<section id="HCDF7C47AE1524AE8B67D28989767F0BE" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Americans from Unauthorized Surveillance Act</short-title></quote>.</text></section> 
<section id="H303C379C73434BC8B9DD97EAA1A5B302"><enum>2.</enum><header>FISA Oversight Office</header> 
<subsection id="H0FFD583803C54064A890C97186EC18D1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the Foreign Intelligence Surveillance Act of 1978 is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H15468D52FD0C44BBA605B099DA59F5EE" display-inline="no-display-inline"> <section id="HBABADFFA96124434A58B1E02DFB3BAE2"><enum>113.</enum><header>FISA Oversight Office</header> <subsection id="HC32AE7B6AA8B476897F75BC78A5EAE05"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established an office, to be known as the <quote>FISA Oversight Office</quote>, within the Department of Justice (hereinafter in this section referred to as the <quote>Office</quote>). The Office—</text> 
<paragraph id="H68973AFE970A468C95E18BB0809786EA"><enum>(1)</enum><text>shall evaluate each application under this title;</text></paragraph> <paragraph id="HCE8F191A0FB544A09FA86B423991AC0B"> <enum>(2)</enum> <text display-inline="yes-display-inline">except as provided in paragraph (3), if the Office determines based on the evaluation under paragraph (1) that the probable cause standard under section 105(a)(2) may not be met, may—</text>

                                                  <enum>(A)</enum>
 <text>petition to be joined as a party; and</text> </subparagraph> <subparagraph id="H3F5F859192B343F1AC3D2631EF6A46C6"> <enum>(B)</enum> <text>file a motion with the court alleging that such standard has not been met; and</text>
                                                  </subparagraph>
                                                  </paragraph> 
<paragraph id="H6DB63012316149CDBDB4FE63FCDBFDA9"><enum>(3)</enum><text display-inline="yes-display-inline">if the application is for the surveillance of a United States person and if the Office determines based on the evaluation under paragraph (1) that the probable cause standard under section 105(a)(2) has not been clearly met, shall—</text> <subparagraph id="H50FBE45FBEB74171A46E395DA1BFC4BA"><enum>(A)</enum><text>petition to be joined as a party; and</text></subparagraph> 
<subparagraph id="H7A99E8B4FAA54999AF9A8A87ADBA670F"><enum>(B)</enum><text>file a motion with the court alleging that such standard has not been met.</text></subparagraph></paragraph></subsection> <subsection id="H8BFBDA396D44477A805E4D881C3E5BE5"><enum>(b)</enum><header>Access to information</header><text display-inline="yes-display-inline">The Federal office filing the application shall provide the Office all available evidence that pertains to an investigation into a United States person. That officer is required to notify the Office each time an application is filed with the court established under section 103(a).</text></subsection> 
<subsection id="H467535757F6B421B862AC7C666B7FA95"><enum>(c)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 365 days after the effective date of this section, the Attorney General and the Director shall submit to the appropriate committees of Congress a report detailing—</text> <paragraph id="HB2DFD841C32D46BCAD90439B6820B626"><enum>(1)</enum><text>the number of applications for which the FISA Oversight Office has filed a motion under subsection (a)(2)(B) or (a)(3)(B) and information regarding the subject of such applications and the information sought to be collected;</text></paragraph> 
<paragraph id="H0D436540CBD24B249705B99F864DBA56"><enum>(2)</enum><text display-inline="yes-display-inline">the number of such applications that the FISA Oversight Office has declined to challenge, and information regarding the subject of such applications and the information sought to be collected, as well as information regarding the Office’s decision not to challenge.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H364ADB979FCA4861939F757AEC5406E2"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for such Act is amended by inserting after the item pertaining to section 112 the following:</text>

<section id="HCB93E0DFC9A7467290E5FEDB47E05E91"><enum>3.</enum><header>Requirement for Foreign Intelligence Surveillance Court to appoint amicus curiae</header><text display-inline="no-display-inline">Section 103(i) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(i)</external-xref>) is amended—</text> <paragraph id="H79EA3E45E6C8414FB9D9E4F1690084C7"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text> 
<quoted-block style="OLC" id="HB95B48A8D7CB45F391EE992C0AF78CFC" display-inline="no-display-inline"> 
<paragraph id="HC5A6F0F993644ACC8026FBDF1DB519CC"><enum>(2)</enum><header>Requirement</header><text display-inline="yes-display-inline">A court established under subsection (a) or (b), consistent with the requirement of subsection (c) and any other statutory requirement that the court act expeditiously or within a stated time, shall appoint an individual who has been designated under paragraph (1) to serve as amicus curiae to assist such court in the consideration of each application for an order or review under this title. </text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> <paragraph id="HEDBE4A8EE65A4E5AAA8889AFC373BA73"><enum>(2)</enum><text>in paragraph (4), by striking <quote>If a court established under subsection (a) or (b) appoints an amicus curiae under paragraph (2)(A)</quote> and inserting <quote>An amicus curiae appointed under paragraph (2)(A)</quote>;</text></paragraph> 
<paragraph id="H42B3EBC29397403789B8823B507059C3"><enum>(3)</enum><text>in paragraph (6)(A), by striking <quote>If a court established under subsection (a) or (b) appoints an amicus curiae under paragraph (2), the amicus curiae</quote> and inserting <quote>An amicus curiae appointed under paragraph (2)(A)</quote>; and</text></paragraph> <paragraph id="HB7C4996B580B4966ABAE3F898BF24387"><enum>(4)</enum><text display-inline="yes-display-inline">by repealing paragraph (7).</text></paragraph></section>
