<official-title display="yes">To prohibit individuals convicted of defrauding the Government from receiving any assistance from the Small Business Administration, and for other purposes.</official-title>

<section id="H2FEDD3C3489F4BB388AD0337EAC05E30" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assisting Small Businesses Not Fraudsters Act</short-title></quote>.</text></section> <section id="HF959BF11155A49FC8033F569AF2470F6" section-type="subsequent-section"><enum>2.</enum><header>Assistance prohibited after fraud conviction</header> <subsection id="HCAE6B1F5902A4B0A8A96BAC1880BEDA2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 16 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/645">15 U.S.C. 645</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H06B23B03F9814A80BE7E9DB64AC1AB6E"> 
<subsection id="H169872CDA25B40D6A0A83B82F2305C81"><enum>(h)</enum><header>Financial assistance prohibition</header> 
<paragraph id="H3F82F5876B2A40FFB92D60D5453BFED5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An associate of a small business concern who is finally convicted of any crime involving or relating to financial misconduct or a false statement with respect to a covered loan or grant shall be ineligible to receive any financial assistance from the Administrator, other than financial assistance under section 7(b).</text></paragraph> <paragraph id="H27669FD36ADA45829480E11305E95C16" commented="no"><enum>(2)</enum><header>Business concerns</header><text display-inline="yes-display-inline">A small business concern that has as an associate an individual subject to paragraph (1) shall be ineligible to receive any financial assistance from the Administrator, other than financial assistance under section 7(b).</text></paragraph> 
<paragraph id="H2C9D1C77DECE473C93D56106A038FFD1"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HEC0E8788FC6D4F3482CBE36C21111AF5"><enum>(A)</enum><header>Associate</header><text display-inline="yes-display-inline">The term <term>associate</term> means, with respect to a small business concern—</text> 
<clause id="HD726AFEC60D440D5B5EE624AA7CBA8D4"><enum>(i)</enum><text display-inline="yes-display-inline">an officer, director, or owner of more than 20 percent of the equity of, or a key employee of, such small business concern;</text></clause> <clause id="H5A81F0B5B831480D8EC1073719A7A762"><enum>(ii)</enum><text display-inline="yes-display-inline">any entity not less than 20 percent owned or controlled by one or more individuals referred to in clause (i); and</text></clause> 
<clause id="H3C172BDA9E3A47DF918757ACAF6CDA29"><enum>(iii)</enum><text display-inline="yes-display-inline">any other individual or entity in control of or controlled by such small business concern, except for a licensed small business investment company (as defined in section 103(3) of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/662">15 U.S.C. 662(3)</external-xref>)).</text></clause></subparagraph> <subparagraph id="H194E004D0FB7426A830B3C38D2FC5413"><enum>(B)</enum><header>Covered loan or grant</header><text>The term <term>covered loan or grant</term> means—</text> 
<clause id="H9C76E97339844971827D9844A383058C"><enum>(i)</enum><text>a loan made under—</text> <subclause id="H68670F9F096A42118DFDC5E376D0C332"><enum>(I)</enum><text>paragraph (36) or (37) of subsection (a) of section 7; or</text></subclause> 
<subclause id="H210944F54073407EBC4B9FD776B5509E"><enum>(II)</enum><text>subsection (b) of such section in response to the COVID–19 pandemic; or</text></subclause></clause> <clause id="H3C15AF6376FB48E99D094C590D97068E"><enum>(ii)</enum><text>a grant made under—</text> 
<subclause id="H7D30735ACEB047739E00426EDEAA30CA"><enum>(I)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); or</text></subclause> <subclause id="HD7A996F9D0124C96ACC29C6087FB7413"><enum>(II)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>).</text></subclause></clause></subparagraph> 
<subparagraph id="H6F70369CA03E4CB09D47868B3DCD9DB4"><enum>(C)</enum><header>Finally convicted</header><text>The term <term>finally convicted</term> means, with respect to a person, that such person has been convicted of an offense and such conviction—</text> <clause id="H18116406934E451CAE7B240A0C3A30C6"><enum>(i)</enum><text>has not been appealed and is no longer appealable because the time for taking an appeal has expired; or</text></clause> 
<clause id="HFCDDC639282D44ACB8C47C0E08E76F67"><enum>(ii)</enum><text>has been appealed and the appeals process for such conviction is completed.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9D642290CC76472C930B1EEE39554906"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (h) of section 16 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/645">15 U.S.C. 645</external-xref>), as added by subsection (a) of this Act, shall not apply to any contract or other agreement entered into by the Government prior to the date of the enactment of this Act.</text></subsection></section>
