<section id="HF44C5FBB530B46859A5237D26D58CD91" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Reviews Certain Act</short-title></quote>.</text></section> <section id="H8E480884C52F4BE79E6C84342BF5D878"><enum>2.</enum><header>Scope of review</header><text display-inline="no-display-inline">Section 106 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336">42 U.S.C. 4336</external-xref>) is amended—</text> 
<paragraph id="HB9662ACA2A2740F0923E925579CEA3EB"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text level="section" style="OLC">; </header-in-text><header-in-text level="section" style="OLC">scope of review</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">level of review</header-in-text></quote>; and</text></paragraph> <paragraph id="HC0AC76322BDA45978E1B0EC937C61BE5"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HCF4A25E6431B4ED1B687BC31768D3F54"><enum>(c)</enum><header>Scope of review</header><text display-inline="yes-display-inline">In preparing an environmental document for a proposed agency action, a Federal agency is only required to consider those effects that share a reasonably close causal relationship to, and are proximately caused by, the immediate project or action under consideration, to comply with the requirements of this Act.</text></subsection> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H2752AB4AFA2D49F0B155A65F4FD28A70" section-type="subsequent-section"><enum>3.</enum><header>Limitations on judicial review of environmental documents relating to energy infrastructure</header><text display-inline="no-display-inline">Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) is amended—</text> 
<paragraph id="HC27928DBEE404D96AB29FFAE41C49393"><enum>(1)</enum><text>by redesignating section 112 as section 110A and moving such section so as to appear after section 110; and</text></paragraph> <paragraph id="H3C1932FA47454CF6BD65033CC935AC6D"><enum>(2)</enum><text>by inserting before section 111 the following:</text>

<section id="H0588BBE49BC14762A1F363FF5CF6E2AC" commented="no"><enum>110B.</enum><header>Limitations on judicial review of environmental documents relating to energy infrastructure</header> 
<subsection id="H954F49208B354671A5BF20D92F86EAEE" commented="no"><enum>(a)</enum><header>Limitations on claims</header> 
<paragraph id="H41E4B684E548401D8EE186F1744DBC94" commented="no"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law (except as provided in subparagraph (A) with respect to a shorter deadline), a claim challenging whether a final agency action relating to energy infrastructure complies with the requirements of this Act shall be barred unless—</text> <subparagraph id="H50A636F3BE7545E4B6CDFD1EFDB81535" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">such claim is filed not later than 180 days after the final agency action is made public, unless a shorter deadline is specified under law;</text></subparagraph> 
<subparagraph id="HC26AAB682B164210A7496CD1FBA024E1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a final agency action for which there was a public comment period on an environmental document, such claim—</text> <clause id="H7BC13D8687694130A36F878ECB59DE31" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">is filed by a party that submitted a substantive and unique comment during such public comment period by the noticed comment deadline for the environmental document and such comment was sufficiently detailed to put the applicable Federal agency on notice of the issue upon which the party seeks review; and</text></clause> 
<clause id="H09D8A220B9384AAEA224185A6D081DA7" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">concerns the same subject matter raised in the comment submitted during the public comment period;</text></clause></subparagraph> <subparagraph id="H642459EC5458474F98E5455B7D838A16" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">such claim is filed by a party that has suffered or imminently will suffer direct harm from the final agency action; and</text></subparagraph> 
<subparagraph id="H20BF1738E32C42DDB8DA97623BE6EC44" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">such claim does not challenge the establishment of a categorical exclusion.</text> </subparagraph></paragraph> <paragraph id="H8F5F76063C134447BF2B7892904C5E96" commented="no"><enum>(2)</enum><header>Energy infrastructure defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>energy infrastructure</term> means a facility, and associated equipment, used for enabling the identification, leasing, development, production, processing, transportation, transmission, refining, and generation needed for energy.</text></paragraph></subsection> 
<subsection id="H959F6901EB044605B77827F1913731FD"><enum>(b)</enum><header>Limitations on remand</header> 
<paragraph id="HF0C4D10847094FD8B8FD74398EE1FF09"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no final agency action shall be vacated by a court, following a decision on the merits, unless the court determines that—</text> <subparagraph id="H62BFEE12041D4F1F8EC998FE7AB164C9"><enum>(A)</enum><text display-inline="yes-display-inline">the major Federal action for which the environmental document or final agency action is prepared will pose a significant risk of a proximate and substantial environmental harm; and</text> </subparagraph> 
<subparagraph id="HE26A37329AA74F37B46CC4C721EE28F6"><enum>(B)</enum><text display-inline="yes-display-inline">there is no other equitable remedy available as a matter of law.</text></subparagraph></paragraph> <paragraph id="HE03D1479A4EE4023A8F7A21CC783EF31"><enum>(2)</enum><header>Remand</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if a court determines there are errors or deficiencies with an environmental document or final agency action that need to be corrected—</text> 
<subparagraph id="H4E07A43AF3ED4121A5106A45C079EB67"><enum>(A)</enum><text display-inline="yes-display-inline">the court may remand the environmental document to the applicable Federal agency with specific instruction to correct such errors or deficiencies within 180 days from the date on which the order of the court was issued to the applicable Federal agency; and</text></subparagraph> <subparagraph id="HB3520B7940EB4F47B9BB81B7B18345C9"><enum>(B)</enum><text display-inline="yes-display-inline">the major Federal action may be carried out pursuant to the final agency action notwithstanding the remand of the environmental document or final agency action under subparagraph (A), including during the time prescribed by the court to the Federal agency to correct such errors or deficiencies, so long as the court has not determined that vacatur is appropriate under paragraph (1).</text></subparagraph></paragraph></subsection> 
<subsection id="H82EE23A39C37485B93AA5E54A27D2C92" commented="no"><enum>(c)</enum><header>No effect on review of compliance with other deadlines</header><text display-inline="yes-display-inline">This section shall not affect the right to obtain review under section 107(g)(3).</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HE78793161ED643578DBB5FC45A159D96"><enum>4.</enum><header>Deference to agencies in judicial review</header><text display-inline="no-display-inline">Section 111 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H7E73882A18E14BE8A4614E43C206E1EF"><enum>(14)</enum><header>Reasonably foreseeable</header><text display-inline="yes-display-inline">To comply with the requirements of this Act, the term <term>reasonably foreseeable</term>, with respect to environmental effects of a proposed agency action, means effects that share a reasonably close causal relationship to, and are proximately caused by, the immediate project or action under consideration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
