<section id="H3F996541F0A74B669B52BE676067D1CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Roads Improvement Act</short-title></quote>.</text></section> <section id="H31DE582E6A0E4FE68B0A32FABB6C6A17" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HA3EB5FB04F5148B29CF53E1F9D8DE48F"><enum>(1)</enum><text display-inline="yes-display-inline">Approximately 160,000 miles of roads exist on or provide access to Tribal lands, with an estimated 65 percent in poor or failing condition.</text></paragraph> <paragraph id="HA0F2D39B4F554F5AAFF9C301CC16AFD6"><enum>(2)</enum><text display-inline="yes-display-inline">Inadequate road grading on Tribal lands contributes to increased vehicle damage, emergency response delays, reduced economic development opportunities, and isolation of Tribal communities.</text></paragraph> 
<paragraph id="H0C5E474F95F544B9B474C20B4AD9E438"><enum>(3)</enum><text display-inline="yes-display-inline">Poor road conditions disproportionately impact Tribal members’ access to healthcare, education, employment, and essential services.</text></paragraph> <paragraph id="H483F6682C48549299D71F9BBA0E17320"><enum>(4)</enum><text display-inline="yes-display-inline">Current Federal funding for Tribal road maintenance addresses less than 35 percent of identified needs.</text></paragraph> 
<paragraph id="HAE92389FD6FF4BDBB3FB15DFA4D62150"><enum>(5)</enum><text display-inline="yes-display-inline">Tribal governments possess the capacity and expertise to manage road grading projects efficiently when provided adequate resources and regulatory flexibility.</text></paragraph> <paragraph id="HA63A131600EA4AE090119280630C8ADB"><enum>(6)</enum><text display-inline="yes-display-inline">Improving Tribal road infrastructure serves Federal trust responsibilities and promotes Tribal self-determination.</text></paragraph></section> 
<section id="HD5067328E1DA4457A67A86B9FE0FF244"><enum>3.</enum><header>Tribal road grading</header><text display-inline="no-display-inline">Section 202(a)(8)(A) of title 23, United States Code, is amended by inserting <quote>grading and</quote> after <quote>excluding road</quote>.</text></section> <section id="HC26C2F3EEA2B4EF09E3748041E881BB3"><enum>4.</enum><header>Study</header> <subsection id="H79798D009FB54192A92DFB7F44523990"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary shall conduct a study to determine the impact of removing the limitation on TTP road grading funds pursuant to the amendment made by section 3, including—</text> 
<paragraph id="H2132CDF5CE40482F881B82EBCDE890D8"><enum>(1)</enum><text display-inline="yes-display-inline">the number of Indian Tribes spending, with respect to road grading, at least—</text> <subparagraph id="H0444483CA02146699EACDE5C8B58F4D7"><enum>(A)</enum><text>25 percent of the TTP funds allocated to the Indian Tribe; or</text></subparagraph> 
<subparagraph id="HAA35277135384FCC9CCE7B0014B88253"><enum>(B)</enum><text>$500,000;</text></subparagraph></paragraph> <paragraph id="H89332B46ABF74DF5819A127C1CAFC8B3"><enum>(2)</enum><text>the number of miles of Tribal roads graded after the removal of the limitation;</text></paragraph> 
<paragraph id="H0EDDE859DF314C6E81ACC58E58F2B00F"><enum>(3)</enum><text>improvements in road condition ratings on participating Tribal transportation facilities;</text></paragraph> <paragraph id="H2E5A7F9AE06E48BEAB04680C741BDB26"><enum>(4)</enum><text>impacts on Tribal economic development, emergency response times, and community access;</text></paragraph> 
<paragraph id="H25514CBB4D3842EC82C3E635EE88C0BD"><enum>(5)</enum><text>Tribal satisfaction with flexibility provided by the removal of the limitation; and</text></paragraph> <paragraph id="H7896907791224F42945BB8FBBB4B2816"><enum>(6)</enum><text>employment of Tribal members in Tribal road grading projects.</text></paragraph> </subsection> 
<subsection id="HBD7379331CDA4AE7959E964EE3B0AE9A"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 2 years after the completion of the study under subsection (a), the Secretary shall submit to Congress a report that includes—</text> <paragraph id="H5B157C9D68B447EBA2A5A15034AB28AC"><enum>(1)</enum><text>the results of the study; and</text></paragraph> 
<paragraph id="HA1DDBCF099194F8D8B5C4E55165DC9A3"><enum>(2)</enum><text>recommendations with respect to addressing the continued need to Tribal road grading and ways to support Tribal road grading initiatives.</text></paragraph></subsection> <subsection id="H672D0CDC95A14181BB380E0D7007713B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0F948C5EBD4C461A82AF33CA5603B3D5"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the Bureau of Indian Affairs.</text></paragraph> <paragraph id="H325902129093422D931F36B58CFEF9B4"><enum>(2)</enum><header>Tribal transportation facility</header><text>The term <term>Tribal transportation facility</term> has the meaning given the term <term>tribal transportation facility</term> in section 101 of title 23, United States Code.</text></paragraph> 
<paragraph id="HD47B0C0BF42640E0906B569B16C4AF56"><enum>(3)</enum><header>TTP</header><text>The term <term>TTP</term> means a tribal transportation program as such term is used in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/2">chapter 2</external-xref> of title 23, United States Code.</text></paragraph> </subsection></section> </legis-body></bill>
