id="HAA9B4A14F40941C1878BFE4A48CD53DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating Access to Critical Therapies for ALS Reauthorization Act of 2026</short-title></quote>.</text></section><section id="H8276D0D79BAB4422B43369FB7490754F"><enum>2.</enum><header>Reauthorization of Accelerating Access to Critical Therapies for ALS Act</header><subsection id="H3081394B451D4358A3A2EC2ACBF29E2F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7 of the Accelerating Access to Critical Therapies for ALS Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/79">Public Law 117–79</external-xref>) is amended by striking <quote>2026</quote> and inserting <quote>2031</quote>.</text></subsection><subsection id="H32E3B5471BA6416A8223B9C0857ACFB5"><enum>(b)</enum><header>Grants for ALS research</header><text display-inline="yes-display-inline">Section 2(f) of the Accelerating Access to Critical Therapies for ALS Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee</external-xref> note) is amended by striking <quote>2026</quote> and inserting <quote>2031</quote>.</text></subsection></section><section id="HD1C0854EACA241C1A1FE277A17C38D4D"><enum>3.</enum><header>Improvements to program for grants for research on therapies for ALS</header><subsection id="HD6F593F2AC5D4948AD7737AC22501929"><enum>(a)</enum><header>Renewal of grants for research on therapies for ALS review</header><text display-inline="yes-display-inline">Section 2(b) of the Accelerating Access to Critical Therapies for ALS Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC1EDB429A4A24889A460BB002C7D1329" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H5D3AF5BFC76B46809D7E41F1F61C0657"><enum>(4)</enum><header>Renewal of grants for research on therapies for ALS review</header><text display-inline="yes-display-inline">In reviewing applications for renewals of a grant awarded under this section with respect to an investigational drug, the Secretary shall request from the manufacturer or sponsor, and assess, the enrollment, safety, and any available efficacy data relating to the investigational drug in the prevention, diagnosis, mitigation, treatment, or cure of amyotrophic lateral sclerosis.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA47C1DEB683546449EE0BE33CC92FB43"><enum>(b)</enum><header>Reporting safety data</header><text display-inline="yes-display-inline">Section 2(c) of the Accelerating Access to Critical Therapies for ALS Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee</external-xref> note) is amended—</text><paragraph id="HBFD85CD99C53456DB86FA89256DE50E3"><enum>(1)</enum><text>in paragraph (2)(B), by striking <quote>and</quote> at the end; </text></paragraph><paragraph id="H249682FB1C0947659332AEF8FD9695D7"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and </text></paragraph><paragraph id="H5ACC7493BCA843DB9FB3485CD2A93464"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2805FF3452774DCF80884CA8FA1B93BB" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H9460CFDB57834ACE92FDE499E8F20DC7"><enum>(4)</enum><text display-inline="yes-display-inline">the entity seeking such grant will promptly report any new and serious adverse events and safety information that is considered to be unexpected with respect to the phase 3 trial to the grant-making institution, in addition to complying with the safety reporting requirements under section 312.32 of title 21, Code of Federal Regulations (or any successor regulations).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDC32B704EE474D9A9EE0A9B893257F91"><enum>(c)</enum><header>Clarifying participating clinical trial definition</header><text display-inline="yes-display-inline">Section 2(e) of the Accelerating Access to Critical Therapies for ALS Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H333CE2C8BA754A96B0E668812D0FA20B" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="HB5DCF98F714A491992A1FF81DEF7882B"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>phase 3</quote>, with respect to a clinical trial, includes a phase 2/3 combined trial that begins enrollment within a timeframe, determined by the Secretary through the terms and conditions of the grant awarded under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H1542911648D14AADBF039F53D1FC275D"><enum>4.</enum><header>FDA rare neurodegenerative disease action plan</header><text display-inline="no-display-inline">Section 4 of the Accelerating Access to Critical Therapies for ALS Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360aa">21 U.S.C. 360aa</external-xref> note) is amended—</text><paragraph id="H3FBBC5567A824656B5637D9AFCB1A0B1"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">ALS and other rare neurodegenerative disease action plan</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">FDA rare neurodegenerative disease action plan</header-in-text></quote>; and</text></paragraph><paragraph id="HB381C414C54440F7B5943F1877A50EF3"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H5C8C53DCE4E44EF2A4CB77D02BBA6EAE" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="H2CF84790A4894160BA47E0EDD4685ECC"><enum>(c)</enum><header>FDA rare neurodegenerative disease action plan</header><paragraph id="H43A4989686654379A622B91BF093D689"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of the <short-title>Accelerating Access to Critical Therapies for ALS Reauthorization Act of 2026</short-title>, the Commissioner of Food and Drugs shall publish on the website of the Food and Drug Administration an action plan that includes a description of the actions that the Food and Drug Administration intends to take during the 5-year period following publication of the action plan with respect to the program enhancements, policy development, regulatory science initiatives, and other appropriate initiatives described in subsection (a).</text></paragraph><paragraph id="H0C88E7ABFF144258A5129820B9995DE4"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of the Accelerating Access to Critical Therapies for ALS Reauthorization Act of 2026, the Commissioner of Food and Drugs shall publish on the website of the Food and Drug Administration a report that describes the actions taken by the Food and Drug Administration under the action plan published under paragraph (1) and the extent to which such action plan meets the requirements specified in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date>July 9,
