<section id="H6342BE90889A43D1BFCF449512CC2CE8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Compensation for Truck Crash Victims Act</short-title></quote>.</text></section> <section id="H86B07E4CB2CE415EA1E30164AAC5750D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H02729C62D2B44838A7C94B24E02BA8F0">
                <enum>(1)</enum>
 <text>In passing the Motor Carrier Act of 1980, <external-xref legal-doc="public-law" parsable-cite="pl/96/296">Public Law 96–296</external-xref>, Congress intended for the minimum insurance levels to maintain safety. According to the House Report No. 96–1069, <quote>the action of the Committee in increasing financial responsibility is to encourage the carriers to engage in practices and procedures that will enhance the safety of their equipment so as to afford the best protection to the public.</quote>.</text>
            </paragraph> 
<paragraph id="H5703355BE83947AE8D4FE0F6264FAC2E">
                <enum>(2)</enum>
 <text>The National Transportation Policy Study Commission (which consisted of six Members of the Senate, six Members of the House of Representatives, and seven public members appointed by the President) recommended mandatory minimum insurance requirements of $1,000,000, in its 1979 Final Report to the Congress, National Transportation Policies through the Year 2000. The Report stated: <quote>As an example, all certificated motor carriers operating upon the highways should be obligated to carry adequate insurance (or proof of financial responsibility equal to such insurance) to protect the public. The insurance should cover public liability, property, damage, cargo and environmental restoration with a $1 million for single occurrence, or another minimum amount sufficient to require periodic <quote>on site</quote> inspection by the insurance company, with the minimum to be updated regularly. Non-certificated motor carriers should be subject to similar standards.</quote>.</text>
            </paragraph> 
<paragraph id="H9F3469B1C68D4858B4373034627389EB"><enum>(3)</enum><text display-inline="yes-display-inline">According to the U.S. Bureau of Labor Statistics, the amount of $750,000, set in 1980 (the year of enactment), would have the same purchasing power as $5,193,665.62 in 2020, if the amount was raised to account for medical-cost inflation.</text></paragraph> <paragraph id="HFC027011E7ED43818F48670114DBF1E7"><enum>(4)</enum><text display-inline="yes-display-inline">That same amount of $750,000 would have the same purchasing power as $5,811,083 in 2025, if the amount was raised to account for medical-cost inflation.</text></paragraph></section> 
<section id="H2D26D554251047CDB234E682AACB2DE7"><enum>3.</enum><header>Minimum financial responsibility for transporting property</header> 
<subsection id="H85097CD519AE47B3BDF46A5590D8089A"><enum>(a)</enum><header>In general</header><text>Section 31139(b) of title 49, United States Code, is amended—</text> <paragraph id="H108E7FACAE894E1BA85DAE6E14C849B0"><enum>(1)</enum><text>in paragraph (2), by striking <quote>$750,000</quote> and inserting <quote>$5,000,000</quote>; and</text></paragraph> 
<paragraph id="HD3BDE26A2BD544C78910E30DC556DBDF"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H83F8A5BDCC1843C7AF7A9FB59CE286A8" style="OLC"> <paragraph id="H348A2C3AC40B460F8295C5BF91C48644" indent="up1"><enum>(3)</enum><header>Adjustment</header><text>The Secretary, in consultation with the Bureau of Labor Statistics, shall adjust the minimum level of financial responsibility under paragraph (2) quinquennially for inflation relating to medical care.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H94D65B62FAD94E27B8D103B4C8D37B41"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 1 year after the date of enactment of this Act.</text></subsection></section> </legis-body></bill>
