<section id="H2B181CD243074AD287574F60DF6C4E23" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guarding U.S. Associations from Rogue Donations Act</short-title></quote> or the <quote><short-title>GUARD Act</short-title></quote>.</text></section> 
<section id="H6DE3728F33D64D65AE4A88FBEC78ED97"><enum>2.</enum><header>Denial of tax-exempt status to certain organizations receiving contributions or gifts from citizens or nationals of foreign adversaries</header> 
<subsection id="HB6232EB01EA14022A13634F6853446CF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/501">Section 501</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H568DA6F445484487906B34548A3960D2" display-inline="no-display-inline"> <subsection id="H0803B98003F2416EB6849A76B68D0F7A"> <enum>(s)</enum> <header>Denial of tax-Exempt status to certain organizations receiving contributions or gifts from citizens or nationals of foreign adversaries</header> <paragraph id="H2444D45687404613B7BD26C7DF3C8AB6"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">Any organization described in paragraph (3) or (4) of subsection (c) which receives any contribution or gift (within the meaning of section 6033(b)(5)) from any individual who is a citizen or national of a foreign adversary shall not be exempt from taxation under subsection (a) for any taxable year ending on or after the date of the receipt of such contribution or gift.</text>
            </paragraph>
            <paragraph id="H997AECFE985144ED80F158344FCB71E4">
              <enum>(2)</enum>
              <header>Foreign adversary</header>
 <text>For purposes of paragraph (1), the term <term>foreign adversary</term> means—</text>
              <subparagraph id="H520D39AE536D44038FD7400EBD66926F">
                <enum>(A)</enum>
 <text>the People’s Republic of China, including the Hong Kong and Macau Special Administrative Regions,</text>
              </subparagraph>
              <subparagraph id="HB89C5E2F901244D5AA704B12B0ED9750">
                <enum>(B)</enum>
 <text>the Republic of Cuba,</text> </subparagraph> <subparagraph id="HDE72F96EE4EF4FC3AF58FEE457B61DC3"> <enum>(C)</enum> <text>the Islamic Republic of Iran,</text>
              </subparagraph>
              <subparagraph id="H1C7A30F6EDEE4F039908C5FF8F5070B2">
                <enum>(D)</enum>
 <text>the Democratic People’s Republic of Korea,</text> </subparagraph> <subparagraph id="H464732A0ABD5437FAC41B88A31E7DF23"> <enum>(E)</enum> <text>the Russian Federation, and</text>
              </subparagraph>
              <subparagraph id="H44F528AC9BC24CC0B85EC1875ADB7F95">
                <enum>(F)</enum>
 <text>such other foreign country as the Secretary, in consultation with the Secretary of State, determines is in the national security interest of the United States.</text>
              </subparagraph>
            </paragraph>
          </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2159E61865A742BDB2D6BEE9F0078E1A"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply with respect to contributions or gifts received after the date of the enactment of this Act.</text> </subsection></section> </legis-body></bill>
