<section id="H772B78C62A2F42A195E08573AA25A55A" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Asylum Fraudsters Enforcement and Removal Act of 2026</short-title></quote> or the <quote><short-title>SAFER Act of 2026</short-title></quote>.</text></section> 
<section id="HEB45536E68C74BAC89B95FDFBA2D1FBB"><enum>2.</enum><header>Prohibition on return to country of concern for asylum applications</header><text display-inline="no-display-inline">Section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H5B07C8996C0641448AAF5E57C9BDD6BF" display-inline="no-display-inline"> <subsection id="H56EB8A63C83649AABD018EAAC542BF96"><enum>(f)</enum><header>Prohibition on return to country of concern</header> <paragraph id="HE91EC04C8E484C4CA021C16B64315D5F"><enum>(1)</enum><header>Prohibition</header><text>The Secretary of Homeland Security or the Attorney General may not grant asylum to an alien who has returned to a country of concern.</text></paragraph> 
<paragraph id="HDFC79EFB0ED642DBBB61460DBDE40ADD"><enum>(2)</enum><header>Effect on status</header><text display-inline="yes-display-inline">An alien who has been granted asylum and returns to a country of concern shall be subject to termination of a grant of asylum, denaturalization, and is subject to any applicable grounds of inadmissibility or deportability under section 212(a) and 237(a).</text></paragraph> <paragraph id="HCC9F1458BB86404EA5783A07DCC5256E"><enum>(3)</enum><header>Exception</header><text>Paragraphs (1) and (2) may be waived by the Secretary of Homeland Security or the Attorney General, as applicable, on a case-by-case basis if—</text> 
<subparagraph id="H8B29CE0626234A0DA98A096A2C18B00A"><enum>(A)</enum><text>the President certifies that the individual is permitted to travel for national security purposes; or</text></subparagraph> <subparagraph id="H1A5C28BFDC494E7EB2F4F7E7C9A1B6C6"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of State certifies that the country of concern has undergone a legitimate transfer of power.</text></subparagraph></paragraph> 
<paragraph id="HF8DE5CFD70414F71B2AAC62F402C6D55"><enum>(4)</enum><header>Country of concern defined</header><text display-inline="yes-display-inline">In this section, the term <quote>country of concern</quote> means the alien's country of nationality or, in the case of a person having no nationality, the country of the alien's last habitual residence for which the alien applied for asylum pursuant to this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> </legis-body></bill>
