFE8A98FD"><enum>(b)</enum><header>Update to regulations</header><text>Not later than 18 months after the date of enactment of this Act, the Federal Communications Commission shall update section 64.610 of title 47, Code of Federal Regulations, or any successor regulation, to ensure consistency with the amendments made by subsection (a).</text></subsection></section></title>
<title id="H6FD80A7D9E5A48C0A7EA6295D3A145ED" style="OLC"><enum>IV</enum><header>Customer service</header>
<section id="HB84D086310C241E290EFD4F0FE9874B1"><enum>401.</enum><header>Usability of advanced communication and video programming services</header><text display-inline="no-display-inline">Section 716 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/617">47 U.S.C. 617</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HF8089C66F9D04ECCAA81532D67BDCD79"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBA73CC8EA607497A87E95AC10DF49B90"><enum>(2)</enum><text>by inserting after subsection (i) the following:</text> <quoted-block id="HEED830D47AC145E0A803FCB48058BE4B" style="OLC" act-name=""> <subsection id="HDBCCFDE19A2F4C4E9C570EA4551CF006"><enum>(j)</enum><header>Usability</header> <paragraph commented="no" display-inline="no-display-inline" id="HF8A152CF138B43DB864B3E6AE41653CA"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text>In this subsection, the term <term>direct video calling services</term> has the meaning given the term in section 225(a).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8D2E6025A34345D1BEF4AD1BA967E73A"><enum>(2)</enum><header display-inline="yes-display-inline">Manufacturers and service providers</header><text>If a manufacturer or service provider to which subsections (a) and (b) apply offers live or machine-generated customer assistance to the general public, each such entity shall, unless not achievable, make such assistance usable to individuals with disabilities who rely on sign language by making available the ability to communicate in real time in sign language with customer service agents through direct video calling services.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD3B837C834914F0C9A1D68FC9202F4A3"><enum>(3)</enum><header>Video programming</header><text display-inline="yes-display-inline">If a video programming provider, multi-video programming distributor, or video apparatus manufacturer to which this Act applies offers live or machine-generated customer assistance to the general public, each such entity shall, unless not achievable, make that assistance usable to individuals with disabilities who rely on sign language by making available the ability to communicate in real time in sign language with customer service agents through direct video calling services.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB778043611AF48E399C8AE3EB61ED749"><enum>(4)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Commission shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HCF0974D1EC5D485782AB872445D1D08C"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this paragraph, prescribe such regulations as may be necessary to implement paragraph (2), which shall contain standards to ensure that direct video calling services for individuals with disabilities who rely on sign language as their primary form of communication receive customer and technical support that is not less effective in terms of availability, scope, and quality than customer and technical support provided to the general public; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9D6F43BFE3A3432DBE6B977E0C862A95"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this paragraph, prescribe such regulations as may be necessary to implement paragraph (3), which shall contain standards to ensure that direct video calling services for individuals with disabilities who rely on sign language as their primary form of communication receive customer and technical support that is not less effective in terms of availability, scope, and quality than customer service provided to the general public.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> <title id="H2DD3C9F640ED47FA957D66AE348FA8DB"><enum>V</enum><header>Emerging technology</header> <section id="H6DE28193C377483080E494F1846A75C4"><enum>501.</enum><header>Emerging technology</header><text display-inline="no-display-inline">Title VII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>) is amended by adding at the end the following:</text>
<quoted-block id="H1F130214A3E44D1A90B8731E408C7559" display-inline="no-display-inline" style="OLC">
<section id="HBFCACE466FF647C69E344DD0274821C0"><enum>723.</enum><header>Emerging technology accessibility</header>
<subsection id="H0F470379685E4D86B195B230117D9B8F"><enum>(a)</enum><header>Augmentative and alternative communication defined</header><text>In this section, the term <term>augmentative and alternative communication</term> means any tool, method, technology, strategy, service, training, coaching, or other support used to supplement or replace speech.</text></subsection> <subsection id="H63712B97F7CC45F2A44D59409B8E9096"><enum>(b)</enum><header>Reports to Congress</header><text>Not later than 5 years after the date of enactment of this section, and every 5 years thereafter, the Commission shall, in consultation with the United States Access Board, submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report assessing—</text>
<paragraph id="HB29BF4D3DAF24A5DBF64B8206FAF9778">
                <enum>(1)</enum>
 <text>the extent to which emerging communication and video programming technologies, such as those that include the use of artificial intelligence, augmented reality, virtual reality, extended reality, dual reality, spatial computing, and other advanced machine learning, wireless technologies, including Wi-Fi and Bluetooth, robotics, the Internet of Things, and other forms of advanced computing power, result in accessibility opportunities and barriers for individuals with disabilities; and</text>
              </paragraph>
<paragraph id="H17789068039A491BBF3450ACF61124B4"><enum>(2)</enum><text>solutions needed to ensure that emerging communications and video programming technologies and services such as those described in paragraph (1)—</text> <subparagraph id="HCB22A8B21BA441B8AE020DC0563193D3"><enum>(A)</enum><text>are accessible to individuals with disabilities; and</text></subparagraph>
<subparagraph id="HAAEDA6B891F644D9A1697A492577F098"><enum>(B)</enum><text>provide the necessary hardware and software to achieve compatibility with peripheral devices or specialized customer premises equipment commonly used by individuals with disabilities to achieve access.</text></subparagraph></paragraph></subsection> <subsection id="H27327BD9451E43A3A3F726719E0CDDD2"><enum>(c)</enum><header>Assessment of effect on individuals with particular barriers</header><text>In preparing each report required under subsection (b), the Commission shall assess the effect of emerging technologies on individuals with disabilities who have particular barriers to participation and communication with those technologies, including individuals with disabilities who—</text>
<paragraph id="H0A689C851EB742139CA49B371A342B6B"><enum>(1)</enum><text>have limited language or communication abilities, including individuals with speech disabilities and those that use augmentative and alternative communication, and individuals with cognitive disabilities;</text></paragraph> <paragraph id="HC14443A6749842B8B243C7C22F2F6222"><enum>(2)</enum><text>have significant, targeted, or multiple disabilities, including individuals who are blind or low vision, deaf or hard of hearing, DeafBlind, have an auditory processing disorder, a cortical or cerebral visual impairment, or have both communication and mobility disabilities; or</text></paragraph>
<paragraph id="H162ACE031518478B854BF123D24B3F1A"><enum>(3)</enum><text>in addition to their disability, lack access to advanced communication services and technology due to age, geographical location, socioeconomic status or Tribal affiliation.</text></paragraph></subsection> <subsection id="HB1CC716F69C84C3E8F050733EDF022B0" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Regulations</header><text>Not later than 2 years after the date on which the Commission submits each report required under subsection (b), the Commission shall prescribe new or update existing regulations for ensuring the accessibility of emerging communications and video programming technologies and services by individuals with disabilities where doing so is necessary to further the goals of the statutory provisions implemented by the regulations of the Commission under parts 6, 7, 14, and 79 of title 47, Code of Federal Regulations, or any successor regulation intended to fulfill these goals.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title>
<title id="H94CC87DB3C084459A92371A36BD3C511"><enum>VI</enum><header>Enforcement and reporting</header>
<section id="H600A990ADA7445C9BEA5EDF500AA51AB"><enum>601.</enum><header>Accessibility enforcement</header>
<subsection id="HB69DA46BCF93486189D1F21BB1BAAD0B"><enum>(a)</enum><header>In general</header><text>Section 503(b)(5) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(5)</external-xref>) is amended by inserting after <quote>uses that tower</quote> the following: <quote>, or in the case of violations of this Act related to requirements of accessibility for individuals with disabilities, including violations of section 225, section 255, section 276(b)(1)(A), subsections (u) through (aa) of section 303, section 330(b), section 710, section 711, section 713, or sections 715 through 719</quote>.</text></subsection> <subsection id="H47975CCE2FD940AD9FA81F7FC094D901"><enum>(b)</enum><header>Other laws</header><text>This Act and the amendments made by this Act shall not be construed to modify, impair, supersede, or preclude enforcement of violations of other State or Federal disability rights and civil rights laws.</text></subsection></section>
<section id="HA2240DE6263E4542A281E0AEBEF299AC"><enum>602.</enum><header>Accessibility complaint reporting</header><text display-inline="no-display-inline">Section 717 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/618">47 U.S.C. 618</external-xref>) is amended by striking subsections (b), (c), (d), and (e) and inserting the following:</text> <quoted-block id="H2C1D3E4849B246CD8BB5C52F788F1F1A" display-inline="no-display-inline" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="HF27CC4E7C69D4166A54CAD33F3ECAAED"><enum>(b)</enum><header>Accessibility complaint reporting requirement</header><text>Not later than 3 years after the date of enactment of the <short-title>Communications, Video, and Technology Accessibility Act of 2026</short-title>, and every 3 years thereafter, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes the following:</text>
