which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To create a database of eviction information, establish grant programs for eviction prevention and legal aid, and limit use of housing court-related records in consumer reports, and for other purposes.</official-title></form><legis-body id="H567306E51FCE4510B74FBEDC6465C3C5" style="OLC"><section id="H28C2FF9C3CEC4887AB9F3F239D65DB99" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Emergencies Lifeline Program Act of 2026</short-title></quote> or the <quote><short-title>HELP Act of 2026</short-title></quote>.</text></section><section id="H9D70553888764F86BB41E67426CC4F6B"><enum>2.</enum><header>Database of eviction information</header><subsection id="H89FEEFDE5ED24F2DA342651DAB4DA520"><enum>(a)</enum><header>Reports by housing providers</header><paragraph id="HA53CA9AC8D284BF996075E010E5AB461"><enum>(1)</enum><header>In general</header><text>The Secretary of Housing and Urban Development shall require each State and local entity that receives covered housing assistance to submit to the Secretary annual reports under this section regarding evictions from assisted dwelling units of the covered housing occurring during the preceding year.</text></paragraph><paragraph id="H063BA2E05E3547FFBD68F4CEEDB5554F"><enum>(2)</enum><header>Contents</header><text>Each report submitted pursuant to subsection (a) shall include—</text><subparagraph id="H521D9AE408E24923A48DE796B688DF64"><enum>(A)</enum><text>for each household subject to an eviction proceeding during the year which the report covers—</text><clause id="H6A062611FA384F20AE69FFB569BF5953"><enum>(i)</enum><text>the reason or reasons that the eviction proceeding was undertaken and, in the case of any eviction proceeding undertaken in whole or in part based on an arrearage in rent owed, the amount of such arrearage and the amount of the tenant’s required contribution toward rent;</text></clause><clause id="H25961B89E122458DBB41825A4D201217"><enum>(ii)</enum><text>the date on which the household was ordered to be evicted;</text></clause><clause id="HFB8378C6DF61419594FFD6C1AFC0DE33"><enum>(iii)</enum><text>the address of the dwelling unit from which the household was evicted;</text></clause><clause id="H994CB696497847F6A4AEC2ECE41F8F36"><enum>(iv)</enum><text>whether the household was represented by legal counsel in any eviction proceeding, if such information is available;</text></clause><clause id="H8C5EB5A78BE74CEC82A191FA2A43C2A4"><enum>(v)</enum><text>the number of days the household was given to vacate the dwelling unit, if such information is available; and</text></clause><clause id="HF6D9EF5EF304491386920A561B6A5397"><enum>(vi)</enum><text>whether a writ of execution was issued in regards to the eviction; and</text></clause></subparagraph><subparagraph id="HE91C51EEB853477086BBE7266A55D9CE"><enum>(B)</enum><text>for each individual in any household subject to an eviction proceeding during the year which the report covers—</text><clause id="HE3236DDC8576467CBFE065BBAE09A6AB"><enum>(i)</enum><text>the name of the individual;</text></clause><clause id="H187BD688388F4D38BF61E11F3BFD6F93"><enum>(ii)</enum><text>the annual income of the individual in the fiscal year prior to the year during which the individual was evicted, if available;</text></clause><clause id="HA9D0380844C349458C1FC19C7F1528B6"><enum>(iii)</enum><text>the disability status of the individual evicted, if available;</text></clause><clause id="H0C6E8BD8B7AE45DD81648DEEB3EDF261"><enum>(iv)</enum><text>any available demographic information about the individual including race, ethnicity, age, and gender;</text></clause><clause id="HAF50AF78BA7C44D39660369A0FB5B296"><enum>(v)</enum><text>any foster care history for the individual, if available;</text></clause><clause id="H6046D4374AA548B4AB301CCB5A65D53B"><enum>(vi)</enum><text>any serious physical health problems or serious mental illness of the individual, if such information is available;</text></clause><clause id="H56F6F3AC0F684113A2AEB1F82321BDB1"><enum>(vii)</enum><text>any history of prior homelessness of the individual, if such information is available; and</text></clause><clause id="H937C3142532E470FA5E0610EE2C63F7F"><enum>(viii)</enum><text>whether the individual has a criminal record, if such information is available.</text></clause></subparagraph></paragraph><paragraph id="HE4E043F4E5534D13B6BB50E6EDE4F91B"><enum>(3)</enum><header>Data requirements</header><text>The Secretary of Housing and Urban Development shall develop requirements for States and local entities that receive covered housing assistance that—</text><subparagraph id="HFE3EF834E88B4FC3BB70538991349391"><enum>(A)</enum><text>provides limitations on how long the information described in paragraph (2) shall be retained; and</text></subparagraph><subparagraph id="HD20E521EF2924E97A240C4D5A6C79589"><enum>(B)</enum><text>establishes data privacy and security requirements for the information described in paragraph (2) that—</text><clause id="HBEC0648B50EA4852B73C41845A0071DB"><enum>(i)</enum><text>includes appropriate measures to ensure that the privacy of the individuals and households is protected and that the information, including any personally identifiable information, is collected and used only for the purpose of submitting reports under paragraph (1); and</text></clause><clause id="H21809809235448ED8472D628BC9FB227"><enum>(ii)</enum><text>ensures that any names collected are redacted and replaced with an anonymous identifier.</text></clause></subparagraph></paragraph></subsection><subsection id="H9BBB267E664D46E1BA87140FFBC951FC"><enum>(b)</enum><header>Database</header><paragraph id="H2C0F5F25CCA54DA9A64D416414034BBA"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a database for collecting and maintaining information submitted in reports pursuant to subsection (a).</text></paragraph><paragraph id="H7D158C4949A946C78DEA3715DA1EF3F2"><enum>(2)</enum><header>Disaggregation</header><text>To the extent possible, such database shall be disaggregated by the smallest census tract, block group, or block possible for the data set, and by income, race, gender, disability, and all other protected classes under the Fair Housing Act.</text></paragraph><paragraph id="H77D4A5D8F1D249238D43929966B809AE"><enum>(3)</enum><header>Privacy protections</header><text>The Secretary shall establish appropriate measures regarding information in the database to ensure that, subject to paragraph (3), the privacy of the individuals and households is protected and that any personally identifiable information is not disclosed, including by redacting all names.</text></paragraph><paragraph id="HCAD09B41D0C247FBA62D7F8A050F3DA3"><enum>(4)</enum><header>Research</header><text>The Secretary may make full and unredacted information available to academic institutions for the purpose of researching causes and solutions to evictions and adherence to civil rights protections.</text></paragraph></subsection></section><section id="H9BA0D9F170E24F06A5B394122C947658"><enum>3.</enum><header>Eviction protection grant program</header><subsection id="H2D1CBD370A0C4DF6A4B03EE4B6F137D8"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a grant program to award competitive grants to eligible entities as described in this section.</text></subsection><subsection id="H824656981CF942088EFB34B491E7C1F3"><enum>(b)</enum><header>Eligibility</header><text>To be eligible for a grant under this section, an entity shall be a nonprofit or government entity.</text></subsection><subsection id="H26CE5F449C8C434B8B1D14E062B5EC6E"><enum>(c)</enum><header>Eligible uses</header><text display-inline="yes-display-inline">An entity that is awarded a grant under this section shall use such grant to provide legal assistance (including assistance related to pretrial activities, trial activities, post-trial activities and alternative dispute resolution) at no cost to eligible low-income tenants at risk of or subject to eviction.</text></subsection><subsection id="HD06E5C5234074929BBF8835246E04244"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall give preference to eligible entities that—</text><paragraph id="H47B6ED475918413BB05860EBE3476ECE"><enum>(1)</enum><text>include a marketing strategy for residents of areas with high rates of eviction;</text></paragraph><paragraph id="H1EED719EDF7C4F758D6D3DB99AE08A56"><enum>(2)</enum><text>have experience providing no-cost legal assistance to low-income individuals, including those with limited English proficiency or disabilities; and</text></paragraph><paragraph id="H652D5FF7FE874095BF9796E180928D9D"><enum>(3)</enum><text>have sufficient capacity to administer such assistance.</text></paragraph></subsection><subsection id="H0025B99808564BC9AF4467399BF9D4D6"><enum>(e)</enum><header>Use in urban and rural areas</header><text display-inline="yes-display-inline">The Secretary shall ensure, to the extent practicable, that the proportion of tenants living in rural areas who will receive legal assistance with grant amounts under this section is not less than the overall proportion of tenants who live in rural areas.</text></subsection><subsection id="HC7B7CB7B00A24A63A5777DEEB0E00D38"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary such sums as needed for—</text><paragraph id="H719DB22FFE324C469D431C3579B54936"><enum>(1)</enum><text>grants under this section; and</text></paragraph><paragraph id="H3E445EB0D60E4002916D6441ADEA6E9E"><enum>(2)</enum><text>assistance under the emergency solutions grants program under subtitle B of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11371">42 U.S.C. 11371 et seq.</external-xref>), to be used only for—</text><subparagraph id="H2EC69DCAF95045FB8249DAF809EACCDD"><enum>(A)</enum><text>providing legal counsel for tenants subject to or at risk of eviction with regard to any eviction related legal proceeding; and</text></subparagraph><subparagraph id="HBD6363D15B2C480993FB61F2AD0F444D"><enum>(B)</enum><text>costs of any court fees associated with an eviction-related legal proceeding for a tenant (excluding any attorneys fees for the attorney of the landlord of the tenant).</text></subparagraph></paragraph></subsection></section><section id="HCC894F4781F64DD1A2E041057ED54408"><enum>4.</enum><header>Consumer reports</header><subsection id="H8DC08C1A6BBC4596840C2500577B4172"><enum>(a)</enum><header>In general</header><text>Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HCC8E63E12C2F4432B0967055340CB27C" style="OLC"><paragraph id="H260B7EBA08664F55A865FAD8694E8DBE"><enum>(9)</enum><text>An eviction, or any information related to an eviction or a proceeding seeking eviction, of a consumer from a rental dwelling.</text></paragraph><paragraph id="HBFDC7A8665E44757A4FD98DD936B6421"><enum>(10)</enum><text>Any adverse item of information related to rent or utility arrears.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H85005B5F17674F4691FF676F508C96FB"><enum>(b)</enum><header>Applicability</header><text>The amendment made by this section shall apply to any consumer report (as defined in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>)) issued on or after the date of the enactment of this Act.</text></subsection></section><section id="H366C3F6EAD4C492CA06AF72D38628A76"><enum>5.</enum><header>Eviction information</header><subsection id="HD7D24DB4063F4D098746E4BF932BF655"><enum>(a)</enum><header>In general</header><text>The Secretary shall, not later than 1 year after the date of the enactment of this Act, issue rules that require each owner of a covered federally assisted rental dwelling unit to ensure that each tenant of such dwelling unit owned by such owner receives information, in writing—</text><paragraph id="H86C5EA28645F498FB0303295B61755A7"><enum>(1)</enum><text>not less than once each year regarding—</text><subparagraph id="HEA345735ADFC4187998AC96F605091E1"><enum>(A)</enum><text>the rights and responsibilities of such owner with regard to eviction; and</text></subparagraph><subparagraph id="H2182228C6D614CB5BFCC766D6A6ACDA4"><enum>(B)</enum><text>local organizations and resources that can provide assistance in eviction-related matters;</text></subparagraph></paragraph><paragraph id="H62E7692118D4429481DAE2FEB579BA75"><enum>(2)</enum><text>upon provision of any notice of eviction, stating the reason or reasons for the eviction; and</text></paragraph><paragraph id="H1AB0BE47B942408F91746433102906E0"><enum>(3)</enum><text>all notices given shall clarify that rights and responsibilities of tenants are subject to State and local law.</text></paragraph></subsection><subsection id="HB138E7A8955C4F3ABADD21A3DFD2CC11"><enum>(b)</enum><header>Hotline</header><text>The Secretary shall, not later than 1 year after the date of the enactment of this Act, establish a hotline to provide assistance with regard to eviction-related matters to tenants of covered federally assisted rental dwelling units. The Secretary shall establish guidance to ensure that the hotline is visible, promoted to consumers, is accessible in English and other languages, has accommodations for those who have disabilities, and maintains adequate staff to match the volume of calls to the hotline. Assistance must direct callers to available resources, including legal aid, and make callers aware of their rights and responsibilities as tenants.</text></subsection></section><section id="H3ACEEC7EEB2B445BB7E8611E4DA082E9"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7649779E56B644D3B8A40CAA75D1841A"><enum>(1)</enum><header>Assistance</header><text>The term <quote>assistance</quote> means any grant, loan, subsidy, contract, cooperative agreement, or other form of financial assistance, but such term does not include the insurance or guarantee of a loan, mortgage, or pool of loans or mortgages.</text></paragraph><paragraph id="H0583B58F59B0482A96582F3842018329"><enum>(2)</enum><header>Covered federally assisted rental dwelling unit</header><text>The term <quote>covered federally assisted rental dwelling unit</quote> means a residential dwelling unit that—</text><subparagraph id="H279004D756424DFF9C2D3580D7BEDD81"><enum>(A)</enum><text>is made available for rental; and</text></subparagraph><subparagraph id="HD1DC91D004014B7E8A563D05E2E531B2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H87FECDA64DB9427FAD388E2904DBDEA2"><enum>(i)</enum><text>for which assistance is provided, or that is part of a housing project for which assistance is provided, under any program administered by the Secretary of Housing and Urban Development, including—</text><subclause id="HED44E30C969A4446A4287C225BF60B20"><enum>(I)</enum><text>the public housing program under the United States Housing Act of 1937 21 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>);</text></subclause><subclause id="HF89563EA3EAB4BD2B2C4EA1D05C41993"><enum>(II)</enum><text>the program for rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>);</text></subclause><subclause id="H4B6174D9ECD84907AB530CF0D8DCA1F5"><enum>(III)</enum><text>the HOME Investment Partnerships program under title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12721">42 U.S.C. 12721 et seq.</external-xref>);</text></subclause><subclause id="H3FD0B5F092244B3D809E7426F6652556"><enum>(IV)</enum><text>title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360 et seq.</external-xref>);</text></subclause><subclause id="H175B839D39034C908CCC438AD47A00F6"><enum>(V)</enum><text>the Housing Trust Fund program under section 1338 of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4568">12 U.S.C. 4568</external-xref>);</text></subclause><subclause id="H2C7BD4E4996B4225A4AECA7BC07A8345"><enum>(VI)</enum><text>the program for supportive housing for the elderly under section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>);</text></subclause><subclause id="HBE53A189C58149ADBEAA2DF256352926"><enum>(VII)</enum><text>the program for supportive housing for persons with disabilities under section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>);</text></subclause><subclause id="H2438FFB591CF416DAAB96297FA9CD47B"><enum>(VIII)</enum><text>the AIDS Housing Opportunities program under subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901 et seq.</external-xref>);</text></subclause><subclause id="HB60B330DA15444A38BDDF1F29DBC3C0A"><enum>(IX)</enum><text>the program for Native American housing under the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>); and</text></subclause><subclause id="H73E4E1FA8EB34868AFC74AF8080B3D8A"><enum>(X)</enum><text>the program for housing assistance for Native Hawaiians under title VIII of the Native American Housing Assistance and Self-Determination Act of 1996 7 (<external-xref legal-doc="usc" parsable-cite="usc/25/4221">25 U.S.C. 4221 et seq.</external-xref>); or</text></subclause></clause><clause id="H0766DFB346FC459C85035856899F6116"><enum>(ii)</enum><text>is a property, or is on or in a property, that has a federally backed mortgage loan or federally backed multifamily mortgage loan, as 11 such terms are defined in section 4024(a) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9058">15 U.S.C. 9058(a)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H94C133830A2E40D4A200C1DCEDBB9BB0"><enum>(3)</enum><header>Covered housing</header><text>The term <quote>covered housing</quote> means a dwelling unit assisted with amounts made available, or a loan or mortgage made, insured, or guaranteed, under any of the following programs:</text><subparagraph id="H75526A747E134C5F96A5A95E1ADF28FF"><enum>(A)</enum><text>The programs for tenant- and project-based rental assistance under section 8 of the United States Housing Act of 1937 (42 U.S.C. 21 1437f).</text></subparagraph><subparagraph id="H94EAD413BC6C468DBA7047773A023924"><enum>(B)</enum><text>The program for public housing under the United States Housing Act of 1937 (42 <external-xref legal-doc="usc" parsable-cite="usc/24/1437">24 U.S.C. 1437 et seq.</external-xref>).</text></subparagraph><subparagraph id="H37EC7FF837E141339AC102D5840CC86F"><enum>(C)</enum><text>The program for supportive housing for the elderly under section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>).</text></subparagraph><subparagraph id="HD44863E3059542E9915821576290CAEF"><enum>(D)</enum><text>The program for supportive housing for persons with disabilities under section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>).</text></subparagraph><subparagraph id="H213DC103651541D7AAEC85D848422436"><enum>(E)</enum><text>The community development block grant program under title I of the Housing and Community Development Act of 1974 (42 <external-xref legal-doc="usc" parsable-cite="usc/11/5301">11 U.S.C. 5301 et seq.</external-xref>).</text></subparagraph><subparagraph id="H211346B2FC6543BA9D198FAA5B4540BC"><enum>(F)</enum><text>The HOME Investment Partnerships program under titles I and II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12704">42 U.S.C. 12704 et seq.</external-xref>).</text></subparagraph><subparagraph id="H614BC7AA4C57474DA79D436DFAA84F31"><enum>(G)</enum><text>The program for housing opportunities for persons with AIDS under subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901 et seq.</external-xref>).</text></subparagraph><subparagraph id="HF1EDC6B5D33148B091309C4287F2BB4F"><enum>(H)</enum><text display-inline="yes-display-inline">The programs for homeless assistance under title IV of the Mckinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11361">42 U.S.C. 11361 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="H885E1FA6E9BE4CFDA9C0194FAFCD5AD4"><enum>(4)</enum><header>Covered housing assistance</header><text>The term <quote>covered housing assistance</quote> means assistance under any program specified in paragraph (3).</text></paragraph><paragraph id="H6B375C5E64D94309AF0CA423BAC41731"><enum>(5)</enum><header>Legal counsel</header><text>The term <quote>legal counsel</quote> means full representation by an attorney throughout proceedings in issue.</text></paragraph><paragraph id="HB3EDE14D842C49E48EA015E3B0933CF8"><enum>(6)</enum><header>Owner</header><text>For the purposes of this Act, the term <quote>owner</quote> means any private person or entity, including a cooperative, an agency of the Federal Government, or a public housing agency, having the legal right to lease or sublease dwelling units.</text></paragraph><paragraph id="H4D0D0C21E19F4DA5A03AB39627FA4DA3"><enum>(7)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means Secretary of Housing and Urban Development.</text></paragraph></section></legis-body></bill>
