<section id="H69103C5393824D59A20D142353566C29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsible Cormorant Management and Control Act of 2026</short-title></quote>.</text></section> <section id="H207FD116504845C0B073DEA66869B075" section-type="subsequent-section"><enum>2.</enum><header>Regional management frameworks for take of double-crested cormorants</header> <subsection id="H017E32AFBAE04E539483225D49365E56"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary, in coordination with the applicable Regional Flyway Council, shall develop a regional management framework for the take of double-crested cormorants for each region covered by a Regional Flyway Council based on existing information.</text></subsection> 
<subsection id="HAB8B22CA65854F85AAE568DBD3EE7DD6"><enum>(b)</enum><header>Requirements</header><text>Each regional management framework developed under subsection (a) shall—</text> <paragraph id="H3A9D13CA19764C69B3A975C4D3268504"><enum>(1)</enum><text>ensure the breeding population of double-crested cormorants is maintained at a sustainable level—</text> 
<subparagraph id="H1E3DE4BDD7B6416BB38E7C7017EBFC56"><enum>(A)</enum><text>in accordance with the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>); and</text></subparagraph> <subparagraph id="H8EA114B283DE491CAF2E92A5EDBD5823"><enum>(B)</enum><text>beginning with the first update required by subsection (e), as informed by the most recent survey carried out under subsection (d);</text> </subparagraph></paragraph> 
<paragraph id="H782EC88F416E4296B805CCDD279B6313"><enum>(2)</enum><text>include, with respect to double-crested cormorants—</text> <subparagraph id="H0087DCB7DAFF4693B2CEC69EE4450CD3"><enum>(A)</enum><text>allowed methods of take; and</text></subparagraph> 
<subparagraph id="H908C5F0D9A79488496315B9E81FD826D"><enum>(B)</enum><text>allowed time periods of take;</text></subparagraph> </paragraph> <paragraph id="H054D0A990E6C4053B6BA0F3810483CE4"><enum>(3)</enum><text>identify entities that may take double-crested cormorants, which shall include—</text> 
<subparagraph id="HF82268326A2845C4821738CDDF801ECB"><enum>(A)</enum><text>State and Tribal agencies; and</text></subparagraph> <subparagraph id="H5D4E83C4DA1A4942B2EC05E40A13B130"><enum>(B)</enum><text>entities licensed or otherwise authorized in a manner the Secretary determines appropriate, which shall include—</text> 
<clause id="HF833188E2480423D8F7580233D2D4836"><enum>(i)</enum><text>State licensed or otherwise authorized hunters;</text></clause> <clause id="HE19C2E793D97422096D43BECAAD58620"><enum>(ii)</enum><text>lake managers; and</text></clause> 
<clause id="H27646777A33E404FBBB415F55DD81103"><enum>(iii)</enum><text>pond managers;</text> </clause></subparagraph></paragraph> <paragraph id="H494022EBD69C4611B7A45541B9F0FB56"><enum>(4)</enum><text>provide for—</text> 
<subparagraph id="HE5113EAECDBF4C748A1268366BBA7A59"><enum>(A)</enum><text>States and Indian Tribes to take specific management actions with respect to double-crested cormorants in accordance with the regional management framework; and</text></subparagraph> <subparagraph id="HBBE68500C579481993D54332F557CAC5"><enum>(B)</enum><text>the implementation of management actions identified under subsection (c); and</text> </subparagraph></paragraph> 
<paragraph id="HF624E89ADEDC407AB570B94BAEE8B7C7"><enum>(5)</enum><text>account for the effects of an overabundant population of double-crested cormorants on—</text> <subparagraph id="HB9957C2817BD44BBAE2C11B5F77F1471"><enum>(A)</enum><text>fisheries;</text></subparagraph> 
<subparagraph id="H2EF6622420C441CD9D055224CAE52123"><enum>(B)</enum><text>sensitive vegetation;</text> </subparagraph> <subparagraph id="H0461D28EBEE04A30AB1448FE781B4CFB"><enum>(C)</enum><text>populations of other migratory birds;</text></subparagraph> 
<subparagraph id="H3FF6BC66B50142EB92AD83B4840E1DA3"><enum>(D)</enum><text>human health and safety;</text></subparagraph> <subparagraph id="H70064EBDF927422180C91F7A74A52BDA"><enum>(E)</enum><text>water quality; and</text></subparagraph> 
<subparagraph id="HFFB2F772A3614DC29EC92AFEDAB54DEE"><enum>(F)</enum><text>species listed as threatened species or endangered species under section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>).</text></subparagraph></paragraph></subsection> <subsection id="HDB018A98163542B2A3870F2E900AC89E" commented="no"><enum>(c)</enum><header>Incorporation of National Wildlife Refuge System</header><text>In developing each regional management framework under subsection (a), the Secretary, in cooperation with the heads of State and Tribal game and fish agencies and the applicable Regional Flyway Council, shall identify appropriate management actions that can be taken within units of the National Wildlife Refuge System to meet management objectives of States, Indian Tribes, the Regional Flyway Councils, and such units with respect to double-crested cormorants while fulfilling the primary purposes of such units.</text></subsection> 
<subsection id="H8B18C6534BA445E99D33D9762A1B5285"><enum>(d)</enum><header>Population surveys</header><text display-inline="yes-display-inline">Not later than 5 years after the date of the enactment of this section and every 5 years thereafter, the Secretary, in coordination with the Regional Flyway Councils, shall carry out a survey of the population of double-crested cormorants.</text></subsection> <subsection id="HCB27092A694D4F4FA14B92ACBCDD9CC8"><enum>(e)</enum><header>Updates</header> <paragraph id="HF36506F56CDE4B3B909689B1459636FF"><enum>(1)</enum><header>In general</header><text>Not later than 5 years after the date of the enactment of this section and every 5 years thereafter, the Secretary, in coordination with the applicable Regional Flyway Council, shall review and update each regional management framework developed under subsection (a).</text></paragraph> 
<paragraph id="H1038CC2CBB4641F9A3DC8A66F9245BEE"><enum>(2)</enum><header>Incorporation of population surveys</header><text>In reviewing and updating a regional management framework under paragraph (1), the Secretary shall incorporate the results of the most recent survey carried out under subsection (d).</text> </paragraph></subsection> <subsection id="H848C6C8046EE449F98667ECFBF6B61A4"><enum>(f)</enum><header>Definitions</header><text>In this section:</text>

                    <enum>(1)</enum>
                    <header>Double-crested cormorant</header>
 <text display-inline="yes-display-inline">The term <term>double-crested cormorant</term> means the species Nannopterum auritum.</text>
                </paragraph> 
<paragraph id="H67B79D6A19E143698F3F6D500CA12EE3"><enum>(2)</enum><header>Regional Flyway Council</header><text>The term <term>Regional Flyway Council</term> means—</text> <subparagraph id="HDFD3DE0704A44C4797C6DFA621734868"><enum>(A)</enum><text>the Atlantic Flyway Council;</text></subparagraph> 
<subparagraph id="H4A5A4F7EB34548B7B54DB8399A997295"><enum>(B)</enum><text>the Central Flyway Council;</text></subparagraph> <subparagraph id="H4CA2AF6762CF4FD1A93E3FB2DBD0BE04"><enum>(C)</enum><text>the Mississippi Flyway Council; and</text></subparagraph> 
<subparagraph id="H2FB9B98B2C1B4780A5B5CE0C6C1641FD"><enum>(D)</enum><text>the Pacific Flyway Council.</text></subparagraph></paragraph> <paragraph id="HAA91B441273E4A4CBCEF299A63ED9062" commented="no"><enum>(3)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph> 
<paragraph id="HDDFC998ADEF14131BCA911890A73F641"><enum>(4)</enum><header>Lake manager</header><text display-inline="yes-display-inline">The term <term>lake manager</term> means a person that is licensed or otherwise authorized by a State regulatory agency to manage a private lake.</text></paragraph> <paragraph id="H37AF3CB861B14E60934F72FC66F7EBF0"><enum>(5)</enum><header>Migratory bird</header><text display-inline="yes-display-inline">The term <term>migratory bird</term> has the meaning given the term <term>migratory birds</term> in section 11 of the Migratory Bird Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/715j">16 U.S.C. 715j</external-xref>).</text> </paragraph> 
<paragraph id="H52691BC82635498CB277BFD705C3835A" commented="no"><enum>(6)</enum><header>Pond manager</header><text display-inline="yes-display-inline">The term <term>pond manager</term> means a person that is licensed or otherwise authorized by a State regulatory agency to manage a private pond.</text> </paragraph> <paragraph id="HDE61112B0B7D4906A97DAD302DA7CCB4"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph> 
<paragraph id="H3133D21B3C314A8F9A44BC3ABB17A56C"><enum>(8)</enum><header>Take</header><text>The term <term>take</term> has the meaning given the term in section 10.12 of title 50, Code of Federal Regulations (as in effect on the date of the enactment of this section).</text> </paragraph></subsection></section> </legis-body></bill>
