<section id="H90B625B0DB2C46D597D98874B3C7EFA7" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Industry Skills Act</short-title></quote>.</text></section> 
<section id="H6437885F72004245B652A493B75BE7CA"><enum>2.</enum><header>Reservations; Reallocation</header> 
<subsection id="H14B097043183414D941BCD7C6FFA5692"><enum>(a)</enum><header>Reservations for statewide activities</header><text display-inline="yes-display-inline">Section 128(a) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3163">29 U.S.C. 3163(a)</external-xref>) is amended—</text> <paragraph id="H8BA9412D3D6B4B2EA663CD52B6D86E6C"><enum>(1)</enum><text>in paragraph (2), by striking <quote>reserved amounts</quote> in each place and inserting <quote>reserved amounts required under paragraph (1)</quote>; and</text></paragraph> 
<paragraph id="H7418DE5D23B34A5CA3589473B315D74F"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H5D2678D242AC484AAB2DEEC27A798701" display-inline="no-display-inline"> <paragraph id="H4758843B14E24312944C11D318E928B4"><enum>(3)</enum><header>Critical industry skills fund, and industry sector partnership and career pathways development fund</header> <subparagraph id="H8A616E8E06D74757BE7540D547C2ACC2"><enum>(A)</enum><header>Authorized reservation</header><text display-inline="yes-display-inline">In addition to the reservations required under paragraph (1) and section 133(a)(2), and subject to subparagraph (B), the Governor may reserve not more than 10 percent of each of the amounts allotted to the State under section 127(b)(1)(C) and paragraphs (1)(B) and (2)(B) of section 132(b) for a fiscal year to establish and administer any one, or both, of the following:</text> 
<clause id="H1AD3C5475F9D4F50B2E2C348F1379939"><enum>(i)</enum><text>A critical industry skills fund described in section 134(a)(4).</text></clause> <clause id="H3ED1F7AAF06646B8B82B8BE4D44D2382"><enum>(ii)</enum><text>An industry or sector partnership and career pathways development fund described in section 134(a)(5).</text></clause></subparagraph> 
<subparagraph id="HEADA3DB241BD47D5991302895678ECE1"><enum>(B)</enum><header>Matching funds</header> 
<clause id="H63392213452C427DB0A29909BCE35BCA"><enum>(i)</enum><header>Requirement</header><text display-inline="yes-display-inline">The amount of funds reserved by a Governor under subparagraph (A) for a fiscal year may not exceed the amount of funds that such Governor commits to using from any of the funds listed in clause (ii) of this subparagraph for the purposes of establishing and administering the funds described in clauses (i) and (ii) of subparagraph (A) for such fiscal year.</text></clause> <clause id="H4028737A678B4D30A87A9EDBB55960A1"><enum>(ii)</enum><header>Sources of matching funds</header><text>The funds listed in this clause are as follows:</text> 
<subclause id="H13CE834AF7874EFCAD70F9C9B4C55E47"><enum>(I)</enum><text display-inline="yes-display-inline">Funds reserved by the Governor under paragraph (1) of this subsection.</text></subclause> <subclause id="HAC73D2024C6E48889EBAFC7989A4A2CB"><enum>(II)</enum><text>Other Federal funds not described in subclause (I).</text></subclause> 
<subclause id="HCC1155A58ACF48E9A7EC4B3EE3D341E7"><enum>(III)</enum><text>State funds.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2D8C36D866494F1B9AC4792FB9C193D2" commented="no"><enum>(b)</enum><header>Reallocation among local areas</header><text>Section 128(c) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3173">29 U.S.C. 3173(c)</external-xref>) is amended—</text> 
<paragraph id="H1DAB83D39A6241D386832583823D2E92" commented="no"><enum>(1)</enum><text>in paragraph (1), by inserting the following before the period at the end: <quote>as performance-based incentive payments</quote>; and</text></paragraph> <paragraph id="H73C43DF6AF784D43BDB6994860DCCE14" commented="no"><enum>(2)</enum><text>in paragraph (4)—</text> 
<subparagraph id="H7FA746EFBDAC4FFB8BBF18A49DD7D3CF" commented="no"><enum>(A)</enum><text>by striking <quote>that does not</quote> and inserting the following:</text> <quoted-block style="OLC" id="H79F2025C7A2847E08D6674539872CDE6" display-inline="yes-display-inline"><text>that—</text> 
<subparagraph id="H4EF32C3124CE4BA0B1DF2DF2994150CF" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">does not</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HD15E8815F29846E287DF1F68E9ACA811" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the period at the end and inserting a semicolon; and</text></subparagraph> 
<subparagraph id="HB1CA4EB922794DCBA2D63DEC7AFB47EC" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H097065C4C8B64758BD72A16071892F0D" display-inline="no-display-inline"> <subparagraph id="H85E8AD2BF34847CCB9CBD06AE0C19FA1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">has met or exceeded an average of 100 percent of the local level of performance described in section 116(c)(1)(B) for the local area across all indicators for the youth program authorized under this chapter for the most recent program year for which performance data is available; and</text></subparagraph> 
<subparagraph id="H3F05A29B82EB4968A7E16851DDB2A547" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">was not subject to corrective action by the Governor under section 184(a)(5)(A) for a determination of non-compliance with the uniform administrative requirements described in section 184(a)(3) for the program year for which the determination under paragraph (2) is made. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> <section id="H3F9542F6DF4449B5BF28694E6DF6E980" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Reservations for State activities; within State allocations; Reallocation</header> <subsection id="HAF418AC68D034F388F2CD898EE5FCF40" commented="no"><enum>(a)</enum><header>Reservations for State activities</header><text>Section 133(a) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3173">29 U.S.C. 3173(a)</external-xref>) is amended—</text> 
<paragraph id="H4E19918643614AFD9DCFACFB800B8694" commented="no"><enum>(1)</enum><text>in paragraph (1), by striking <quote>section 128(a)</quote> and inserting <quote>section 128(a)(1)</quote>; and</text></paragraph> <paragraph id="H04CD728FE30746BDA4A051573027DDFC" commented="no"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H180B8802FA9C46E39404C323596397FC" commented="no"><enum>(3)</enum><header>Critical industry skills fund, and industry or sector partnership and career pathways fund</header><text display-inline="yes-display-inline">In addition to the reservations required under paragraphs (1) and (2), the Governor may make the reservation authorized under section 128(a)(3).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H586C4794A4FA4448BB0385D9B21D236A" commented="no"><enum>(b)</enum><header>Within State allocations</header><text>Section 133(b)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3173">29 U.S.C. 3173(b)</external-xref>) is amended—</text> 
<paragraph id="HCF2C56DC5E334928AECBD0F24CB6C8E0" commented="no"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subsection (a)(1)</quote> and inserting <quote>paragraph (1) or (3) of subsection (a)</quote>; and</text></paragraph> <paragraph id="HE4EC44D4CC8F42C2B3C87A4E16011E6A" commented="no"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>paragraph (1) or (2) of subsection (a)</quote> and inserting <quote>paragraph (1), (2), or (3) of subsection (a)</quote>.</text></paragraph></subsection> 
<subsection id="H8A1A278718444304AECEF937A6CDF7FE" commented="no"><enum>(c)</enum><header>Reallocation among local areas</header><text>Section 133(c) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3173">29 U.S.C. 3173(c)</external-xref>) is amended—</text> <paragraph id="H3F6FCA74B6F2496FA30B155731459B6D" commented="no"><enum>(1)</enum><text>in paragraph (1), by inserting before the period at the end, the following: <quote>as performance-based incentive payments</quote>;</text></paragraph> 
<paragraph id="H12A729E082474FD99C1066C6709D3C7C" commented="no"><enum>(2)</enum><text>in paragraph (4)—</text> <subparagraph id="H6F74B10068CC4AEB87B385738A146B81" commented="no"><enum>(A)</enum><text>in subparagraph (A)—</text>

<clause id="HCD94F26B86044FCBA3F8CB23395E58AB" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">was not subject to corrective action by the Governor under section 184(a)(5)(A) for a determination of non-compliance with the uniform administrative requirements described in section 184(a)(3) for the program year for which the determination under paragraph (2) is made; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H9CB4F3E6EBB14CA48CC62B11184269DF" commented="no"><enum>(B)</enum><text>in subparagraph (B)—</text> 
<clause id="HEC37EF7AFE584FCEAD3FCC12F616E240" commented="no"><enum>(i)</enum><text>by striking <quote>that does not</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="yes-display-inline" id="H6D9C2D8BC1C84831B3413975776E3ED6"><text>that—</text>

<clause id="HD1D72FEEC2014DF9809CDA3368A01A2E" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">was not subject to corrective action by the Governor under section 184(a)(5)(A) for a determination of non-compliance with the uniform administrative requirements described in section 184(a)(3) for the program year for which the determination under paragraph (2) is made; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="H098D89D1DBF14446ACE27F2B3EEE1FCA" commented="no"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H0F67BBF8F77144D398A1B12E7CBEC415" display-inline="no-display-inline"> 
<paragraph id="H809C81A4FBBD4BF9BC2B7524599BF2F7" commented="no"><enum>(5)</enum><header>Use of incentive funds</header><text display-inline="yes-display-inline">Any amounts provided to a local area as a performance incentive payment under this subsection shall not be subject to the requirements described in section 134(c)(1)(B). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="HE79ECE7309364E94A76A5453729F9C7E"><enum>4.</enum><header>Use of funds for employment and training activities</header><text display-inline="no-display-inline">Section 134(a)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)(1)</external-xref>)—</text> 
<paragraph id="H24EF7774EF5F40E79F2821DF2F7E85F8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 134(a)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)(1)</external-xref>)—</text> <subparagraph id="HB9F5F67154F0420392D50EDAE4E1E4A7"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="H42388491605F4202A73AC67B4E4C6DAA"><enum>(B)</enum><text>in subparagraph (B)—</text> <clause id="HA4BA2336D4AD4573B6F77FD29118592E"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>128(a)</quote> and inserting <quote>128(a)(1)</quote>; and</text></clause> 
<clause id="HEDDA7CAB62054F6E8D1967CD51F6FF15"><enum>(ii)</enum><text>by amending clause (ii) to read as follows:</text> <quoted-block style="OLC" id="H8BE7E0E0ED6D4FA4870249AA60779230" display-inline="no-display-inline"> <clause id="HDBA42FA064194047A602A6D3A2A0FDFE" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">may be used to carry out any of the statewide employment and training activities described in paragraph (3) (including establishing and administering any one, or both, of the funds referred to in subparagraph (C)); </text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H54A7D44BF6EB4DE59C740487CB4E71EE"><enum>(C)</enum><text>by inserting before the flush left text at the end the following:</text> <quoted-block style="OLC" id="H07E1391CFF3F40ABA5AC9F7DACCB6278" display-inline="no-display-inline"> <subparagraph id="H19E6A8F07F6D420F906BF9AA3084E112" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">as described in section 128(a)(3), shall be used to establish and administer any one, or both, of the following:</text> 
<clause id="HBD8057DB3750408E9C0D85712F1AB3A6" commented="no"><enum>(i)</enum><text>a critical industry skills fund described in paragraph (4); or</text></clause> <clause id="H50FD85EC059A4758B13C70B434680C66" commented="no"> <enum>(ii)</enum> <text display-inline="yes-display-inline">an industry or sector partnership and career pathways development fund described in paragraph (5).</text>
                            </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1377E29636EB4F03A40E1039D451322D"><enum>(2)</enum><header>Required statewide employment and training activities</header> 
<subparagraph id="H2E1304A93B9849B188742828E54183CE" commented="no"><enum>(A)</enum><header>Statewide rapid response activities</header><text>Section 134(a)(2)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)(2)(A)</external-xref>) is amended—</text> <clause id="H70E3C0A362394A2EA0B457ADAC6F3A2E"><enum>(i)</enum><text>in clause (i)—</text> 
<subclause id="HF958DF9BDF4A41F78EF00DFEC6B0739D" commented="no"><enum>(I)</enum><text>in subclause (I)—</text> <item id="HEE2CF9F7D5BE46A1AE42521E606E14D1" commented="no"><enum>(aa)</enum><text>by striking <quote>working</quote> and inserting <quote>as a rapid response unit working</quote>; and</text></item> 
<item id="H19AEBF19E12841C3823037339F462B5D" commented="no"><enum>(bb)</enum><text>by striking <quote>and</quote> at the end;</text></item></subclause> <subclause id="H8E1B6570EA544A599911BDB55691934D" commented="no"><enum>(II)</enum><text>in subclause (II), by striking the period at the end and inserting <quote>; and</quote>; and</text></subclause> 
<subclause id="H8C6A88504F9B46A0A0988FCECE1694C4" commented="no"><enum>(III)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H26E9530A9DB5412EAAB662E0ED7606B8" display-inline="no-display-inline"> <subclause id="H9E8222E8C7F7417DA723EA36D971C707" commented="no"> <enum>(III)</enum> <text display-inline="yes-display-inline">provision of additional assistance to any local area that has excess demand for individual training accounts for dislocated workers in such local area and requests such additional assistance under this subclause in accordance with paragraph (4) of section 414(c) of the American Competitiveness and Workforce Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3224a">29 U.S.C. 3224a(5)</external-xref>), upon a determination by the State that, in using funds allocated to such local area pursuant to paragraph (1) of such section 414(c) and in using funds as required under subsection (c)(1)(B) of this section for the purpose described in paragraph (2)(A) of such section 414(c), the local area is in compliance with the requirements of such section 414(c). </text>
                                </subclause>
                                <after-quoted-block>; and</after-quoted-block>
                            </quoted-block></subclause></clause> 
<clause id="H57F4DED70B574637B4F3DE02C33704C5"><enum>(ii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H40259494C0834423A53AEE68C27FCF6E" display-inline="no-display-inline"> <clause id="H5B55D17780434A94A186F17BB69CC7C1" commented="no"><enum>(iii)</enum><header>Insufficient funds to meet excess demand</header><text display-inline="yes-display-inline">If a State determines that a local area with excess demand as described in clause (i)(III) has met the compliance requirements described in such clause, but the State does not have sufficient funds reserved under section 133(a)(2) to meet such excess demand, the State—</text> 
<subclause id="HAFCFA2898A1B49FEAA60BDB54E05428B"><enum>(I)</enum><text>shall notify the Secretary of such excess demand; and </text></subclause> <subclause id="H777E1163055A404D926BBEDFA2BAE994"><enum>(II)</enum><text>if eligible, may apply for a national dislocated worker grant under section 170 of this Act.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H7F672550626C45A09B0B17A473505C8A">
                    <enum>(B)</enum>
                    <header>Statewide employment and training activities</header>
 <text>Section 134(a)(2)(B) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)(2)(B)</external-xref>) is amended—</text>
                    <clause id="H32620580E7B84D0089062EC2692B5237">
                        <enum>(i)</enum>
 <text>in clause (i)—</text> <subclause id="HE44CD8F0925149858989C53492BF4283"> <enum>(I)</enum> <text>in subclause (III), by striking <quote>and</quote> at the end;</text>
                        </subclause>
                        <subclause id="H581226058F154BC2BCA494DD4A000F24">
                            <enum>(II)</enum>
 <text display-inline="yes-display-inline">by amending subclause (IV) to read as follows:</text>
                            <quoted-block style="OLC" id="H5D6FBAADC70C4E029BA825B8855F2D12" display-inline="no-display-inline">
                                <subclause id="H15B38E7EDEFC40B3AE5E09714FC4D18E">
                                    <enum>(IV)</enum>
 <text display-inline="yes-display-inline">local areas, one-stop operators, one-stop partners, and eligible providers, including the development and training of staff, which may include—</text>
                                    <item id="H1BAB875E479447B484B1E4900BEFD08F">
                                        <enum>(aa)</enum>
 <text display-inline="yes-display-inline">the development and training of staff to provide information about wage levels and available benefits across in-demand industry sectors or occupations, and information about opportunities for individuals with barriers to employment to enter in-demand industry sectors or occupations and nontraditional occupations;</text>
                                    </item>
                                    <item id="HF2707C76DF3242FF90915E0F4075B216">
                                        <enum>(bb)</enum>
 <text display-inline="yes-display-inline">providing capacity building and technical assistance to State board and local board members on the development of exemplary program activities;</text>
                                    </item>
                                    <item id="H7ED2DB0E67894C7A874CA0046FD87699">
                                        <enum>(cc)</enum>

<paragraph id="HE19B09ECE286443FAF6E3BD318094460"><enum>(4)</enum><header>Critical industry skills fund</header><text display-inline="yes-display-inline">Section 134(a) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)</external-xref>), as amended, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="HC3CDBEE6C0634D64A7296343E87C2E5D" display-inline="no-display-inline"> <paragraph id="HE31BED199AD34E0197EEE1586ACF09D6" commented="no"><enum>(4)</enum><header>Critical industry skills fund</header> <subparagraph id="H585A963D93764ADF8BB7E50AC3242FC9" commented="no"><enum>(A)</enum><header>Performance-based payments</header><text>In addition to the funds described in paragraph (3)(A), a State may use any funds reserved under paragraph (3)(A) of section 128(a) to establish and administer a critical industry skills fund to award performance-based payments on a per-worker basis to eligible entities that provide, to prospective workers or incumbent workers (which may include youth age 18 through age 24), eligible skills development programs that are in any of the industries and occupations identified by the Governor (in consultation with the State board) for purposes of this paragraph, and that will result in employment or retention with an employer in such an industry or occupation (in this paragraph referred to as a <quote>participating employer</quote>).</text></subparagraph> 
<subparagraph id="H1F12977B11F048D4AD29F1D709C7FD7E" commented="no"><enum>(B)</enum><header>Optional priority</header><text display-inline="yes-display-inline">The Governor (in consultation with the State board) may select the industries and occupations identified under subparagraph (A) that should be prioritized under this paragraph.</text></subparagraph> <subparagraph id="H01505E23CED3432EABA6F5C1D5376320" commented="no"><enum>(C)</enum><header>Submission of proposals</header><text display-inline="yes-display-inline">To be eligible to receive a payment under the critical industry skills fund established under this paragraph by a State, an eligible entity shall submit to the Governor, a proposal describing the eligible skills development program to be provided by the eligible entity under this paragraph, in such form, at such time, and containing such information, as the Governor may reasonably require.</text></subparagraph> 
<subparagraph id="H553BF8700B4B48E6B62C7E25EE5FE8BB" commented="no"><enum>(D)</enum><header>Reimbursement for approved proposals</header> 
<clause id="H6C78247495934607943B0FC825DF4D65" commented="no"><enum>(i)</enum><header>State requirements</header> 
<subclause id="H90BE788C25164BB296F472FC8012CFE5" commented="no"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to each eligible entity whose proposal under subparagraph (C) has been approved by the Governor, the Governor shall make payments (in an amount determined by the Governor and subject to the requirements of subclause (II) of this clause, subparagraph (E), and any other limitations determined necessary by the State) from the critical industry skills fund established under this paragraph to such eligible entity for each participant of the eligible skills development program described in such proposal and with respect to whom the eligible entity meets the requirements of clause (ii).</text></subclause> <subclause id="HA65DCFF3AA0C44689A6002249597EDA6" commented="no"><enum>(II)</enum><header>Payments</header><text>In making payments to an eligible entity under subclause (I) with respect to a participant—</text> 
<item id="H6069306CB0334BF393FEB1DB8184DBF1" commented="no"><enum>(aa)</enum><text display-inline="yes-display-inline">a portion of the total payment shall be made after the participant successfully completes the eligible skills development program offered by the eligible entity; and</text></item> <item id="H0749D7752DA04CBFBF8F47B5D5200609" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">the remainder of such total payment shall be made after the participant has been employed by the participating employer of the eligible entity for the 6-month period after successful completion of the program.</text></item></subclause></clause> 
<clause id="H02DBD1AC114B4D9BB13ADCB92E8D9D3A" commented="no"><enum>(ii)</enum><header>Eligible entity requirements</header><text display-inline="yes-display-inline">To be eligible to receive the payments described in clause (i) with respect to a participant, an eligible entity shall submit such documentation as the Governor determines necessary to verify whether the participant meets the requirements of items (aa) and (bb) of clause (i)(II), and to comply with the performance reporting described in subparagraph (F).</text></clause></subparagraph> <subparagraph id="H86710EFA63D4412987AE6F2063EE6048" commented="no"><enum>(E)</enum><header>Non-Federal cost sharing</header> <clause id="H6B1B2BBCBE7C46119AB5297CC3630BDA" commented="no"><enum>(i)</enum><header>Limits on Federal share</header><text display-inline="yes-display-inline">An eligible entity may not receive funds under subparagraph (D) with respect to a participant of the eligible skills development program offered by the eligible entity in excess of the following costs of such program with respect to such participant:</text> 
<subclause id="HBE1D6C2FA2CD47F3BCDF75D0EDB9AE5B" commented="no"><enum>(I)</enum><text>In the case of a participating employer of such eligible entity with 25 or fewer employees, 90 percent of the costs.</text></subclause> <subclause id="H4540906D97224F5182643D33DBF876EB" commented="no"><enum>(II)</enum><text>In the case of a participating employer of such eligible entity with more than 25 employees, but fewer than 100 employees, 75 percent of the costs.</text></subclause> 
<subclause id="H343F56B449864F8987EA32739C77EFF2" commented="no"><enum>(III)</enum><text>In the case of a participating employer of such eligible entity with 100 or more employees, 50 percent of the costs.</text></subclause></clause> <clause id="HAB8F79AE834648F38B8FB65D58EE44EC" commented="no"><enum>(ii)</enum><header>Non-Federal share</header> <subclause id="HF8A956709E8041D68A21AF6E1CCC7796" commented="no"><enum>(I)</enum><header>In general</header><text>Any costs of the eligible skills development program offered to a participant by such eligible entity that are not covered by the funds received under subparagraph (D) shall be the non-Federal share provided by the eligible entity (in cash or in-kind).</text></subclause> 
<subclause id="H149B6C4E0FAA4434945C925472527DC0" commented="no"><enum>(II)</enum><header>Employer cost sharing</header><text display-inline="yes-display-inline">If the eligible skills development program is being provided on-the-job, the non-Federal share provided by an eligible entity may include the amount of the wages paid by the participating employer of the eligible entity to a participant while such participant is receiving the training.</text></subclause></clause></subparagraph> <subparagraph id="HE3BA4C20494D415AA94DC8E45F5641DF"><enum>(F)</enum><header>Performance reporting</header><text display-inline="yes-display-inline">Using the participant information provided by eligible entities under subparagraph (D)(ii), the State shall submit to the Secretary a report, on an annual basis, with respect to all participants for which the eligible entities received funds under this paragraph for the most recent program year, which shall include—</text> 
<clause id="H96DC2243FD184FCDA588D8542530EF28"><enum>(i)</enum><text display-inline="yes-display-inline">the number of individuals who participated in eligible skills development programs provided by such eligible entities through the critical industry skills fund under this paragraph; and</text></clause> <clause id="H3C0EDF9084EC4FA1BAACAD50740E29D6"><enum>(ii)</enum><text>the performance of such participants on the primary indicators of performance described in subclauses (I) through (III) of section 116(b)(2)(A)(i).</text></clause></subparagraph> 
<subparagraph id="H8FE27A18EA8E4D0DBA0C6C9D59D57C0B"><enum>(G)</enum><header>Definitions</header><text>In this paragraph:</text> <clause id="HB2F46677747B4971B8AF0E14129D3BC3" commented="no"><enum>(i)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> 
<subclause id="HB5854307D898433B928FF46795644C66" commented="no"><enum>(I)</enum><text>a participating employer or a group of participating employers;</text></subclause> <subclause id="H08706CF99DE34520A8772001409A81DD" commented="no"><enum>(II)</enum><text>an industry or sector partnership that includes a participating employer; or</text></subclause> 
<subclause id="H15D29D50A46F4676B0F66F83C646CD7D" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">another entity serving as an intermediary (such as a local board) that is in partnership with a participating employer.</text></subclause></clause> <clause id="H3EB79CF4EC7F42BD88E55EDC148A0389" commented="no"><enum>(ii)</enum><header>Eligible skills development program</header><text display-inline="yes-display-inline">The term <term>eligible skills development program</term>, when used with respect to an eligible entity—</text> 
<subclause id="H5210C47A6D3B44499518479AAA225347"><enum>(I)</enum><text>means a program with respect to which a State may set a maximum and minimum length (in weeks);</text></subclause> <subclause id="HBC45E43333E646178BB96F38AF2C7A77"><enum>(II)</enum><text display-inline="yes-display-inline">includes work-based education or related occupational skills instruction that—</text> 
<item id="H2D313E8729504D4CA273CE50FE1B70D0"><enum>(aa)</enum><text>develops the specific technical skills necessary for successful performance of the occupations in which participants are to be employed upon completion; and</text></item> <item id="H977A451E8C704F2BB378F4C010F744A8"><enum>(bb)</enum><text>may be provided—</text> 
<subitem id="H6D61C1567590472B92EF1C1450C7F856"><enum>(AA)</enum><text>by the eligible entity; or</text></subitem> <subitem id="H7C5B711F5F8F43EA8E45EC8D62C32A91"><enum>(BB)</enum><text>by any training provider that is selected by the eligible entity and without regard to whether such provider is on a list of eligible providers of training services described in section 122(d); and</text></subitem></item></subclause> 
<subclause id="H3E026951F2A14547AE84915613828715"><enum>(III)</enum><text>does not include employee onboarding, orientation, or professional development generally provided to employees.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HF1F147CF3C32497485280C3313E27BB8" commented="no"><enum>(5)</enum><header>Industry or sector partnership and career pathways development fund</header><text display-inline="yes-display-inline">Section 134(a) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)</external-xref>), as amended, is further amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HF8740AFFAA2446139720C01634B0C4CC" display-inline="no-display-inline"> 
<paragraph id="H0B5462425CCE49D7A04D7D4A265D789D" commented="no"><enum>(5)</enum><header>Industry or sector partnership and career pathways development fund</header> 
<subparagraph id="H8C938B1A9F904A2BB5A2A5D90304B243" commented="no"><enum>(A)</enum><header>Purpose</header><text>The purpose of this paragraph is to establish new or expand existing industry or sector partnerships and career pathway programs to encourage regional economic growth and competitiveness, and improve worker training, retention, and advancement.</text></subparagraph> <subparagraph id="HB0C52C1A91B74C5C8A29D5D86CD58280" commented="no"><enum>(B)</enum><header>Description of Fund</header><text display-inline="yes-display-inline">In addition to the funds described in paragraph (3)(A), a State may use any funds reserved under paragraph (3)(A) of section 128(a) to establish and administer an industry or sector partnership and career pathways development fund to award grants to eligible partnerships to establish or expand industry or sector partnerships that include employers in a high-growth or high-wage industry of the State in order to meet the following objectives:</text> 
<clause id="H20246ACDA0AB414C80242904BB98C8DD" commented="no"><enum>(i)</enum><text>Build capacity among such partnerships to prepare jobseekers and incumbent workers participating in such partnerships for careers in such a high-growth or high-wage industry.</text></clause> <clause id="H0EA6237C59AD4D8AB7FAEAEDF32DE46C" commented="no"><enum>(ii)</enum><text>Leverage the capacity of such partnerships to develop, improve, expand, or implement education, employment, and training opportunities for individuals with barriers to employment.</text></clause> 
<clause id="H31026C0B9C204463BB502221CFCB1CC4" commented="no"><enum>(iii)</enum><text>Strengthen coordination between such industry or sector partnerships and one-stop partners for the local areas involved that are described in paragraphs (1) and (2) of section 121(b).</text></clause> <clause id="HBC82CAA3CD1A497AA9697A3C287EF6D7" commented="no"><enum>(iv)</enum><text>Develop or expand a career pathway program that utilizes integrated education and training strategies and supports multiple points of entry and exit for working learners.</text></clause></subparagraph> 
<subparagraph id="H4F19FB33C228464E824F3D706D2152E9" commented="no"><enum>(C)</enum><header>Duration</header><text>Each grant awarded under this paragraph shall be for a period of not more than 2 years.</text></subparagraph> <subparagraph id="H28782170A3D44AC0A5D132BDE3234B6F" commented="no"><enum>(D)</enum><header>Award basis</header> <clause id="HC8F9CD0221FF43C28F2B1F9CA6AA08B5" commented="no"><enum>(i)</enum><header>Geographic diversity</header><text>The Governor shall award grants under this paragraph in a manner that ensures geographic diversity in the areas in the State in which activities will be carried out under the grants.</text></clause> 
<clause id="H6B458CD0CA2849A4816BF90CB82873EF" commented="no"><enum>(ii)</enum><header>Priority</header><text>In awarding grants under this paragraph, the Governor shall give priority consideration to eligible partnerships that—</text> <subclause id="HFE35DCBFAECA4BF6AACE907743734C1E" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">include (or will include) as a partner in the industry or sector partnership to be established or expanded under this paragraph, a 2-year public institution of higher education;</text></subclause> 
<subclause id="HD5289F4632334516A1B4FCF43E690077" commented="no"><enum>(II)</enum><text>demonstrate long-term sustainability of such industry or sector partnership; and</text></subclause> <subclause id="H45C60B5CC3414F61BCD2A019F6386ED7" commented="no"><enum>(III)</enum><text>demonstrate the ability of such industry or sector partnership to serve individuals who—</text> 
<item id="H8D7C5D2521D34E64BDB6ECC17AC7ACCA" commented="no"><enum>(aa)</enum><text>are individuals with a barrier to employment, including individuals with disabilities;</text></item> <item id="H8C87204CA8BD4B4BA422B1002C6E60BB" commented="no"><enum>(bb)</enum><text>are facing significant worker dislocation due to a disruption or change in the regional or State economy or labor market;</text></item> 
<item id="HA5795BFFFD23448F98525BC80A1EC27A" commented="no"><enum>(cc)</enum><text>have traditionally been underserved by regional economic development and sector partnership activities (including rural areas in the State); or</text></item> <item id="H8C144C47EF0244FB833CC628DE284E79" commented="no"><enum>(dd)</enum><text>are—</text> 
<subitem id="H5282F1DEF34C4469B11F2915B2F04E89" commented="no"><enum>(AA)</enum><text>out-of-school youth, disadvantaged youth, or disadvantaged adults; or</text></subitem> <subitem id="HD2A068B393004C669F53AFA42E06C68E" commented="no"><enum>(BB)</enum><text>unemployed individuals, within the meaning of section 6(b)(1)(B) of the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/49e">29 U.S.C. 49e(b)(1)(B)</external-xref>).</text></subitem></item></subclause></clause> 
<clause id="H3216B919CAC14165BE9AB3193AEF9795" commented="no"><enum>(iii)</enum><header>Additional optional priority</header><text>In awarding grants under this paragraph, in addition to the priority consideration required under clause (ii), the Governor may give priority consideration to eligible partnerships that include, or will include, as a partner in the industry or sector partnership to be established or expanded under this section—</text> <subclause id="HB850D91A675B42EDAC76BEDA3A1A595A" commented="no"><enum>(I)</enum><text>a 4-year public institution of higher education at which the highest degree that is predominantly awarded to students is an associate degree; or</text></subclause> 
<subclause id="H4E00CC162EF047F2AB81F0CB303347A5" commented="no">
                                    <enum>(II)</enum>
 <text>a 2-year Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)).</text>
                                </subclause></clause></subparagraph> 
<subparagraph id="H7F6A17CBFA744D26992DF9A445189286" commented="no"><enum>(E)</enum><header>Application</header> 
<clause id="HE1E2BB6C430348818810AB3AD69DEE87" commented="no"><enum>(i)</enum><header>In general</header><text>An eligible partnership seeking a grant under this paragraph shall submit an application to the Governor at such time, in such manner, and containing such information as the Governor may reasonably require, including the contents described in clause (ii).</text></clause> <clause id="HF98A219EE46242A8925C9ACA37406229" commented="no"><enum>(ii)</enum><header>Contents</header><text>An eligible partnership seeking a grant under this paragraph shall submit an application to the Governor under clause (i) containing, at minimum—</text> 
<subclause id="HC5C9F3D59E8E425593B1C06FDAA0131E" commented="no"><enum>(I)</enum><text>a description of the eligible partnership, and the industry or sector partnership that will be established or expanded with such grant;</text></subclause> <subclause id="HFBAEF6E945B04CC09D87B467B5938447" commented="no"><enum>(II)</enum><text>the expected participation and responsibilities of each of the partners that will be included in such industry or sector partnership;</text></subclause> 
<subclause id="H9194F08A7B3E4BDCBB2A910BF1A88C1E" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">a description of the high-growth or high-wage industry sector to be served by such industry or sector partnership, and a description of how such industry sector was identified;</text></subclause> <subclause id="H57E9559040A14A368265FF558E17DA20" commented="no"><enum>(IV)</enum><text>a description of the workers and other individuals who will be targeted or recruited by such industry or sector partnership, including the number of workers and other individuals who will be served by the partnership;</text></subclause> 
<subclause id="HB521039530984FF89986ECD10972D793" commented="no"><enum>(V)</enum><text>an analysis of the existing labor market to be served by such industry or sector partnership, which includes—</text> <item id="H3E388B49A52C4E0A90597028358BA5AC"><enum>(aa)</enum><text>a description of potential barriers to employment for the targeted workers and other individuals;</text></item> 
<item id="H3467088C43774D44B6A87DCA6A61135D"><enum>(bb)</enum><text>the estimated share of such workers and other individuals who are individuals with a barrier to employment; and</text></item> <item id="H4A113D670D214329AE14B97C65E8294A"><enum>(cc)</enum><text>a description of strategies that will be developed to help such workers and other individuals overcome such barriers;</text></item></subclause> 
<subclause id="H99052F31383D430382359E1B13F3ED17" commented="no"><enum>(VI)</enum><text display-inline="yes-display-inline">a description of the Federal and non-Federal resources, available under provisions of law other than this paragraph, that will be leveraged in support of such industry or sector partnership and the activities carried out by the partnership under this paragraph;</text></subclause> <subclause id="H276E58E893E547D4AC37A11FC64E5CA0" commented="no"><enum>(VII)</enum><text display-inline="yes-display-inline">a description, using common, linked, open-data descriptive language, of the recognized postsecondary credential that will be provided to individuals who successfully complete the education and training program provided through an education provider in such industry or sector partnership;</text></subclause> 
<subclause id="HFCD1A90CFD4B4C59AA8F2CB4D11A256B" commented="no"><enum>(VIII)</enum><text>an assurance that any eligible provider of training services in such industry or sector partnership is on a list of eligible providers of training services described in section 122(d); and</text></subclause> <subclause id="H90FE62AEF3474E6DB3B5B0FF29EFEE67" commented="no"><enum>(IX)</enum><text>a commitment from a participating employer in such industry or sector partnership to employ each participant of such education and training program (which may be a career pathway program) for not less than a 1-year period, in accordance with the employment policies of such employer, after successful completion of the training portion of the education and training program operated by such participating employer.</text></subclause></clause></subparagraph> 
<subparagraph id="HD580B37A6EC14FFAAB1058EF3F841786" commented="no"><enum>(F)</enum><header>Uses of funds</header> 
<clause id="H6839A39774764E25976060DD316672B9" commented="no"><enum>(i)</enum><header>In general</header><text>An eligible partnership awarded a grant under this paragraph shall use such grant funds to establish a new industry or sector partnership or expand the industry or sector partnership of the eligible partnership to meet the objectives listed in subparagraph (B)—</text> <subclause id="H5250B366F9884291BF582AF731FCCB8C" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">by engaging businesses in accordance with clause (iii); and</text></subclause> 
<subclause id="HC85125F8397C45B8A8F8E6DCBCDD4495" commented="no"><enum>(II)</enum><text>by carrying out an education and training program that—</text> <item id="HBE478FC844E54541B7FB48CDF7C61D0D" commented="no"><enum>(aa)</enum><text display-inline="yes-display-inline">leads to the recognized postsecondary credential described in the eligible partnership’s application in subparagraph (E)(ii)(VII);</text></item> 
<item id="H3B93A154A0C84470930AE848676B93F8" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">includes an apprenticeship, work-based learning, or on-the-job training program that leads to an employment commitment described in subparagraph (E)(ii)(IX) with a participating employer of the industry or sector partnership;</text></item> <item id="H096779D447BF4260A5E4811687C81DF8" commented="no"><enum>(cc)</enum><text display-inline="yes-display-inline">may include the development or expansion of a new or existing career pathway program as described in clause (iv); and</text></item> 
<item id="H63B49C8EDE2B4E8C87D8AF900072A8EA" commented="no"><enum>(dd)</enum><text>may include the provision of supportive services as described in clause (v).</text></item></subclause></clause> <clause id="H8E96A055FE8D454B83EA32BB906442A9" commented="no"><enum>(ii)</enum><header>Planning activities</header><text display-inline="yes-display-inline">An eligible partnership receiving a grant under this paragraph may use not more than 20 percent of the grant funds to carry out planning activities during the first year of the grant period that are necessary to establish a new industry or sector partnership or expand the industry or sector partnership of the eligible partnership, which may include—</text> 
<subclause id="H9CD36EE2C3B24BA8A5F70B43C777DCB5" commented="no"><enum>(I)</enum><text>recruiting key stakeholders in the high-growth or high-wage industry to be served by such industry or sector partnership;</text></subclause> <subclause id="H3A8F46D5923E411D879F233E265D87EF" commented="no"><enum>(II)</enum><text>conducting outreach to local businesses, employers, labor organizations, local boards, education and training providers, and business and employer associations;</text></subclause> 
<subclause id="HBFED2489C8634D8D8C30F65FFCB58753" commented="no"><enum>(III)</enum><text>identifying, through an evaluation, the training needs of multiple businesses in the high-growth or high-wage industry, including identifying any needs for—</text> <item id="HF9B3F82426464A2EB749B8140ECA331D" commented="no"><enum>(aa)</enum><text>skills critical to competitiveness and innovation in the high-growth or high-wage industry;</text></item> 
<item id="H964EC62D752A4E7FACCD45D81455D508" commented="no"><enum>(bb)</enum><text>an education and training program, including any apprenticeship program or other work-based learning program supported by the grant; and</text></item> <item id="H93C9E33D46944E408E0A591C716A59A4" commented="no"><enum>(cc)</enum><text>the usage of career pathways to align education and training with job openings in the high-growth or high-wage industry; and</text></item></subclause> 
<subclause id="HFBB547FA4AB5436EAFA63F03A2FA0540" commented="no"><enum>(IV)</enum><text display-inline="yes-display-inline">recruiting individuals with barriers to employment to participate in the education and training program.</text></subclause></clause> <clause id="H8F5EB53CA1B74ACFADC6D2653FDFD024" commented="no"><enum>(iii)</enum><header>Business engagement</header><text>An industry or sector partnership established or expanded with a grant under this paragraph shall use the grant funds to engage businesses (including small and medium-sized businesses that are in the high-growth or high-wage industry and that may be a participating employer of the partnership) in the establishment and implementation of an apprenticeship, work-based learning, or on-the-job training program offered through the education and training program of the partnership, and which may include—</text> 
<subclause id="H3CB8320C7CB449169573FF94AF513878" commented="no"><enum>(I)</enum><text>the navigation of the registration process for a sponsor of such an apprenticeship program;</text></subclause> <subclause id="H74D524286CA54EA894DB9EE143DF9018" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the connection of the business with an education provider in the industry or sector partnership to develop classroom instruction to complement learning through such an apprenticeship, work-based learning, or on-the-job training program;</text></subclause> 
<subclause id="H4F596139B49041E393FF3D5A415A603E" commented="no"><enum>(III)</enum><text>the development of such a work-based learning program;</text></subclause> <subclause id="H0C58FD44011747B4937959F2EE9B457E" commented="no"><enum>(IV)</enum><text>the provision of career awareness activities for participants of such an apprenticeship, work-based learning, or on-the-job training program, such as career guidance and academic counseling;</text></subclause> 
<subclause id="H76F3477FA4514FF38951771C7B1B2009" commented="no"><enum>(V)</enum><text>the recruitment of individuals with barriers to employment to participate in such an apprenticeship, work-based learning, or on-the-job training program; and</text></subclause> <subclause id="H02CFC65E462D4AD296EA7836D02BEF65" commented="no"><enum>(VI)</enum><text>other evidence-based approaches to connecting businesses with workers and establishing pathways to unsubsidized employment for individuals participating in the education and training program and other programs funded under this title.</text></subclause></clause> 
<clause id="HA8823825A25640B8A4DBC7F04AF6582D" commented="no"><enum>(iv)</enum><header>Career pathway programs</header> 
<subclause id="H7766189729E348BC8D47161FE263708A"><enum>(I)</enum><header>In general</header><text>An industry or sector partnership established or expanded with a grant under this paragraph may use such grant funds for the development or expansion of a new or existing career pathway program that utilizes integrated education and training strategies and supports multiple entry and exit points for working students and other working participants, which may include—</text> <item id="HC01038ECE5A646DCBE631F2DF4E38090" commented="no"><enum>(aa)</enum><text>dual-enrollment approaches for participants, including youth, seeking to participate in a career pathway program; and</text></item> 
<item id="H1FC3FA49AED3413EA29821BF9EBE10EF" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">strategies that help working students and other nontraditional and adult student populations access skills and the recognized postsecondary credentials described in subparagraph (E)(ii)(VII) of the eligible partnership’s application.</text></item> </subclause> <subclause id="H83C3088EF7F448BC9C5BFAB0933EA7E4" commented="no"><enum>(II)</enum><header>Authorized activities</header><text>In establishing or expanding such new or existing career pathway program, the industry or sector partnership may use a grant under this paragraph for—</text> 
<item id="H83EAE1C986014925B59DAAB52171C113" commented="no"><enum>(aa)</enum><text>the provision of evidence-based professional development for faculty and other staff of an education provider in the industry or sector partnership;</text></item> <item id="HFF645A761A844B808074FF9F81474F92" commented="no"><enum>(bb)</enum><text>the acquisition of equipment necessary to support the delivery of the career pathway program; and</text></item> 
<item id="HAC102C7A64DC4B20A747FFF215FEB607" commented="no"><enum>(cc)</enum><text>any other evidence-based activities to support the development or implementation of the career pathway program.</text></item></subclause></clause> <clause id="H671EB92E1C9E42FAA507138BAD7498D5" commented="no"><enum>(v)</enum><header>Supportive services</header><text display-inline="yes-display-inline">In accordance with section 181(h), an industry or sector partnership established or expanded with a grant under this paragraph may use such grant funds to provide supportive services to support the success of individuals, including individuals with barriers to employment, who are participating in training services, as described in subsection (c)(3)(D), which are offered through such partnership.</text></clause></subparagraph> 
<subparagraph id="HCD2BF6685CF544078BDA0E06D902BBFB" commented="no"><enum>(G)</enum><header>Designation of a fiscal agent</header><text>An eligible partnership receiving a grant under this paragraph shall designate an entity of the eligible partnership as the fiscal agent for the receipt, management, and expenditure of the grant funds.</text></subparagraph> <subparagraph id="H40FA4082F6B5407CAB946AD3509F4465" commented="no"><enum>(H)</enum><header>Non-Federal cost sharing</header> <clause id="H91AF93331E194319A2BE51FBF03D01B4" commented="no"><enum>(i)</enum><header>Limits on Federal share</header><text display-inline="yes-display-inline">An industry or sector partnership established or expanded with a grant under this paragraph may not receive such grant funds for purposes of funding the education and training program offered through such partnership in excess of the following costs of establishing, operating, and sustaining such program:</text> 
<subclause id="H6C5B00890B9A452F9926BD5BF60C10F4" commented="no"><enum>(I)</enum><text>In the case in which the participating employers in such eligible partnership employ 25 or fewer employees, 70 percent of the costs.</text></subclause> <subclause id="HF0A0C137F6B2415892B03CA23D749EF6" commented="no"><enum>(II)</enum><text>In the case in which the participating employers in such eligible partnership employ more than 25 employees, but fewer than 100 employees, 55 percent of the costs.</text></subclause> 
<subclause id="H87E43F8B25AE46EEAAD6A44E20A8DDDE" commented="no"><enum>(III)</enum><text>In the case in which the participating employers in such eligible partnership employ 100 or more employees, 40 percent of the costs.</text></subclause></clause> <clause id="H63A5BB746418417C86A24C147D052AE8" commented="no"><enum>(ii)</enum><header>Non-Federal share</header><text>Any costs of establishing, operating, and sustaining such program that are not covered by the grant received under this paragraph shall be the non-Federal share provided by the industry or sector partnership.</text></clause></subparagraph> 
<subparagraph id="H732BF0EA57D544B2AD135520D889BFBE" commented="no"><enum>(I)</enum><header>Performance reporting</header><text>Not later than 2 years after the first award of funds under this paragraph is made by the Governor and on an annual basis thereafter, the Governor shall prepare and submit to the Secretary a report with respect to the participants served by each eligible partnership receiving funds under this paragraph in the most recent program year, which report shall include—</text> <clause id="HE1BF946CE22A4B1C9104B80D2FC7A66B" commented="no"><enum>(i)</enum><text>levels of performance achieved by the eligible partnership, with respect to the primary indicators of performance under clause (i) or (ii) of section 116(b)(2)(A), as applicable, for all individuals served by the eligible partnership, disaggregated by race, ethnicity, sex, disability status, and age; and</text></clause> 
<clause id="HB788A3E0B28A46ADB4E6066A093D98CF" commented="no"><enum>(ii)</enum><text>levels of performance achieved by the eligible partnership with respect to the primary indicators of performance under clause (i) or (ii) of section 116(b)(2)(A), as applicable, for individuals with barriers to employment served by the eligible partnership, disaggregated by race, ethnicity, sex, disability status, and age.</text></clause></subparagraph> <subparagraph id="H6752A3BC5BAD43AFA57C7BBF58E40FCE" commented="no"><enum>(J)</enum><header>Availability of report</header><text>The report submitted by eligible partnerships under subparagraph (I) shall—</text> 
<clause id="H2C3D6427F85D42BDA161C75535FDC700" commented="no"><enum>(i)</enum><text>be made digitally available by the Secretary using linked, open, and interoperable data; and</text></clause> <clause id="H7C1962FF915B4F089DA016F6B505EF8C" commented="no"><enum>(ii)</enum><text>include the number of individuals who were served by each such eligible partnership.</text></clause></subparagraph> 
<subparagraph id="H09F003A2B00947729A5C579E24585557" commented="no"><enum>(K)</enum><header>Limit on administrative costs</header><text display-inline="yes-display-inline">An eligible partnership receiving a grant under this paragraph may not use more than 10 percent of the grant funds for administrative costs.</text></subparagraph> <subparagraph id="HA8C22C55FF444E91BAA6C09828F13EA1" commented="no"><enum>(L)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text> 
<clause id="H324278AEA8C44915B0A3A9EC6CEB3A43" commented="no"><enum>(i)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means—</text> <subclause id="HEE0CD1E22ED14F91872CCDB7ED715E07" commented="no"><enum>(I)</enum><text>an industry or sector partnership that—</text> 
<item id="H64850E2B35584D0B82D2088C39219B27"><enum>(aa)</enum><text>includes a participating employer; and</text></item> <item id="HACF8915166FD49E8B5CD4AE4BD02D4B1"><enum>(bb)</enum><text>is seeking to further implement or expand such industry or sector partnership; or</text></item></subclause> 
<subclause id="H86379BEBD4074EA998195BC8576C287F" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">a workforce collaborative that is seeking to become an industry or sector partnership that includes a participating employer.</text></subclause></clause> <clause id="HD0F88273AEC542D9A807E4C38F3AB328" commented="no"><enum>(ii)</enum><header>High-growth or high-wage industry</header><text>The term <term>high-growth or high-wage industry</term>, when used with respect to an eligible partnership, means an industry that—</text> 
<subclause id="HCAD5A27F2A8D4CEC9642429C2FB82BED" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">has, or is expected to have, a high rate of growth and an unmet demand for skilled workers, as determined by the Governor of the State in which the eligible partnership is located;</text></subclause> <subclause id="H286E6AFF2C02452BAF791A2B0D152672" commented="no"><enum>(II)</enum><text>has been designated by the Governor as an in-demand industry experiencing high growth in such State; and</text></subclause> 
<subclause id="H34B4A18482BC4510B12733F49B995969" commented="no"><enum>(III)</enum><text>includes occupations determined by the Governor—</text> <item id="H21A08EE39721479CBA65886279E7492A" commented="no"><enum>(aa)</enum><text>with wages that are significantly higher than an occupation of similar level of skill or needed skill development; or</text></item> 
<item id="HB1FD88BAF4D8459395841AF898C7D2BC" commented="no"><enum>(bb)</enum><text>that are aligned with career pathways into higher wage occupations.</text></item></subclause></clause> <clause id="H451A8F0C0F174BBB8974AADC8CD04E68" commented="no"><enum>(iii)</enum><header>Participating employer</header><text>The term <term>participating employer</term>, when used with respect to an eligible partnership, means an employer in a high-growth or high-wage industry that is (or will be) part of the industry or sector partnership that will be expanded (or established) by the eligible partnership under this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H36C97EC8B9E245C6AA086BDFF4D7583C"><enum>5.</enum><header>Study on statewide critical industry skills funds</header><text display-inline="no-display-inline">Section 169(b)(4) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3224">29 U.S.C. 3224(b)(4)</external-xref>) is amended—</text> <paragraph id="H17BC92DF763343D5A88576A72BFF60D7"><enum>(1)</enum><text>by redesignating subparagraph (K) as subparagraph (L); and</text></paragraph> 
<paragraph id="HC4585210A0654896BE2183B8FCB424DB"><enum>(2)</enum><text>by inserting after subparagraph (J) the following:</text> <quoted-block style="OLC" id="H8FDC6F1876124A189D64F7727774119E" display-inline="no-display-inline"> <subparagraph id="HD8F0F49F82D64C4B8C713ACA648252D1"><enum>(K)</enum><header>Study on statewide critical industry skills funds</header><text display-inline="yes-display-inline">The Secretary shall, not later than 4 years after the date of enactment of this subparagraph, conduct a study that will review the usage of statewide critical industry skills funds established by States under section 134(a)(4) and identify, for purposes of measuring the overall effectiveness of the program—</text> 
<clause id="HE258F6D9D29149F592FB859702DE5438"><enum>(i)</enum><text>the industries targeted by the funds under section 134(a)(4);</text></clause> <clause id="HD932773F0E9245A0A9007705AEDCB755"><enum>(ii)</enum><text>the occupations for which workers are being upskilled;</text></clause> 
<clause id="H5010CE3E4C494DB593C72909CE440091">
                            <enum>(iii)</enum>
 <text>how frequently skills development is provided to prospective workers and incumbent workers; and</text>
                        </clause> 
<clause id="HCC7CF46A84694D67A9535AFF01EB64A8"><enum>(iv)</enum><text>the reported performance outcomes.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
