<section id="H3B685E3F4BFF4D0D9F2A268D5E894236" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Bereavement Act of 2026</short-title></quote> or the <quote><short-title>Sarah Grace-Farley-Kluger-Barklage Act</short-title></quote>.</text></section> <section id="H233386D4312E4B7A8D02CDBE088C6EB8"><enum>2.</enum><header>Family leave because of the death of a son or daughter</header> <subsection id="H97CD86140D964E1C9D3384DA283BC3F7"><enum>(a)</enum><header>Son or daughter</header><text display-inline="yes-display-inline">Section 101(12) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(12)</external-xref>) is amended by—</text> 
<paragraph id="HA0E1BC8C9DC244EAA2E0F39BDD31DF56"><enum>(1)</enum><text>redesignating subparagraphs (A) and (B) as clauses (i) and (ii), resepctively;</text></paragraph> <paragraph id="HC077BEF6ECCA45FC85EAFEF69820CE3E"><enum>(2)</enum><text>by striking <quote>, who is—</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H70FEA9F36D774F68A814081788FC4139" display-inline="no-display-inline"> 
<subparagraph id="HDAF6614DBD9B42329DDACE0588899750"><enum>(A)</enum><text display-inline="yes-display-inline">who is—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H0677E5F62DD74752AA5ED778429E21E3"><enum>(3)</enum><text>in clause (ii), as so redesignated, by striking the period at the end and inserting</text> 
<quoted-block style="OLC" id="HFE1DDDCFF61043619E433B99CEC4583D" display-inline="yes-display-inline"><text>; or</text> <subparagraph id="H9ADC38B665154A5F8AF1E8BBBC63AD9A"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to leave taken under section 102(a)(1)(G), who is any years of age.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6ED4E2260F6A44F3A4EBCEE0C716A1D8"><enum>(b)</enum><header>Family leave</header> 
<paragraph id="H7C932CE43D06482CB00F22D8C312B0CD"><enum>(1)</enum><header>Entitlement to leave</header><text>Section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text> <quoted-block display-inline="no-display-inline" id="H3843A77B2013480EBA9A98F577D6AD3C" style="OLC"> <subparagraph id="H86E35DB300E8432AA4AA5DB3B808DA97"><enum>(G)</enum><text>Because of the death of a son or daughter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H236B0D21AB7C4B529D8DD28497E14CD8"><enum>(2)</enum><header>Expiration of entitlement</header><text>Section 102(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(2)</external-xref>) is amended—</text> <subparagraph id="H308B2626D97A4DF4B39317A707EF6373"><enum>(A)</enum><text>by striking <quote>under subparagraphs</quote> and inserting</text> 
<quoted-block style="OLC" id="HEA74C4CDBAAA4C17832D1F26C4A5F15A" display-inline="yes-display-inline"><text>under—</text> <subparagraph id="HE07FAD307E7C49D4BECD411EF660F8AA"><enum>(A)</enum><text display-inline="yes-display-inline">subparagraphs</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H3D4B1DD7496F41BE8F4AFE4A0B262B1B"><enum>(B)</enum><text>in subparagraph (A), as so redesignated, by striking the period at the end and inserting</text> <quoted-block style="OLC" id="H643E2E42CA3040698FF55BA229ADE554" display-inline="yes-display-inline"><text>; and</text> 
<subparagraph id="H2728E9FA6BE047EB87EF4FB7D0F7BA75"><enum>(B)</enum><text display-inline="yes-display-inline">subparagraph (G) of paragraph (1) for a death of a son or daughter shall expire at the end of the 12-month period beginning on the date of such death.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H16950452E98F4B0AA347347D026A42E3"><enum>(3)</enum><header>Requirements relating to leave</header> <subparagraph id="H51EFE9552D444141A5724125C6129D5E"><enum>(A)</enum><header>Schedule</header><text>Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the third sentence the following new sentence: <quote>Leave under subsection (a)(1)(G) shall not be taken by an employee intermittently or on a reduced leave schedule unless the employee and the employer of the employee agree otherwise.</quote>.</text></subparagraph> 
<subparagraph id="HE0C1422EF48A44108DCDA9C29D2CBB5D"><enum>(B)</enum><header>Substitution of paid leave</header><text>Section 102(d)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(B)</external-xref>) is amended, in the first sentence, by striking <quote>(C) or (D)</quote> and inserting <quote>(C), (D), or (G)</quote>.</text></subparagraph> <subparagraph id="H6BD83DA9349046CEBF5119D777E3C2AD"><enum>(C)</enum><header>Notice</header><text>Section 102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H819F2CE5A66D453C8E460AB5317F9CCD" style="OLC"> 
<paragraph id="H8507EF98C5F7430C93254B8F65687CED"><enum>(4)</enum><header>Notice for leave due to death of a son or daughter</header><text>In any case in which the necessity for leave under subsection (a)(1)(G) is foreseeable, the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H09353FB0EC7A4D6396F4A22CD78ED444"><enum>(D)</enum><header>Spouses employed by same employer</header><text>Section 102(f)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(f)(1)(A)</external-xref>) is amended by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraph (A), (B), or (G)</quote>.</text></subparagraph> 
<subparagraph id="HCCDA83EBB5F54037A1CA8556E6115BE9"><enum>(E)</enum><header>Certification requirements</header><text>Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HF822C0C090A64D868574CA600EB20C88" style="OLC"> <subsection id="H0DA3A6617D54497F80916408FE9A90AD"><enum>(g)</enum><header>Certification related to the death of a son or daughter</header><text>An employer may require that a request for leave under section 102(a)(1)(G) be supported by a certification issued at such time and in such manner as the Secretary may by regulation prescribe. If the Secretary issues a regulation requiring such certification, the employee shall provide, in a timely manner, a copy of such certification to the employer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HC52B470798974BE6AF0A8E17BECA96A5"><enum>(F)</enum><header>Failure to return from leave</header><text>Section 104(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)</external-xref>) is amended—</text> <clause id="H57823A8851F444C4AB200FEA987DF1A2"><enum>(i)</enum><text>in paragraph (2)(B)(i), by inserting before the semicolon the following: <quote>, or a death that entitles the employee to leave under section 102(a)(1)(G)</quote>; and</text></clause> 
<clause id="H08ABA9367A0C46D7B3C7E54B08FEEC3B"><enum>(ii)</enum><text>in paragraph (3)(A)—</text> <subclause id="H54A36C98A17B4CAEBDE9210062EA85A0"><enum>(I)</enum><text>in the matter preceding clause (i), by inserting <quote>, or the death,</quote> before <quote>described</quote>;</text></subclause> 
<subclause id="H976FA420733B4CCB90923C4CCD6BCFE8"><enum>(II)</enum><text>in clause (ii), by striking <quote>or</quote> at the end;</text></subclause> <subclause id="H96357A7BB41E4455AF4D6076DB6162AF"><enum>(III)</enum><text>by redesignating clause (iii) as clause (iv); and</text></subclause> 
<subclause id="HE782ACEF5AD14B4691719B481971DDF2"><enum>(IV)</enum><text>by inserting after clause (ii) the following:</text> <quoted-block display-inline="no-display-inline" id="H7FA6B86528E24F57B2CE5968EFEC5389" style="OLC"> <clause id="H8386FE109CCC4E9D983F10DD8585A7F7"><enum>(iii)</enum><text>a certification that meets such requirements as the Secretary may by regulation prescribe, in the case of an employee unable to return to work because of a death specified in section 102(a)(1)(G); or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph> 
<subparagraph id="H44ABE2324FCD473EBE5A7784D57E7D2E"><enum>(G)</enum><header>Employees of local educational agencies</header><text>Section 108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2618">29 U.S.C. 2618</external-xref>) is amended—</text> <clause id="H862B0C247ED94783AF8C2C42FEFB189C"><enum>(i)</enum><text>in subsection (c)(1)—</text> 
<subclause id="HB9855ABFA25D4954BE752BC242129051"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by inserting after <quote>medical treatment</quote> the following: <quote>, or under section 102(a)(1)(G) that is foreseeable,</quote>; and</text></subclause> <subclause id="HA1343005C7654A45B6A6F4F40BCE7C71"><enum>(II)</enum><text>in subparagraph (A), by inserting after <quote>to exceed</quote> the following: <quote>(except in the case of leave under section 102(a)(1)(G))</quote>;</text></subclause></clause> 
<clause id="HC3657580D7A14EADA008AD6F0371CC01"><enum>(ii)</enum><text>in subsection (c)(2), by striking <quote>section 102(e)(2)</quote> and inserting <quote>paragraphs (2) and (4) of section 102(e), as applicable</quote>; and</text></clause> <clause id="HFED2243744084642AE02810ABD6041C3"><enum>(iii)</enum><text>in subsection (d), in paragraph (2) and (3), by striking <quote>or (C)</quote> each place it appears and inserting <quote>(C), or (G)</quote>.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H43ADA17AFB6D4512B08E555860DE1F0E"><enum>(c)</enum><header>Family leave for civil service employees</header> 
<paragraph id="HD9B9829292F14A7690A9F6CFCFBB0D2F"><enum>(1)</enum><header>Son or daughter</header><text>Section 6381(6) of title 5, United States Code, is amended—</text> <subparagraph id="HCB427BD06F0D429DAF114B17C9DF2A75"><enum>(A)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></subparagraph> 
<subparagraph id="H3CB716928EA64055BCAB35128DD52A62"><enum>(B)</enum><text>by striking <quote>, who is—</quote> and inserting the following:</text> <quoted-block style="USC" id="H9CA625598B314FE2AD1C56BE45AC9BF3" display-inline="no-display-inline"> <subparagraph id="H62AC7826069041EBA523760BCF2262B1"><enum>(A)</enum><text display-inline="yes-display-inline">who is—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HC4F458BDD4394C05A839068573BC5070" commented="no"><enum>(C)</enum><text>in clause (ii), as so redesignated, by striking <quote>disability;</quote> and inserting</text> <quoted-block style="USC" id="HAAACB961A1D54888A19E99D3D5450624" display-inline="yes-display-inline"><text>disability; or</text> 
<subparagraph id="H4419BA73B62546E59BD7F378A2BE1C43"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to leave taken under section 6382(a)(1)(F), who is any years of age;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H0BA8312332944BB2A5BA24D760C771B0"><enum>(2)</enum><header>Entitlement to leave</header><text>Section 6382(a)(1) of such title is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H49CF6C087ECD4557ADEA71283EE5A207" display-inline="no-display-inline"> 
<subparagraph id="H279AE838F16546B5B6A689EE861847D1" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">Because of the death of a son or daughter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H64805A1AE8C746CD8217229967151BDB"><enum>(3)</enum><header>Expiration of leave</header><text display-inline="yes-display-inline">Section 6382(a)(2) of such title is amended by—</text> 
<subparagraph id="HB54C49D446D34AAEB289213D85D06B2B"><enum>(A)</enum><text>striking <quote>under subparagraph</quote> and inserting</text> <quoted-block style="USC" id="HB2776F9AFD374A5AA473FE6CC50F28AC" display-inline="yes-display-inline"><text>under—</text> 
<subparagraph id="H7A859BE1BF7C42A79F0842943F86B8FF"><enum>(A)</enum><text display-inline="yes-display-inline">subparagraph</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HAB8B18EE42F042C1BF00CD9AD2F8B1D0"><enum>(B)</enum><text>in subparagraph (A), as so redesignated, by striking the period at the end and inserting</text> 
<quoted-block style="USC" id="HC7F1A88ED57148998A532DC6B0C2C66B" display-inline="yes-display-inline"><text>; or</text> <subparagraph id="H84C0198D6B914285B192630247E58AAB"><enum>(B)</enum><text display-inline="yes-display-inline">subparagraph (F) of paragraph (1) for a death of a son or daughter shall expire at the end of the 12-month period beginning on the date of such death.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H59C38FDC6FF14C8E98690C9600F4E6FB"><enum>(4)</enum><header>Requirements relating to leave</header> 
<subparagraph id="H9157DFA4C221477E9261A534E4AA08A9"><enum>(A)</enum><header>Schedule</header><text>Section 6382(b)(1) of such title is amended by inserting after the third sentence the following new sentence: <quote>Leave under subsection (a)(1)(F) shall not be taken by an employee intermittently or on a reduced leave schedule unless the employee and the employing agency of the employee agree otherwise.</quote>.</text></subparagraph> <subparagraph id="H04E65B6572B74FDDA485A3A1DFCD6A0B"><enum>(B)</enum><header>Substitution of paid leave</header><text>Section 6382(d) of such title is amended, in the first sentence, by striking <quote>or (E)</quote> and inserting <quote>(E), or (F)</quote>.</text></subparagraph> 
<subparagraph id="H8286F612256A403999D7B7928E03B05C"><enum>(C)</enum><header>Notice</header><text>Section 6382(e) of such title is amended by adding at the end the following new paragraph:</text> <quoted-block style="USC" id="H4BB79E9FE6B54D21B8A8DE45F4D3B623" display-inline="no-display-inline"> <paragraph id="H4E8F127E0206460490F8A3634FA6A118" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In any case in which the necessity for leave under subsection (a)(1)(F) is foreseeable, the employee shall provide such notice to the employing agency as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HD0F243B382994BCAA70694F3C51D05E3"><enum>(D)</enum><header>Certification requirements</header><text>Section 6383 of such title is amended by adding at the end the following:</text> <quoted-block style="USC" id="HA6103AE4ECBE4FC9A5FE41D894029E6C" display-inline="no-display-inline"> <subsection id="HC67525E1A6EB47ECBD24A0E7F96020C3"><enum>(g)</enum><text display-inline="yes-display-inline">An employing agency may require that a request for leave under section 6382(a)(1)(F) be supported by a certification issued at such time and in such manner as the Office of Personnel Management may by regulation prescribe. If the Office issues a regulation requiring such certification, the employee shall provide, in a timely manner, a copy of such certification to the employer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section>
