<section id="H3FBFCBD127884D8AA2F51E5FC90614C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Build More Power Act</short-title></quote>.</text></section> <section id="H3E8EA425CDEE42D8B2AC082812E80717"><enum>2.</enum><header>Loan guarantees for electric generating facilities required to operate per an emergency designation</header> <subsection id="HD11201DC0895406FB9F4845437CBC7C6"><enum>(a)</enum><header>Energy infrastructure reinvestment financing</header><text display-inline="yes-display-inline">Section 1706 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16517">42 U.S.C. 16517</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HEB7CAD3F83C04A1EBE274289A28F9A2F"><enum>(g)</enum><header>Section 202(c) facilities</header> 
<paragraph id="H8DA9D34ABA3F441F8A8A574D09A651D6"><enum>(1)</enum><header>Treatment of required electric energy generation</header><text display-inline="yes-display-inline">Energy infrastructure that is required by an order issued under section 202(c) of the Federal Power Act to generate electric energy shall be considered to have ceased operations for purposes of subsection (a)(1).</text> </paragraph> <paragraph id="HAB959E7CDED5454BB2A3DBF979504115"><enum>(2)</enum><header>Solicitation of applications</header> <subparagraph id="H8B9E12C99B1A406AB30E25B9C5A4AF6C" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary issues an order under section 202(c) of the Federal Power Act requiring energy infrastructure to generate electric energy, the Secretary shall, when issuing such order, solicit an application for a guarantee under this section for a project described in paragraph (1), (2), or (3) of subsection (a) with respect to such energy infrastructure.</text> </subparagraph> 
<subparagraph id="HFF3F805C93B040B3A2D096655338040B"><enum>(B)</enum><header>Existing orders</header><text display-inline="yes-display-inline">With respect to any energy infrastructure required to generate electric energy by an order issued under section 202(c) of the Federal Power Act on or before the date of enactment of this subsection, and if such order is in effect on such date of enactment, the Secretary shall, not later than 60 days after such date of enactment, solicit applications for a guarantee under this section for projects described in paragraph (1), (2), or (3) of subsection (a) with respect to such energy infrastructure.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H73E641DEE6474E64A33124976D65CF7B"><enum>(b)</enum><header>Extension of availability of funds and commitment authority</header> <paragraph id="HB904C855E20243C984C05AF9F9478BCC"><enum>(1)</enum><header>Energy Policy Act of 2005</header><text display-inline="yes-display-inline">Section 1706(f) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16517">42 U.S.C. 16517(f)</external-xref>) is amended by striking <quote>2028</quote> and inserting <quote>2032</quote>.</text></paragraph> 
<paragraph id="H2C55705A3B16442C92845E243261868E"><enum>(2)</enum><header>Inflation Reduction Act of 2022</header><text display-inline="yes-display-inline">Section 50144 of the <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/16517">42 U.S.C. 16517</external-xref>) is amended—</text> <subparagraph id="H7AFAA212FF8A4472B8AB62B88947D092"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>2026</quote> and inserting <quote>2032</quote>; and</text> </subparagraph> 
<subparagraph id="HAFBF35AACCD74E5CBD4F165B8E5AF667"><enum>(B)</enum><text>in subsection (b)—</text> <clause id="H5D0058FC7AD14FD6BE8C2468DE823D44"><enum>(i)</enum><text>by striking <quote>The Secretary may</quote> and inserting the following:</text>

<paragraph id="HA67E06047B814739BF31A67CA406DD38"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause> <clause id="HF203AF910F784AD993AEC676FADBFB0D"><enum>(ii)</enum><text>by striking <quote>2028</quote> and inserting <quote>2032</quote>; and</text></clause> 
<clause id="H2A2A51FF9ADE40FE940500FB4C25DE7B"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H935F3E21654943BDAEA087EF351CE4C3" display-inline="no-display-inline"> <paragraph id="HF9FA015310BC4E319E98271B9875FC61"><enum>(2)</enum><header>Set aside for certain section 202(c) facilities</header><text display-inline="yes-display-inline">Of the total principal amount described in paragraph (1), not less than $20,000,000,000 of such amount shall be used to guarantee loans for projects described in section 1706(a) of the Energy Policy Act of 2005 with respect to energy infrastructure required to generate electric energy by an order issued under section 202(c) of the Federal Power Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection> 
<subsection id="H1E3EA9C704644CDD9C391BED0732B146" commented="no"><enum>(c)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary of Energy shall submit to Congress a report describing—</text> <paragraph id="H670A7A48E53A43258752790A8A4C2AB6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the projects for which the Secretary made guarantees under section 1706 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16517">42 U.S.C. 16517</external-xref>) during the period of 1 year beginning on such date of enactment;</text></paragraph> 
<paragraph id="H046EE749FCCC4DD5880DB932050D4F1A" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the amount of electric capacity added by such projects;</text> </paragraph> <paragraph id="H8A74526F1D574AD7AD374323BC95AD9E" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">the total principal amount of guarantees made under section 1706 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16517">42 U.S.C. 16517</external-xref>) during the period described in paragraph (1); and</text></paragraph> 
<paragraph id="HCD6CDC518DB3417FAE3757A4E1A08B7C" commented="no"><enum>(4)</enum><text>recommendations on how to best incentivize investment in upgrades to aging coal facilities.</text></paragraph></subsection></section> </legis-body></bill>
