<section id="H55488A4967554B53A531420B54B0A502" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Illegal Aliens Drunk Driving</short-title></quote>.</text></section> <section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="H260CEEAAA4C649E39F9164AEDF070E9B"><enum>2.</enum><header display-inline="yes-display-inline">Aggravated felony for driving under the influence or while intoxicated</header><text display-inline="no-display-inline">Section 101(a)(43) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(43)</external-xref>) is amended—</text>
<paragraph id="H2703C300462649D0B7F2F27F6490E24A"><enum>(1)</enum><text>in subparagraph (T), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HCFF8211CDEB9422597516F2CD8CE96FD"><enum>(2)</enum><text>by redesignating subparagraph (U) as subparagraph (V); and</text></paragraph>
<paragraph id="H3E39C2F945E84D41A5CE95395E110609"><enum>(3)</enum><text>by inserting after subparagraph (T) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H89B0F7ABF5BD4F9BAA93FB8F101CCAF9"> <subparagraph id="H6F9BFFCC871C4218A2D5F9B28DEDEECF"><enum>(U)</enum><text>an offense relating to driving while intoxicated, impaired, or under the influence of alcohol, a controlled substance (as defined in section 102(6) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(6)</external-xref>)), or any other illegal narcotic or intoxicating substance—</text>
<clause commented="no" display-inline="no-display-inline" id="H5EB17150A81D4530824521C267E5A3EC"><enum>(i)</enum><text display-inline="yes-display-inline">which resulted in the death of, or serious bodily injury to, another person; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H403B6667CD8E4B02976D3C64F38CC594"> <enum>(ii)</enum> <text display-inline="yes-display-inline">for which the alien was convicted, without regard to whether the conviction is classified as a misdemeanor or felony under Federal, State, tribal, or local law; and</text>
            </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HA02BE0488549473B8873F0BA4BFA7A7D"><enum>3.</enum><header>Inadmissibility for aggravated felony</header><text display-inline="no-display-inline">Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)(F)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H199CE59E855240CEAE8A8828ADB39E8A"><enum>(1)</enum><text>by redesignating subparagraph (F) as subparagraph (J) and moving such subparagraph so that it appears immediately after subparagraph (I); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD712E1E0ABDD42B08D0B419384572FFD"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (E) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H20493A88D8AF44E3A0D3C828D1912C3F"> <subparagraph id="H955350B1999949E492EF09CBBAB64DEF"><enum>(F)</enum><header>Aggravated felony for drunk driving or driving while intoxicated</header><text display-inline="yes-display-inline">Any alien who is convicted of, admits having committed, or admits committing acts constituting the essential elements of, any law or regulation of a State, the United States, or a foreign country relating to an offense described in section 101(a)(43)(U) is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HC89108B9E8014A38A48924861EB1B4CB"><enum>4.</enum><header>Effective date; application</header>
<subsection id="H009EABEF3CA34DE294794152BABEDE4E"><enum>(a)</enum><header>Effective date</header><text>This Act and the amendments made by this Act shall take effect on the date of the enactment of this Act.</text></subsection> <subsection id="H276F92D168EF4387ACA52EE6F30A4E14"><enum>(b)</enum><header>Application</header><text>The amendments made by sections 2 and 3 shall apply—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H94F7EC416B564B68802B422F3A949119"><enum>(1)</enum><text display-inline="yes-display-inline">to actions taken on or after the date of the enactment of this Act, regardless of when the relevant criminal conviction occurred;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC072DD9801874C1D9F0FDBA18F96AA28"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to section 276(b), only to violations of section 276(a) occurring on or after such date of enactment; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4F94950B38394EB18F3B8C13A9D938F5"><enum>(3)</enum><text>with respect to section 237(a)(2)(A)(iii), if the underlying aggravated felony is described in section 101(a)(43)(U) or 212(a)(2)(F), only to actions taken on or after the date of the enactment of this Act, regardless of when the relevant criminal conviction occurred.</text></paragraph></subsection></section> </legis-body></bill>
