<section id="HFE9EAD3A6A134C9DA2F2F641D9603F61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modal Parity in Permitting Act</short-title></quote>.</text></section> <section id="HF728A603C8AE4721A222FC13985EDAFE"><enum>2.</enum><header>Acquisition of real property interests</header> <subsection id="HBF3B7C8D6FD342AF931E237EB12F0D70"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5323(q) of title 49, United States Code, is amended—</text> 
<paragraph id="H375F511CE3584DCAA5A368914ACCF379"><enum>(1)</enum><text>in the heading by striking <quote><header-in-text level="subsection" style="OLC">Corridor preservation</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Real property interests</header-in-text></quote>;</text></paragraph> <paragraph id="HAEC623F107034595914B118D4609FFB8"><enum>(2)</enum><text>in paragraph (1) by striking <quote>right-of-way</quote> each time it appears and inserting <quote>real property interests</quote>;</text></paragraph> 
<paragraph id="H8DCE7EA56712455A8074FEC1DB8295B6"><enum>(3)</enum><text>by inserting <quote>acquired</quote> after <quote>may use the</quote>; and</text> </paragraph> <paragraph id="H83485F9A9CFE4B78A21ABDE78CE78923"><enum>(4)</enum><text>in paragraph (2) by striking <quote>Right-of-way</quote> and inserting <quote>Real property interests</quote>.</text></paragraph></subsection> 
<subsection id="H08215185FA5C4937826F90F58AC21DD8"><enum>(b)</enum><header>Updates required</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act the Administrator of the Federal Transit Administration shall update FTA Circular 5010.1F, or any successor circular or regulations, and any other necessary guidance necessary to implement the amendments made by subsection (a).</text></subsection></section> <section id="H11EBC2265CB44297A383AAE8CFF6487A"><enum>3.</enum><header>Passenger rail project transactions</header> <subsection id="HBD49E3C4B3264AF9A0E6F6CD8CEF6023"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/242">Chapter 242</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="H087AC19215DE4B319804D901BD6C9E2C"><enum>24203.</enum><header>Passenger rail project transactions</header> 
<subsection id="H8770E6946C274B38B746D42A8FEBFE5F"><enum>(a)</enum><header>Real property interests</header><text display-inline="yes-display-inline">A recipient of financial assistance under chapter 229, 249, or 243 may use such assistance to acquire through purchase, lease, or otherwise secure or control real property interests before or during the completion of the environmental reviews for a project that may use such property interests if the acquisition or related transaction is otherwise permitted by Federal law.</text></subsection> <subsection id="H559383F275A84321919503EBDC5356A1"><enum>(b)</enum><header>Timing of development</header><text>A real property interest acquired, leased, or otherwise secured or controlled under subsection (a) may not be physically developed or improved in anticipation of the proposed project until all required environmental reviews for the project have been completed.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5D5E2A9BAA7A4887AFF2F3DE6DFFC58A"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/242">chapter 242</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="HDB81AEB801764D6885B640E31D54D8CE" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">24203.
