<section id="HE4AA965759D74EEABC0BE88F284F398F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Child Health Coverage Compensation in Divorce Act of 2026</short-title></quote>.</text></section> <section id="H232A8C36B7A4402E95A1A19E8413BD38"><enum>2.</enum><header>Medical child support order requirements</header> <subsection id="H15EB32656A434BCDA4D8C71445D262FC"><enum>(a)</enum><header>Public Health Service Act requirements</header><text>Subpart II of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HE43D75D814B14720BEA7F39FC054F8E0"><enum>2730.</enum><header>Coverage pursuant to medical child support orders</header><text display-inline="no-display-inline">In any case in which a child has benefits under the group health plan or health insurance coverage of a noncustodial parent (including a stepparent), such plan or the issuer offering such coverage shall—</text> <paragraph id="HC5A155CF5EA14FB0959FB1C9D57A25D2"><enum>(1)</enum><text>provide such information to the custodial parent as may be necessary for the child to obtain benefits through such plan or such coverage;</text></paragraph> 
<paragraph id="HE67A072957BA40B593E9E639456E59C5"><enum>(2)</enum><text>permit the custodial parent (or provider, with the custodial parent’s approval) to submit claims for covered services without the approval of the noncustodial parent; and</text></paragraph> <paragraph id="H653DF52DC2C24D53871CFA3801108C0D"><enum>(3)</enum><text>make payment on claims submitted in accordance with paragraph (2) directly to such custodial parent or the provider.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEED410D621BF4A2E98A327128A7896C9"><enum>(b)</enum><header>Federal Employees Health Benefits Program requirements</header><text>Section 8904 of title 5, United States Code, is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H26480709BB044199828E8CB4EBC62052" style="USC"> <subsection id="H28926A6F846C42659DF7E505EB08E74A"><enum>(c)</enum><text display-inline="yes-display-inline">In any case in which a child has health coverage through the carrier of a noncustodial parent (including a stepparent) under the program established under this chapter, such carrier shall—</text> 
<paragraph id="HA37B7295B7234E5EBDEDEAB0F95075B5"><enum>(1)</enum><text>provide such information to the custodial parent as may be necessary for the child to obtain benefits through such coverage;</text></paragraph> <paragraph id="H5DEF869E46B548B6B745FB5E48353FFA"><enum>(2)</enum><text>permit the custodial parent (or provider, with the custodial parent’s approval) to submit claims for covered services without the approval of the noncustodial parent; and</text></paragraph> 
<paragraph id="H8AB83C299990426BBAF7A90A878C3771"><enum>(3)</enum><text>make payment on claims submitted in accordance with paragraph (2) directly to such custodial parent or the provider.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9A65423858D0441FA0A65AD400D16505"><enum>(c)</enum><header>Federal health care programs</header><text>Part A of title XI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H775E8B99B58E446F8B04CE7B0B28EC87"><enum>1150D.</enum><header>Coverage pursuant to medical child support orders</header><text display-inline="no-display-inline">In any case in which a child has benefits under a Federal health care program through a noncustodial parent (including a stepparent), such program shall—</text> <paragraph id="H7CD593C70F0640F19A4F12324FAB2D5A"><enum>(1)</enum><text>provide such information to the custodial parent as may be necessary for the child to obtain benefits through such program;</text></paragraph> 
<paragraph id="H4564E9D2785A4CD2B92A0C6B7568A682"><enum>(2)</enum><text>permit the custodial parent (or provider, with the custodial parent’s approval) to submit claims for covered services without the approval of the noncustodial parent; and</text></paragraph> <paragraph id="H75EA92E3C14D467D8BF6401B9ACB5DC5"><enum>(3)</enum><text>make payment on claims submitted in accordance with paragraph (2) directly to such custodial parent, or State agency (if applicable).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB476AB72457E40718EFEA18078A16767"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to plan years beginning on or after January 1, 2026.</text></subsection></section> </legis-body></bill>
