<section id="H3BB12BA871D94D0CABB72A8F1CC30596" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Interstate Ferry Fairness Act</short-title></quote>.</text></section> <section id="H4219049949A24AD4838AAF57203A8F64"><enum>2.</enum><header>Amendment to allow privately owned ferries and ferry terminal facilities to be eligible for Ferry Boat Program</header> <subsection id="HFC9E947207584A1DB60E5F4CFB6BAAF1"><enum>(a)</enum><header>Permissibility of Federal participation in construction of privately owned ferries or ferry terminal facilities</header><text>Section 129(c) of title 23, United States Code, is amended—</text> 
<paragraph id="H3B8DB1BC5232469CA54EC9D41272F284"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph id="H17230946501543A886FEBADB9CD6598D"><enum>(A)</enum><text>by inserting <quote><header-in-text level="subparagraph" style="USC"><enum-in-header>(A)</enum-in-header></header-in-text></quote> before <quote>The operation</quote>; and</text></subparagraph> 
<subparagraph id="HF17CE71E2C2D46B2AF857E6FBB6481E7"><enum>(B)</enum><text>by striking <quote>on a route</quote> and all that follows through the period at the end and inserting </text> <quoted-block style="USC" id="H5F87BBB21976435E9D93DB6E0EEDB4E7" display-inline="yes-display-inline"><text display-inline="yes-display-inline">on a route—</text> 
<clause id="H27104A09B40F44A9B0AA75320EAB265D" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">classified as a public road within the State and which has not been designated as a route on the Interstate System or on a public transit ferry eligible under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49; or</text></clause> <clause id="H1E1B972F2FEA4106A18B7B452BE7C68C" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">between 2 adjoining States and that connects one or more public roads.</text></clause> 
<subparagraph id="H95BDBDE44331495C94E1FDA3FBE27E50" indent="up1"><enum>(B)</enum><text>Projects under this subsection may be eligible for both ferry boats carrying cars and passengers and ferry boats carrying passengers only.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HF25F977088B9462BBF2D373E988DA08E"><enum>(2)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H74F5B8DD5C894A1FAF34E5E7DAC2D19C"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>shall be</quote> and all that follows through the period at the end and inserting </text> <quoted-block style="USC" id="H4852CE62224448909A66806B97D042D1" display-inline="yes-display-inline"><text display-inline="yes-display-inline">shall be—</text> 
<clause id="H5D9FB08E7C1B4ABFBE621759DD6675B1" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">publicly owned or operated;</text></clause> <clause id="HE3F970E2C4EA4D71820D7538C48176B7" indent="up1"><enum>(ii)</enum><text>majority publicly owned, if the Secretary determines with respect to such majority publicly owned ferry or ferry terminal facility that the ferry boat or ferry terminal facility provides substantial public benefits; or</text></clause> 
<clause id="HD436393B76184346AE3D015C64AA12AF" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to a ferry that operates between 2 adjoining States or a ferry terminal facility that supports such a ferry, privately owned or majority privately owned, if the Secretary determines with respect to such ferry or ferry terminal facility that the ferry boat or ferry terminal facility provides substantial public benefits or otherwise meets the foremost needs of the surface transportation system described in section 101(b)(3)(D).</text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph> <subparagraph id="HAB0BDB928FBF455FA727A0A51DD1529C"><enum>(B)</enum><text>in subparagraph (B)—</text> 
<clause id="H70F43B38DE59455A92D4FE2EE0F4694A"><enum>(i)</enum><text>by striking <quote>Any Federal participation</quote> and inserting <quote><header-in-text level="clause" style="USC"><enum-in-header>(i)</enum-in-header></header-in-text> Except as provided in clause (ii), any Federal participation</quote>; and</text></clause> <clause id="HA6144475624D4F27B154D4E6FE47B3BE"><enum>(ii)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block style="USC" id="H475CB94F973640AC96BE487A658E2419" display-inline="no-display-inline"> 
<clause id="H039FA57003F24AF7A934FF8D6296D275" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">Federal participation may involve the construction or purchase, for private ownership, of—</text> <subclause id="H4CD5C2EA8CBF4B2B98F161C2798AEC8C"><enum>(I)</enum><text>a ferry boat that operates between 2 adjoining States; or</text></subclause> 
<subclause id="H39C00B69F3DE4BACB2127B9F71E43CA0"><enum>(II)</enum><text>a ferry terminal facility or any other eligible project under this section that supports such ferry boat.</text></subclause></clause><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="H6255D1E8F149410D98DAFCF629F86100"><enum>(3)</enum><text>in paragraph (4)—</text> 
<subparagraph id="H5057C1BF33C443438208C9FE52CBFFA1"><enum>(A)</enum><text>by inserting <quote><header-in-text level="subparagraph" style="USC"><enum-in-header>(A)</enum-in-header></header-in-text></quote> before <quote>The operating authority</quote>;</text></subparagraph> <subparagraph id="HD6131328CD2441CB8D59CEC0615704D2"><enum>(B)</enum><text>by striking <quote>such ferry</quote> and inserting <quote>a publicly owned or a majority publicly owned ferry</quote>;</text></subparagraph> 
<subparagraph id="HAEF4D2619BD24B09B98278B50CAB9B8C"><enum>(C)</enum><text>by striking <quote>a privately operated toll ferry</quote> and inserting <quote>a privately operated toll ferry not subject to subparagraph (B)</quote>; and</text></subparagraph> <subparagraph id="HF2F6A78AAC0749AD94E951D6D49DA547"><enum>(D)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" id="H0C63249A8E11401A9B361B85C55492BF" display-inline="no-display-inline"> 
<subparagraph id="HED0EC1F3078741C9884D816A9A5FDE18" indent="up1"><enum>(B)</enum><text>A privately owned or majority privately owned ferry operating between 2 adjoining States may charge a fare for passage on such ferry in an amount not more than the sum of an amount necessary to produce revenues sufficient to cover actual and necessary costs of operation, maintenance, repair, debt service, negotiated management fees, plus an amount that the Secretary determines is a reasonable rate of return for the ferry. All revenues derived therefrom shall be applied to such actual and necessary costs, except the ferry may retain the amount that the Secretary determines is a reasonable rate of return.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HF293F6190FBE4BA896A37CAD01130D01"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H337301FE39EB4023808BB588C1208CF1"><enum>(1)</enum><header>Surface transportation block grant program</header><text>Section 133(b)(1)(B) of title 23, United States Code, is amended to read as follows: </text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H88B450A14E0346DD8D0D92BA5B4541DF"> 
<subparagraph id="H03E488444DC046278E42B684FE298E30"><enum>(B)</enum><text display-inline="yes-display-inline">ferry boats and terminal facilities that are eligible for funding under section 129(c);</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HE6D77A49711641BD91DC49D1AFDFD3F0"><enum>(2)</enum><header>Construction of ferry boats and ferry terminal facilities</header><text display-inline="yes-display-inline">Section 147(c) of title 23, United States Code, is amended by striking <quote>public entities</quote> and inserting <quote>entities</quote>.</text></paragraph></subsection> 
<subsection id="HD3EEC535577A452B8DC1EE85502362E5"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take affect with respect to a privately owned, or majority privately owned, ferry or ferry terminal facility for purposes of eligibility of the program under section 147 of title 23, United States Code, on the date that is 1 year after the date of enactment of this Act.</text> </subsection> </section> </legis-body></bill>
