        <official-title display="yes">To allow certain students, including those who have a student
            aid index equal to or less than zero, to qualify for supplemental nutrition assistance
            program benefits under the Food and Nutrition Act of 2008.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Overcoming Higher Education Hunger Through the Supplemental Nutrition Assistance Program Act of 2026</short-title></quote> or the <quote><short-title>OHH SNAP Act of 2026</short-title></quote>.</text>

            <enum>2.</enum>
            <header>SNAP treatment of educational loans</header>
 <text display-inline="no-display-inline">Section 5(k) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(k)</external-xref>) is amended—</text>
            <paragraph id="H897300D765DB4D2C999AF57B55A864EF">
                <enum>(1)</enum>
 <text>by striking paragraph (3); and</text> </paragraph> <paragraph id="HC4038079E3F94103875C8D26D8C5AE4A"> <enum>(2)</enum> <text>by redesignating paragraph (4) as paragraph (3).</text>
            </paragraph>
        </section>

            <enum>3.</enum>
            <header>Eligibility of students to participate in the supplemental nutrition assistance
                program</header>
 <text display-inline="no-display-inline">Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended—</text>
            <paragraph id="H05A72F5DEB0D4FB7BF268AE58AAACFF3">
                <enum>(1)</enum>
 <text>in subsection (e)—</text> <subparagraph id="H3886643784DA40058A182B00352BB304"> <enum>(A)</enum> <text>in paragraph (7), by striking <quote>or</quote> at the end;</text>
                </subparagraph>
                <subparagraph id="HDD9758BA1C114EB0B7B2E1B88FFBE3FD">
                    <enum>(B)</enum>
 <text>in paragraph (8), by striking the period at the end and inserting a semicolon; and</text>
                </subparagraph>
                <subparagraph id="HA5DB5CC8260C44AAB8DE096517D98D53">
                    <enum>(C)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="H1DADD4B3D80549EB92BB24E53AA15AAA" style="OLC"> <paragraph id="H6BD3C736D07140F5B32B7B0BDAE7D181"> <enum>(9) </enum> <text display-inline="yes-display-inline"> has a student aid index that is equal to or less than $0, as determined by the procedures established in part F of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087kk-1087vv">20 U.S.C. 1087kk–1087vv</external-xref>); or</text>
                        </paragraph>
                        <paragraph id="H53285325D4C04613A43C1BE867600325">
                            <enum>(10)</enum>
 <text>is determined to be <quote>independent</quote> based on one of the criteria specified in subparagraphs (B), (C), (D), (G), and (H) of section 480(d)(1) of the Higher Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv</external-xref>).</text>

                <enum>(2)</enum>
 <text display-inline="yes-display-inline">in subsection (o)(2)(A), by striking <quote>work</quote> and inserting <quote>attending an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) or work, in the aggregate,</quote>.</text>

            <enum>4.</enum>
            <header>Effective date; application of amendments</header>
            <subsection id="H2BE2A18823F0405994C04ECB3BA3315C">
                <enum>(a)</enum>
                <header> Effective date</header>
 <text display-inline="yes-display-inline">Except as provided in subsection (b), this Act and the amendments made by this Act shall take effect 180 days after the date of the enactment of this Act.</text>
            </subsection>
            <subsection id="HFDA835B58E984C738F3AF8097D487498">
                <enum>(b)</enum>
                <header>Application of amendments</header>
 <text display-inline="yes-display-inline">The amendments made by this Act shall not apply with respect to certification periods that begin before the effective date of this Act.</text>
            </subsection>
