<section id="H731D26B3032D4930A58398FA50B3D873" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parents Decide Act</short-title></quote>.</text></section> 
<section id="H2F1622CF56044165A5F5DDFC56BBE5ED"><enum>2.</enum><header>Required age verification for users of operating systems</header> 
<subsection id="H662309B6D2C149F7AAF2AB6820DCBF3E"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline">An operating system provider, with respect to any operating system of such provider, shall carry out the following:</text> <paragraph id="HD2EF7CFB8F9C4E5A9B440617EA46C0A3"><enum>(1)</enum><text>Require any user of the operating system to provide the date of birth of the user in order to—</text> 
<subparagraph id="H718D0245A97945528EE743D9D56A9C78"><enum>(A)</enum><text>set up an account on the operating system; and</text></subparagraph> <subparagraph id="H010BECE6C3ED495E9CC0AC5ACDB9EBAB"><enum>(B)</enum><text>use the operating system.</text></subparagraph></paragraph> 
<paragraph id="HB0D7D955CBA2406DA4366E427540D9D3"><enum>(2)</enum><text>If the relevant user of the operating system is under 18 years of age, require a parent or legal guardian of the user to verify the date of birth of the user.</text></paragraph> <paragraph id="H032A5BB42F254B14ADFAEA57922F02F4"><enum>(3)</enum><text display-inline="yes-display-inline">Develop a system to allow an app developer to access any information as is necessary, collected by the operating system to carry out this section and any regulation promulgated under this section, to verify the date of birth of a user of an app of the app developer.</text></paragraph></subsection> 
<subsection id="H4110D20C5BF64EA699ABEFF1D8550793" commented="no"><enum>(b)</enum><header>Safe harbor</header><text display-inline="yes-display-inline">An operating system provider may not be held liable for a violation of a provision of this Act or a regulation promulgated under this Act if the provider follows the requirements described in such provision or regulation.</text> </subsection> <subsection id="H2061BE3688244A18A6F39E48B3C6D6DE"><enum>(c)</enum><header>Enforcement by Commission</header> <paragraph id="H0EC32E72ED4C4B76A77970E58D7675A2"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph> 
<paragraph id="H4D9A0ACAB7474FEDA6952B8324CB87B4"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this section and any regulation promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection> <subsection id="HC127CA413E1542D19E5A6C84F7917F63"><enum>(d)</enum><header>Regulations</header> <paragraph id="H74DF2921303F4556A25DFE8D754AD294"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Commission shall promulgate, under section 553 of title 5, United States Code, regulations to carry out this section, including regulations relating to the following:</text> 
<subparagraph id="H3AD040C255C1481C8FFB5F3C1FB9CDF9"><enum>(A)</enum><text>How an operating system provider can—</text> <clause id="H140D4B9D242746E6B51BF67340A39244"><enum>(i)</enum><text>verify the date of birth of a parent or legal guardian described in subsection (a)(2); and</text></clause> 
<clause id="H4FB10E67E4794430B34D45813AB88F97"><enum>(ii)</enum><text>carry out the requirements described in subsection (a) with respect to an operating system of such provider that may be shared by individuals of varying ages.</text></clause></subparagraph> <subparagraph id="H78CF3DEE6C6C41C4BC337686BD63593B"><enum>(B)</enum><text display-inline="yes-display-inline">Data protection standards related to how an operating system provider shall ensure a date of birth collected by the operating system provider from a user, or the parent or legal guardian of the user, to carry out this section and any regulation promulgated under this section—</text> 
<clause id="HDE6540244BE74FAFA4A82C89FE4E0D04"><enum>(i)</enum><text>is collected in a secure manner to maintain the privacy of the user or the parent or legal guardian of the user; and</text></clause> <clause id="H36CA58C486634FA89DD717B13CF2DC50"><enum>(ii)</enum><text>is not stolen or breached.</text></clause></subparagraph> 
<subparagraph id="H3F590AC491CB45D28D27828FDC1C8F75" commented="no"><enum>(C)</enum><text>How an operating system provider shall—</text> <clause id="H5D4D0C7C8CE9491BB6BD654BBE0EF072"><enum>(i)</enum><text>ensure an app developer can access information collected by the operating system provider to carry out this section and any regulation promulgated under this section, subject to the data protection standards under subparagraph (B), to verify the date of birth of a user of an app of the app developer; and</text></clause> 
<clause id="H1336F6977EF341A2AACD8123A747CB8A"><enum>(ii)</enum><text>ensure the parent or legal guardian of a user of an operating system who is under 18 years of age is allowed to control what such user is allowed to access on a device.</text></clause></subparagraph> </paragraph> <paragraph id="H6C8E222F257C46859877BA75785334EB"><enum>(2)</enum><header>Briefing to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Commission shall brief Congress on the following information:</text> 
<subparagraph id="HBF5AB83F599241F5943D524815B03D6A"><enum>(A)</enum><text>The rulemaking process of the Commission with respect to such regulations.</text></subparagraph> <subparagraph id="HF8CBB45F674643D0A54129AA14ED6B79"><enum>(B)</enum><text>Any considerations of the Commission with respect to implementing such regulations.</text> </subparagraph></paragraph></subsection> 
<subsection id="H73E5169DF4E247E6916C1EFB11EE697C"><enum>(e)</enum><header>Report</header><text>Not later than 18 months after the date of the enactment of this Act, the Commission shall submit to Congress a report on—</text> <paragraph id="H329C67CF93B040C599D49BD32715D316"><enum>(1)</enum><text display-inline="yes-display-inline">how operating system providers carry out the requirements described in subsection (a); and</text></paragraph> 
<paragraph id="H35F25FE6CEBE494F9D87E41BFA07B224"><enum>(2)</enum><text>any recommendation for legislative action related to updating such requirements.</text></paragraph></subsection> <subsection id="HB461A257B37344F790AD5FA438AAC234"><enum>(f)</enum><header>Effective date</header><text>This section, and any regulation promulgated pursuant to subsection (d)(1), shall take effect on the date that is 1 year after the date of the enactment of this Act.</text></subsection> 
<subsection id="H95CF380818614B34A1FA647AAD6E951E"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HF8CE7D31EEF04CB29DA12C5B499944FA"><enum>(1)</enum><header>App</header><text>The term <quote>app</quote> means a software application or electronic service that may be run or directed by a user on a computer, mobile device, or any other general purpose computing device.</text> </paragraph> 
<paragraph id="HDCB321E7332848F4AAC734C320CB57BE"><enum>(2)</enum><header>App developer</header><text>The term <quote>app developer</quote> means a person that owns or controls an app that is available for use in the United States.</text> </paragraph> <paragraph id="HBA082687CF2D490C97D2855AD4B5C37E"><enum>(3)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Trade Commission.</text> </paragraph> 
<paragraph id="H3A7E7D4892FD419F8382167232E10AFF"><enum>(4)</enum><header>Operating system</header><text>The term <quote>operating system</quote> means software that supports the basic functions of a computer, mobile device, or any other general purpose computing device.</text></paragraph> <paragraph id="HF45408E11DAC48BD801B821DC35797A5"><enum>(5)</enum><header>Operating system provider</header><text>The term <quote>operating system provider</quote> means a person that develops, licenses, or controls the operating system on a computer, mobile device, or any other general purpose computing device.</text> </paragraph></subsection></section>
