<section id="HEA5C4CEA8AE84346A4CC9DD386B84724" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paul Laurence Dunbar Commemorative Coin Act</short-title></quote>.</text></section> <section id="HF24F46136ADC4924BE8DF4146FFDB6CE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="H7D08AC1EF8514C7BA7207551638A961B"><enum>(1)</enum><text display-inline="yes-display-inline">Paul Laurence Dunbar was one of the first influential African-American poets in American literature, writing such classics as <quote>Majors and Minors</quote> and <quote>Lyrics of Lowly Life</quote>, and composing the lyrics to <quote>In Dahomey</quote>, the first all-African-American musical produced on Broadway;</text></paragraph> <paragraph id="HA85931652E9A42BCACAC9F15D5E822A0"><enum>(2)</enum><text display-inline="yes-display-inline">Paul Laurence Dunbar was born on June 27, 1872, to freed slaves Joshua and Matilda Murphy Dunbar;</text></paragraph> 
<paragraph id="H8EB65C7BF956440E9B05ED9242EF01E4"><enum>(3)</enum><text display-inline="yes-display-inline">Paul Laurence Dunbar first published a series of poems at age 14 in the Dayton Herald;</text></paragraph> <paragraph id="H2661D786C36741C09ED73E8DE1DBF00D"><enum>(4)</enum><text display-inline="yes-display-inline">in 1893, Paul Laurence Dunbar published a series of poems in a work entitled <quote>Oak and Ivy</quote>;</text></paragraph> 
<paragraph id="H6C72EB3C0BD54D00A1FD4308A71745DB"><enum>(5)</enum><text display-inline="yes-display-inline">by the late 1890s, Paul Laurence Dunbar had become a prominent author, having had his poems published in such major national newspapers and magazines as The New York Times;</text></paragraph> <paragraph id="HB8828BEBEA594B07B20961CA897686AC"><enum>(6)</enum><text display-inline="yes-display-inline">over his career, Paul Laurence Dunbar published more collections of poems, short stories, and novels;</text></paragraph> 
<paragraph id="H74C676D05B514132BBAE449252960F60"><enum>(7)</enum><text display-inline="yes-display-inline">Paul Laurence Dunbar died on February 9, 1906, at 33 years of age;</text></paragraph> <paragraph id="HAE2ECC21D3554B6F86481D65D3DCEF44"><enum>(8)</enum><text display-inline="yes-display-inline">Paul Laurence Dunbar Senior High School (hereafter referred to as Dunbar High School) was established in the District of Columbia in 1870 as the Preparatory High School for Colored Youth, and was the first public high school for African-American students in the country;</text></paragraph> 
<paragraph id="H22BCC791344346B2896D10D4523514AB"><enum>(9)</enum><text display-inline="yes-display-inline">the Preparatory High School for Colored Youth was renamed in 1916 in honor of Paul Laurence Dunbar;</text></paragraph> <paragraph id="H22B3164C7B7E422BA1BFC239BB76EB27"><enum>(10)</enum><text display-inline="yes-display-inline">the Dunbar Alumni Federation (hereafter in this Act referred to as the <quote>Federation</quote>) was organized in 2002 to provide scholarships and other financial support to students and graduates of Dunbar High School;</text></paragraph> 
<paragraph id="H7A518444D3E148C0BDCBCC2D0611C6F2"><enum>(11)</enum><text display-inline="yes-display-inline">the Federation promotes and supports scholarship efforts, along with school and community activities;</text></paragraph> <paragraph id="HCD859EC2C72A4AE0B56E76A36A2982F9"><enum>(12)</enum><text>the Federation leverages the prestige of Dunbar High School and its distinguished alumni to enhance the education of Dunbar High School students;</text></paragraph> 
<paragraph id="HCD6A334A004D4568AF29F5B7448E84FA"><enum>(13)</enum><text display-inline="yes-display-inline">the Federation promotes Dunbar High School alumni from more than 35 years of graduating classes through their scholarship efforts, community activities, and other endeavors to support Dunbar High School;</text></paragraph> <paragraph id="HF5497C9E3A83473BB9BACCB2A90E0A38"><enum>(14)</enum><text display-inline="yes-display-inline">the Federation helps finance such student development activities as the Debate Team, the Band, the Ski Team, the Junior Reserve Officer Training Corps, and athletics;</text></paragraph> 
<paragraph id="HB33A264C3A954F408C2F722B66826622"><enum>(15)</enum><text display-inline="yes-display-inline">the Federation funds faculty, staff, and parent appreciation and development activities; and</text></paragraph> <paragraph id="HDAB53042264143B193A7771A7AE592E1"><enum>(16)</enum><text display-inline="yes-display-inline">the Federation collects and assembles artifacts and memorabilia from alumni for historical and legacy displays to chronicle Dunbar High School’s rich history.</text></paragraph></section> 
<section id="H406983A974F041DE814036DA3CE28A33"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H2597E42188544AD79DFA6232CD1B6153"><enum>(a)</enum><header>Denominations</header><text display-inline="yes-display-inline">In recognition and celebration of Paul Laurence Dunbar, the Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text> <paragraph id="H8D35F09791F54AEDA0B3E8D4A8B69D92"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 50,000 $5 coins, which shall—</text> 
<subparagraph id="H7D28BC5C6F83473CA08500518BD46DB6"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph> <subparagraph id="H8CA7D77D355B40FBA81105870985E7F8"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph> 
<subparagraph id="HF81710B41C4748DCB1F00353644FAC53">
                        <enum>(C)</enum>
 <text>contain not less than 90 percent gold.</text> </subparagraph></paragraph> <paragraph id="H3510FC7051D5431D824DF3F3C32DEE1F"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 400,000 $1 coins, which shall—</text> 
<subparagraph id="H0059598495F541BC917C0A7665E2489A"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> <subparagraph id="H19E183298DE545D4874C6F8B2E42B0CD"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="H49EA560836854E7E8E787BEE35B0854E">
                        <enum>(C)</enum>
 <text>contain not less than 90 percent silver.</text> </subparagraph></paragraph> <paragraph id="H934B6218558A40CCAB1402C42E7D5CAE"><enum>(3)</enum><header>Half-dollar clad coins</header><text>Not more than 750,000 half-dollar coins which shall—</text> 
<subparagraph id="H47DE29F0727D465D846D447449BF9F97"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph> <subparagraph id="HC28AF676AE7E4FCB9FB84FDE825FFFEB"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph> 
<subparagraph id="H72877554E6914BE094C0E4140C4AAF28"><enum>(C)</enum><text>be minted to the specifications for half-dollar coins contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph></subsection> <subsection id="HBA534BD0B50D465C96EDF28FA3F59C47"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection> 
<subsection id="H357B57431E4B4EB884BD83FD215EB650"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> <section id="HB64187DD2BF64BFBB4F1E761AFDF23EE"><enum>4.</enum><header>Design of coins</header> <subsection id="HC2FE7DACF67747ACB071CEDB6A21CF6D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The design for the coins minted under this Act shall be emblematic of Paul Laurence Dunbar.</text></subsection> 
<subsection id="H208471116E814DC88AD1EE846D811580"><enum>(b)</enum><header>Designations and inscriptions</header><text>On each coin minted under this Act there shall be—</text> <paragraph id="HCF2044B431FD4E4481C1C82F552F20D9"><enum>(1)</enum><text>a designation of the denomination of the coin;</text></paragraph> 
<paragraph id="HF9E043FB0C944DD1B42BE82A577AF0FC" commented="no"><enum>(2)</enum><text>an inscription of the year <quote>2028</quote>; and</text></paragraph> <paragraph id="HB463186FCD2F40F080CF38D7C7B16083"><enum>(3)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></paragraph></subsection> 
<subsection id="H7AC3035A1DA44896B3F98D412005D4B5"><enum>(c)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> <paragraph id="H31245603683F439C96CD009DD1DFF6B8"><enum>(1)</enum><text>selected by the Secretary after consultation with—</text> 
<subparagraph id="H0BF5B8B7E0A644E1B741008973054B87"><enum>(A)</enum><text>the Commission of Fine Arts; and</text></subparagraph> <subparagraph id="H04A0DFA7462440DABE36E9458B52B9ED"><enum>(B)</enum><text display-inline="yes-display-inline">the Federation; and</text></subparagraph></paragraph> 
<paragraph id="H0A2544091B6341AAA1411B38EB55AFC1"><enum>(2)</enum><text display-inline="yes-display-inline">reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> <section id="HD31037B307084F858D2ED620549CAB0C"><enum>5.</enum><header>Issuance of coins</header> <subsection id="H107B60641308412E8FEA859C378F46AF"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="HBBCB7022D330467BB9997EAB07BE7205" commented="no"><enum>(b)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2028.</text></subsection></section> <section id="HA9A5C3F4D23A4CB383DAB67BE3A521A2"><enum>6.</enum><header>Sale of coins</header> <subsection id="HB2C701491812454B8AC8B786A1E30BFB"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price based upon the sum of—</text> 
<paragraph id="H55ABB60A1A394DAA8D552D2242636EBB"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> <paragraph id="HC5BCB613900E45F09C1374F66DC55259"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph> 
<paragraph id="HCF48F5FA6D814CE3954E405D2F90DAC1"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> <subsection id="HA9EBF0285CA34C4287814F56FC099CB7"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="H90D21A14347F48A0B49F6CA21CB33230"><enum>(c)</enum><header>Prepaid orders</header> 
<paragraph id="HFBB8386C7836463F86DF466D0F6AA746"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> <paragraph id="HCF2E7B9D613A4B52B2E68A4653E5E6EE"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> 
<section id="H28D60712D20C4A1898D7953314090D1F"><enum>7.</enum><header>Surcharges</header> 
<subsection id="HF939D5B8D7E4400D87938AA45F97FDC9"><enum>(a)</enum><header>In general</header><text>All sales of coins minted under this Act shall include a surcharge as follows:</text> <paragraph id="H25A9ACF2174D4E3491FBCBC123564396"><enum>(1)</enum><text>A surcharge of $35 per coin for the $5 coin.</text></paragraph> 
<paragraph id="H6408BFE69E1743CC8F3086423DE1727C"><enum>(2)</enum><text>A surcharge of $10 per coin for the $1 coin.</text></paragraph> <paragraph id="H0EE20D2D07344479AEDF7FDAFCED8192"><enum>(3)</enum><text>A surcharge of $5 per coin for the half-dollar coin.</text></paragraph></subsection> 
<subsection id="HD4A983F5F92A4F46B8B953E52906D99D"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the Federation.</text></subsection> <subsection id="HF513EFCA9D884BE78F38F6627E10624C"><enum>(c)</enum><header>Exemption to commemorative coin program limitations</header><text display-inline="yes-display-inline">This Act shall—</text> 
<paragraph id="HDA1462025A784376B7C6EB46BF9101AD"><enum>(1)</enum><text>not be subject to section 5112(m)(1) of title 31, United States Code; and</text></paragraph> <paragraph id="H4ED94732705D48DFA6798AF8F5DEC650"><enum>(2)</enum><text>not be a <quote>commemorative coin program</quote> for purposes of such section.</text></paragraph></subsection> 
<subsection id="HE454BFBD323C410F8BC95C39E7B42F44"><enum>(d)</enum><header>Audit</header><text display-inline="yes-display-inline">The recipient described under subsection (b) shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection></section> <section id="HE4CE1492A69443AC9F3D0DA343813D6F"><enum>8.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text> 
<paragraph id="H6A132476825148729A01B4C2D583A821"><enum>(1)</enum><text>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph> <paragraph id="H0A8C78519CA5481591C4376903D955D3"><enum>(2)</enum><text>no funds, including applicable surcharges, are disbursed to the recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section>
