<section id="H0C61C8BF741E486AA06BF1BC659F4CDA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Care Utilization through Bed Exchange and Data Sharing Act of 2026</short-title></quote> or the <quote><short-title>ICU Bed Act of 2026</short-title></quote>.</text></section> <section id="HDD519BE8E93F4C71BB82E044B26D7BD0"><enum>2.</enum><header>Requiring hospitals to report bed availability in real time as a Medicare condition of participation</header> <subsection id="H1F3A3F0F28A7499891FEFD42101F7517"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1866 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc</external-xref>) is amended—</text> 
<paragraph id="HD51D421AD3CD433396C2427E03501940"><enum>(1)</enum><text>in subsection (a)(1)—</text> <subparagraph id="HAD5CB87995D74D919F0DE3C91DB45A5E"><enum>(A)</enum><text>in subparagraph (X), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H3A0AC29AD64648E1AB78C89FF96E8595"><enum>(B)</enum><text>in subparagraph (Y), by striking the period at the end and inserting <quote>, and</quote>; and</text></subparagraph> <subparagraph id="HFF0F2AB0BF954B01B59BFC880F1A5211"><enum>(C)</enum><text>by inserting after subparagraph (Y) the following new subparagraph:</text>

<subparagraph id="H8288401A45A74FABBB781DC7E6CFFAB4" indent="up1" commented="no"><enum>(Z)</enum><text display-inline="yes-display-inline">beginning 1 year after the date of the enactment of this subparagraph, in the case of a hospital, critical access hospital, or rural emergency hospital, to comply with the real-time intensive care unit bed availability requirements described in subsection (l).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H96BE28BD869646BFBCC3202F059F9A8E"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

              <enum>(l)</enum>
              <header>Real-Time intensive care unit bed availability reporting requirements</header>
              <paragraph id="H4DC7E90828D049C5AE4627931792D352">
                <enum>(1)</enum>
                <header>In general</header>
 <text>For purposes of subsection (a)(1)(Z), the real-time intensive care unit bed availability requirements described in this subsection are, with respect to a hospital, critical access hospital, or rural emergency hospital, that such hospital—</text>
                <subparagraph id="H6402A5F3143F4E18BF695EF7376C5BFC">
                  <enum>(A)</enum>
 <text>participate in a shared data reporting system that provides information in real time regarding the number of intensive care unit beds available at such hospital to each hospital, critical access hospital, and rural emergency hospital participating under this title that is located in the same region established by the Secretary under <internal-xref idref="HEB4A87F743944FD4810721FF42752215" legis-path="(l)(2)">paragraph (2)</internal-xref> as such hospital; and</text>
                </subparagraph>
                <subparagraph id="H934638B0726B4596B9C4B1009C8139FE">
                  <enum>(B)</enum>
 <text>maintain a shared strategy with each such hospital located in such region to efficiently transfer patients between such hospitals in the case that such a hospital reaches or nears intensive care unit bed capacity.</text>
                </subparagraph>
              </paragraph>
              <paragraph id="HEB4A87F743944FD4810721FF42752215">
                <enum>(2)</enum>
                <header>Regions</header>
 <text display-inline="yes-display-inline">The Secretary shall establish regions with respect to which a hospital, critical access hospital, or rural emergency hospital shall meet the requirements under <internal-xref idref="H4DC7E90828D049C5AE4627931792D352" legis-path="(l)(1)">paragraph (1)</internal-xref>. In establishing such regions, the Secretary shall take into account—</text>
                <subparagraph id="HC0A7C0A7BE6D4E1DA1BF464B342A1511">
                  <enum>(A)</enum>
 <text>the geography and population of a region; and</text> </subparagraph> <subparagraph id="H58E69EF12B524518A10521FFFEB14064"> <enum>(B)</enum> <text>the time it takes to travel between such hospitals in a region.</text>
                </subparagraph>
              </paragraph>
            </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H454BE2A02603433798994B6931380604"><enum>(b)</enum><header>Partnership for State and regional hospital preparedness</header><text display-inline="yes-display-inline">Section 319C–2 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-3b">42 U.S.C. 247d–3b</external-xref>) is amended—</text> <paragraph id="H2C073DC7AF44460E99085BB51DD5E411"><enum>(1)</enum><text>in subsection (c), by inserting <quote>, including for activities to prepare for the efficient transfer of patients between hospitals and other health care facilities to prevent overcapacity at such facilities during a public health emergency, and</quote> before <quote>with respect to</quote>; and</text></paragraph> 
<paragraph id="HC07A224BAF07402A99722EDF3FF4CBA9"><enum>(2)</enum><text>in subsection (j)(1), by inserting <quote>and each of fiscal years 2026 through 2031</quote> after <quote>through 2023</quote>.</text></paragraph></subsection></section> </legis-body></bill>
