<section id="H3C5D3893423441D0BF414DC9764A347A" section-type="section-one"><enum>1.</enum><header>Credit for renewable materials production</header> 
<subsection id="H31BDF1DF96CA41C1AE75D79A3997BCED"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text> <quoted-block id="H1D0EBFD4EB974EB6BD74F91C2E56D036" style="OLC"> <section id="HC74016B285C549DEBCCB7A142C06E633"><enum>45BB.</enum><header>Renewable materials production credit</header> <subsection id="HA3E6A3BC364F47A69D62B5C9F1060FF9"><enum>(a)</enum><header>Allowance of credit</header><text>For purposes of section 38, the renewable materials production credit for any taxable year is an amount equal to the product of—</text> 
<paragraph id="HB2A1BE1978C84F8C89F4EB561ECA64A4">
                                <enum>(1)</enum>
 <text>10 cents, multiplied by</text> </paragraph> <paragraph id="HECFE59570AA2480CA1C26F08D94ADC34"><enum>(2)</enum><text>the number of pounds of qualified renewable material which is—</text> 
<subparagraph id="H683A12E7C42F486198FC003BE10AC8B2"><enum>(A)</enum><text>produced by the taxpayer during such taxable year at a renewable material production facility, and</text></subparagraph> <subparagraph id="HBA6CAAA81F4C4187A5D3C601BCF80DB0"><enum>(B)</enum><text>either—</text> 
<clause id="HFEA66D29346947009A2488AD0D2707D3"><enum>(i)</enum><text>sold by the taxpayer to an unrelated person, or</text></clause> <clause id="H3E4B0EABD6F9400DAAF9C7035E68DEAB"> <enum>(ii)</enum> <text>used by the taxpayer producing such qualified renewable material,</text>
                                    </clause><continuation-text continuation-text-level="subparagraph">only if such sale or use is in a trade or business of the taxpayer during the taxable year.</continuation-text></subparagraph></paragraph></subsection> 
<subsection id="HB7D759AE847C45DF8DB0FF55D2D484FF"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text> <paragraph id="HE3629C7D448B4976935C21E51EC52672"><enum>(1)</enum><header>Qualified renewable material</header> <subparagraph id="H4E2C625B28764B2FA0C745828151C038"><enum>(A)</enum><header>In general</header><text>The term <quote>qualified renewable material</quote> means the biobased carbon content portion of any product, including a chemical, produced using biological conversion, thermal conversion, catalytic conversion, chemical conversion, or a combination thereof, from biomass.</text></subparagraph> 
<subparagraph id="H579FF3C2C3AE4456BADBF2E5A0AEF740"><enum>(B)</enum><header>Exclusions</header><text>The term <quote>qualified renewable material</quote> shall not include any product—</text> <clause id="H916BD8A73E444C1BBB60DBFF09D8AA08"><enum>(i)</enum><text>which is suitable for use as a fuel in any vehicle (whether or not the vehicle is manufactured primarily for use on public streets, roads, and highways), marine vessel, watercraft, or aircraft,</text></clause> 
<clause id="H6C96E375860E44DBB44D9B8325A5AE47"><enum>(ii)</enum><text>used to generate heat or electricity,</text></clause> <clause id="HAD093805D0A94C26B05D195681130AEB"><enum>(iii)</enum><text>which is suitable for use as food or feed,</text></clause> 
<clause id="H839806A538E944BE8AA85EBBF1C983DA"><enum>(iv)</enum><text>produced from biomass which was not manufactured, produced, grown, or extracted in whole or in significant part within—</text> <subclause id="H3C0B784CD790403387040A0B44297E3B"><enum>(I)</enum><text>the United States (within the meaning of section 638(1)), or</text></subclause> 
<subclause id="HA54EF79AE31748B480591318E0D41C9A"><enum>(II)</enum><text>a possession of the United States (within the meaning of section 638(2)), or</text></subclause></clause> <clause id="HEF18AD24A0D34E2AA84A41692020359C"><enum>(v)</enum><text>which is derived from coprocessing biomass with a feedstock which is not biomass.</text></clause></subparagraph> 
<subparagraph id="H8A6A9002A6F64998A84A29B28F22AF99"><enum>(C)</enum><header>First sale or use to qualify</header><text>In the case where multiple points in a supply chain may be eligible under this section, the qualified renewable material that first meets the requirements of this section will be the only qualified renewable material eligible.</text></subparagraph></paragraph> <paragraph id="H930453A2C8204015BC57914CE9FEC87C"><enum>(2)</enum><header>Biobased carbon content portion</header><text>The term <quote>biobased carbon content portion</quote> means the biobased carbon content as determined pursuant to ASTM D6866.</text></paragraph> 
<paragraph id="H15F734D5D8B349CA91B39928F118603A"><enum>(3)</enum><header>Biomass</header><text>The term <quote>biomass</quote> has the same meaning given such term in section 45K(c)(3), except <quote>biomass</quote> does not include any qualified renewable material.</text></paragraph> <paragraph id="H7DBAE93BAE3D48DEBEFC3DF6EFC96090"><enum>(4)</enum><header>Renewable material production facility</header><text>The term <quote>renewable material production facility</quote> means any facility—</text>
<subparagraph id="HC9F582BF96424637830857F09D4FBF64"><enum>(A)</enum><text>that produces qualified renewable material during a qualifying credit period, and</text></subparagraph> <subparagraph id="HB73403757A704E7D90094A04AC110B9E"><enum>(B)</enum><text>located in the United States or a possession of the United States (within the meaning of section 638(2)).</text></subparagraph></paragraph> 
<paragraph id="H3B8BEFDAB7E04DA0A97731C9681CE22C" commented="no"><enum>(5)</enum><header>Qualifying credit period</header> 
<subparagraph id="H851BC973F22247B388F03C1FC6D333A5" commented="no"><enum>(A)</enum><header>In general</header><text>The term <quote>qualifying credit period</quote> means the 10-year period beginning on the later of—</text> <clause id="H211D2B4EEBF441F381D7889E76F4D3EC" commented="no"><enum>(i)</enum><text>the date the renewable material production facility was originally placed in service,</text></clause> 
<clause id="HE2B7625C929641AE96E7B13DD28C6640" commented="no"><enum>(ii)</enum><text>the date the modifications described in subparagraph (B) were placed in service, or</text></clause> <clause id="HF3C0A9240798464DB2CA8C39ED484FE2" commented="no"><enum>(iii)</enum><text>the date of enactment of this section.</text></clause></subparagraph> 
<subparagraph id="H45C08E9E586C4891814C7859B0DB1B37" commented="no"><enum>(B)</enum><header>Modifications</header><text>The modifications described in this subparagraph are substantial modifications to an existing facility which allow such facility to produce qualified renewable material.</text></subparagraph></paragraph></subsection> <subsection id="HBBCEB9223E3B4A679AB48C8BEC521D51"><enum>(c)</enum><header>Special rules</header> <paragraph id="HFF5AB220993C4D68950B8F9DED54D460"><enum>(1)</enum><header>Credit attributable to taxpayer</header> <subparagraph id="HF2048A045A7B4BFFB003A6CAC01A059C"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in subparagraph (B) or in any regulations prescribed by the Secretary, any credit under this section shall be attributable to the person that sells or uses the qualified renewable material.</text></subparagraph> 
<subparagraph id="H6E0E0A582F1346DCB3DD8D91CB74541C"><enum>(B)</enum><header>Election</header><text>If the person described in subparagraph (A) makes an election under this subparagraph in such time and manner as the Secretary may prescribe by regulations, the credit under this section—</text> <clause id="H1C043FE2B6174A2D8FF0B6A7F27E95BA"><enum>(i)</enum><text>shall be allowable to the person to whom the qualified renewable material is sold, and</text></clause> 
<clause id="H29A82BEF6B0143D1BC304CF5B2339A6D"><enum>(ii)</enum><text>shall not be allowable to the person described in subparagraph (A).</text></clause></subparagraph></paragraph> <paragraph id="HB38A9E94FF1543518F702A08ECE1C7F7"><enum>(2)</enum><header>Coordination with investment credit</header><text>The term <quote>renewable material production facility</quote> shall not include any facility for which a renewable materials investment credit determined under section 48F is allowed under section 38 for the taxable year or any prior taxable year.</text></paragraph> 
<paragraph id="H5E70037756AC441986261F02328B978E"><enum>(3)</enum><header>Credit reduced for tax-exempt bonds</header><text>Rules similar to the rules of section 45(b)(3) shall apply.</text></paragraph> <paragraph id="H671207CD424A4108B90D1B42A6E6E32B"><enum>(4)</enum><header>Limitation</header><text>The amount of the credit determined under subsection (a) with respect to any facility for any taxable year (determined after the application of paragraph (3)) shall not exceed $10,000,000.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H49F5E1141675478DAF063B75DF98CD12"><enum>(b)</enum><header>Coordination with clean fuel production credit</header><text>Section 45Z(d)(4)(B) is amended by adding at the end the following:</text> <quoted-block id="H05FB27341A894B5C963DD3D0749724B2" style="OLC"> <clause id="H64BB1D0A98264B7380EF55F41426530B"><enum>(iv)</enum><text>The renewable materials production credit under section 45BB.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H10060AF444144B94826166E41AEBD81F"><enum>(c)</enum><header>Credit made transferable</header><text>Section 6418(f)(1) is amended—</text> <paragraph id="H4C4A1D5ABABB4DE28057720F71DC3F25"><enum>(1)</enum><text>in subparagraph (A) by adding at the end the following:</text>

<clause id="HFF0677C6EEC8421298871FCB81B4413D"><enum>(xii)</enum><text>The renewable materials production credit determined under section 45BB.</text></clause><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph> <paragraph id="H3858924CEC8C482797B953F23429A61E"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>or (vii)</quote> and inserting <quote>(vii), or (xii)</quote>.</text></paragraph></subsection> 
<subsection id="HE376975B4F944271ADB49B2BE51EAC3E"><enum>(d)</enum><header>Credit made part of general business credit</header><text>Subsection (b) of section 38 of such Code is amended by striking <quote>plus</quote> at the end of paragraph (40), by striking the period at the end of paragraph (41) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text> <quoted-block id="H66D837ED44194C47854FBBE2662E2E61" style="OLC"> <paragraph id="H276FEF4C2BB24633AC242436B580343B"><enum>(42)</enum><text>the renewable materials production credit determined under section 45BB.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8186732911E14ACAACB46FBE8DA20A8E"><enum>(e)</enum><header>Clerical amendment</header><text>The table of sections for subpart D of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following:</text> <quoted-block id="H5A6099387526440B8B9B41ADA3DD2D77" style="OLC"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 45BB. Renewable materials production credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H83E3D526D0694A9D97E3E576686CEFA0"><enum>(f)</enum><header>Regulations</header><text>The Secretary, in consultation with the Secretary of Agriculture, shall establish regulations or other guidance for implementing the credit established under this section within 180 days of the date of enactment.</text></subsection> 
<subsection id="H885BD083C2424F95966C5B3B30A7742A"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply to qualified renewable material produced on or after the date of enactment.</text></subsection></section> <section id="HA08E201855334806B48C30E0907FA777"><enum>2.</enum><header>Credit for renewable materials investment</header> <subsection id="H32FC7D351D82410EA0B4A653C784F04D"><enum>(a)</enum><header>In general</header><text>Subpart E of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>

<section id="H137457D1BBBA4B2ABDE23CE60B78B504"><enum>48F.</enum><header>Renewable materials investment credit</header> 
<subsection id="HD80732A7276D4EFFBBC3059620EACFA4"><enum>(a)</enum><header>Allowance of credit</header><text>For purposes of section 46, the renewable materials investment credit for any taxable year is an amount equal to 30 percent of the qualified investment for the taxable year with respect to any qualified facility.</text></subsection> <subsection id="H651A21A5A56B424E834DB347CD1E764A"><enum>(b)</enum><header>Qualified investment</header> <paragraph id="H9E788786D7FB40A5A302A049CDECCA3F"> <enum>(1)</enum> <header>In general</header> <text>For purposes of subsection (a), the qualified investment for any taxable year with respect to any qualified facility is the basis of any qualified property placed in service by the taxpayer during such taxable year which—</text>
                                <subparagraph id="H5644056CE53B475F8639099C010461B2">
                                    <enum>(A)</enum>
 <text>is used in the production of qualified renewable material, and</text>
                                </subparagraph>
                                <subparagraph id="HA54CD4DF1596452A80AD37CC00902C0D">
                                    <enum>(B)</enum>
 <text>is part of a qualified facility.</text> </subparagraph> </paragraph> <paragraph id="HDB5342B57E03457EA948ADF8C52C4FA7"><enum>(2)</enum><header>Qualified property</header><text>For purposes of this section, the term <quote>qualified property</quote> means property—</text> 
<subparagraph id="H1826C403903345C99AE2C2FE9649953C"><enum>(A)</enum><text>which is—</text> <clause id="H95196C0BFBB44803997C9A69B595292E"><enum>(i)</enum><text>tangible personal property, or</text></clause> 
<clause id="HD9192D0B244848BAABD54C000ED06343"><enum>(ii)</enum><text>other tangible property (not including a building or its structural components), but only if such property is used as an integral part of the qualified facility,</text></clause></subparagraph> <subparagraph id="HC1D4A89DD28347A09F11824814C4904F"><enum>(B)</enum><text>with respect to which depreciation (or amortization in lieu of depreciation) is allowable,</text></subparagraph> 
<subparagraph id="HDDB96553D247448BAA50A9CF7F4414DF"><enum>(C)</enum><text>which is constructed, reconstructed, erected, or acquired by the taxpayer, and</text></subparagraph> <subparagraph id="H09A9322A6F97495690D5B98AD35D1D83"><enum>(D)</enum><text>the original use of which commences with the taxpayer.</text></subparagraph></paragraph> 
<paragraph id="HAE31C0A6ACF7457A83312DC4605A1257"><enum>(3)</enum><header>Qualified facility</header> 
<subparagraph id="HBAF9D58609094AB18D5740736A0B86DB"><enum>(A)</enum><header>In general</header><text>The term <quote>qualified facility</quote> means a renewable material production facility within the meaning of section 45BB(b)(3).</text></subparagraph> <subparagraph id="H985FCB9FF50C4CB9A6E8A29C5506EFB4"><enum>(B)</enum><header>Exclusion</header><text>The term <quote>qualified facility</quote> shall not include any facility for which a renewable materials production credit determined under section 45BB is allowed under section 38 for the taxable year or any prior taxable year.</text></subparagraph></paragraph> 
<paragraph id="H987FC1EBBD9C46FDA7393C7676937BFA"><enum>(4)</enum><header>Coordination with rehabilitation credit</header><text>The qualified investment with respect to any qualified facility for any taxable year shall not include that portion of the basis of any property which is attributable to qualified rehabilitation expenditures (as defined in section 47(c)(2)).</text></paragraph></subsection> <subsection id="H790AD0502CF94E62A224FD6E462DA54D"><enum>(c)</enum><header>Special rules</header> <paragraph id="H33897647639148E9915DA3D81D8852B4"><enum>(1)</enum><header>Certain progress expenditure rules made applicable</header><text>Rules similar to the rules of subsections (c)(4) and (d) of section 46 (as in effect on the day before the date of the enactment of the Revenue Reconciliation Act of 1990) shall apply for purposes of subsection (a).</text></paragraph> 
<paragraph id="H2A1A8FC94A4648818E0CCE26C2A98EC1"><enum>(2)</enum><header>Credit reduced for tax-exempt bonds</header><text>Rules similar to the rules of section 45(b)(3) shall apply.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF14B74805DD74C47847358E7B5AA60E1"><enum>(b)</enum><header>Coordination with clean fuel production credit</header><text>Section 45Z(d)(4)(B), as amended by section 1, is amended by adding at the end the following:</text>

<clause id="HBB7AF2769AA54601B97A32D319438D16"><enum>(v)</enum><text>The credit determined under section 46 to the extent that such credit is attributable to the renewable materials investment credit.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H222EFB761412493CB44BF74AF8C2A9CA"><enum>(c)</enum><header>Credit made transferable</header><text>Section 6418, as amended by section 1, is amended—</text> 
<paragraph id="H31FEB61B64E849ABBF71EFF29736D1B5"><enum>(1)</enum><text>in subsection (f)(1)(A) by adding at the end the following:</text> <quoted-block id="H5CFC748A4F3C448E8B19BC8A676F7E09" style="OLC"> <clause id="H4D0DC452B5564BE58E7C82E4A1916B52"><enum>(xiii)</enum><text>The renewable materials investment credit determined under section 48F.</text></clause><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H045C17BDD8E84C5B8AF3C7199C82C0BB"><enum>(2)</enum><text>in paragraph (g)(3) by striking <quote>(xi)</quote> and inserting <quote>(xi), or (xiii),</quote>.</text></paragraph></subsection> <subsection id="HDB9ECA769E464A7E9B7B2FF68DF7F7F5"><enum>(d)</enum><header>Conforming amendments</header> <paragraph id="HC2BECB8D4919457E91E17BE9638A898C"><enum>(1)</enum><text>Section 46 of such Code is amended—</text> 
<subparagraph id="H3D3BC6F0D72040BDA8EFB4FEE364CFB0"><enum>(A)</enum><text>in paragraph (6) by striking <quote>and</quote> at the end,</text></subparagraph> <subparagraph id="HB4819D7642D5446C89D72FD3BE03056B"><enum>(B)</enum><text>in paragraph (7) by striking the period at the end and inserting <quote>, and</quote>, and</text></subparagraph> 
<subparagraph id="H43D39FD4C5834E969B1D2B7BE7066CEE"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H1254EEA4FAE047FAB9D1E8FFBC66FB61" style="OLC"> <paragraph id="HA79D0A14D59A47D6B088D0B3406CC072"><enum>(8)</enum><text>the renewable materials investment credit.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H645BD5D159FA489E897C76CF31B65A66"><enum>(2)</enum><text>Section 49(a)(1)(C) of such Code is amended—</text> <subparagraph id="H4C444C97AAF64CDFB80B94E2A0D14180"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of clause (vii),</text></subparagraph> 
<subparagraph id="H9308AE9C92F6474CA1709C4DCBAF4E4E"><enum>(B)</enum><text>by striking the period at the end of clause (viii) and inserting <quote>, and</quote>, and</text></subparagraph> <subparagraph id="H42A3DD28188F43CAA64020252081B564"><enum>(C)</enum><text>by adding at the end the following new clause:</text>

<clause id="H7423F6B602F345D2B5DFF55AEAA56E20"><enum>(ix)</enum><text>the basis of any qualified property which is part of a qualified facility under section 48F.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HD700E5FBBA7447F29B6237BE021F90AE"><enum>(3)</enum><text>Section 50(a)(2)(E) of such Code is amended by striking <quote>or 48E(e)</quote> and inserting <quote>48E(e), or 48F(c)(1)</quote>.</text></paragraph> 
<paragraph id="H13BD56FA1A9D4854A47C93ADE5AE4928"><enum>(4)</enum><text>The table of sections for subpart E of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 48E the following new item:</text> <quoted-block id="H4E361F8A67F64342B7D2B162625EB6E5" style="OLC"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 48F. Renewable materials investment credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H4092CE1CF34B40C790F8C8DF6029CBFD"><enum>(e)</enum><header>Regulations</header><text>The Secretary, in consultation with the Secretary of Agriculture, shall establish regulations or other guidance for implementing the credit established under this section within 180 days of the date of enactment.</text></subsection> 
<subsection id="H96A20715B911421A996D8D867049C1C6"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after the date of enactment.</text></subsection></section> </legis-body></bill>
