                    Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to restrict visa issuance to individuals who have directed, authorized, significantly supported, participated in, or carried out violations of religious freedom.</official-title></form><legis-body id="HDA8147A794BA439584FFE35B7A99D30A" style="OLC"> 
<section id="HED2A094432874A1593361FC836E14D33" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Banning Perpetrators of Religious Persecution Act of 2026</short-title></quote>.</text></section> <section id="H99A1659F564747C3A4605ED3A8258524"><enum>2.</enum><header>Restricting visa issuance to individuals who have carried out violations of religious freedom</header><text display-inline="no-display-inline">Section 212(a)(2)(G) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)(G)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H203CBAC3290A4F31AA286D32F8DB6A1D"> 
<subparagraph id="H0FCE834B81F64DC79E69319D60E4AEBA" commented="no" display-inline="no-display-inline"><enum>(G)</enum><header display-inline="yes-display-inline">Aliens who have committed violations of religious freedom</header> 
<clause commented="no" display-inline="no-display-inline" id="H7E39C8658EEA4159AD54DF5146F9656C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who—</text> <subclause commented="no" display-inline="no-display-inline" id="HB13F7FFC22674E47A76BBC01AF5F2266"><enum>(I)</enum><text display-inline="yes-display-inline">while serving as a foreign government official, was responsible for, or directly carried out, at any time, particularly severe violations of religious freedom (as defined in section 3(13) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6402">22 U.S.C. 6402(13)</external-xref>)); or</text></subclause> 
<subclause id="HFED3CEC3CF9048B6853AAC2D8988B17B">
                            <enum>(II)</enum>
 <text>at any time while outside the United States, directed, authorized, significantly supported, participated in, was responsible for, or carried out particularly severe violations of religious freedom or violations of religious freedom (as defined in section 3(16) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/6402">22 U.S.C. 6402(16)</external-xref>));</text>
                        </subclause><continuation-text continuation-text-level="clause">is inadmissible.</continuation-text></clause> 
<clause id="HDF6AE5CF79CF44629F404F8FB5A26F78"><enum>(ii)</enum><header>Public notice</header> 
<subclause commented="no" display-inline="no-display-inline" id="H90D543ACAE5F4033B74CA594575CB369"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the limitations under section 222(f) with respect to the confidentiality of certain immigration records and except as provided under subclause (II), the Secretary of State shall post, on a publicly accessible website of the Department of State—</text> <item commented="no" display-inline="no-display-inline" id="H852DD87807F24CD2AB3C62880068014A"><enum>(aa)</enum><text display-inline="yes-display-inline">the names of all of the aliens determined to be inadmissible under clause (i); and</text></item> 
<item commented="no" display-inline="no-display-inline" id="H1818E6902EAD48599DC6CF7954A91E80"><enum>(bb)</enum><text display-inline="yes-display-inline">the countries or other locations in which violations of religious freedom described in such clause took place.</text></item></subclause> <subclause commented="no" display-inline="no-display-inline" id="H121B260292CC430D9EEFF64C21379049"><enum>(II)</enum><header>Exception</header><text display-inline="yes-display-inline">If the Secretary of State determines, on a case-by-case basis and in the Secretary’s sole and unreviewable discretion, that the public release of the identity of any particular alien determined to be inadmissible under clause (i) would have adverse foreign policy consequences for the United States, the Secretary—</text> 
<item commented="no" display-inline="no-display-inline" id="H35E981F140E0494A9CB92CB9C6CC9612"><enum>(aa)</enum><text display-inline="yes-display-inline">may exclude such alien from the disclosure requirement under subclause (I); and</text></item> <item commented="no" display-inline="no-display-inline" id="H6D542369995C493A8A6802DD1EAF6C15"><enum>(bb)</enum><text>shall submit a semiannual report to Congress, in accordance with section 51(a) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2723">22 U.S.C. 2723(a)</external-xref>), explaining the reasons for such exclusion.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
